MINUTESHARDYSTON TOWNSHIPMUNICIPAL UTILITIES AUTHORITYDecember 7, 2020The meeting of the Hardyston Township Municipal Utilities Authority was held on Monday,December 7, 2020 at 7:00 p.m., at the Municipal Building located at 149 Wheatsworth Road.Members present were Mr. Kula, Mr. Kaminski, and via conference call, Mr. O’Grady and Ms.Van Allen. Also present were Carrine Kaufer and Mike Vreeland and via conference call,Attorney Ryan Scerbo.After a salute to the flag, Mr. Kula stated compliance with the Open Public Meetings Act.MINUTES: A MOTION was made by Kaminski, seconded by O’Grady to approve theminutes of the November 2, 2020 meeting. In favor, Kula, Kaminski, O’Grady and Van Allen.OLD BUSINESS:Indian Field Phase II As-Built Plans – Nothing new to reportPhase III Conveyance – Ms. Kaufer stated that Beazer homes had received the necessarysignatures from the HOA and the conveyance was being finalized.Bonds – Ms. Kaufer stated that the Township’s Attorney Fred Semrau had been in touch with thebonding company and that an agreement was likely to be reached by the end of the year tocomplete the as built plans using the cash portion of the bonds.Crystal Springs Shotmeyer Tract/ Bypass –Nothing new to report.Irrigation – Nothing new to report.Operational Considerations – Nothing new to report.NEW BUSINESS:A.A RESOLUTION OF THE HARDYSTON TOWNSHIP MUNICIPALUTILITIES AUTHORITY ACKNOWLEDGING THAT A TWO-YEARMAINTENANCE PERIOD HAS ELAPSED WITH RESPECT TO THEFACILITIES TRANSFERRED FROM BEAZER HOMES, LLC INCONNECTION WITH THE INDIAN FIELD, PHASE III DEVELOPMENT

A MOTION was made by Kaminski and seconded by O’Grady. In favor, Kula,Kaminski, O’Grady and Van Allen.HARDYSTON TOWNSHIP MUNICIPAL UTILITIES AUTHORITYA RESOLUTION OF THEHARDYSTON TOWNSHIP MUNICIPAL UTILTIES AUTHORITYACKNOWLEDGING THAT A TWO-YEAR MAINTENANCE PERIOD HAS ELAPSEDWITH RESPECT TO THE FACILITIES TRANSFERRED FROM BEAZER HOMES,LLC IN CONNECTION WITH THE INDIAN FIELD, PHASE III DEVELOPMENTWHEREAS, the Hardyston Township Municipal Utilities Authority (the “Authority”)owns and operates a water supply system and a wastewater conveyance system servicing theresidents of Hardyston Township (collectively the “Systems”); andWHEREAS, a development known as Indian Field was constructed in HardystonTownship (the “Township”) in phases over the course of multiple years (“Indian FieldDevelopment”)WHEREAS, Phase III of the Indian Field Development was constructed and is currentlyowned by Beazer Homes, LLC (the “Developer”); andWHEREAS, as a condition of approvals received from the Township the Developer wasrequired to post certain performance security to ensure that the construction of the developmentswould be completed in accordance with Township approvals and that the water and sewerfacilities associated with Indian Field Phase III (the “Facilities”) would be properly transferred tothe Authority; andWHEREAS, as a condition of approvals received from the Township the Developer wasrequired to transfer the Facilities as well as certain easements to the Authority upon thecompletion of the development; andWHEREAS, pursuant to a Resolution dated June 5, 2017, the Authority declared that theIndian Field Phase III development was complete and that the Developer fulfilled its obligationsto the Authority with respect to providing a final inspection of the Facilities, and as-builtdrawings of the Facilities; andWHEREAS, the Developer was unable to transfer the necessary easements and Facilitiesto the Authority as required due to a title issue which issue is now resolved; andWHEREAS, the Developer has requested that the Authority acknowledge that the timethat has passed from 2017 to now be accepted as the maintenance period and that the Developernot be required to post a maintenance bond for an additional two-year period; and

WHEREAS, the Authority’s General Consulting Engineer has provided a memorandumattached hereto as Exhibit A in which the Engineer notes that he has no objection to theDeveloper’s request; andNOW, THEREFORE, BE IT RESOLVED by the Board of the Hardyston TownshipMunicipal Utilities Authority as follows:1.The Administrator is hereby authorized and directed to advise Beazer Homes, LLCthat its request not to post a maintenance bond for the transferred Facilities is granted.2.Upon execution of all necessary and appropriate documents the Authority’sEngineer is authorized and directed to recommend to the Township that it reduce the Beazer Homes,LLC Performance Bond No. 104307972 and associated cash escrow by 164,904.00.B.A RESOLUTION OF THE HARDYSTON TOWNSHIP MUNICIPALUTILITIES AUTHORITY AUTHORIZING AN AGREEMENT WITHMUNICIPAY NATIONWIDE PAYMENT SOLUTIONS FOR THEPURPOSE OF ACCEPTING ELECTRONIC RECEIPT TRANSACTIONSFOR WATER AND SEWER CHARGESA MOTION was made by Kaminski and seconded by O’Grady. In favor, Kula,Kaminski, O’Grady and Van Allen.HARDYSTON TOWNSHIP MUNICIPAL UTILITIES AUTHORITYRESOLUTIONA Resolution Authorizing an Agreement with MuniciPay Nationwide Payment Solutions forthe Purpose of Accepting Electronic Receipt Transactions for Water and Sewer ChargesWHEREAS, N.J.A.C. 5:30-9.1 et seq. permits municipal authorities to accept electronic receipttransactions such as credit cards and debit cards as a means of collecting municipalobligations; andWHEREAS, the Hardyston Township Municipal Utilities Authority (Authority) desiresto accept credit cards, debit cards and e-checks for the collection of water and sewerpayments; andWHEREAS, the acceptance of credit cards, debit cards e-checks by the Authority will makepayment easier and more efficient; and

WHEREAS, the Authority will not incur any fees associated with the use of credit cards or echecks for tax payments since the fee is assessed to each individual user, and the UtilityBilling Specialist will post the charge for credit card or e-check use on the website and at themunicipal building;WHEREAS, the Authority now desires to enter into an Agreement with MuniciPayNationwide Payment Solutions as the most reasonable and least expensive provider ofelectronic receipting.NOW, THEREFORE, BE IT RESOLVED by the Commissioners of the Hardyston TownshipMunicipal Utilities Authority, in the County of Sussex, State of New Jersey, that the MUAAdministrator is hereby authorized to execute an Agreement with MuniciPay NationwidePayment Solutions.This Resolution shall take effect immediately upon adoption.PAYMENT OF BILLS:A MOTION was made by O’Grady and seconded by Van Allen to pay the bills as per the bill listof December 7, 2020.
