Introduction If a claimant feels that he/she is experiencing undue hardship as aresult of a crime and needs an award immediately, he/she can requestan emergency award (EA). In order to approve an EA, OVS must findthat an award would likely be made in the claimant’s case and thatundue hardship would result if immediate payment were not made. EAs are only granted before services have been rendered and/orpaid for otherwise, a regular claim must be filed. EAs are not grantedfor reimbursement. This presentation will discuss the various EAs that OVS provides, thedocumentation required for each one and how you, the Advocate, canfacilitate the process.

The Office of Victim Services grants emergencyawards for the following expenses: FuneralHIV Medication for Sexual AssaultPrescription DrugsMoving/Storage/RelocationLoss of EarningsLock Replacement or Security System InstallationEyeglasses/Contacts/Emergency Medical Equipment

For All EA RequestsAdvocates must provide: Claimants photo ID. If the claimant does not have a photo ID, thenrequest two forms of non-photo ID at least one bearing a signature. Police precinct and complaint number or a copy of police report or anOVS acceptable equivalent (FRE proof, etc.). The Detective or Police Officer in charge of investigation, their nameand phone number.

Funeral EA Requests Itemized funeral contract signed by the claimant.The liability section must be signed by theclaimant. Provider’s Tax ID#. Copy of the Death Certificate (if available). OVS will pay up to 2,500 on an emergency award towards afuneral. If the funeral costs are less than 2,500, OVS will pay thefull amount up to 2,500.If Contributory Conduct is suspected after interviewing lawenforcement, OVS may deny the EA request.

If a homicide takes place at work If the homicide takes place at work, then the family of thedeceased may be eligible for certain compensation fromWorkers’ Compensation Board (WC). This might includefuneral expenses. The maximum funeral benefit from WC is 6,000 inMetropolitan New York counties and up to 5,000 in all others.As a result, OVS does not award emergency assistance forfuneral expenses unless the costs exceed 6,000 in NYC and 5,000 in all other counties. If the funeral cost exceed thesemaximums, OVS can pay the exceeding amount on anemergency basis.

HIV/Antibiotics/Pain/OtherMedication EA Requests Copy of prescription or equivalent proof that claimant has beenprescribed the requested medication; either from the pharmacy ormedical provider and contain the following: victim’s name, medicationname, name of the medical provider and the date prescribed (ex: acall to pharmacy to confirm the electronic transmission of theprescription would be proof). Cost estimate from pharmacy including the Store Number, Tax ID#,telephone number and contact person. Criminal Justice Agency report information or proof* of completed FREexam

Proof a rape kit was used: Sexual Assault form or Authorization for Release of Information and Evidence to Law EnforcementAuthorities form (both found in the rape kit).2. If no rape kit was used but a forensic examination was performed: Provide proof of the completion of the examination and A diagnosis of a sexual assault (in medical record).3. A letter from the medical professional who performed the FRE indicating: a sexual assault kit was completed or a forensic exam was completed and a diagnosis of sexual assault was made.
