INTRODUCTIONWHAT DOES A PROFESSIONALLYCOMPETENT PERSON DO?WHO NEEDS TO BEPROFESSIONALLY COMPETENT?Some companies need to operate large vehicles to carryout their business, even where road haulage is not themain trade. Other companies operate passenger-carryingvehicles, such as buses and coaches.The Traffic Commissioners (the issuing authority foroperator licences) require professional competence tobe proven by at least one member of the managementteam of operators of most goods vehicles and passengercarrying vehicles.Such companies may employ a huge number of staff. Therole of the professionally competent person in this type ofbusiness will be to oversee the transport operation. Here,the transport manager will be responsible for ensuringcompliance with all the requirements of road transportlaw but may not do the work themselves. This may involveoverseeing a number of people/employees who carry outappropriate tasks such as managing drivers and drivers’hours, repairs and regular servicing, etc. through a systemof procedures and policies which ensure compliance withroad transport law.This applies to all businesses which hold a standardoperator’s licence. Generally, those who operate nonexempt goods vehicles with a gross plated weight ofmore than 3,500 kg (including the weight of any trailer)or vehicles which are not plated and which have anunladen weight of more than 1,525 kg require both sucha licence and a professionally competent person. Thosewho operate passenger-carrying vehicles with more thannine passenger seats, and in which the passengers payto travel, will also require a standard operator licenceand a professionally competent person. (There aresome exemptions from the requirement to employ aprofessionally competent person.)In a smaller company, or for a sole proprietor operatinga transport business with lorries or buses, the role of theprofessionally competent person may include every taskwithin the business. For example: as well as openingthe mail and keeping the accounts, they may haveresponsibility for ensuring compliance with legislationaffecting drivers’ hours and the many other aspects ofroad transport law, monitoring drivers using an efficientsystem of procedures, and for ensuring the effectivemanagement of vehicle maintenance.The professionally competent person will often beemployed as the transport manager. One way ofdemonstrating this competence is by achieving therelevant OCR Certificate of Professional Competence(CPC).WHAT IS THE OCR CPCQUALIFICATION?Compliance with the law is achieved by fulfilling legalobligations laid down by various regulations.These qualifications are regulated by Ofqual and theWelsh Government as vocationally related qualifications(VRQs). Successful completion of the CPC award willqualify students to be nominated as the professionallycompetent person on a standard operator licence inany business – large or small and engaged in nationalor international operations. There are separate CPCqualifications for road haulage and for passengertransport operations.A professionally competent person is expected tounderstand both the successful management of abusiness and the specific legal obligations involved inoperating large vehicles in all settings.Certificate of Professional Competence3Syllabus, Student and Tutor Guide

Under EU law, the international versions of thesequalifications, gained in the UK, are recognised asmeeting the competence requirements in all other EUmember states. Some member states may, however,require those with a UK CPC to take a further examinationon specific aspects of transport operation which areunique to that member state if they wish to be nominatedas a competent person for a business based in thatcountry. Please note this specification and associatedassessment materials are available in English only.A candidate achieving a Certificate of ProfessionalCompetence in either Road Haulage or PassengerTransport has the following progression routes available: enter the profession of Transport Manager undertake higher level qualifications part-time orfull-time in further or higher education, e.g. HNC,HND, degree undertake additional complementary qualificationsin the workplace e.g. Level 3 Certificate inLogistics Operations or Level 3 NVQ Certificate inManagement.This qualification has been designed to meet therequirements of the Regulation (EC) No 1071/2009of the European Parliament and of the Council of 21October 2009 establishing common rules concerning theconditions to be complied with to pursue the occupationof Road Transport Operator.WHAT DO STUDENTS HAVE TODO?Study for professional competence will cover a wide rangeof topics applicable to all businesses that need to complywith road transport law. Students should base their studyaround the total concept of road transport operations andnot limit their learning to the areas they already know,or plan to work in immediately. They will be tested in allareas of required knowledge, full details of which aregiven in this guide.The qualification specifications have been deriveddirectly from Regulation (EC) No 1071/2009 and provideassessment which is comparable to the assessmentprovided in other EU member states.Achievement of the Certificate of ProfessionalCompetence in either Road Haulage or PassengerTransport demonstrates that the holder of thequalification is qualified to perform the effective andcontinuous management of undertakings engaging solelyin transport operations within any EU member state.Any aspect of the law current at the time of theexamination may be tested.The OCR CPC award is a Level 3 qualification. Level 3is considered to be an Advanced Level qualification.Advanced Level qualifications are normally studied afterthe age of 16, subsequent to Level 2/GCSE qualifications.These qualifications are recommended for delivery forlearners aged 18 and above.This qualification specifically aims to: assess the professional competence of applicantsfor Goods Vehicle Operator Licence and theirnominated Transport Managers (road haulage) assess the levels of knowledge and practicalaptitude necessary for the management of atransport undertaking as set out in Annex 1 ofRegulation (EC) No 1071/2009 assess skills and knowledge at a level which isharmonised at a minimum level with the skills andknowledge assessed in all Member StatesAlthough there are no entry requirements for thisqualification, it is recommended that students have goodEnglish and Maths skills equivalent to Level 2 (GCSE)before they begin studying the CPC qualification atLevel 3. If students are not sure of their current skill levels,they should discuss this with a learning provider who canarrange an assessment of their needs.The OCR CPC qualification is currently a lifetime award,which means that, once obtained, the qualification willnot expire, and holders will be considered professionallycompetent for the rest of their lives. WHAT DO THE OCREXAMINATIONS INVOLVE?To be successful in obtaining the CPC qualification, aswell as studying road haulage or passenger transport, asappropriate to the qualification required, all students willneed to study and apply information based on the lawconcerning business.OCR’s CPCs in Road Haulage and Passenger Transporteach consist of a single multiple-choice assessment and asingle case study assessment.Students will then be required to use this knowledge to: read and analyse information answer direct questions on various aspects ofrelevant transport operations and associated laws answer questions related to a case study, applyingthe principles of transport operations andassociated laws solve problems, applying various principles, rulesand legislation.Students will need to pass two examinations to gainthe Certificate of Professional Competence for RoadHaulage OR the Certificate of Professional Competence forPassenger Transport .Both elements test national and international knowledgeand application. So, to achieve an International CPC,candidates will only need to pass two units. Units will begraded Pass or Fail.The examination will include assessments where studentsmay be required to understand and analyse information,write a series of procedures or instructions, makecomments on systems and policy, and/or perform a rangeof mathematical calculations, applying suitable formulaeand functions.Examinations take place four times every year, in March,June, September and December.They should be able to present their answers in a varietyof formats including explanations, reports, instructions,tables and charts.Candidates who wish to gain a CPC can either studyin their own time or attend a training course at a CPCtraining centre. OCR does not endorse CPC trainingcentres for the delivery of CPC training programmesalthough OCR approves centres to offer and invigilate theexamination sessions. MULTIPLE CHOICEIn summary, the new CPC qualifications are designed tobe accessible to candidates and to give clear guidance forcentres and tutors. They are built around relevant content,giving more time to concentrate candidates’ learning andknowledge on a pertinent range of topics. This documentcontains clear guidance for tutors on what to teach andwhat candidates should learn, indicates the depth andbreadth of required knowledge, understanding and skills,and signposts tutors and students to useful sources ofinformation.The multiple-choice assessment is available as a quarterly,paper-based test.
