FINDINGSThe California Regional Water Quality Control Board, Colorado River Basin Region(hereinafter Regional Water Board), finds:A. Background. Seeley County Water District (hereinafter Discharger) is currentlydischarging pursuant to Order R7-2007-0036 and National Pollutant DischargeElimination System (NPDES) Permit No. CA0105023. The Discharger submitted aReport of Waste Discharge (ROWD) dated March 7, 2012, and applied for a NPDESpermit renewal to discharge up to 0.25 MGD of treated wastewater from the SeeleyCounty Water District Wastewater Treatment Plant, hereinafter Facility. The applicationwas deemed complete on April 12, 2012. A site visit was conducted on December 2,2011, to observe operations and collect additional data to develop permit limitations andconditions.For the purposes of this Order, references to the “discharger” or “permittee” inapplicable federal and state laws, regulations, plans, or policy are held to be equivalentto references to the Discharger herein.B. Facility Description. Seeley County Water District owns and operates the municipalwastewater treatment plant. The current total design capacity of the wastewatertreatment plant is 0.25 MGD. The treatment system consists of a lift station, a drumscreen, a bar screen, a “Clemson” aerated pond treatment system with surfaceaerators, pre-disinfection filtration via pressure sand filters, and an ultraviolet (UV)disinfection system. Following installation of the Clemson process facilities in 2004, oneof the original 2.4-acre lagoons was retrofitted to a primary oxidation pond prior to theClemson facilities (comprised of Clemson ponds, or reaction basins). Currently, thedrum and bar screens are bypassed and wastewater first enters the primary oxidationpond before being directed through the Clemson ponds. The Facility provides domesticsewage services to a population of approximately 2,100 located in the town of Seeleywhich is located in the Imperial Valley. Wastewater is discharged from Discharge Point001 (see Table 2 on cover page) to the New River, a water of the United States, via anunnamed tributary. Attachment B provides a map of the area around the Facility.Attachment C provides a flow schematic of the Facility.No sludge is processed or disposed of at the Facility.C. Legal Authorities. This Order is issued pursuant to section 402 of the federal CleanWater Act (CWA) and implementing regulations adopted by the U.S. EnvironmentalProtection Agency (USEPA) and Chapter 5.5, Division 7 of the California Water Code(commencing with section 13370). It shall serve as a NPDES permit for point sourcedischarges from this facility to surface waters. This Order also serves as WDRspursuant to Article 4, Chapter 4, Division 7 of the Water Code (commencing with section13260).D. Background and Rationale for Requirements. The Regional Water Board developedthe requirements in this Order based on information submitted as part of the application,through monitoring and reporting programs, and other available information. CA0105023Sheet (Attachment F), which contains background information and rationale for Orderrequirements, is hereby incorporated into this Order and constitutes part of the Findingsfor this Order. Attachments A through E and G through J are also incorporated into thisOrder.E. California Environmental Quality Act (CEQA). Pursuant to Water Code section13389, this action to adopt an NPDES permit is exempt from the provisions of chapter 3of CEQA, commencing with section 21100 of the Public Resources Code.F. Technology-based Effluent Limitations.Section 301(b) of the CWA andimplementing USEPA regulations at section 122.44, Title 40 of the Code of FederalRegulations1, require that permits include conditions meeting applicable technologybased requirements at a minimum, and any more stringent effluent limitationsnecessary to meet applicable water quality standards. The discharge authorized by thisOrder must meet minimum federal technology-based requirements based onequivalent-to-secondary Treatment Standards at Part 133. The Regional Water Boardhas considered the factors listed in Water Code section 13241 in establishing theserequirements. A detailed discussion of the technology-based effluent limitationsdevelopment is included in the Fact Sheet (Attachment F).G. Water Quality-Based Effluent Limitations. Section 301(b) of the CWA and section122.44(d) require that permits include limitations more stringent than applicable federaltechnology-based requirements where necessary to achieve applicable water qualitystandards.Section 122.44(d)(1)(i) mandates that permits include effluent limitations for allpollutants that are or may be discharged at levels that have the reasonable potential tocause or contribute to an exceedance of a water quality standard, including numeric andnarrative objectives within a standard.Where reasonable potential has beenestablished for a pollutant, but there is no numeric criterion or objective for the pollutant,water quality-based effluent limitations (WQBELs) must be established using:(1) USEPA criteria guidance under CWA section 304(a), supplemented wherenecessary by other relevant information; (2) an indicator parameter for the pollutant ofconcern; or (3) a calculated numeric water quality criterion, such as a proposed statecriterion or policy interpreting the state’s narrative criterion, supplemented with otherrelevant information, as provided in section 122.44(d)(1)(vi).H. Water Quality Control Plans. The Regional Water Board adopted a Water QualityControl Plan for the Colorado River Basin (hereinafter Basin Plan) on November 17,1993 that designates beneficial uses, establishes water quality objectives, and containsimplementation programs and policies to achieve those objectives for all watersaddressed through the plan (including amendments adopted by the Regional WaterBoard to date). In addition, the Basin Plan implements State Water Resources ControlBoard (State Water Board) Resolution No. 88-63, which established state policy that allwaters, with certain exceptions, should be considered suitable or potentially suitable formunicipal or domestic supply. An advisory has been issued by the Imperial County Health Department warning against theconsumption of any fish caught from the river and the river has been posted with advisories against any body contactwith the water.Rare, endangered, or threatened wildlife exists in or utilizes some of these waterway(s). If the RARE beneficial usemay be affected by a water quality control decision, responsibility for substantiation of the existence of rare,endangered, or threatened species on a case-by case basis is upon the California Department of Fish and Game on itsown initiative and/or at the request of the Regional Water Board; and such substantiation must be provided within areasonable time frame as approved by the Regional Water Board.Requirements of this Order implement the Basin Plan.The immediate receiving water is the New River (via an unnamed tributary). The 2010USEPA CWA Section 303(d) list of impaired waters (hereinafter 303(d) List) identifiesthe New River as impaired by the following chemical constituents: chlordane,chlorpyrifos, copper, dichlorodiphenyltrichloroethane (DDT), diazinon, dieldrin,hexachlorobenzene, mercury, nutrients, organic enrichment/low dissolved oxygen,polychlorinated biphenyls (PCBs), pathogens, sediment, selenium, toxaphene, toxicity,trash, and zinc. The New River Dissolved Oxygen TMDL was adopted by the RegionalBoard on May 20, 2010 (Resolution No. R7-2010-0011), approved by the State WaterResources Control Board on December 6, 2011 (Resolution No. 2011-0061), andapproved by the Office of Administrative Law on March 21, 2012. The New RiverDissolved Oxygen TMDL has not yet received USEPA approval. The New River is alsolisted as impaired for bacteria and sediment / siltation. USEPA has approved theRegional Water Board’s TMDLs for these parameters. These TMDLs establish wasteload allocations (WLAs) for fecal coliform, E. coli, enterococci, and sediment. Theestablished effluent limitations for fecal coliform, E. coli, enterococci, and TSS in thisOrder comply with the WLAs established in the New River TMDLs. A Trash TMDL forthe New River has been approved by the Regional Water Board and State Water Board,the Office of Administrative Law, and USEPA. The TMDL essentially establishes aprohibition on the discharge of any trash to the New River by point sources. This Orderprohibits discharges of trash to the New River.In addition, the 303(d) List classifies the Salton Sea as impaired by arsenic, chlorpyrifos,DDT, enterococcus, nutrients, and salinity. Tributaries to the Salton Sea, including theNew River, may be affected by the development of TMDLs for the Salton Sea. NoLimitations and Discharge Requirements7

CA0105023TMDL has been developed to date for the Salton Sea, although a nutrient TMDL isunder development for the Salton Sea that may impact the permitted discharges totributaries to the Salton Sea (i.e., New River).I. Thermal Plan. The State Water Board adopted the Water Quality Control Plan forControl of Temperature in the Coastal and Interstate Water and Enclosed Bays andEstuaries of California (Thermal Plan) on May 18, 1972, and amended this plan onSeptember 18, 1975. This plan contains temperature objectives for surface waters.The Thermal Plan does not apply these objectives to the unnamed tributary to the NewRiver, a slough.J. National Toxics Rule (NTR) and California Toxics Rule (CTR). USEPA adopted theNTR on December 22, 1992, and later amended it on May 4, 1995 and November 9,1999. About forty criteria in the NTR applied in California. On May 18, 2000, USEPAadopted the CTR. The CTR promulgated new toxics criteria for California and, inaddition, incorporated the previously adopted NTR criteria that were applicable in thestate. The CTR was amended on February 13, 2001. These rules contain water qualitycriteria for priority pollutants.K. State Implementation Policy. On March 2, 2000, the State Water Board adopted thePolicy for Implementation of Toxics Standards for Inland Surface Waters, EnclosedBays, and Estuaries of California (State Implementation Policy or SIP). The SIPbecame effective on April 28, 2000 with respect to the priority pollutant criteriapromulgated for California by the USEPA through the NTR and to the priority pollutantobjectives established by the Regional Water Board in the Basin Plan.
