SUPREME COURT, COUNTY OF NASSAURULES GOVERNINGPUBLIC FORECLOSURE AUCTIONSGENERAL PROVISIONS1. Pursuant to Order of the Chief Administrative Judge, AO/157/20, the Court may begin acceptingRequests to file a Notice of Sale which will enable the resumption of public Foreclosure Auctions inNassau County in accordance with these rules;2. When authorized by the Court in accordance with these rules, Foreclosure Auctions will be held on adate certain between Monday through Thursday promptly at 02:30 p.m. (exclusive of Court holidays)on the North Side steps of the Nassau County Supreme Court located at 100 Supreme Court Drive,Mineola, N.Y. 11501;3. A Foreclosure Auction Calendar and Terms of Sale will be posted on a bulletin board located near theNorth side steps of the courthouse, forty-five (45) minutes prior to the commencement of theForeclosure Auction;4. Foreclosure Auctions that were previously noticed and published for sale but cancelled due to the nonappearance of the Court Appointed Referee will be rescheduled by the Court upon the filing of asubsequent Request to File a Notice of Sale by Plaintiff’s Counsel as provided below;5. The Court Appointed Referee shall conduct and supervise the noticed Foreclosure Auction and allinterested parties must be present. A representative of the Plaintiff, authorized to act on Plaintiff’sbehalf must appear at the Foreclosure Auction / Foreclosure Sale;6. The Court reserves its right to withdraw any and/or all of the properties from sale prior to and throughthe date of the Foreclosure Auction and to make any corrections with regard to the generalinformation pertaining to any parcels on the Foreclosure Auction list;13 October 2020

7. The Foreclosure/Ex Parte Clerk is authorized to reject and/or return, for corrections, any paperssubmitted to the Court which are not in compliance with these rules.CONVERSION TO E-FILE1. For all non-E-filed cases, a request by counsel to convert the underlying foreclosure action to an E-filecase must first be filed. To do this, Counsel must complete a Stipulation and Consent to E-Filing Form[EF-10 Form], which can be found on the “Forms” link in the NYSCEF system. Upon its completion theEF-10 Form must be uploaded to the Electronic Document Delivery System (“EDDS”) for furtherprocessing by the Court;2. If not originally e-filed, Plaintiff’s counsel shall confirm that the matter has been converted to E-filebefore proceeding further.PRE-FORECLOSURE AUCTION STATUS CONFERENCEFORECLOSURE AUCTION1. Plaintiff’s Counsel shall serve the Defendant borrower(s) and their attorney(s) with a Pre-ForeclosureAuction Status Conference Form;3. Plaintiff’s counsel shall also prepare a Request to File a Notice of Sale;4. The required Pre-Foreclosure Auction Status Conference Form and Request to File a Notice of Sale canbe found closure.shtml5. Plaintiff’s counsel shall file the Request to File a Notice of Sale and the Pre-Foreclosure Auction StatusConference Form with the Affidavits of Service for the Pre-Foreclosure Auction Status ConferenceForm in the NYSCEF System;6. Upon review and approval of these required submissions, the Court shall schedule a Pre-ForeclosureAuction Status Conference which will be held in person in the Foreclosure Settlement Conference Partlocated on the lower-level of the Courthouse;7. Upon final approval, the Court shall issue an order with the date and time of the Foreclosure Auctionupon which Plaintiff’s Counsel can publish the Notice of Sale in accordance with these rules and asauthorized by the Court’s outstanding Judgement of Foreclosure and Sale;8. Pursuant to RPAPL §231, Plaintiff must arrange for the timely publication of the foreclosure sale andthe costs of the publication may be recouped by the Plaintiff from the proceeds of the foreclosure sale;13 October 2020

9. Plaintiff and/or Plaintiff’s Counsel must notify the Court Appointed Referee of any knownencumbrances or stays in advance of the Foreclosure Auction/Foreclosure Sale;COURT APPOINTED REFEREES1. Upon notice of a Court appointment as a Referee, the Referee certifies that he or she is eligible to actpursuant to the provisions of Part 36 of the Rules of the Chief Administrative Judge (22 NYCRR Part 36),including, but not limited to § 36.2 (c) (“Disqualification from appointment”), and § 36.2 (d)(“Limitations on appointments based upon compensation”);2. If the Court Appointed Referee is disqualified from appointment pursuant to the provisions of Part 36,the Referee must immediately notify the Appointing Justice on notice to the appearing parties or theirattorneys;3. The Court Appointed Referee shall within 30 days of the closing of the subject property, complete andsubmit, through the NYSCEF System, the Surplus Monies Form, before which time he or she may notrequest or receive any compensation for computing the amounts due or conducting the foreclosuresale. The required Surplus Monies Form can be found closure.shtml4. Pursuant to CPLR § 8003(a), in the discretion of the court, upon the filing of his or her report, and uponthe filing of the Surplus Monies Form in NYSCEF, a fee shall be paid to the Court Appointed Referee forthe computation of the amount due;5. If a Plaintiff adjourns or cancels a Foreclosure Auction / Foreclosure Sale, Plaintiff must provide at leastfive (5) days-notice, both in writing and by telephone to the Court Appointed Referee. If such notice isnot timely given, then the Court Appointed Referee may make an application by submitting anaffirmation seeking additional attorney fees to the Court;6. The Referee shall not request or accept additional compensation for the computation unless it has beenfixed by the court in accordance with CPLR § 8003(b);7. A Court Appointed Referee is prohibited from accepting or retaining any funds for him or herself orpaying funds to him or herself without compliance with Part 36 of the Rules of the Chief AdministrativeJudge.SUBSTITUTION OF COURT APPOINTED REFEREES1. If a Court Appointed Referee is unable to act pursuant to Part 36 or otherwise unavailable, he or shemust promptly petition the Appointing Court for the appointment of a substitute Referee;13 October 2020

If a Court Appointed Referee does not appear for a scheduled Foreclosure Auction, the ForeclosureAuction shall be cancelled and plaintiff’s counsel or the Court Appointed Referee shall contact theCourt to obtain the new date and time on which the subject property will be rescheduled for Auctionby filing a subsequent Request to File a Notice of Sale.THIRD-PARTY BIDDERS1. It is the sole responsibility and obligation of a bidder, prior to the date of the Foreclosure Auction, toacquaint him or herself with the subject property or any of the subject properties he or she intends tobid on, any encumbrances thereon, and the Terms of Sale, which is a legally binding and enforceablecontract against the parties involved, before placing a bid at the Foreclosure Auction. It is stronglyadvisable to consult an attorney and to be thoroughly familiar with the Terms of Sale;2. On the day of the Foreclosure Auction, a successful third-party bidder shall provide the CourtAppointed Referee proof of identification;3. As directed by the Referee on the day of the sale, a successful third-party bidder shall execute theTerms of Sale for the purchase of the subject property and pay to the Court Appointed Referee tenpercent (10%) of the sum bid;4. While the Court does not prohibit the tender of a cash down payment, the Court Appointed Refereemay refuse cash on grounds of security and/or convenience and the property will need to be reauctioned in the absence of a down payment acceptable to the Referee. The Court therefore stronglyencourages successful third-party bidders to pay the full ten percent (10%) of the sum bid by certifiedcheck or bank check made payable to the Court Appointed Referee;5. Double-endorsed checks will not be accepted by Court Appointed Referees;6. A Foreclosure Sale will not be deemed final until the full ten (10%) percent deposit has been paid bythe successful third-party bidder to the Court Appointed Referee and a contract has been signed,which must take place immediately following the Foreclosure Auction at the Courthouse;7. If a successful third-party bidder fails to pay the full ten (10%) percent deposit and sign the Terms ofSale for the subject property as directed by the Referee, the Court Appointed Referee will exercisehis/her discretion to determine if the property will re-bid on the same day or re-noticed for a newauction;8. The amount of the successful bid, which will become the “Purchase Price”, will be recorded by theCourt Appointed Referee on the Memorandum of Sale that will memorialize the foreclosure sale andbe signed by the Court Appointed Referee, bank representative, and the successful third-party bidder.The required Memorandum of Sale Form can be found closure.shtml13 October 2020

CONCLUSION OF FORECLOSURE AUCTION1. The Court Appointed Referee shall complete and submit a Fiduciary Form at the conclusion of eachday’s Foreclosure Auction sales;2. The Court Appointed Referee, bank representative, and successful third-party bidder shall memorializeeach sale by completing, executing, and submitting the Memorandum of Sale;3. The Fiduciary Form and the Memorandum of Sale shall promptly be submitted to the Court by theCourt Appointed Referee on the day of the Foreclosure Auction at the Clerk’s office, which is locatedon the first floor of the courthouse in Room 186;4. The Court Appointed Referee shall within 30 days of the closing of the subject property, complete andsubmit, through the NYSCEF System, the Surplus Monies Form, before which time he or she may notrequest or receive any compensation for conducting the foreclosure sale;5. FORECLOSURE AUCTION PROGRAMRULES AND FORMSINSTRUCTIONS:REQUEST TO FILE NOTICE OF SALE

N.Y.S. SUPREME COURT, COUNTY OF NASSAUFORECLOSURE AUCTION PARTREQUEST TO FILE NOTICE OF SALEINSTRUCTIONSPursuant to the Administrative Order of the Chief Administrative Judge, AO/157/20, effective July 27, 2020,Foreclosure Auctions may resume as of October 15, 2020.IT IS IMPORTANT TO NOTE THAT THE PROCEDURES AND PROTOCOLS ARE SUBJECT TO CHANGE.Accordingly, with respect to Foreclosure Auctions, the Court has adopted and implemented the following proceduresand protocols with respect to Plaintiff’s submission of a Request to File a Notice of Sale to the Court: On October 15, 2020, the Court will begin accepting Requests to file a Notice of Sale, which will enable it tobegin preparations for the resumption of holding Foreclosure Auctions;In order to initiate the Foreclosure Auction procedure, Plaintiff’s counsel shall submit electronically, to theCourt, a Request to file either an initial or subsequent Request to File Notice of Sale;Plaintiff’s counsel may access the Request to file a Notice of Sale on the Court’s website. The link to the Court’swebsite is as /foreclosure.shtml ; Upon completion of the Request to file a Notice of Sale, Plaintiff’s counsel must submit it through the NYSCEFSystem;For non-E-file cases, a request by counsel to convert a hard copy case to an electronic case must be filed.Counsel must complete a Stipulation and Consent to E-Filing Form [EF-10 Form], which can be accessed byclicking on the “Forms” link in NYSCEF. After completing the Stipulation and Consent to E-Filing Form counselmust upload it to the Electronic Document Delivery System (“EDDS”);After the submission by Plaintiff’s counsel of the initial Request to File a Notice of Sale together with the COVID19 Pre-Foreclosure Status Conference Form, the Court, in accordance with AO/157/20, effective July 27, 2020,referred to above, shall schedule a Pre-Foreclosure Auction Status Conference. If the Request to File a Notice ofSale is granted by the Court, then it will render an Order, which will include, inter alia, the date and time of theForeclosure Auction;If, upon review, the Court rejects the Request to File a Notice of Sale and/or the COVID-19 PreForeclosure Auction Status Conference Form because it is incomplete and/or otherwise insufficient,then Plaintiff’s counsel, Defendant, and Defense counsel will be directed to appear before the Courtfor an in person COVID-19 Pre-Foreclosure Auction Status Conference.If, upon receipt of a submission by Plaintiff’s counsel of a COVID-19 Pre-Foreclosure Auction StatusConference Form, which indicates that Defendant and/or Defense counsel have not responded to thenotice of the COVID-19 Pre-Foreclosure Auction Status Conference, the Court will schedule an inperson status conference within 10 days.Rev. 23 OCTOBER 2020

If Plaintiff’s counsel fails to submit a completed Pre-Foreclosure Auction Status Conference Form to theCourt, the Court will place the matter on its Non-Compliance Calendar for further conferencing andnotify Plaintiff’s counsel, Defendant(s)/homeowner(s) and his/her/their legal representative, if any, ofthe date on which to appear before the Court. The change in location of the Foreclosure Auctions to the North Side steps of the Supreme Court shall be statedin all future Notices of Sale, which must also include the notification language that Foreclosure Auctions will beheld “Rain or Shine.”;The Notice of Sale shall also specify that if proper social distancing cannot be maintained or there are otherhealth or safety concerns, then the Court Appointed Referee will cancel the foreclosure auction; andThe Notice of Sale shall be submitted by the Court Appointed Referee to NYSCEF at least 10 days prior to thedate of the foreclosure auction;Any questions about the procedure may be directed to the Clerk at 516.493.3113. N.Y.S. SUPREME COURT, COUNTY OF NASSAUFORECLOSURE AUCTION PARTCOURT APPOINTED REFEREE POST FORECLOSURE AUCTIONPROCEDURE NOTICEAn assessment of the Foreclosure Auction Part (“FAP”) was conducted by the court. The purpose of the assessment wasto determine whether Court Appointed Referees selected from a list of eligible referees compiled pursuant to Part 36 ofthe Rules of the Chief Judge [Part 36 Eligible Fiduciary List] are properly accounting for and timely reporting theexistence of surplus monies and timely filing a Report of Sale (“ROS”) after the closing of a subject property which wassold at foreclosure auction.The responsibilities of a Court Appointed Referee during the foreclosure process include, inter alia: scheduling theforeclosure sale; appearing at court on the date of the foreclosure auction and selling the subject property at auction;closing the sale; distributing the proceeds of the sale, including payment of any surplus funds to the Nassau CountyTreasurer, and filing the ROS and Surplus Monies Form (“SMF”) with the Office of the Nassau County Clerk (“NCC”) andthe Court within 30 days of closing.The assessment by the court revealed, inter alia, that Court Appointed Referees, in many instances, do not properlyaccount for and timely report the existence or non-existence of surplus monies to the court.Such practice places an undue strain on the limited court staff responsible for, among other things, supporting theForeclosure Auction Part. Court personnel assigned such tasks are required to, among other things: enter and trackinformation pertaining to the foreclosure auction; review documents on both the court’s and NCC’s computer systems;and to ultimately dispose of such matters. Accordingly, it is essential that as an appointee of the court, a CourtAppointed Referee, among other things: review all documents prepared for submission for accuracy and completenessprior to filing; and to timely file both the SMF and ROS.EFFECTIVE IMMEDIATELY: Court Appointed Referees: Shall, as an appointee of the court, carry out his or her responsibilities in conformance with both applicable statutesand requirements of the court, and in compliance with the time frames therein; Shall, on the date of the foreclosure auction complete and submit to the Court both Fiduciary Form, which will bereviewed by the Fiduciary Clerk, and the Memorandum of Sale; Shall, within 30 days of the closing of the subject property, complete and submit to the court Surplus Monies Form.Upon the filing of the Surplus Monies Form in NYSCEF, a fee shall be paid to the Court Appointed Referee forconducting the foreclosure sale. The Court Appointed Referee shall not submit SMF to the Court on the date of theForeclosure Auction; Must submit the SMF to the Court through the NYSCEF System; That are found to be negligent by the Court in performing their duty to timely file an accurate SMF and ROS with theCourt shall be directed to appear at a conference with a Court Attorney Referee prior to and in addition to theStatus Conference date. If there persists a situation where a Court Appointed Referee is found to be negligent bythe Court in performing his or her duty to timely file an accurate a SMF and ROS he or she may be removed from thePart 36 Eligible Fiduciary List.Rev. 13 October 2020
