Issue 91-215LIBRARYNovember6. 1991The Commission has affirmed sanctions "imposed by the NASD on Michael David Sweeneyand his son, Michael Gregory Sweeney, of Spokane, Washington, former salesmen for DeanWitter Reynolds, Inc. The NASD censured the Sweeneys, fined them 5,000, and requiredthem to disgorge 17,263 to the association and to attend a staff interview regardingsales practices.While the Commission affirmed the NASD's sanctions, it ordered thatthe disgorgementdirected by the NASD be paid to the investors injured by therespondents' conduct in this case rather than to the association.The Commission affirmed NASD findings that the respondents excessively traded theaccounts of four couples who were at or near the age of retirement.The Sweeneys'actions depleted their customers' net investments by amounts ranging from 22% to 44%.The Commission announced that when ordering disgorgement in the future the NASD shouldrequire the payment of prejudgment interest at an appropriate rate on the amount tobe disgorged or explain why it is not necessary. It noted that the failure to collectsuch interest provides "a strong financial incentive for respondents to seek delayin the resolution of proceedings.The Commission also endorsed the NASD' s previouslystated policy that "ill-gotten gains" should be disgorged to customers who sufferedthe loss.As noted above, the NASD was directed to adhere to that policy in thiscase.(ReI. 34-29884)IICOMPLAINT FOR INJUNCTION FILED AGAINST SONIC ELECTRIC ENERGY CORPORATION,JR., DANIEL VON FELLENBERG AND DAVID WAGNERRAYMOND WEILAGE,On September 26 the Commission filed a complaint for final judgment of permanentinjunction in the U. S. District Court for the District of Colorado naming SonicElectric Energy Corporation (Sonic), a Colorado corporation, Raymond L. Weilage, Jr.(Weilage) of Atlanta, Georgia, Daniel Rudolf von Fellenberg(von Fellenberg) ofGeneva, Switzerlandand David J. Wagner (Wagner) of Englewood,Colorado.Thecomplaint alleges that Sonic, Weilage and von Fellenberg violated the registrationand antifraud provisions of the federal securities laws and that Wagner aided andabetted the registration violations.
