APPEAL FORMATS - VENTURA SUPERIOR COURTRevised January 30, 2019COVERS AND INDEXES All covers and index pages are numbered (except master indexprinted from Yeslaw) All pages have line numbers including covers and index and cert Order of covers is Appeal cover, Sessions Index, Witness Index,Exhibits Index, Daily Cover, Transcript, Cert. If there are no witnessesor exhibits, you do not need to add these pages. Underlining and/or bold print (if you use) is not supported byelectronic filing so is not necessary EXCEPT the underline for thecaption box and the line above your name on the cert page which isdescribed in another section Each date and reporter is a separate volume. Multiple consecutivedates can be included in one volume only if all dates have the samejudge and reporter Each volume will have its own index specific to that volume The first volume needs to have a master index in addition to theindex for that volume. Yeslaw (or other vendor) creates a masterindex and attaches to electronic copy. However, for paper copy youwill need to print this off Yeslaw and insert into the first volume. Donot number the master index printed from Yeslaw No hyphens may be used for incorrectly numbered pages on coversor index. Hyphens can be added at the end of the transcript if you goover your blocked number of pages.

APPEAL COVER Case No. and B No. are on the top line There is NO blank line between the 11 ---000--- 11 and the caption Volume Numbers and Page numbers for that volume go to the rightof the birdcage instead of at the bottom of the page. Indicate theactual number of pages, including cert page, in your transcript, notthe pages you were blocked. The line at the bottom of the birdcage needs to be manually typed in(Shift repeated hyphen) instead of a format through your software Insert judge's name for your date on the Appeal Cover as opposed tothe judge being appealed from (Might be the same judge) If you are putting multiple dates in one volume, make sure to includeall dates on the cover (Please remember that if you have differentjudges, they have to be separate volumesVOLUME INDEX - Includes Sessions, witnesses, exhibits There will always be at least a Sessions index in every volume Must state "MASTER INDEX - VOLUME(#)" at the top of each indexpage Each index must be on its own page

A. SESSIONS INDEX Must include the heading "SESSIONS" plural Must include the date with which session (A.M. or P.M.) underneath Numbers in the page column must align with the session and anyproceedings listed, NOT the date of the session (see sampletranscript) When including a Marsden or sealed proceeding on an index, give thepage number where the blurb is located within the transcript and notthe actual page the sealed proceeding begins on (See sampletranscript)B. WITNESS INDEX Must have a chronological index. Alphabetical is done by Yeslaw (orother vendor) Witness names are listed by first and then last name (See sampleindex) No commas between names or titles (See sample index) Witness names all capped Examinations must be in paragraph format and can no longer be intable format. (See sample index) Make sure page numbers align with the examination line

C. EXHIBITS INDEX There needs to be at least two spaces between exhibit number andthe description. No dashes (see sample transcript) Page numbers need to align with the exhibit number and the firstdescription line so that hyperlinks will be made correctlyDAILY COVER Underline on birdcage must be manually typed in (Shift repeatedhyphen) Must have page number It is not necessary to list type of proceedings. "REPORTER'STRANSCRIPT OF PROCEEDINGS" is acceptable on appeal daily covers Appearances - Move all the way to left margin. (See sampletranscript)

SEALED/CONFIDENTIAL PROCEEDINGS A sealed record is that which has been sealed by Order of the Court.A confidential record is that which is required by statute or case lawto be sealed, i.e., Marsden motion, Pitchess motion, juvenilehearings. Sealed/confidential proceedings are always in a separate volume.Sealed proceedings become a separate volume by adding a letter tothe volume number. Example: If you are Volume 4 and have aMarsden, the Marsden would become Volume 4A. Sealed/confidential proceedings must be designated as being sealedor confidential. See Tab 4 for samples and exact language on coversper CRC 8.45(c}(1)(B) and (C) Use the Daily Cover from the sealed transcript on the outside ofenvelope. Add the B Number, Volume number, and page numbers tothis cover. (See Tab 4C) All sealed/confidential proceedings are filed under separate seal butare now numbered consecutively. Do not assign or estimate aseparate block of pages for sealed proceedings. They are inclusive inthe block for the regular coinciding volume Sealed/confidential proceedings must have its own cert. The certmust have a page number. Do not include the hyphenated blockedpage number on this cert. Rather, the hyphenated page numbergoes on the cert for the coinciding regular volume. Sealed/confidential proceedings can oftentimes be a stand-aloneproceeding with nothing on the record before or after. If you haveonly sealed proceedings with no other proceedings before or after, itis labeled as the "A" volume. The normal coinciding volume wouldinclude the appeal cover, sessions index, daily cover, the sealed

proceedings blurb on its own page, and cert. (See Tab 3A} If there are proceedings before the sealed portion, a blurb must beplaced in the transcript where the sealed proceedings take placestating the page numbers of the sealed proceedings and the nextpage number if proceedings resume in open court after the sealedportion. Resumed proceedings will start on a new page. You willhave to change the page number so that it follows the last page ofthe sealed portion.Example: Your blurb is on page 4. Sealedportion starts at page 5 and ends with cert on page 10. Your nextpage number for resumed proceedings in open court will be 11. Nonew cover or dateline needed. Begin new page with a blurb on line 1stating "(Proceedings resumed in open court.}" (See Tab 38} If proceedings do not resume after the sealed portion, you would addthe end-of-volume blurb stating what the next volume and pagenumber will be (See Tab 3C} Sealed/confidential proceedings must be included on the Sessionsindexes of both the appeal volume and corresponding "A" volumea. Appeal Index - Indicate Sealed or ConfidentialProceedings/Hearing followed by "May Not Be Examined WithoutCourt Order." Include the page numbers of the sealedproceedings. Do not disclose the substance of the hearing, i.e.,Marsden Motion, Pitchess Motion. In the page number columnuse the number of the page where the blurb is located within thetranscript indicating there is a sealed portion instead of the actualpage the sealed proceeding begins on. (See sample indexes inTabs 3A, 38, 3C}b. Sealed volume index - Indicate Sealed or ConfidentialProceedings/Hearing followed by "May Not Be Examined WithoutCourt Order" (See overview and samples in Tab 4}

Sealed/confidential proceedings have to be uploaded seperately onYesLaw. Make sure you give the coordinator a separate ASCII file forthe sealed proceedings. Refer to the Transcript Production/ASCIIsection of the guidelines on how to label sealed ASClls. Whenuploading to YesLaw, make sure to select "sealed/confidential" onthe drop down box for type of proceedings. Transmission of Sealed/Confidential Transcripts (Envelopes)a. If all parties are present, each copy goes in its own envelope, i.e.,Court, DA, defense present - three envelopesb. If one party is not present, original and one copy in one envelopeand one copy in another envelope, i.e., Marsden, Court andDefense present - two envelopesc. Exception: Hobbs Motions or any motion under Evidence Code1041 or 1042 (unsealing search warrants/confidential informants),ALL copies in one envelope.TRANSCRIPT BODY See sample transcripts for dateline format All pages are to be numbered consecutively Delete all headers and footers (VesLaw adds them) If your transcript exceeds the block of pages you were given, youmust add a -1, -2, etc, to your last assigned page number. Forexample: If you were assigned pages 1-50 and you have 52 pages,you must number them 50-1 and 50-2. At the end of your transcript (before your cert page) you must

include a blurb (per CRC 8.144) stating what the next volume andpage number will be. Do not forget to add a page for your cert whengiving next page number. (See example in the sample transcript forexact wording of blurb}. You do not have to include this blurb if youhave no blank pages in your transcript or if you are the last volume.REPORTER'S CERT All volumes must have a cert Certs must have a page number Remove the clause at the bottom of cert regarding Government Code(if you use that}. We may be adding a new one. Certs have to be electronically and digitally signed If your transcript has fewer pages than what was assigned to you,then you will have to include the assigned number with your certpage number. Ex: Your cert is page 277 but you were blocked pages1-300, your cert page number will be 277-300. (See sampletranscript} You must manually underline the birdcage and the line above thereporter's name Follow wording of the sample cert so that we are all consistent
