The supplier warrants the goods supplied under this contract are new, unused of the mostrecent or current models and incorporate. All recent improvements in design and materialswill be same unless provided otherwise in the contract. The supplier further warrants thatgoods supplied under this contract shall have no defect arising from design, materials orworkmanship (except insofar as the design or materials is required by the purchaser'sspecifications) or from any act of omission of the supplier that may develop under normaluse of the supplied goods in conditions obtaining in the country of final destination.2. The warranty shall remain valid for 12 months after the goods have been delivered,commissioned and accepted at the final destination indicated in the contract or 16 monthsfrom the date of receipt of goods whichever period concludes earlier.3. The purchaser shall promptly notify the supplier in writing of any claims arising under thiswarranty.4. Upon receipt of such notice, the supplier shall, with all reasonable speed, repair of replacethe defective goods or parts thereof, without cost to the purchaser.5.
