Artikel 18 van die Boedelwet. 1965 (hieronder die Hoofwetgenoem). word hierby gewysig(a) deur subartikel (3) deur die volgende subartikel tevervang:. (3) Jndien die waarde van 'n boedel nie meer as[seshonderd] eenduisend vyfhonderd rand bedra nie.kan die Meester van 'n kennisgewing kragtens subartikel(I) en van die aanstelling van 'n eksekuteur afsien. enopdrag gee aangaande die wyse waarop so 'n boedelberedder en verdeel moet word.";(b) deur subartikel (4) deur die volgende subartikel tevervang:. (4) Jndien die waarde van 'n boedel nie meer as[tweeduisend] vyfduisend rand bedra nie. kan dieMeester in 'n in subartikel (I) bedoelde geval. sonderenige kennisgewing kragtens daardie subartikel. diepersoon of persone wat hy geskik ag om eksekuteur ofeksekuteurs van die boedel van die oorledene te wees.aanstel en eksekuteursbriewe aan hom of hulle uitreik.'·.5101520Wysiging vanartike! 29 vanWet 66 van 1965.2. Artikel 29 van die Hoofwet word hierby gewysig deur dievoorbehoudsbepaling by subartikel (1) deur die volgende voorbe 25houdsbepaling te vervang:. Met dien verstande dat indien die waarde van die boedel niemeer as [tweeduisend] vyfduisend rand bedra nie. dieMeester skriftelik onder sy handtekening die eksekuteur kangelas om in die kennisgewing 'n deur die Meester bepaaldetydperk (van minstens veertien en hoogstens dertig dae) te 30vermeld.··.Wysiging vanartike! 30 vanWet 66 van 1965.3. Artikel 30 van die Hoofwet word hierby gewysig deurparagraaf (b) deur die volgende paragraaf te vervang:.(b) daarna. tensy. in die geval van goed ter waarde vanhoogstens [tweehonderd] vyfhonderd rand. die Mees- 35ter of. in die geval van enige ander goed. die Hof andersgelas.··.Wysiging vanartike! 34 vanWet 66 van 1965.4. Section 18 of the Administration of Estates Act, 1965 Am ndment of5 (hereinafter referred to as the principal Act), is hereby amended- C:l f 5(a) by the substitution for subsection (3) of the following c o .subsection:"(3) If the value of any estate does not exceed [six]one thousand five hundred rand, the Master may10dispense WIth a notIce under subsection (1) and with theappointment of an executor and give directions as to themanner in which any such estate shall be liquidated anddistributed. ' , ;(b) by the substitution for subsection (4) of the following15subsection:"(4) If the value of any estate does not exceed [two]five thousand rand, the Master may, in any case referred"t()in subsection (1), without any notice under thatsubsection, appoint and grant letters of executorship to20such person or persons as he deems fit and proper to beexecutor or executors of the estate of the deceased.".1:2. Section 29 of the principal Act is hereby amended by the Am ndment ofsubs tution for the proviso to subsection (1) of the following ecti 2,/proVISO:ct0.25"Provided that.if the value of the estate does not exceed[two] five thousand rand, the Master may by writing underhis hand'direct the executor to specify in the notice a period(not being less than fourteen or more than thirty days)determined by the Master.".fJ653. Section 30 of the principal Act is hereby amended by the Am ndment ofsubstitution for paragraph (b) of the following paragraph:section 30 of"(b) thereafter, unIess, In. the case 0 f property 0 f a val ue not Act 66 ofexceeding [two] five hundred rand, the Master or, inthe case of any Oilier property, the Court otherwise35directs,".301965.4. Section 34 of the principal Act is hereby amended by the Am ndment ofsubstitution for subsection (2) of the following subsection: :l f 5"(2) If the Master is satisfied that the value of the assets in c o .the insolvent estate does not exceed [two] five thousand40rand, the estate shall, subject to the rights ot7reditors, beliquidated and distributed in such manner as he may direct. Section 35 of the principal Act is hereby amendedAm ndment of(a) by the sub titution for paragraph (a) of subsection (I) of i :65.the followmg paragraph:"(a) six months after letters of executorship have beengranted to him, if the gross value of the estateexceeds [two] five thousand rand; or";(b) by the substitution forparagraph (b) of subsection (1) ofthe following paragraph:"(b) three months after letters of executorship have beengranted to him, if the gross value of the estate doesnot exceed [two] thousand rand; or".6. Section 80 of the principal Act is hereby amended by the Am ndment ofsubstitution for subsection (2) of the following subsection: ec:l 5"(2) The Master may at any time authorizeco.(a) any alienation of immovable property belonging to a15minor or to a person for the administration of whoseproperty a tutor or curator has been appointed, if thevalue of the particular property to be alienated does notexceed [four] ten thousand rand and the alienationwould be in the 1'iiterest of the minor or of such person,20as the case may be; and(b) any mortgage of any such immovable property to anamount not exceeding in the case of anyone such minoror person, [four] ten thousand rand, if the mortgage is25necessary for the preservation or improvement of theproperty or for the maintenance, education or otherbenefit of such minor or person, as the case may be.".7. Section 102 of the principal Act is hereby amended by the Am ndment ofsubstitution for paragraph (h) of subsection (1) of the following tJ66 1 2 9:530 paragraph:ct0 1."(h) contravenes or fails to comply with the provisions ofsection 6 (4), section 8 (1) or (2), section II (1), section26 (I) or of the last-mentioned section as applied bysection 85, section 28 (I), (2) or (3) or of the35last-mentioned section as applied by section 12 (7) or bysection 70 (1) or by section 85, section 30, section 35(I), or with any direction under section 35 (2) or anynotice under section 43 [(2) or] (3) J)L(4) or of thelast-mentioned section as applied by sec'iJ0ii'"06 (2); or".408. This Act shall be called the Administration of EstatesAmendment Act, 1978.Short title.5
