B. Public safety department:1. Deputizing and training of personnel authorized to issuecitations for infractions and misdemeanor offenses.2. Providing supplementary patrols in natural resourcesand parks facilities as jointly determined by the directorof the department of parks, cultural and natural resources and the director of the department of publicsafety.3. Responding, as appropriate, to requests from department personnel for assistance in situations beyondtheir capacity or authority to act.(Ord. 11684 § 14,1995: Ord. 6798 § 69, 1984).7.12.700 Enforcement methods. Violation of the parkrules may be a civil infraction or criminal misdemeanor. Theinitial method of enforcement shall be by a request forvoluntary compliance. Violation of the King County Code maybe subject to enforcement by the King County sheriff pursuantto K.C.C. 7.12.650 and 7.12.660. In addition, any personfailing to comply with the park rules shall be subject to the lossof park or recreation facility use privileges and ejection fromcounty park areas or associated marine park areas. In thefuture, at the direction of the department director, the parkrules ordinance may be updated to request that certaindepartment personnel be commissioned by the King Countysheriff for the purpose of issuing citations to the violators ofadopted park rules. (Ord. 13037 § 3, 1998: Ord. 12003 § 19,1995: Ord. 11684 § 15, 1995: Ord. 6798 § 70, 1984).7.12.710 Contractual agreements. Any other provisionsof this chapter notwithstanding, the manager is authorized toenter into a contract or agreement with the director of the KingCounty department of public safety to provide specific parkpatrol services to enforce the laws and ordinances of KingCounty within King County park areas. (Ord. 6798 § 71, 1984).VII - MISCELLANEOUS PROVISIONS7.12.720 Severability. Should any section, subsection,paragraph, sentence, clause, or phrase of this chapter beordered unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portion of thischapter. (Ord. 6798 § 72, 1984).7.12.730 Collective bargaining obligation. Should anyprovision of this chapter constitute a subject or subjectsappropriate for collective bargaining as defined by RCW41.56.030, implementation of such provision, as it applies toany member of a collective bargaining unit, will occur only afterthe obligation to bargain has been satisfied.(Ord. 6798 § 73, 1984).-18-B. Alcoholic beverages” or “liquor” includes the four varietiesof liquor defined as alcohol, spirits, wine and beer, all fermented, spirituous, vinous, or malt liquor, and all otherintoxicating beverages, and every liquor, solid or semisolidor other substance, patented or not, containing alcohol,spirits, wine or beer; all drinks or drinkable liquids and allpreparations or mixtures capable of human consumption.Any liquor, semisolid, solid or other substance whichcontains more than one percent alcohol by weight shall beconclusively deemed to be intoxicating;C. “Associated marine area” means any water area within onehundred feet of any “King County trail, open space, parkarea” or “marine facility” such as a dock, pier, float, buoy,log boom, or other object which is part of a “King Countypark area”, provided that such area does not includeprivate property;D. “Boat” means any contrivance up to sixty-five feet in lengthoverall, used or capable of being used as a means oftransportation on water.E. “Camper” means a motorized vehicle containing sleepingand/or housekeeping accommodations, and shall include apickup truck with camper, a van-type body, a convertedbus, or any similar type vehicle;F. “Camping” means erecting a tent or shelter or arrangingbedding or both for the purpose of, or in such a way as willpermit remaining overnight, or parking a trailer, camper, orother vehicle for the purpose of remaining overnight;G. “Campsite” means designated camping sites which aredesignated for the use of tent campers, and which have nowater and/or electrical facilities available for hookup to atrailer or a camper;H. “Discrimination” means any action or failure to act, whetherby single act or part of a practice, the effect of which is toadversely affect or differentiate between or among individuals or groups of individuals, because of race, color,religion, national origin, age, sex, marital status, parentalstatus, sexual orientation, the presence of any sensory,mental or physical handicap, or the use of an animal guideby a blind or deaf or otherwise physically or mentallychallenged person;I. “Department” means any division of the King Countydepartment of parks and cultural resources department.J. “Facility” or “facilities” means any building, structure, orpark area operated by the King County parks and culturalresources department;K. “Facility manager” means a duly appointed King Countyparks and cultural resources department employee;L. “King County open space, trail or park area” means anyarea under the ownership, management, or control of theparks and cultural resources department;M. “Director” means department director of the King County*(natural resources and parks division) parks and culturalresources department;N. “Motor vehicle” means any self-propelled device capable ofbeing moved upon a road, and in, upon, or by which anypersons or property may be transported or drawn, andshall include, but not be limited to, automobiles, trucks,motorcycles, motor scooters, jeeps or similar typefour-wheel drive vehicles, and snowmobiles, whether or notthey can be legally operated upon the public highways;-3-

O. “Person” means all persons, groups, firms, partnerships,corporations, clubs, and all associations or combination ofpersons whenever acting for themselves or as an agent,servant, or employee;P. “Rocket” means any device containing a combustiblesubstance which when ignited propels the device forward;Q. “Trail” means any path, track, or right-of-way designed foruse by pedestrians, bicycles, equestrians, or othernon-motorized modes of transportation;R. “Trailer” means a towed vehicle which contains sleeping orhousekeeping accommodations;S. “Trailer site” means a designated camping site which haswater and/or electrical facilities available for hookup, andwhich is designed for the use of persons with trailers orcampers. (Ord. 12003 § 1, 1995: Ord. 11684 § 13, 1995:Ord. 8166 § 1, 1987: Ord. 6798 § 1, 1984).7.12.020 Program - Purpose. The playgrounds, activitycenters, pools, and other facilities of the division are established by law for public recreation purposes. The public recreation programs consist primarily of activities planned anddirected by the division, and secondarily of recreation activitiesof community groups brought under control of the division whenauthorized by and conducted under permit issued by thedivision. (Ord. 6798 § 2, 1984).II - ADMINISTRATION7.12.030 Administrative rules - Hours and conditionsof operation. The manager shall promulgate rules settingforth the times and conditions upon which the county parks andrecreation facilities will be open, closed, or used by the public.Such rules shall be promulgated in accordance with the procedures established in K.C.C. 2.98. (Ord. 6798 § 3, 1984).7.12.040 Permits for community groups. The department may grant permits to community groups to meet orconduct activities in the department’s buildings or in thedepartment’s other facilities if those buildings, portions ofbuildings, or facilities are not otherwise required by the department. A nominal fee may be charged according to thedepartment’s current adopted fee ordinance. The fee ordinanceis adopted by metropolitan King County council during itsannual budget process.Facilities cannot be reserved more than ninety days in advanceunless otherwise authorized by the department. All suchpermits must be approved by the department. King Countyswimming pools are excluded from the provisions of K.C.C.7.12.040. (Ord. 12003 § 2, 1995: Ord. 6798 § 4, 1984).7.12.050 Special use permits.A. Groups which do not meet all of the requirements set forthin K.C.C. 7.12.040 and groups which desire to use KingCounty swimming pools may be granted special usepermits by the department, and will be charged a fee.Where appropriate, special conditions of use will beestablished by the department and so noted on the specialuse permit. A schedule of the charges for special servicesin King County recreational facilities will be established bythe department with the approval of the King County-4council.7.12.660 Misdemeanors. Any person found guilty ofviolating any provision of Part IV of this chapter is guilty of amisdemeanor and upon conviction shall be punished by a fineof not more than 500.00, or by imprisonment in the county jailfor not more than 90 days, or both. (Ord. 6798 § 66, 1984).7.12.670 Administrative sanctions. In addition to anyprescribed penalty, any person failing to comply with anyprovision of this chapter shall be subject to the loss of park orrecreation facility use privileges and ejection from the countypark area or associated marine park area.(Ord. 6798 § 67, 1984).VI - PARK SAFETY - ENFORCEMENT7.12.680 Park safety.A. General. Park rules, as promulgated in this chapter, areestablished to provide a system by which the greatestnumber of people may obtain the maximum satisfactionfrom the use of county parks and recreation facilities. Forthe rules to serve this purpose, they must be understoodand followed by the park users. Accordingly, park safetyinvolves both public awareness and rule enforcementprograms.B. Application of park safety program. The degree and extentto which the application of park safety shall be adapted tocounty parks shall be based on purpose and location ofeach park and recreation facility, its environment andsurrounding community, the number and type of personsusing it, the number and type of rule violations that haveoccurred in the past, and the perception that the people ofthe county have of the park or facility as a safe place touse. The division shall keep records of safety problemsand rules violations in each facility and continuouslyevaluate its safety program for each facility based onthose records. (Ord. 6798 § 68, 1984).7.12.690 Responsibilities. Park safety is the responsibilityof both the department of public safety and the department ofparks, cultural and natural resources. Specific responsibilitiesinclude the following:A. Parks, cultural and natural resources department:1. Enforcing rules of conduct set forth in the ordinance forwhich department personnel have appropriate authority.2. Developing and implementing public awareness programs regarding the purpose of the facilities and therules governing their use.3. Encouraging voluntary compliance with rules based onawareness.4. Training department personnel in the appropriate use ofadministrative sanctions as a means of park ruleenforcement.5. Notification of law enforcement officers who haveprimary jurisdiction in a particular geographic areawhenever department personnel observe violations ofpark rules requiring further law enforcement authority orother violations of local, state, or federal laws; whenever there is an emergency requiring law enforcementassistance; or whenever they need assistance inexecuting their responsibilities pursuant to this chapter.-17-

C. The sale and consumption of alcoholic beverages ispermissible at designated indoor and outdoor locationswithin Marymoor Park, King County Aquatic Center andindoors at the Lake Wilderness Center, Gold Creek Lodgein Woodinville and Issaquah Lodge at Beaver Lake byspecial use permit groups, if the activities conform to therequirements of the Washington State Liquor Control Boardunder Title 66 RCW, and that the serving and consumptionis confined to the designated location.The director shall designate the locations within the parkand recreational facility where the activity is permissible.The director of parks and recreation may issue a specialuse permit to the Team Seattle National Events Committee, allowing the sale and consumption of alcoholicbeverages by the special use permit group at Fort DentPark, during the Men’s Masters 45 & Over Slow PitchSoftball National Championship Tournament for theinclusive dates of September 10 through 12, 1999.(Ord. 13608 § 4, 1999: Ord. 12003 § 18, 1995: Ord. 9473 §1, 1990: Ord. 8538 § 2, 1988: Ord. 6798 § 64, 1984).7.12.642 Intoxication. Being or remaining in, or loiteringabout in any county park, recreation area, or associated marinearea while in a state of intoxication is prohibited.(Ord. 8538 § 3, 1988). [Editor’s Note: language was not designated by underliningin Ord. 12003.]7.12.645 Interference with trails. It shall be unlawful forany person to place, deposit, or otherwise cause or suffer to belocated any structure, device, or natural or artificial thing thatthreatens or endangers any portion of a trail owned ormaintained by King County, or that tends to endanger personstraveling thereon, obstructs or tends to obstruct or constitutesa hazard to persons traveling thereon.This section shall not apply to employees of King County inthe performance of their duties or to persons acting pursuant towritten direction of King County. (Ord. 7620, 1986).V - PENALTIES7.12.650 Infractions.A. Failure to perform any act required or the performance ofany act prohibited by Part III of this chapter shall bedesignated as an infraction.B. Any person cited for a violation of Part III of this chapter,shall be subject to the applicable Justice Court Rules andbail schedules.C. Any person found guilty of committing an infraction shallbe assessed a monetary penalty not to exceed 500.00.D. A finding that an infraction has been committed shall notgive rise to any other legal disability which is based uponconviction of a crime.(Ord. 8518 § 2, 1988: Ord. 6798 §65, 1984).-16-B. Groups applying for special use permits for activities atwhich the consumption of alcoholic beverages is intended,must meet the requirements of state law with respect toliquor permits as a precondition. During the course of theactivity, the state liquor permit must be displayed withinthe area. (Ord. 12003 § 3, 1995: Ord. 8538 § 1, 1988:Ord. 6798 § 5, 1984).7.12.060 Cancellation of permit. The division reserves theright to cancel a permittee’s reservation for cause or if thedivision wishes to make use of the facility which in the judgment of the division supersedes the need of the permittee.Notice of the division’s cancellation for priority use shall begiven at least twenty-four hours in advance. Notice of cancellation for cause may be given at any time. (Ord. 6798 § 6, 1984).7.12.070 Religious services or group rallies. Religiousservices or group rallies may be permitted in King County parkareas where facilities are adequate, and where such activitieswill not conflict in any way with normal park usage. To avoidconflict, permission for such activities must be obtained inadvance from the manager. Permission for use of loudspeakersby groups must be obtained in advance. (Ord. 6798 § 7, 1984).7.12.080 Use of facilities - Building use hours. Activities for groups using the facilities Sundays through Thursdaysshall normally cease at 10:00 p.m. unless otherwise approvedon the use permit. On Fridays and Saturdays groups mustagree to be out of the facilities by 12:30 a.m. unless otherwiseapproved in the use permit. (Ord. 6798 § 8, 1984).7.12.090 Cleanup. All persons must leave facilities in acondition considered satisfactory to the facility manager incharge who will supervise cleanup activity. No person shallconduct activities causing extra custodial work unless previousagreement has been made to pay for such work and this is sostated in the use permit. (Ord. 6798 § 9, 1984).7.12.100 Liability. Persons using facilities by permit will berequired to protect, save and hold King County, its elected andappointed officials and employees while acting within the scopeof their duties, harmless from and against all claims, demandsand causes of action of any kind or character, including the costof defense thereof, arising in favor of a person or group’smembers or employees or third parties on account of any actionincluding but not limited to personal injuries, death or damage toproperty arising out of the use of premises, or in any wayarising out of the acts or omissions of the person, group and/orits agents, employees or representatives. (Ord. 6798 § 10,1984).7.12.110 Liability insurance. During all periods of use,persons using facilities by permit shall, except when a waiver isobtained from the department, obtain and maintain publicliability insurance acceptable to the county and/or other insurance necessary to protect the public and the county on-5-

premises to be used, with limits of liability not less than: 500,000 each person personal injury; 500,000 each occurrence personal injury; 250,000 each occurrence property damage;ora combined single limit personal injury and/or propertydamage liability of 1,000,000 per occurrence.Persons shall provide a certificate of insurance, or, uponwritten request of the county, a duplicate of the policy, asevidence of the insurance protection provided. This insuranceshall not be cancelled or reduced without prior written notice tothe county at least thirty days in advance of the cancellation.(Ord. 12003 § 4, 1995: Ord. 6798 § 11, 1984).7.12.120 Adults to accompany minors. Adults must bepresent and responsible at all assemblies of minors throughoutthe entire function. (Ord. 6798 § 12, 1984).B. Model aircraft and rockets:1. No person shall fly rockets or model aircraft in anyKing County park area except in areas specificallydesignated and/or posted for that purpose;2. All engines over 0.15 cubic inches used in modelaircraft being flown in designated King County parkareas shall be muffled;3. All persons flying model aircraft in designated KingCounty park areas shall abide by the Official Academyof Model Aeronautics Safety Code;4. All persons desiring to shoot model rockets in a KingCounty park area shall obtain a permit to do so fromthe parks and recreation services office. (Ord. 12003§ 16,1995: Ord. 8727, 1988: Ord. 8166 § 7, 1987:Ord. 6798 § 60, 1984).7.12.610 Solicitation. No person shall solicit, sell, or7.12.130 Storage of equipment - Liability of county.Persons using facilities should not expect storage space forequipment necessary for their programs. If temporary storageis provided, King County shall not be held responsible for lossor damage. County equipment shall not be loaned to anynon-county person, group or organization without prior writtenpermission from the department. (Ord. 12003 § 5, 1995: Ord.6798 § 13, 1984).7.12.140 Equipment regulations - Failure to perform.The misuse of a park facility or the failure to conform withthese regulations, the instructions of division employees, orthe conditions of a permit will be sufficient reason for denyingany future permits. (Ord. 6798 § 14, 1984).peddle any goods, services, wares, merchandise, liquids, oredibles for human consumption, or distribute or post anyhandbills, circulars, or signs, or use any loud-speakers or otheramplifying devices, in any King County park area, except byconcession contract or by special use permit issued by thedivision. (Ord. 6798 § 61, 1984).7.12.620 Fireworks. No person shall possess, discharge,set off, or cause to be discharged, in or into any King Countypark area, any firecracker, torpedo, rocket, firework, explosive,or substance harmful to the life or safety of persons orproperty, unless so authorized by the division.(Ord. 6798 § 62, 1984).7.12.630 Firearms, weapons.7.12.150 Facility use - Sale of goods or services. Theuse of park facilities for financial gain shall be allowed onlythrough concession contracts secured by the county’s competitive bid process, negotiated concession contracts or byspecial use permit issued by the division. (Ord. 6798 § 15,1984).III - RULES GOVERNING USE OF FACILITIES INFRACTIONS7.12.160 Camping occupancy policy. In order to affordthe general public the greatest possible use of the King Countypark system on a fair and equal basis, continuous occupancyof designated camping facilities by the same person or persons shall be limited to seven days. Shorter limitation ofoccupancy may be established and posted by the departmentat any individual facility or area. (Ord. 12003 § 6, 1995: Ord.6798 § 16, 1984).7.12.170 Occupancy - Number of vehicles. The numberof vehicles occupying camping facilities shall be limited to onecar or camper, or one vehicle with trailer, per camp or trailersite. A greater number may be authorized in specific areaswhen constructed facilities so warrant. (Ord. 6798 § 17, 1984).-6-No personexcept duly authorized law enforcement personnel shallpossess a bow and arrow, crossbow, or air or gas weapon in acounty park. No person shall discharge across, in, or into anyKing County park area a firearm, bow and arrow, crossbow, airor gas weapon, or any device capable of injuring or killing anyperson or animal, or damaging or destroying any public orprivate property. Provided that: Where the department forgood cause has authorized in writing a special recreationalactivity upon finding that it is not inconsistent with King Countypark use this section shall not apply. (Ord. 12003 § 17, 1995:Ord. 8166 § 8, 1987: Ord. 6798 § 63, 1984).7.12.640 Alcoholic beverages. Selling, openingor possessing alcoholic beverages in an open container,or consuming any alcoholic beverage in a King County park,recreation area or associated marine area is prohibited exceptin the following designated areas subject to approval by themanager and under the following conditions:A. The sale and consumption of alcoholic beverages ispermissible in the club house at the Enumclaw golf course.B. The sale and consumption of alcoholic beverages ispermissible for special use permit groups at the KingCounty fairgrounds, if the activities conform to the requirements of the Washington State Liquor Control Board underTitle 66 RCW.-15-

formation, plant, flower lighting system, sprinkling system,gate, barricade or lock or other property lawfully in any park, orto remove sand, soil, or sod in any park. No person shall cutdown, destroy, or in any way injure any vegetation, living ordead, in any King County park area unless authorized to do soby the department. No person shall deface, damage or destroyany property, material or equipment which is under the jurisdiction of the division.Damage to wildlife. Except for fishing and shellfishing inauthorized areas and subject to rules promulgated by theWashington State Fish and Wildlife Commission, it is unlawfulin any park in any manner to attempt to capture, tease, annoy,disturb, or strike any animal, with any stick, weapon or otherdevice or throw or otherwise propel any missile or other objectat or in the vicinity of any such animal.(Ord. 12003 § 14, 1995: Ord. 6798 § 55, 1984).7.12.560 Removal of property. No person shall changethe position of or remove any county property, material, orequipment including vegetation and wildlife from its originalposition in any area under the jurisdiction of the department.(Ord. 12003 § 15, 1995: Ord. 6798 § 56, 1984).7.12.570 Outside household or commercial waste.No person shall deposit any household or commercial garbage,refuse, waste, or rubbish which is brought in such form fromany private property, in any King County park area garbage canor other receptacle designated for such purpose.(Ord. 6798 § 57, 1984).7.12.180 Fees. Fees for the use of campsites or trailer sitesare due and payable daily. The daily fee covers use of facilities until the vacating time of the following day.
