MICROSOFT SELECT AGREEMENT FOR THE STATE OF OHIO

Microsoft Consulting Services prices are also listed in thisdocument. This document is updated on a monthly basis to reflect current pricing for Microsoft productsfrom Dell Marketing L.P., SHI International Corp. and Microsoft. For all otherquestions contact your vendor sales representative at the appropriate number or the DAS ITProcurement Services representative at (614) 728-0906.MICROSOFT SELECT AGREEMENT FOR THE STATE OF OHIOSelect Agreement. The State and Microsoft Corporation have entered into a Select Agreement thatpermits all entities of State and Local government (affiliates) to procure Microsoft products at the lowestpossible Select price level, Level D.Actual product prices are established by contracts with two Large Account Resellers (LAR), Dell MarketingL.P., and SHI International Corp. This pricing is available to any affiliate, regardless of the size ofthe affiliate or the volume of products procured. In order to take advantage of this pricing, each affiliate mustestablish its own Select or Enterprise Enrollment with one of the LARs.The State’s contracts with the LARs provide the following benefits: Enrollees enjoy uniform product pricing at the lowest possible level. Enrollees receive necessary account administration and support services from the LAR. Enrollees have the availability of Microsoft Consulting Services at competitive rates from Microsoft. Enrollees have the availability of Premier Support services.Select Enrollment. The State’s affiliates can establish Select Enrollments with the LAR under the termsand conditions of the State’s Select Agreement and the LAR’s contract.Enrollees can purchase products from all pools, at unit prices established by this contract, regardless of thevolume of products the enrollee purchases.Select enrollees are not required to acquire licenses equivalent to Microsoft’s standard requisite number ofpoints during the term of the enrollment. However, product media shall be provided under the followingconditions.1. Affiliates who do not expect to acquire licenses equivalent to the standard requisite number of pointsduring the term of the enrollment can execute a Special Enrollment that has been created by MicrosoftCorporation. The LAR will provide these enrollees with World Wide Fulfillment media, or vendorduplicated media, for the software products ordered for a cost of 23.00 per CD.2. Affiliates who execute the standard Enrollment expect to acquire licenses equivalent to, or greater than,the standard requisite number of points during the term of the enrollment, and those enrollees willreceive the standard Select CD-ROM kits at no cost.Software Product Pricing.1. The Contract establishes unit pricing at Level D for all Microsoft products in all product pools, i.e.,Application Pool, Server Pool, and System Pool.2. The prices are based upon the LAR’s percentage discounts from Microsoft Level D EstimatedRetail Price (ERP).3. If Microsoft Corporation introduces new products, the discounts established by the contract will beapplied to Microsoft’s new product ERPs to determine product pricing under the State’s SelectAgreement.Enterprise Agreement and Enrollment. Pursuant to the State’s Select Agreement, the State’s affiliatescan establish Enterprise Enrollments with the LAR. Enterprise enrollees must meet Microsoft’s standardrequirement for the minimum number of qualified desktops.Academic Agreement and Enrollment. The State and Microsoft Corporation have entered into anAcademic Agreement that permits academic affiliates to procure Microsoft products at the lowest possibleAcademic price level, Level A. The State’s affiliates can establish Academic Enrollments with the LARunder the terms and conditions of the State’s Academic Agreement and the LAR’s contract.

Account Management Services. Services provided by the LAR include, but are not limited to,the following:1. Orientation and planning sessions with individual affiliates regarding enrollment benefits, termsand conditions, service elements;2. Direct sales to affiliates;3. Provision of media to enrollees;4. Usage reports;5. Direct assistance to enrollees to satisfy compliance verification requirements, and any otherreporting requirements;6. Availability of a Select/Enterprise licensing expert that can be contacted by telephone;7. Internet access to account information.Microsoft Corporation Consultants. ENROLLMENTThe Select Agreement is between Microsoft Corporation and the Ohio Department of AdministrativeServices. All eligible government entities are considered by Microsoft to be “affiliates” of DAS, and mayestablish enrollments under the master Agreement number.Enrollees will not execute a Select Agreement or an Enterprise Agreement. DAS established the onlySelect and Enterprise Agreements that are required and authorized under the terms of this contract.Affiliates wishing to participate in the Select program must execute a Microsoft State and LocalGovernmentSelect Enrollment only.Affiliates wishing to establish Enterprise Agreements must execute a Microsoft State and LocalGovernment Enterprise Enrollment.Affiliates wishing to establish Academic Agreements must execute a Microsoft State and LocalGovernmentAcademic Enrollment.Release and Permit Required Entities wishing to enroll must obtain a Release and Permit fromAcquisitionManagement.
