How do mandatory reporting lawsconflict with ethical principles?10

Texas FamilyCode Chapter261a) A person having cause tobelieve that a child's physicalor mental health or welfarehas been adversely affectedby abuse or neglect by anyperson shall immediatelymake a report as provided bythis subchapter.11

Texas FamilyCode Chapter261(b) If a professional has cause tobelieve that a child has been abusedor neglected or may be abused orneglected, or that a child is a victimof an offense under Section 21.11,Penal Code, and the professional hascause to believe that the child hasbeen abused as defined by Section261.001, the professional shall makea report not later than the 48th hourafter the hour the professional firstsuspects that the child has been ormay be abused or neglected or is avictim of an offense under Section21.11, Penal Code. A professionalmay not delegate to or rely onanother person to make the report.12

Texas FamilyCode Chapter261c. The requirement to reportunder this section applieswithout exception to anindividual whose personalcommunications mayotherwise be privilegedincluding an attorney, amember of the clergy, amedical practitioner, a socialworker, a mental healthprofessional, and anemployee of a clinic or healthcare facility that providesreproductive services.13

Immunities§261.106.(a) A person acting in good faith who reports or assists in the investigation of areport of alleged child abuse or neglect or who testifies or otherwise participatesin a judicial proceeding arising from a report, petition, or investigation of allegedchild abuse or neglect is immune from civil or criminal liability that mightotherwise be incurred or imposed.(b) Immunity from civil and criminal liability extends to an authorized volunteer ofthe department or a law enforcement officer who participates at the request ofthe department in an investigation of alleged or suspected abuse or neglect or inan action arising from an investigation if the person was acting in good faith and inthe scope of the person's responsibilities.(c) A person who reports the person's own abuse or neglect of a child or who actsin bad faith or with malicious purpose in reporting alleged child abuse or neglect isnot immune from civil or criminal liability.14

(a) A person commits an offense ifthe person is required to make areport under Section 261.101(a)and knowingly fails to make areport as provided in this chapter.Failure toReport(a-1) A person who is a professionalas defined by Section 261.101(b)commits an offense if the person isrequired to make a report underSection 261.101(b) and knowinglyfails to make a report as provided inthis chapter.15

(c) An offense under Subsection (a-1) is aClass A misdemeanor, except that theoffense is a state jail felony if it is shownon the trial of the offense that the actorintended to conceal the abuse or neglect.DON’T FORGET CIVIL LIABILITY AND YOURLICENSE!
