How the 1122 Program WorksBackground InformationSection 1122 of the fiscal year 1994 National Defense Authorization Act established theauthority for State and local governments to purchase law enforcement equipmentthrough Federal procurement channels, provided that the equipment is used in theperformance of counter-drug activities. The "1122 Program" affords State and localgovernments the opportunity to maximize their use of taxpayer dollars, by takingadvantage of the purchasing power of the Federal Government to receive discountscommensurate with large volume purchases.The statute defines the terms "State" and "units of local government" as follows:The term 'State' includes the District of Columbia, the Commonwealthof Puerto Rico, the Commonwealth of the Northern Mariana Islands,and any territory or possession of the United States.The term 'unit of local government' means any city, county, township,town, borough, parish, village, or other general purpose politicalsubdivision of a State; an Indian tribe which performs law enforcementfunctions as determined by the Secretary of the Interior; or any agencyof the District of Columbia government or the United States Governmentperforming law enforcement functions in and for the District of Columbiaor the Trust Territory of the Pacific Islands.The authority for the 1122 Program resides with the Department of Defense. TheU.S. Army, as the Executive Agent of the program, formed a steering committee initiallyconsisting of representatives from the Army, the General Services Administration(GSA), the Defense Logistics Agency (DLA), and the Department of Justice. Today,the Army, GSA, and DLA are actively involved in the program. The Army also maintainsa website (http://www.army.mil/article/18384/) that contains a variety of informationregarding the 1122 Program. One of GSA’s responsibilities under the program is thedevelopment of a Catalog that delineates the items available under the 1122 Program.1122 Program Expansion July 2011Section 885 of the Duncan Hunter National Defense Authorization Act forFiscal Year 2009 amended 10 U.S.C. 381, to expand the procurement authorityunder the 1122 Program beyond counter-drug activities, to include equipment forhomeland security and emergency response activities.The amended statute defines the terms "State" and "units of local government" asfollows:1

The term ''State'' includes the District of Columbia, the Commonwealth ofPuerto Rico, the Commonwealth of the Northern Mariana Islands, and anyterritory or possession of the United States.The term ''unit of local government'' means any city,county, township, town, borough, parish, village, or other general purposepolitical subdivision of a State; an Indian tribe which performs lawenforcement or emergency response functions as determined by theSecretary of the Interior; or any agency of the District of Columbiagovernment or the United States Government performing law enforcement oremergency response functions in and for the District of Columbia or the TrustTerritory of the Pacific Islands.The statute further specifies that any equipment to be used for homeland securityactivities must be included on the Authorized Equipment List published by theDepartment of Homeland Security (DHS) https://www.rkb.us/mel.cfm?subtypeid 549.The Office of the Secretary of Defense provided the following to describe EmergencyResponse:“First responders plus emergency management, public health, clinical care, publicworks, and other skilled support personnel (such as equipment operators) that provideimmediate support services during prevention, response, and recovery operations. Theemergency responder community consists not just of fire, law enforcement, and medicalimmediate responders to an accident or emergency situation but also to theinfrastructure that supports them and other emergency response organizations.”The Governor of each State participating in the 1122 Program appoints a State Point ofContact (SPOC) to administer the State’s activities under the program. The orderingprocess begins when the State or local government activity identifies items needed insupport of its counter-drug mission, homeland security and emergency responseactivities. The activity will use the 1122 Program Equipment and Supplies Catalog todetermine if the desired items are available via the Federal procurement system. TheSPOC will ensure that funds are available for the purchase request. Any entity wishingto make a purchase through the 1122 Program must contact their designated SPOC inorder to make a purchase. This program is still limited to the purchase of equipmentonly.Effective July 11, 2011 only those SPOCs meeting the mandatory requirements listedbelow will be authorized to request material from the sources of supply. States withouta designated and certified SPOC are ineligible to participate in any part of the 1122Program.1. SPOC certification or completion of interim training sessions.2. Current SPOC appointment orders from the Governor.3. DOD approvedPublic Key Infrastructure (PKI) External Certificate Authority (EAC) digitalcertificate (required for DOD EMAIL accounts).2

For questions regarding State participation or SPOC certification requirements shouldbe addressed to the Office of the 1122 Program Executive m@mail.mil,For Items Available From the Army or DLA:The State or unit of local government submits its request to the State Point of Contact(SPOC) in accordance with the procedures established by the State. The State or unitof local government must also secure funding for the items requested and provide theSPOC with a check or other form of payment, along with its request.In order to avoid unnecessary expenditures, upon receipt of a request for equipment,the SPOC should screen the State’s excess property program, the DefenseReutilization and Marketing Service http: (www.dispositionservices.dla.mil), and theFederal Surplus Personal Property Donation Program before initiating a purchaseaction. Once the SPOC determines that the items are not available under anyexcess/surplus program, the SPOC examines the request to ensure that the items areappropriate for counter-drug activities and verifies that proper payment has beensubmitted. The SPOC then ascertains that the requested items are available in theDepartment of Defense Supply System, from the Army or the Defense Logistics Agency(DLA), and submits the order to the appropriate agency. The equipment issubsequently delivered directly to the State or unit of local government.Should any problems arise relating to items ordered from the Army or DLA, or for statusof shipments, the State or unit of local government should contact the SPOC who, inturn, will then contact the Army or DLA for resolution.For Items Available From GSA Schedules see page 15 of the catalog.Additional Items Available From GSAIn addition to the items available from GSA Schedules under the 1122 Program, GSAoffers State and local governments the ability to obtain supplies (products) and servicesunder both the Cooperative Purchasing Program and the Disaster Recovery PurchasingProgram, as noted below:Cooperative Purchasing ProgramUnder the Cooperative Purchasing Program, State and local government entities maypurchase a variety of Information Technology (IT) products, software, and services fromcontracts awarded under GSA Schedule 70, General Purpose Commercial InformationTechnology Equipment, Software, and Services, as well as from contracts awardedunder the Consolidated Schedule containing IT Special Item Numbers (SINs).State and local government entities may also purchase alarm and signal systems,facility management systems, firefighting and rescue equipment, law enforcement andsecurity equipment, marine craft and related equipment, special purpose clothing, andrelated services from contracts awarded under GSA Schedule 84, Total Solutions forLaw Enforcement, Security, Facility Management Systems, Fire, Rescue, SpecialPurpose Clothing, Marine Craft, and Emergency/Disaster Response.3

While the 1122 Program limits the items available under Schedules 70 and 84 to thosespecifically identified in this Catalog, the Cooperative Purchasing Program providesState and local governments with the authority to purchase all of the products andservices under both Schedules 70 and 84 (in addition to all of the IT SINs under theConsolidated Schedule). It was designated as theArmy Communications and Electronics Command in 1981. What You Can Get From the Defense Logistics AgencyWhat You Can Get From the Defense Logistics AgencyThe Defense Logistics Agency (DLA) is the Department of Defense's largest logisticscombat support agency, providing worldwide logistics support in both peacetime andwartime to the military services as well as several civilian agencies and foreigncountries. As America’s combat logistics support agency, DLA provides the Army,Navy, Air Force, Marine Corps, other federal agencies, and combined and allied forceswith the full spectrum of logistics, acquisition and technical services. The Agencysources and provides nearly 100 percent of the consumable items America’s militaryforces need to operate, from food, fuel and energy, to uniforms, medical supplies, andconstruction and barrier equipment. DLA also supplies more than 84 percent of themilitary’s spare parts and manages the reutilization of military equipment. DLA isheadquartered at Fort Belvoir, Virginia as a global enterprise and likely to be whereverthe United States has a military presence.In order to participate in the 1122 Program, each state must have a State Point ofContact (SPOC) who is appointed and designated in writing by their respectivegovernor. The designation letter must be on file with the Executive Agent for the 1122Program as well as with DLA’s 1122 Program Manager. The primary responsibility ofthe SPOC is to administer and oversee the program for their state and local governmentcustomers. The SPOC is responsible for validating the equipment to be ordered isapplicable to counter–drug, homeland security and emergency response missions. TheSPOC is also responsible for ensuring advance payment is provided for the itemsordered and submitting the funding document when an order is placed. The equipmentto be ordered cannot be subject to, and/or be prohibited from sale to state and localgovernments by the requirements of other statutes, regulation or policy.
