New requirements forproperty managersProperty managers are employed by land agentsand manage residential or commercial properties.If you run a property management business,you must be a registered land agent.Property manager registrationFrom 28 September 2019 property managersmust be registered.Requiring property managers to be registeredmeans that only suitably qualified people can takeon the responsibility of managing someone else’svaluable asset. This will offer greater security forlandlords and also tenants.You can apply for registration from 1 February2019 if you: have completed the relevant qualifications have a police clearance no more than 12months old are 18 years of age, or over pay the application fees.A registration cannot be granted if you have been: convicted of an indictable offence ofdishonesty convicted of a summary offence of dishonestyin the last 10 years.It is recommended that you lodge yourapplication for registration by 30 August 2019 toensure that you receive your registration in timeto comply from 28 September 2019. There is nofinancial disadvantage in applying early.
Please note that you will not need to hold a propertymanagers registration if: you only manage properties for yourself or relatives you work for a community housing provider you work for an agent and take calls or arrangemaintenance appointments in relation to properties(e.g. reception duties).PenaltiesFrom 28 September 2019 anyone who is employedas a property manager must be registered, otherwisethey risk a maximum penalty of 20,000. Applying for registrationFrom 1 February 2019 you can apply online atsa.gov.au/realestateOnce your application for a property managerregistration is approved, you will be notified byConsumer and Business Services (CBS).Digital registrationThe real estate industry is moving to digitalregistration, which means that you will be able tocarry your property manager registration on yourmobile phone or tablet. Plastic registration cards arebeing phased out.If you are unable to display your digital registrationdue to circumstances beyond your control – eg nointernet coverage or a faulty phone – CBS complianceofficers will consider alternative methods to checkwhether you are appropriately registered.
Responsibilities of propertymanagersAs a property manager you must comply withcertain legal obligations: Carry your registrationYou must carry your registration with you at alltimes while working as a property manager. Act honestlyYou must not provide false information toyour landlords or tenants. For example, youmust not seek payment from the landlord formaintenance work that has not actuallybeen done. Deal with trust money appropriatelyWhen receiving trust money it must bepromptly deposited into the agent’s trustaccount. You must not misuse funds fromtrust accounts. Manage the tenancyThe Residential Tenancies Act 1995 sets outrequirements for things such as lodging a bond,collecting rent, paying accounts, arrangingrepairs and issuing notices to the tenant if theyare in breach of the rental agreement.If you breach the law with how you managea property, you could be fined or yourregistration cancelled.
