Their volunteertime is spent performing the crucial tasks of maintaining and preparing trails by brushing,grading, signing the trails, trail grooming and performing safety inspections.2

Go tohttp://www.ridesmartwi.org/overview.htm for more information.What’s Considered an All-Terrain Vehicle?According to Wisconsin Law an ATV must meet all of the followingspecifications: an engine-driven devicenet weight of 900 pounds or lesswidth of 50 inches or lesshas a seat designed to be straddledtravels on 3 or more low-pressure tiresWhat is not an All-Terrain Vehicle?The following are not ATVs and in most cases cannot be operated onATV trails or ATV Routes: utility-type, side by side vehicles (pg. 24) 6-8 wheel amphibious vehicles golf carts go carts off-road motorcycles anything outside the ATV specifications listed above3

Registration Requirements All ATVs kept in Wisconsin for longer than 15 consecutive days arerequired to be registered in Wisconsin. ATVs meeting the above requirement must: 1) display current Wisconsin registration decals or, 2) must have a validated registrationreceipt with the operator or, 3) must have a validated registrationrenewal receipt. Operators should carry all necessary registration cards and paperwork with them for display to a law enforcement officer uponrequest.DzDz Display—Unless you are exempt from registration, your ATVmust display current registration decals. The decals must be prominently visible on both sides of the ATV and in a position which isforward of the operator.Registration Options Public Use —Allows operation on any areas open to public riding,frozen surface of any waterways and on private property with permission. Valid for up to 2 years, beginning July 1 and expiring twoyears later on June 30th. Private Use, Agricultural —ATVs can be privately registeredfor agricultural use if they are going to be used for agriculturalpurposes. It does not permit operation in areas open to the public,including the frozen surfaces of any waterway. You may dual registeryour ATV for public use also. The Agricultural Use registrationremains valid until ownership is transferred. Private Use, Non-Agricultural —For use exclusively on privateproperty (used on land owned by the applicant or an immediatefamily member). Remains valid until ownership is transferred. Municipal Government Use —Used for county, city, village ownedATVs.Non-Resident Registration OptionsAll ATVs kept in Wisconsin for longer than 15 consecutive days are required to be registered in Wisconsin. Non-residents operating their ATVsin Wisconsin for less than 15 consecutive days must purchase an ATVTrail Pass if not currently registered in Wisconsin. ATV Trail Passes areavailable at most license vendors and vehicle registration agents. Licensevendors can be found by going to dnr.wi.gov and searching “licenseagents.” Trail passes must be displayed in a highly visible location on theforward half of your ATV.4

You must have one of the following to meet registrationrequirements while operating on these areas:Use on Public Trails Valid ATV Trail Pass Wisconsin Public Use registrationUse on Frozen Waterways Wisconsin Public Use registration Valid ATV Trail Pass Valid out of state ATV registration (see “Special Attention” below)Use on Private Property Wisconsin Public Use registration Wisconsin Private Use registration (land owned by applicant or immediate family member only) Valid ATV Trail Pass Valid out of state ATV registrationSpecial Attention for Illinois, Michigan or other states:Illinois and Michigan do not have an ATV registration system that is recognized in Wisconsin. You must either register your ATV in Wisconsin orpurchase a valid ATV Trail Pass to legally operate in Wisconsin.How do I register my ATV?There are three ways to complete an original, transfer, or renewal of anATV registration, or to request replacement decals and/or certificatecards:Online – The DNR site provides a secure, easy and convenient methodto register your recreational vehicle. Online registration allows you tocomplete your ATV registration transactions for the ATV you currentlyown, or to register recently purchased ATVs. The online site provides aTemporary Operating Receipt that you may use to ride your ATV prior toreceiving the registration decals in the mail. Visit dnr.wi.gov and selectthe Boat-ATV-Snowmobile Registration link under Online Services.Agents - Locate an agent near you to complete your registration needs.Registration Agents can process boat, ATV and snowmobile registrations(renewals, transfers, originals, and print replacement decals.) RegistrationAgents can provide you with the certificate and decals for an additionalfee. For a complete list of Vehicle Registration Agents and DNR offices goto dnr.wi.gov.5

By Mail – Complete the All Terrain Vehicle (ATV) Registration Application (Form 9400-376), make a photocopy, and mail the original application and appropriate fees to the address provided on the form. The ATVRegistration Application (Form 9400-376) is available from DNR ServiceCenters by calling 1-888-936-7463 or you can download and print a copyfrom our web site at dnr.wi.gov. To legally operate the ATV, the registration decals and certificate must be received or the customer must obtain avalidated receipt from a Registration Agent Service CenterATV Purchased from a Wisconsin Dealer – At the time of the sale, theWisconsin ATV Dealer will complete and submit an ATV registrationapplication. Your copy of the application form signed by the dealer or avalidated receipt must be carried with you while operating the ATV untilyour decal and registration certificate arrive in the mail. If the WisconsinDealer is also an authorized Vehicle Registration Agent, they may provideyou with the certificate and decals for an additional fee.ATV Purchased from a Private Party or Out-of-State Dealer—Chooseone of the registration options above to complete the registration. Youmust carry your validated receipt while operating until your registrationcard and decals arrive in the mail. The seller must give you the signedcertificate or a bill of sale at the time of the transaction.Transfer of ownership ATVs Previously Registered in Wisconsin – Choose one of the registration options above to apply for transfer of ownership within 10days of purchase. If the previous owner’s registration is not current,you must apply for transfer of ownership, and renew the registrationbefore operation. You must carry your validated receipt while operating until your registration card and decals arrive in the mail. Transferfee: 5, Renewal fee: 30. ATVs Not Previously Registered in Wisconsin — Choose one of theregistration options above to apply for original Wisconsin registration prior to operation. You must carry your validated receipt whileoperating until your registration card and decals arrive in the mail. When you sell or transfer ownership of an ATV, you must sign theregistration certificate and give it to the new owner at the time of saleor transfer.Lost or destroyed registrations—Choose one of the registration optionsabove to apply for a replacement certificate card or expiration decal.Change of address—Within 15 days of changing your address, you mustnotify the DNR in writing, stating your new address and the certificatenumber for the machine you own. This process is important to completeso that you receive a registration renewal notification by mail. You canalso change your address by going to the boat-ATV-snowmobile on-linewebpage. Add your e-mail address and you will recieve renewal notifications for all of your recreational vehicles.6

Alcohol and DrugsIt is illegal to operate an ATV under the influence of alcohol or otherdrugs while on any property that is open to the public (generally thismeans trails, routes, lakes/rivers or corridors). Being under the influenceis a condition in which a person’s ability to operate an ATV, because ofthe consumption or use of an intoxicant, is impaired to the extent that theperson is less able to exercise the clear judgment and steady hand necessary to handle and control the ATV. No person may operate an ATV with a blood alcohol concentration(BAC) of 0.08% or more. In addition, a person can be arrested foroperating under the influence with a BAC that is under 0.08%. No person may operate an ATV with any detectable amount of arestricted controlled substance in their blood. Don’t drink and ride. This can lead to problems, injuries and sometimes death. If you do drink alcoholic beverages, wait until you aredone riding for the day.Implied Consent law—You are required to provide a sample of yourbreath, blood or urine if an officer has probable cause to believe you areoperating an ATV under the influence. By operating an ATV on areas opento the public you have automatically consented to provide a sample of yourbreath, blood or urine to an officer who requests the test. If you refuse toprovide a breath, blood or urine sample, you will be charged with an additional violation.General Age and Safety Certificate RequirementsATV safety education certification is required for all riders (residents andnonresidents) who are at least 12 years old and born on or after January 1,1988. Safety Certifications issued from another state or province of Canada will be accepted. Riders must carry their certificate while operating.The ATV Safety Institute (ASI) generally offers ATV safety training toATV owners after the purchase of a new ATV. ASI certificates do notmeet the Safety Education Requirement in Wisconsin unless they wereobtained in another state or province that uses ASI as their official stateATV safety certification program.Small ATV ExceptionThis exception only exists for ATV operators age 11 or younger. Oncethe ATV operator turns age 12, they are eligible for and must completean ATV Safety Course to continue to operate in areas open to the public.(ATV Safety Institute certificates are not valid in Wisconsin).7

All of the following conditions must be met under the “Small ATV Exception”: Operation must be on a public, off-road ATV trail ONLY. Roadwayuse is not allowed even to cross a road or to operate on a roadwaylegally designated as an ATV Route. (Small ATVs may be towed,pushed or operated by the parent in these situations). The child must be accompanied (see definitions Pg. 27) by a parentor legal guardian (not an uncle, grandparent or neighbor). The child must be operating a registered, four-wheel ATV of 90 ccor less. The child must be wearing a helmet. Once the child turns age 12, they must complete ATV Safety tocontinue to operate, even if accompanied by a parent.ATV Safety Certification may be obtained by successfully completing aDNR sponsored ATV safety course. Volunteer instructors typically offerlocal courses early spring through fall.DzDz ATV courses are advertised in your local newspaper at varioustimes of the year. If you want to enroll in an ATV safety course,contact the DNR Call Center at 1-888-936-7463 or visit us on theweb to find an instructor who is currently advertising a classdnr.wi.gov and search for “ATV Safety”DzDz A new internet safety certification course is also available. Ifcompleting the online class, you must print out the receipt confirmingyour successful completion of the course and carry it with you untilyou receive your safety certificate from the DNR.DzDz Prior to Enrolling in a Safety Class you must obtain a DNRCustomer Identification (Account) number. If you have purchaseda Wisconsin fishing or hunting license in the past, you already havea customer account. Inspect your DNR approvals (hunting license,fishing license, etc.) for you ID number1. This nine-digit number must be assigned to you by the DNR2. It must be unique, you cannot use another person’s number oryou will not receive your certificate3. You may quickly obtain an ID number by calling 1-888-9367463 or visiting a DNR Service Center4. If you are not sure if you have and ID number assigned to you,double-check first by calling 1-888-936-7463A state motor vehicle driver’s license is not required to operate an ATV inWisconsin.8

Helmet RequirementsYou are required to wear a helmet except when traveling for the purpose ofhunting or fishingAt Least 12, but under 18If you are under age 12, a helmet is required to beworn at all timesA helmet is not required but is STRONGLY encouragedUnder Age 12Public Use (for ridingareas open to the public)A helmet is not required on lands owned andcontrolled by your immediate family but it isSTRONGLY encouragedRegistration TypeAgricultural UseA helmet is not required under age 18 if you are operating on lands underthe management and control of your immediate family. However you areSTRONGLY encouraged to wear one.If circumstances (age and property use) would require you to wear a helmetas the operator, then you as the passenger must wear a helmet under similarcircumstances. For example, a helmet would be required for a 12-year-oldpassenger while the ATV was being operated on public propertyIf you are under 18 and riding on someone else’s property you must wear ahelmet unless you are traveling for the purposes of hunting or fishingA helmet is not required on lands owned andcontrolled by your immediate family but it isSTRONGLY encouragedPrivate UsePassenger UseIf circumstances (age and property use) would require you to wear a helmet as the operator, then youas the passenger must wear a helmet under similarcircumstances. For example, a helmet would berequired for a 12-year-old passenger while the ATVwas being operated on public propertyNOTE: Bicycle Helmets Do Not Meet ATV Helmet Requirements9
