§16-605-1SUBCHAPTER 1GENERAL PROVISIONS§16-605-1 Purpose and scope of chapter 16-605.This chapter governs the (1)Form and content of tariffs of watercarriers of property and passengers, and theinformation and data to be submitted for theestablishment of new or revised rates,fares , or charges; and{2) Filing of financial and statisticalinformation by water carriers of propertyand passengers. As used in this chapter,unless the context c l early r e quires otherwise:"Basic tariff " means the current tariff on fi l ewith the commission. A basic tariff may be added tofrom time to time t hrough supplements ."Certificate of public convenience and necessity"means a certificate to operate as a water carrier,issued by the commission pursuant to sections 269-20and 271G- 10, HRS."Commission" means the publ i c u t ilitiescommission of the State ."Commodity rate" means the specific rateapplicabl e to a commodity, as described in a tariff."Consumer advocate" means the executive directorof the division of consumer advocacy of the departmentof commerce and consumer affairs."General rate increase" means a partial or flatincrease in the general level of the rates or chargesfor revenue purposes or to increase the rate of605-4330 7

§16-605-2return. None of the following constitutes a generalrate increase:(1)Establishment of a fare, rate, or charge fora new service;(2)Adjustment of or a change in a particularfare, rate, or charge for the purpose ofeliminating inequities, preferences, ordiscrimination; or(3)Increase in fares, rates, or chargesresulting from a commission-approvedautomatic rate adjustment clause or costrecovery mechanism.1111HRS means the Hawaii Revised Statutes.11Issuing carrier or agent" means the watercarrier or person authorized by the water carrier toissue and publish tariffs on behalf of the carrier."Joint routes and rates 11 mean routes and ratesthat result from two or more water carriers, or from awater carrier and motor carrier, providingtransportation service over a route at a through rate.11Major accounts 11 mean those accounts as definedin the commission's Uniform System of Accounts forWater Common Carriers that represent large or generalclasses of financial statement items."Person" means the same as in section 271G - 5,HRS."Point of destination" means the precise locationwhere property is delivered into the custody of theconsignee or its agent."Point of origin" means the precise locationwhere property is delivered into the custody of thewater carrier by the consignor or its agent."Rate" means the same as in section 271G-5, HRS."State" means the State of Hawaii."Supplement" means an addition or additions tothe basic tariff.11Symbol 11 means an identifying mark or letter todenote changes to a tariff."Tariff" means a schedule of rates, fares,charges, classifications, and sailings and the rules,regulations, and practices affecting any rate, fare,charge, classification, or sailing.It includes the605-53307

§16-605-2schedules in a basic tariff and in supplements. Asthe context requires, "tariff" also means the specificrates, fares, or charges imposed in a schedule."Tariff change" or "tariff revision" means anychange, revision, or addition to or deletion of atariff."Through rate" means a single rate or combinationof rates that determines the charge from a point oforigin to a point of destination."Water carrier" or "common carrier by water"means the same as in section 271G-5 , HRS.[EffJAN - 1 2019 ] (Auth: HRS §§269-6, 269-51,271G-7)(Imp: HRS §§269-6, 269-51 , 271G-5, 271G-7)§16-605-3 Tariff filing requirements.(a) Awater carrier may not commence any service withoutfirst having a tariff for the service approved by andon file with the commission.(b} A tariff must be fi l ed with the commissionin the original and three copies.(c) A water carrier may file the tariff eitherin person at the commission s off i ce or by UnitedStates mail, postage prepaid, and addressed to thecommission at its main offic e .(d) A tariff may be filed by the water carrieror by its agent appointed as provided in secti on16-605-6. §16-605-6§16-605-5 Tariff change - posting. No changemay be made in any rate, fare, charge, classification,or sailing or in any rule, regulation, or practiceaffecting the rate, fare, charge, classification, orsailing, except upon forty-five days' notice of theproposed change filed with the commission andpublished and posted at he water carrier's principalplace of business and at each of the carrier'sstations and offices; provided that:{l) A change in a fuel surcharge approved by thecommission may be made after thirty days'notice of the proposed change filed andposted as provided above; and(2)Any change or addition to a tariff, approvedon short notice filing as provided insection 16-605-41, may be made on less thanforty - five days' notice.[EffJAN O1 2019 l (Auth: HRS §§269-6,271G-7, 271G-17J (Imp: HRS §§269-6, 271G-7,271G-16, 271G-17)§16-605-6 Power of attorney.(a) A watercarrier may appoint an agent to file and publish atariff or supplement in whic h the water carrierparticipates by executing a power of attorney in favorof the agent. The power of attorney must be in theform set forth in Appendix A. The agent must be anorganization expressly authorized by the commission topublish and file tariffs on behalf of water carriers.{b) A power granted an agent by a power ofattorney may not be delegated by the agent to anyother person. A water carrier may not grant powers ofattorney to two or more agents which, if exercised,would result in conflicts in rates or otherconditions.(c) A water carrier may revoke a power ofattorney upon forty-five days' written notice to thecommission and the agent. Upon the revocation of apower of attorney, the water carrier may appoint a newagent, and the water carrier o r its new agent shall605-73307

§16-605-6file a revisi o n to its tariffs r e flecting the changein agency. Such a revision is subject to the noticeprovision provided in section 16-605 - 5 .(d) When two or more water carri ers join in athrough rate filed by an agent , all such carriersjoining in the through rate sha l l execute powers ofa ttorney in favor of the agent for purposes of filingthe through rate.[Ef fJAN " l 2019 ] (Auth: HRS§§269-6, 271G-7 , 271G - 17) (Imp: HRS §§269 - 6, 271G-7 ,271G-16 , 271G - 17)§§16-605-7 to 11 (Reserved)SUBCHAPTER 2TARIFF FORMAT AND CONTENTS , SUPPLEMENT, RATES ,SAILING SCHEDULE, TRANSFER OF TARIFFS,CHANGE IN WATER CARRIER'S LEGAL NAME§16-605-12 Tariff format - generally.(a)Eachtariff and suppl ement must be typewritten on pape r8-1/2 x 11 inches in size.(b) Each page of a tariff or supplement must:(1) Be in a form suitable for insertion into alooseleaf binder and c o ntain margins atleast 5/8 inches wide o n the binding edge;and(2) Be numbered . The title page may be page 1 orsimply labeled "Title Page" with the nextsucceeding page numbered page 1.{c) The text of the tariff or supplement mustnot contain any erasures, handwritten additions, orother a l terations.(d) Each tariff and supplement fi l ed with thecommissio n must comply with subsections (a), (b), and605-8

§16-605-13(c). For access by the general public, including itscustomers, the water carrier may maintain its tariffsand supplements through an electronic website;provided that hard copies must be made available, uponrequest.[EffJAN O 1 2019 ] (Auth: HRS §§269-6,271G-7, 271G-17) (Imp: HRS §§269-6, 271G- 7, 271G-17)§16-605-13 Tariff content.(a) A tariff mustcontain the following:(1) Title page;(2) Check sheet;(3) Table of contents;(4) Listing of water carriers participating inthe tariff;(5) Definitions of technical and other importantterms used in the tariff;(6) Rules;(7)Index of stations and points for passengercarriage;(8)Index of commodities for property carriage,where rates are established for specificcommodities;(9) List of zones for property carriage, wherezone rates apply;(10) Table of fares or rates and charges;(11) Explanation of abbreviations, symbols, andreference marks used in the tariff; and(12) Sailing schedules .Subsections (b) to (1) define each of the contentmatter listed in subsection (a), except item (5) ,which is self-explanatory.(b) The title page must bear the name of thewater carrier. The name must be the same as thatappearing on the carrier's certificate of publicconvenience and necessity (or application for acertificate, if none has been issued). If a trade nameis used, the name of the carrier or partners mustprecede the trade name .605-9'3307

§16-605-13Example:John Doe and William DoeDoing Business asABC Water CarrierIf two or more water carriers join in a through rate ,the names of all participating carriers must be shown .The title page must also contain:(1)The name, title, and street address of theofficer or agent issuing the tariff ;( 2)A brief description of the tariff contents ,including zones and points covered by thetariff; and( 3)A reference to the classification tariff, ifa classification of articles is published ina separate tariff.Examples:"Governed, except as otherwiseprovided, by the {name ofclassification) of ABC Company , PUC No.xxx, as modified by supplement orsuccessive issues."or"For reference to governingclassification and other governingpublications, see Item xx, Page yy, asamended. 11(c)The check sheet must list all tariff pages.Each listed page must indicate its current revision .Example: PageRevisionTitle4th13rd2Original .If the tariff has less than five pages, includingthe title page, the check sheet may be omitted.{d) The table of contents must list inalphabetical order the subject covered by the tariff.For each subject, reference must be made to the pageon which the subject may be found. If the tariff hasless than five pages, including the title page, andthe title page or the interior arrangement plainlydiscloses the contents , the table of contents may beomitted.605-103307

§16-605-13(e) A listing of water carriers participating inthe tariff is necessary where the tariff is filed byan agent representing a number of water carriers,except that if the number of participating watercarriers is less than five, the participating watercarriers may be listed on the title page.(f) The rules must clearly define theapplicability of the fares or rates and chargesspecified in the tariff and the scope, nature, andlimitations of services covered by the tariff.(g) The index of stations and points forpassenger carriage must list in alphabetical order allstations and points from and to which the tariffapplies, together with a reference to the page of thetariff where the corresponding fares are noted. Noindex is necessary if the tariff is less than fivepages, including the title page, or if the fares arelogically presented in a table or grouped in the samesection of the tariff.(h) The index of commodities for propertycarriage must list in alphabetical order thecommodities to which specific rates are specified inthe tariff. For each commodity, reference must be madeto the page of the tariff or to the item where therate for the commodity is noted. No index is necessaryif the tariff is less than five pages, including thetitle page, or if the rates to each destination arearranged by commodities, listed in alphabetical order.(i) The list of zones for property carriage,where zone rates apply, must describe the boundariesof each zone and include a map for each zone.(j) The table of fares or rates and charges mustbe expressed in cents or dollars and cents. Inaddition:( 1) For passenger carriage, the table mustidentify the points between which and theroutes to which each fare applies;( 2)For property carriage, the table mustexpress the rates and charges in terms of anexplicit, definable measure commonly usedand understood in the trade, such as per 100605-113307

§16-605-13pounds, per mile , per hour , per cubic foot,per ton, per container , etc.;(3) For property carriage, if a rate or chargeis based on distances from a point of originto a point of destination, the table mustshow the mileage and indicate how themileage was determined; and(4) For property carriage, where rates arestated in terms of per package or perbundle, the table mu st state thespecifications for the package or bundle .(k) An explanation of all abbreviations,symbols, and reference marks used in the tariff mustappear on each page of the tariff where theabbreviations, symbols, or reference marks are used,except that when abbreviations, symbols , and referencemarks are used consistently t h roughout the tariff, ageneral explanation of the abbreviations, symbols, andreference marks may be placed in a separate section ofthe tariff.(1) Sailing schedules must comply with therequirements of section 16-605-21.[EffJAN-12019] (Auth: HRS §§269-6, 271G-7,271G-17) (Imp: HRS §§269-6, 271G-7, 271G-17)§16-605-14 Tariff page .(a) Each tariff pagemust contain the following informati on:(1) Name of the water carrier o r agent issuingthe tariff;(2) Name and number of the tariff ;(3)Page number of the tariff. If the page is arevised page 1 the number of the revisionmust precede the page number (e.g., 11 4threvised page 25");(4) Date of the i ssuance of the page or revisedpage and its contents ; and(5) Effective date of the page and its contents.(b) The last page of the tariff must contain thenotation, "The End. 11[EffJAN - 1 2019 ] (Auth:605-1 23307

§16-605-16HRS §§269-6, 271G-7, 271G-l 7}(Imp:HRS §§269-6,271G-7, 271G-16, 271G-17}Supplement. Each supplement to abasic tariff must be consecutively numbered, startingwith "Supplement No. l." The supplement must identifyon the title page the basic tariff to which it is asupplement and briefly describe the nature of thesupplement. In addition to meeting the requirement ofsection 16-605-13, each page of the supplement mustcontain the following:(1) The supplement number immediately below thename and number of the tariff to which it isa supplement; and(2)The supplement number preceding the pagenumber (or revised page number) in the upperright hand c9rner of the page.[EffJAN O l 2019 ] (Auth : HRS §§269-6,271G-7, 271G-17) (Imp:HRS §§269- 6, 271G-7,§16-605-15271G-16,271G 17)§16-605-16 Joint routes and rates. Watercarriers:(1) May establish joint routes and through rateswith one another and with motor carriersengaged in common carriage ; and(2)Shall establish reasonable rules governingthese rates.Interline revenues are to be divided by agreementbetween the participating carriers. §16-605-17§16-605-17 Class rates for property carriage.(a) Water carriers of property may group articles intoclasses and establish class rates. The classificationmust clearly describe the commodities included in eachclass, the ratings assigned to the classes, andrelevant rules . The rules must precede theclassification of articles and be consecutivelynumbered and separately indexed.·(b) The classification of articles must bepublished either in the rate tariff or in a separateclassification tariff. When published in a separateclassification tariff, the classification tariff must :(1) Make reference to the class rates in therate tariff;(2) Contain an alphabetical list of all articleslisted, unless the number of articles is sosmall that the tariff plainly discloses itscontents; and(3)Identify the water carriers participating inthe classification tariff.(c) A carrier participating in class rates orits agent shall not publish separate duplicative orconflicting class or commodity rates.[EffJAN - 1 2019 ] (Auth: HRS §§269-6, 271G - 7,271G-17) (Imp:HRS §§269-6, 271G-7, 271G - 16, 271G - 17)§16-605-18 Exceptions to class rates.(a ) Arate for an article lower than the rates for classesof articles must be published as a commodity rate, orif the article is otherwise included in a class ofarticles for which a class rate has been established,as an exception to the c l ass. Exceptions must bepublished as part of a tariff of class rates under t heheading ff Exceptions to Classification" or in aseparate tariff.If a separate tariff of exceptionsis published, specific reference to the exceptionsmust be made in all rate tariffs where the exceptionsare applicable .(b)If a tariff establishes a commodity rate,the class rate on the same artic le between the same605-14

§16-605-20points or zones via the same route does not applyunless the tariff that establishes the commodity rateexplicitly allows either the commodity or the classrate to be used.The provisions of this subsectionmust be included in the classification tariff.[EffJAN O1 2019 ] (Auth: HRS §§269-6, 2718-7)(Imp: HRS §§269-6, 2718-7, 2718-16, 271G-17),I§16-605-19 Lowest rate applicable.(a)If awater carrier of property has a tariff containingclassification or commodity rates, the water carriermust observe and incorporate the following rule in itstariff:When a classification rate and a commodity rateare named between specific points, the lower ofthe rates is the lawful rate, unless somecombination of classification rates or commodityrates or classification and commodity rates makesan even lower rate, in which case the lowest rateor combination of rates is the applicable rate.(b) A water carrier of passengers must observeand incorporate the following rule in its tariff:When a combination of fares makes a lower farethan the published through fare, the combinationis the lawful fare and must be applied.[EffJAN O1 2019 ] (Auth: HRS §§269-6, 271G-7)(Imp: HRS §§269 - 6, 2718 - 7, 2718-16)§16-605-20 Sailing schedules.(a)The cargosailing schedule, with departure and arrival dates andwith time of departure and arrival, must be publishedin an appropriate section of each tariff.Thepublication does not alter the water carrier's dutieswith respect to the receipt and delivery of cargo asestablished by statutory or common law.(b)The passenger sailing schedule withdeparture dates and times must be published in anappropriate section of each tariff .605-153307

§16-605-20[Eff(Imp :JAN - 1 2019 ] (Auth: HRS §§269-6, 271G-7)HRS §§269-6, 271G 7, 271G-16)§16-605-21 Use of "all points." The term "allpoints" or similar terms may not be used in any tariffto indi cate the points from or to which fares apply.[EffJAN- 1 2019 J (Auth: HRS §§269 - 6, 271G-7)(Imp : HRS §§269-6 , 271G- 7 , 271G-16)§16-605-22 Transfer of tariffs.(a)When acertificate of public convenience and necessity orother operating right is transferred , the transfereecarrier may adopt the tariffs and other instrumentsissued by or on behalf of the transferor carrier, ifpermitted by the commission's order authorizing thetransfer of the operating rights. The transfereecarrier shall file three copies of the adoption noticewith the commission .(b) Upon filing of the adoption notice with thecommission, the transferee carrier shall serve a c o pyof the adoption notice on each agent that publishes atariff containing rates or other provisions in whichthe transferor carrier participated.(c) Upon filing of the adoption notice, thetransferee carrier shall supplement or reissue eachtariff i ssued by the transferor carrier indicatingthat the tariff has been adopted by the transfere ecarrier. The tariff supplement or reissue must b econsistent with the commission order authorizing thetransfer.(d)If the transferee carrier elects not toadopt the tariffs issued by the transferor carrier,the transferee carrier shall file a temporary adopt ionnotice and new tariffs not later than ten days afterthe effective date of the commission order authori z ingthe transfer of the operating authority . The newtariffs are effective forty-five days after theirfiling, unless suspended by the commission for a605-163307

§16-605-30longer period.[Effnt] (Auth: HRS§§269-6, 271G-7) (Imp:JAti!RS %9-6, 271G-7, 271G-14,271G-17)§16-605-23 Change in water carrier's legal name.A water carrier that changes its legal name without achange in ownership or control shall immediatelynotify the commission in writing of the change andshall amend its tariffs to show the new name of thecompany. The water carrier shall immediately providewritten notification of the name change to all agentswho have issued tariffs in which the water carrierparticipates, and the agents shall promptly amend thetariffs to change the name of the water carrier. Thetariff change must show the new name of the watercarrier and its former name; for example: "ABCTransportation, Inc. (formerly XYZ Water CarrierCo.). 11[EffJAN Q120\9] (Auth: HRS §§269 - 6,271G-7) (Imp: H'.R.S §§269-6, 271G-7, 271G-1 7)§§16-605-24 to 29 (Reserved)SUBCHAPTER 3TARIFF CHANGE OR REVISION, GENERAL RATEINCREASE, TEMPORARY RATE INCREASE§16-605-30 Tariff changes or revisions.(a)Awater carrier desiring to publish and apply fares orrates and charges, sailing schedules, or rules orconditions different from those previously filed bythe water carrier or its agent shall file anapplication for a tariff change in acc ordance with t he605-173307

§16-605-30applicable provisions of this chapter and chapter16-601. The carrier shall file the original and threecopies of the application with the commission. Thecarrier shall include the following information in itsapplication:(1)Name of applicant (as shown on thecertificate of public convenience andnecessity) and address of principal office;(2)Complete and detailed description of thechanges sought;(3) All points or zones to and from which thechanges are sought to be applied;(4)Effective date of the changes; and(5)Reasons for the changes.(b)The carrier shall attach to its application,in its revised form, the basic tariff or supplementpages affected by the requested changes. A page maybe replaced by more than one revised page. Therevised pages must comply with the requirements ofsection 16-605 - 12. If the original tariff orsupplement has a check sheet, the carrier shall alsoattach a revised check sheet that reflects the revisedbasic tariff page or supplement page.(c)The carrier shall indicate on each revisedbasic tariff page or supplement page the effect of thechange to the current tariff by the use of thefollowing symbols:(R)to denote a reduction.(I)to denote an increase.(A)to denote an addition.(C)to denote a change that is neither areduction nor an increase.The symbol must be placed next to each change. If awording is being changed, the symbol must be placednext to the word or next to the first word in therevised phrase.(d) When a new basic tariff is issued cancelingin its entirety a previously issued tariff or tariffsor when a new supplement is issued canceling in itsentirety a previously issued supplement orsupplements, the title page of the new tariff or newsupplement must indicate the tariff or supplement605-18)307

Thecarrier shall include in the computation thebeginning and ending balances for each ofthe following ratemaking components:(A)Plant in service and accumulateddepreciation;(B) Materials and supplies inventory,working cash, and other additions torate base;(C)Deferred income taxes, investment taxcredits, and other deductions to ratebase; and(D) Breakdown of related companies'property or equipment investmentallocated to the carrier, such as tugs .For each investment of relatedcompanies, the carrier shallspecifically identify the originalcost, accumulated depreciation, and thebasis of allocation ;(8)Schedule on computation of working cash;(9)Summary of charter hire expenses paid by thewater carrier to related companies by islandand by month for the periods specified insection 16-605-31(e). The carrier shallidentify in the exhibit the equipment orservice provided by and the total expensepaid to the related company;(10) Schedule of operating revenues for allports. The carrier shall indicate in theschedule, by port, the outbound and inboundtonnage for proper ty carriers, the number ofpassengers for passenger carriers, and theoutbound and inbound revenues.
