Clock starts 2 hours after “agreedupon due time specified by customer or start of unload if before scheduled due time.” Forexample, if the transport is due at 8am, at 10 am the demurrage clock starts if he has not been“unloaded and released.” The clock stops when the transport truck is “unloaded and released/free toleave the jobsite,” not when the vehicle actually departs. The “due time,” “start unload,” and “finishunload” is documented on the bill of lading and the customer signs to acknowledge these times (andif any demurrage exists).Truck hold fee for each truck placed on hold by the customer in excess of 2.00 hours, 125.00 perhour (en route or still in plant ready to leave).Minimum Spread Charge: 8 hours x hourly rate for product type being shotPer Diem for Spreader Operators required to remain onsite or when unable to work due to weather orbreakdowns: 400.00 per night. This covers their travel to and from a local/regional hotel/motel,their overnight stay, plus food, etc. This charge will apply to any distributor which, due to hours ofservice, daily workload, weather, customer breakdown or excess oil in their tanks, is required toremain on the jobsite (or nearby hotel/motel accommodation). Charge is per distributor, per night.Return Freight on oil hauled back to plant (breakdown/weather/cancellation) ½ rate on the quantityreturned (eg 45.00 rate from Nampa to jobsite x 50% rate for returns x 8 tons returned due to rain 180.00 charged for the return). Full freight charges to destination and ½ freight charges will beassessed on returned product.No credit will be given for diluted materials.
