(U) The Fou rth Amendment to the U nited States Constitution protects allU.S. persons anywhere in the world and all persons within the U nited Statesfrom unreasonable searches and seizures by any person or agency acting onbehalf of the U.S. Government. The Supreme Court has ruled that theinterception of electronic communicatio ns is a search and seizure within themeaning oft he Fourth Amendment. It is therefore mandatory that signalsintelligence (SIGINT) operations be conducted pursuant to procedures whichmeet the reasonableness requirements ofthe FoUI1h Amendment.(U) BalancingForeignIntelligence Needand PrivacyInterest1.2. (0) In determining whether United States SIGINT System (OSSS)operations are "reasonable," it is necessa1y to balance the US. Government'sneed for foreign intelligence information and the privacy interests ofpersonsprotected by the FoUI1h Amendment. Striking that balance has consumed muchtime and effort by all branches of the U nited States Government. The results ofthat eff011 are reflected in the references li sted in Section 2 below. The most important is thatintelligence operations and the protection of constitutional rights are notincompatible. It is not necessary to deny legitimate foreign intelligencecollection or suppress legitimate foreign intelligence information to protect theFot11ih Amendment rights ofU.S. persons.(U) Minimizationof U.S. PersonInformation1.4. (0) These minimization procedures implement the constitutional principleof"reasonableness" by giving different categories of individuals and entitiesdifferent levels of protection. These levels range from the stringent protectionaccorded U.S. citizens and permanent resident aliens in the United States toprovisions relating to foreign dip lomats in the U.S. These differences reflect yetanother main theme of these procedures, that is, that the focus of all foreignintelligence operations is on foreig n entities and persons.(U) OversightFunctions1.5. DOCID:40862223ECRE1'//3I//i\:EL 1'0 USA FVfSYauthorize the COLLECTION of information to, fi·om, or about aU.S. PERSON who is outside the UNITED STATES whensecuring the prior approval of the Attorney General is notpractical because:(a) (U) The time required to obtain such approval wou ldresult in the loss of significant FOREIGNINTELLIGENCE and would cause substantial harm tothe national security.(b) (U) A person's life or physical safety is reasonablybelieved to be in immediate danger.(c) (U) The physical security of a defense installation orgovernment prope1iy is reasonably believed to be inimmediate danger.{2) (U//FOUO} In those cases where the DIRNSNCHCSSauthorizes emergency COLLECTION, except for actions takenunder paragraph d.(I)(b) above, DIRNSA/CHCSS shal l find thatthere is probable cause that the TARGET meets one of thefollowing criteria:(a) (U) A person who, for or on behalf of a FOREIGNPOWER, is engaged in clandestine intelligence activities(including cove1i activities intended to affect the politicalor governmental process), sabotage, orINTERNATIONAL TERRORIST activities, or activitiesin preparation for INTERNATIONAL TERRORISTactivities; or who conspires with, or knowingly aids and"electronic surveillance" encompasses 1) the acquisition by an electronic, mechanical, or other surveillancedevice the contents of any wire or radio communications sent by or intended to be received by a particular,known, United States person ifthe contents are acquired by intentionally targeting the U.S. person undercircumstances in which a person has a reasonable expectation of privacy and a warrant would be required forlaw enforcement purposes, absent the U.S. person' s express or implied consent; 2) the acquisition by electronic,mechanical, or other surveillance device of the contents of any wire communication to or fi·om a person in theUnited States, without the consent of any party thereto, if such acquisition occurs in the United States, but doesnot include those communications of computer trespassers that wou ld be permissible under section 2511(2)(i) oftitle 18 of the United States Code; 3) the intentional acquisition by an electronic, mechanical, or othersurveillance device of the contents of any radio communication, under circumstances in which a person has areasonable expectation of privacy and a warrant would be required if the acquisition were undetiaken for lawenforcement purposes, and ifboth the sender and all intended recipients are located inside the United States; or4) the installati o n or use of an electronic, mechanical, or other survei llance device in the United States formonitoring to acquire information, other than from a wire or radio communication, under circumstances inwhich a person has a reasonable expectation of privacy and a warrant wou ld be required if the acquisition wereunde1iaken for law enforcement purposes.SEGRET/t'SI//REL TO US,\:, 'f \'E'l
