1. IntroductionMaharashtra is one of the prominent coastal states in India with a coastline of around720 km. In accordance with the Maharashtra Maritime Board (MMB) Act 1996, the coastlineis regulated and administered by the MMB, which is the nodal agency responsible for thedevelopment of the Non-major Ports under MMB and for overall development of state’smaritime sector. In accordance with the MMB Act 1996, MMB also acts as the regulator forinland water transportation in the state. Over the years, MMB has taken a number ofinitiatives to harness the potential of the coastline by developing Greenfield ports, captivejetties, multipurpose jetties, inland water transport and shipyards.2. Objective of the assignmentMaharashtra Maritime Board (MMB) invites online bids ONLY from QCINABETMOEF&CC approved Accredited Environment Consultant for(i) Implementation ofthe approved Environment Management Plan (EMP)(ii) Carry out Environment monitoringby testing the samples collected in the field through MOEF&CC approved EnvironmentalLaboratory for the work of proposed maintenance dredging activities being planned in thePatalganga River & Dharamtar Creek in the coastal district of Raigad for a two year period(in two phases: first phase: 01 October 2020-30 September 2021& second phase : 01October 2021- 30 September 2022)The EMP including Environment monitoring as documented in the EnvironmentImpact Assessment (EIA) report has been approved by Environment Dept., Govt ofMaharashtra through an Environmental Clearance (EC) for the proposed maintenancedredging work in the Patalganga River & Dharamtar Creek of the coastal district of Raigad inthe year 2016.In accordance with the directives as given in Govt. of Maharashtra (Department ofRevenue and Forests) Government Resolution (GR) “ गौखिन-१०/१०१४/ . . ५००/ख”dated21.05.2015, this work of maintenance dredging will be executed by the respective DistrictCollector on behalf of MMB.The work of maintenance dredging will be executed by theRevenue Department (District collector) in whose jurisdiction the creek/river is falling onlyafter receipt of the required authorisation and necessary details of dredging from MMB toexecute the dredging activity . The District Collector in accordance with the above GR willinitiate other related activities like issuing e-tender etc.The charter of duties of the district collector after receipt of the details of dredgingand authorisation from MMB include preparation of the tender document, e-tendering,selection of the bidder and issue of work order of dredging to the successful bidder. Theother aspects of dredging process including control on illegal dredging and variousgrievances arising due to dredging is monitored by various committees consisting ofrepresentatives of various departments including MMB. The responsibility of Environmentrelated aspects of dredging like EIA and EMP etc has been entrusted to MMB.3. Scope of services3.1MMB is pleased to announce that Environment Clearance (EC) for the proposedmaintenance dredging activities to Clear Navigational Waterways and Channels of Creeksand Rivers of Raigad including Patalganga River & Dharamtar Creek has been granted byState level Environment Impact Assessment Authority (SEIAA) in the year 2016.WhilstE-Tender No. MMB/CEO/HGR/03 for FY 20-21Page 4 of 51

granting the EC, the Environment Management Plan (EMP) along with Environmentmonitoring program has been also approved by the Environment department of Govt ofMaharashtra.3.2In accordance with Govt. of Maharashtra (Department of Revenue and Forests)Government Resolution (GR) “ गौखिन-१०/१०१४/. ५००/ख”dated 21.05.2015,permission/authorisations has been granted by MMB to respective Raigad District Collectorfor carrying out maintenance dredging activity in the blocks falling in the Patalganga River &Dharamtar Creek as indicated in Annexure VIII for the year 2020-21.The respective DistCollector in accordance with the above mentioned GR will follow the due e-tenderingprocess to select the bidders for carrying out dredging in the respective sub-blocks of thecreek for this year(2020-21),whose permission will be valid till 30th Sept 2021(Phase-I) orwhenever the dredging finishes in that sub-block(depending on the quantity ofdredging) , whichever is earlier.).Next year, in year 2021 the Dist. Collector will againfollow the e-tendering process to select bidders for the dredging only after receipt ofnecessary authorisation from MMB to do so and that permission for dredging will be valid till30 Sept 2022(Phase-II) or whenever the dredging finishes in that sub-block(depending onthe quantity of dredging) , whichever is earlier.3.3The actual work order for undertaking dredging in the sub-blocks will be issued byRaigad Dist Collector only when that particular sub-block has been bided for dredging. Incase, there are no bidders for that particular sub block(s), no work order for dredging will beissued and hence no EMP & Environment monitoring is required to be carried out for thosesub-blocks where no work order for dredging has been issued by Raigad Dist Collector.EMP & Environment monitoring will be required to be carried out ONLY for those sub-blockswhere work order has been issued for dredging by the Raigad District Collector. Theconsultant appointed by MMB for carrying out EMP and monitoring will be required to carryout this work for two years in two phases; in first phase from 01 October 2020 -30 Sept2021) or whenever the dredging finishes in that sub-block(depending on the quantity ofdredging) , whichever is earlier.& in second phase from 01 October 2021 -30 Sept 2022) orwhenever the dredging finishes in that sub-block(depending on the quantity of dredging) ,whichever is earlier. For the second year 2021-22, the Raigad Dist Collector will again followthe same procedure as enumerated above for selection of bidder for carrying out dredging.The rates quoted by the bidder for EMP and monitoring will be valid for two years i.e.202021 and 2021-22.3.4After the dredging completes for the first year 2020-21 on 30 Sept 2021(Phase-I), theRaigad district collector will again follow the same procedure for selecting the bidder forcarrying out maintenance dredging for the period 01 Oct 2021- 30 Sept 2022 , after receiptof the authorisation from MMB to do so .Only after the work order is issued by the RaigadDist Collector for carrying out dredging for the year 2021-22, the consultant will be againissued fresh work order for implementation of EMP and to carry out Environment monitoringfor those sub-blocks where work order for dredging has been issued as part of Phase II.3.5In the case of EMP, the selected bidder will be fully responsible for implementationof all the aspects of Oil Spill Contingency Plan and for other aspects of EMP as stated inthe approved EIA, the bidder is required to act as safety coordinator/ In-Charge and bringout any violation/aberration of the Environment norms (as specified in the EMP planenumerated in EIA) being observed in the field to MMB’s notice. The bidder will be requiredto ensure that the laid down guidelines/SOPs in the approved EMP for ensuring the safety ofEnvironment from the aspects of Air, water suspended solid and turbidity, water quality,E-Tender No. MMB/CEO/HGR/03 for FY 20-21Page 5 of 51

water transport, traffic management, Human health and safety arising due to this proposeddredging activity are being followed strictly by the dredgers employed for this dredgingwork.3.6The bidder will also be required to maintain not only photographic evidence but alsovideo photography of his every visit through good quality photographs and Videos dulyannotated with date and time as an evidence of carrying out of his activities in the field andalso of the dredging process in progress in the field. A part of these photographs and Videoswill form part of the comprehensive report, which will be submitted at the end of the completeactivity (at the end of both phase I & II). The permission of the dredging (in Phase I) is from01 Oct 2020 or whenever the work order is issued for dredging(whichever is later)bythe Dist collector till 30 Sept 2021 or whenever the dredging completes due to exhaustion ofthe indicated quantity to be dredged by the contractor , whichever is earlier. Hence theEMP and monitoring will be required only for that period, when the dredging is in progressfor that particular sub-block. The quality of photographs and video photographs must be ofsufficient resolution so that any violations of the environment norms can be easilydeciphered from them and they can also be used as a piece of evidence, if required.3.7In the case of EMP, the bidder will be fully responsible for implementation of all theaspects of Oil spill contingency plan in the event of reporting of any oil spill incidentattributed to this dredging activity in the project area. The bidder will be required to deployhis resources in the field to tackle Oil spill as per their location within the following timeschedule:(i)For sites falling in Raigad District (Patalganga River & Dharamtar creek) :12 hrsThe scope of work of Environmental Monitoring will include measurement of Ambient AirQuality Monitoring, Noise Monitoring, Fresh water and Marine water Monitoring and Solidwaste Monitoring at various locations of creeks and rivers of Raigad Districts as per thestandards laid down by Environment department. Monitoring shall be done as per theprogramme approved by Environment Department while granting EC for this project.The detailed scope of work for carrying out Environment Monitoring and also EMP,which has been approved whilst granting EC is placed at Annexure I.In addition to the above, the bidder will also be required to undertake followingstudies whilst carrying out the work of Environment monitoring and implementation of EMP:(a) Study the impact of dredging and dumping on marine ecology and draw up amanagement plan and compare it with physio-chemical and bioticcomponents in the adjacent clearer (blue) waters(b) The report shall also include Benthic study, which includes study of impact ofdredging activity on the rivers, estuary and the sea including the intertidalbiotopes, corals and coral communities, molluscs, sea grasses, sea weeds,subtidal habitats, fishes, other marine and aquatic micro, macro and megaflora and fauna including benthos, plankton, turtles , birds etc. as also theproductivity. In order to obtain first-hand information/ opinion on the assignment, the tenderers areadvised to acquaint themselves fully with the location of the individual site of the blockswhere maintenance dredging activity is proposed before submitting their proposal.3.8In addition to the weekly/ fortnightly/monthly reports containing the monitoringrecords, the bidder will also be required to prepare a comprehensive detailed reportcontaining his observations about the environmental aspects of the dredging processincluding selected record of his monitoring activity carried out in the field and should alsocontain selected photographs and Videos as described in Para no 3.6. This comprehensivereport will be required to be forwarded through MMB to all the required authorities as per theextant regulations in force.A copy of the comprehensive EMP Report will be required to be sent to following Authoritiesthrough MMB:a) MMBb) Environment Department Gov. of Maharashtrac) MOEF Nagpurd) MPCB Mumbaie) Regional Office of MPCBf) Any other office as deemed necessary.The bidder will act as “Eyes and Ears” of MMB and ensure that any violations ofEnvironment norms or acts which are not permissible as per EC permission letter andleading to environment degradation due to this dredging activity are immediately brought tothe notice of MMB. The bidder will also be required to investigate any environment relatedcomplaints arising out of this dredging activity in his allotted field area. The bidder will ensurecompliance of all the terms and conditions as listed out in the EC permission letter in letterand spirit.A copy of the relevant extracts of the Minutes of meeting of MCZMA & SEAC-Icontaining the terms and conditions whilst recommending the maintenance dredgingproposal and forwarding it to SEIAA for accord of final EC and also a copy of the ECaccorded by SEIAA containing the terms and conditions is placed at Annexure IX4. Special terms & conditions4.1 The accredited consultants after accreditation with Quality Council of India/NationalAccreditation Board of Education and Training (QCI/NABET) and involved in preparation ofEMP report would need to include a certificate in this regard in the EMP reports prepared bythem and also certify that data provided by other Organization(s)/ Laboratories includingtheir status of approvals etc. vide Notification of the MoEF&CC.4.2 Team members should have 12 yrs of experience including marine oil spill impact studiesfrom any government/research organizations.4.2 The EMP and monitoring will be required to be carried out only till the time maintenancedredging activity is in progress in the first phase from 01 Oct 2020/ whenever dredgingcommences in that particular sub-block - 30 Sept 2021/whenever dredging finishes inthat particular sub-block, whichever is earlier and in second phase from 01 Oct 2021/whenever dredging commences in that particular sub-block - 30 Sept 2022/wheneverdredging finishes, whichever is earlier. 4.3 The bidder will be responsible for making good to the satisfaction of MMB any loss of andany damage to all structures and properties belonging to MMB and if such loss or damage isdue to fault and/or the negligence or willful acts or omission of the bidder, his employees,agents, representatives or subcontractors during this entire process of carrying outEnvironment monitoring and implementation of EMP,whenever and wherever required.4.4 The contractor will be fully responsible for the safety, security and insurance of hisemployees who are deputed in the field for undertaking observations towards Environmentmonitoring and for implementation of EMP. You should indemnify MMB against, all claims,demands, proceedings, damages, costs, charges and expenses whatsoever and howsoeverarrives in respect of any accident while executing this work.4.5 In case of bidder not having his own MOEF&CC approved Environment laboratory then it isimperative for the bidder to analyze all the samples collected in the field only in anMOEF&CC approved Environment laboratory having all the necessary certifications.4.6 On the front page of EMP report, the name of the consultant/consultancy firm along withtheir complete details including their accreditation, shall be indicated.4.7 While submitting the EMP report, the name of the experts associated with/involved in thepreparation of these reports and the laboratories through which the samples have been gotanalysed should be stated in the report. It shall clearly be indicated whether theselaboratories are approved under the Environment (Protection) Act, 1986 and the rules madethere under (Plea
