WHAT IS INCLUDEDWHAT IS NOT INCLUDEDInsuranceYou can add an additional driver with ouragreement. We will need to see their drivinglicence and a charge will apply.You can also buy additional cover for injuryto the driver and loss of or damage to thepossessions of you and your passengers bypurchasing Personal Insurance (PI).Damage WaiversYou can reduce your liability to us for the CDW orTP excess to zero by purchasing SuperCover (SC).As a cheaper alternative, where available, youcan take Glass & Tyres (G&T) to eliminate yourliability for the CDW or TP excess for damageto the vehicle’s windows and tyres.FuelYou can choose to pay for a whole tank of fuelin advance so you don’t need to fill the tank onreturn (although no refund will be given for anyunused fuel). Ask for Fuel Purchase Option (FPO).Breakdown ServiceYou can buy additional cover for the call outcosts relating to breakdowns that are your fault,including for flat batteries, lost keys, use of thewrong fuel or keys locked in the vehicle with ourPersonal Emergency Roadside Service (PERS).EquipmentYou can choose from our range of additionalequipment and services, including HertzNeverlost, child seats, winter tyres, snow chainsand Wi-Fi, subject to availability at each location.MileageWe do not cover you for any parking fines,private parking charges, road tolls or trafficviolations you incur on your trip. We will processthese on your behalf, pass on the charge andadd an administration fee.Third party insurance is included in your rateand protects you or any authorised driveragainst claims from any other person fordeath, injury or damage to property if you havean accident.Most rates include Collision Damage Waiver(CDW) and Theft Protection (TP). These limityour liability to us for damage to or loss of thevehicle to the excess amount stated on yourRental Agreement.Your rental is provided with a full tank of fuel.You can either return the vehicle full or pay forus to refill the tank for you at the rate shownon your Rental Agreement.A basic breakdown service is included in yourrental to cover call outs for mechanical faultsand accidents.Your rate includes all compulsory equipment.Although there is normally no limit on distancecovered during your rental, some exceptionsmay apply which will be shown on yourRental Agreement.5

BASICSRENTAL AGREEMENTDISPUTESYour Rental Agreement is the document yousign when you pick up your vehicle (generallyheaded “Rental Agreement” or “RentalRecord”) which includes a summary of yourrental (e.g. length, services taken and anestimate of charges to be paid). By signing,you indicate that these details are correct aswell as your acceptance of:We aim to resolve all disputes amicably. Forcontact details and information about anyavailable independent dispute resolutionservices, please see Annex 6 (Contacts). these Rental Terms; and any Country Specific Terms provided (i.e.local variations and additions to theseRental Terms).The Rental Agreement is made with the Hertzcompany or franchisee named on it and allreferences to “Hertz”, “we”, “us” and “our”are to that company.RESPONSIBILITYOurs: We are responsible to you for providingthe vehicle in good overall and operatingcondition and for replacing the vehicle in theevent of breakdown. Our responsibility coversdeath or personal injury resulting from ouracts or omissions. It does not extend to otherlosses arising from your rental unless theyare a direct and foreseeable result of ournegligence or breach of these Rental Terms.In this case our responsibility to you will notcover loss of profits or loss of opportunity.If we are unable to resolve a dispute, the lawof the country where you signed the RentalAgreement will apply. Any part of this RentalAgreement which is held to be illegal orunenforceable under applicable law shall beconsidered to have been deleted, leaving theremainder in full force and effect.PRIVACYWhen you rent with us, you consent to usprocessing your personal information inaccordance with our Privacy Policy. Please seeAnnex 5 (Privacy Policy) for further information.LONGER TERM RENTALSIf your rental is for 28 days or longer youmust return the vehicle to one of our rentallocations at least every 28th day or at anytime when requested by us. We reserve theright to terminate this Rental Agreement atany time by giving you 30 days’ notice eitherorally or in writing.Yours: You must care for, use and return thevehicle in accordance with this RentalAgreement.IMPORTANTYou are responsible to us if the vehicle isreturned late, lost or damaged, as well asfor traffic fines and other charges thatarise during the rental.Please read the Rental Agreement carefullyto understand your obligations in full.6

PICK UPCHARGESYour Rental Agreement shows any chargesagreed at the start of the rental (which havenot been prepaid) and your agreement to paythese and any other charges that arise by theend.IMPORTANTWe typically reserve an amount on yourcredit card (or take a deposit) at leastequal to the estimated charges shown onyour Rental Agreement. This will bereleased (or repaid) on return followingpayment of the rental charges. For fulldetails please check with the location attime of pick-up or online before travelling.Please see Annex 1 (Charges Explained) foran explanation of the principal charges andpotential additional charges that may arisefrom your rental. We will provide you with afinal invoice on return.Currency conversionIf you are travelling we may give you theoption to pay in your home currencyusing a competitive rate of exchange.Please see Annex 7 (Currency Conversion)for further details in those countriesproviding this service.VEHICLEDefinition: All references to “the vehicle”in these Rental Terms are to the vehicle wesupply to you for your rental, including anyreplacements, plus all parts and accessoriesbelonging to the vehicle and any additionalequipment provided to you, such as child seats,NeverLost units, DVD players, ski chains etc.Condition: It is important that you checkthe condition of the vehicle at the start ofthe rental and on return. We will provide asummary of any pre-existing damage on ourVehicle Condition Report. Please see Annex 3(Damage Policy) to understand how we willprocess damage caused during your rental.Care: You are responsible for looking after thevehicle and reducing the risk of breakdownand damage by complying with our RentalRestrictions (below). You must also make sureyou use the correct fuel and check the tyres, oiland other fluid gauges, refilling as necessary.IMPORTANTYou are responsible for returning thevehicle in the condition we provided it in,subject to fair wear and tear. You will beresponsible to us, to the extent allowedunder applicable law, for any additionaldamage found on return.Fuel: We will supply your vehicle with a full tankof fuel. You will need to return the vehicle with afull tank or pay for the additional fuel requiredto fill the tank on return, including a RefuellingService Charge for the convenience of havingus refuel the vehicle for you.Fuel Purchase Option (FPO)You might find it more convenient to payfor a full tank at the start of the rental andsave time refuelling on return by takingthis option.Please see Annex 2 (Fuel Policy) for a fullexplanation of your options.7

PICK UPRENTAL RESTRICTIONSUse: The vehicle belongs to us and you maynot sub-rent, transfer or sell it. You may notuse the vehicle: To carry passengers for remuneration (e.g.as a taxi or car sharing arrangement orsimilar). Off road or on roads unsuitable for thevehicle (including racetracks). When it is overloaded with passengers and/or baggage. To tow or push any vehicle, trailer or otherobject (without our express permission). To carry anything which may harm thevehicle (including explosive or combustiblematerials) or delay our ability to rent thevehicle again (because of its condition orsmell). To carry cargo for remuneration (except inthe case of trucks and vans). To take part in any race, rally or othercontest. In restricted areas, including airport serviceroads and associated areas. In contravention of any traffic or otherregulations. For any illegal purpose.Driving abroad: You may drive the vehicle inany of the countries indicated in the CountrySpecific Terms. If you want to drive the vehiclein any other country you must gain ourprior permission.Multiple rentals: You may not rent more than2 vehicles at any time unless you have set up acorporate account with us and have our priorpermission to do so.IMPORTANTIf you do not comply with these RentalRestrictions: You will be responsible for any damage,losses and expenses we suffer as aresult. You may lose the benefit of anyinsurance or waivers of liability youhave taken. We may terminate the RentalAgreement and take the vehicle back atany time at your expense.Authorised drivers: Only the renter and anyother person authorised by us may drive thevehicle, although they may not drive if theyare over-tired or under the influence of anysubstance that may impair their consciousnessor ability to react, such as alcohol, drugs orcertain medication.8

DURING YOUR RENTALFINES, TOLLS AND OTHER CHARGESACCIDENTSYou are responsible for all fines, road tolls,congestion charges and other similar charges(including parking fines or charges) incurredin relation to the vehicle during your rental.Some of these will be sent to us for payment,which we will pay and recover from you by wayof reimbursement. Alternatively, we may berequired to provide your details to the relevantauthority, who will contact you directly.If you have an accident you agree to co-operatewith us and our insurers in any investigation orsubsequent legal proceedings. You must alsotake the following steps:IMPORTANTIn addition to any fine or charge youincur, we may also apply anadministration charge to reimburse usfor the time and costs we incur in dealingwith these matters.BREAKDOWNAssistance: If you experience any problemwith the vehicle due to mechanical failure oraccident you should call Emergency RoadsideAssistance (see the Country Specific Terms orthe Rental Agreement) and they will arrangehelp. Although this service is included in yourrate, you will be responsible to us for anybreakdown call out costs we incur where youare at fault. Please note that you must notallow anyone to service or repair the vehiclewithout our permission.Notification: You must inform the locationin any event, and Emergency RoadsideAssistance if there is damage to the vehicle,using the numbers on the Country SpecificTerms or the Rental Agreement. Report theaccident to the police as soon as you canif anyone has been injured or property hasbeen damaged. Please check Country SpecificTerms (given to you at the counter) for anyadditional requirements or variations.Accident Report Form (ARF): Complete theARF (available either in the vehicle or byrequest on return) and hand it to a member ofstaff. The ARF must be completed, signed and,where possible, agreed with any third partyeven if there is no damage to the vehicle.Do Not Admit Fault: Take the name and addressof everyone involved, including witnesses, andcollect the information requested on the ARF.IMPORTANTIf you fail to comply with these accidentinstructions your waiver products may bevoid. Please check your Country SpecificTerms for full requirements.Premium EmergencyRoadside Assistance (PERS)In some countries you can buy thisadditional product to cover breakdowncall out costs where you are at fault. Forfull details see Annex 4 (Insurance &Waivers).9

DURING YOUR RENTALDAMAGE AND THEFTResponsibility: You are responsible for alllosses incurred by us to the full value of thevehicle if the vehicle is lost or damaged duringyour rental and our costs unless the loss ordamage is directly due to us or we have beenreimbursed by a third party or their insurers.IMPORTANTYour liability to us may include (amongstothers): Cost of repairs - loss of rental income. Towing and storage charges. Loss in value of the vehicle. An administration charge to recover ourcosts for dealing with these issues andany related claim.Security: You are responsible for the securityof the vehicle and should try to minimisethe risk of theft or vandalism by parking ina safe place. Always remove valuable items(including any removable radio, DVD player orNeverLost unit) from sight and make sure thevehicle is locked. You must also comply withour return instructions (see Return below).Theft: If the vehicle is stolen you need toinform the police, call Emergency RoadsideAssistance as soon as you can and completean ARF (see the Accident procedure above).You must be able to show that you have takenappropriate care by returning the keys to us,otherwise our applicable waiver products willbe invalid.Insurance and Waiver OptionsYour rate automatically includes ThirdParty Liability Insurance which protectsyou and any authorised driver againstclaims from any other person for death,personal injury or damage to propertycaused by the vehicle during the rental.In addition (if not already included inyour rate) you can choose: Optional Waivers such as SuperCover,CDW and TP): to reduce or eliminateyour liability to us for damage to orloss of the vehicle; and Personal Insurance (PI): to provide coverfor you and your passengers for (i)death, injury and medical expenses,and (ii) loss of or damage topossessions, when using the vehicle. If you accept our optional products youagree to the terms set out in Annex 4(Insurance & Waivers).Third party insurance: If you have purchasedexcess waiver insurance or similar from a thirdparty to cover your liability to us for the excessunder our waiver products, you will remainliable to us for any amount due up to theexcess and must seek reimbursement fromyour insurer.IMPORTANTTo the extent allowed under applicablelaw, our insurance and waiver productswill be void if you breach these RentalTerms, or if the loss or damage is causedintentionally. Our waivers may also beinvalid if the loss or damage is caused bythe gross negligence of you or an authorised driver. For full details of exclusionssee Annex 4 (Insurance & Waivers).10

RETURNRETURN PROCEDURERequirements: You need to return the vehicleto the return location by the time stated onyour Rental Agreement, or as otherwise agreedwith us, or additional charges may apply (seeVariations below).Outside Operating Hours: You may return thevehicle outside location opening hours with ourprior agreement, in which case you must: Parking: lock the vehicle and park in our carpark or, if unavailable, a secure place nearby. Information: complete the Return Details onthe back of this Rental Terms booklet andleave it in the vehicle with any otherdocuments (such as an Accident ReportForm). Keys: do not give the keys to anybody whenyou park the vehicle, even if they appear tobe our employee, but post them with clearinstructions where to find the vehicle throughthe location's key box.IMPORTANTIf you return the vehicle out of hours youwill remain fully responsible for the vehicle,including any damage, until we are able tolocate it.VARIATIONSChange to time or location: If you want tochange the time or place of return or arrangefor us to collect the vehicle, you should call thelocation at the number provided on the RentalAgreement. Any amendment to the agreedreturn arrangement is at our discretion andmay involve additional charges.IMPORTANTA change to the Return Time might involvean increase to your rental charges, because a different (current) rate may apply.If you change Return Location we maycharge a One Way Fee to cover our costof returning the vehicle to its originallocation.Late return: Your rental charges are calculatedin 24 hour periods from the time shown on theRental Agreement. If you return the vehicle lateyou enter into a new 24 hour period and will becharged for that and every successive 24 hourperiod you enter before return at a current,standard rate.To help you, we typically allow a short‘grace period’ to return the vehicle withoutbeing charged an extra day. See Annex 2(Charges Explained) or ask at the counterfor details.In certain circumstances, we may also applya small Early Return Charge or Late ReturnCharge towards costs we incur if you returnthe vehicle other than at the agreed time. Fordetails, see Annex 1 (Charges Explained).CHARGESNotification: We will check the vehicle on yourreturn and add any additional charges arisingfrom your use of the vehicle, such as for fuel,vehicle condition/ damage and early/ latereturn, to your invoice. Please see Annex1 (Charges Explained) for a detailed list ofpotential charges.IMPORTANTSome charges can’t be finally determinedon return, such as for major damage orany fines we receive relating to yourrental. We will notify you of any suchcharges and arrange for payment whenthese are identified.Invoice and payment: We will provide aninvoice on your return or by email or post.If you don’t pay your charges in the timeindicated on your invoice we may charge youthe applicable statutory commercial intereston the outstanding charges.11

ANNEX 1 – CHARGES EXPLAINED(A) YOUR ESTIMATE OF CHARGES (SEE YOUR RENTAL AGREEMENT)Your Rental Agreement provides an estimate of the charges applicable to your rental. These chargesmay typically include the following:COMPULSORY CHARGESRental RateThe agreed rental rate is shown as a per week or per day amount, includesthird party insurance and may include Collision Damage Waiver (CDW) andTheft Protection (TP).MileageAn estimated mileage may also be included in your rental rate. A fee mayapply if you exceed this estimate.Location Service ChargeIncluded at certain locations (e.g. airports and railway stations) to reflect thehigher cost of providing services from there.Vehicle Licence FeePasses on your share of the charges we incur for keeping the vehicle on theroad.Young Driver SurchargeMay apply if you or any additional driver is under 25 years old.OPTIONAL PRODUCTS AND SERVICESAdditional DriverWe apply a standard fee for each additional driver added to your rental tocover our additional insurance costs.One Way FeeMay apply if you return the vehicle to a location different from the startlocation. You will be advised at the time of reservation if your journey ispermissible.Delivery &Collection ChargesApply if you request that your rental vehicle is delivered to or collected from alocation other our rental location.Insurance &Waiver OptionsThe Rental Agreement will show if our insurance and waiver options have beenaccepted or declined by you or are otherwise included in your rate. We alsoshow the excess applicable to Collision Damage Waiver (CDW) and Theft Protection (TP) and the full charge for the agreed rental period, inclusive of tax.Optional equipmentThe Rental Agreement lists any optional equipment you have selected, suchas baby/ child seats, winter tyres, Neverlost and Hertz Entertainment (Wi-Fi),showing the full charge for the agreed rental period. inclusive of tax.12

TOTALEstimated RentalChargesYour total estimated charges at the start of the rental including tax. Chargesare ‘estimated’ because they exclude any potential fuel or other charges youmay incur through your use of the vehicle during your rental.Total EstimatedRental ChargesThe Estimated Rental Charges plus the maximum fuel charge you could incurif you return the vehicle empty (i.e. a full tank of fuel with a refuelling servicecharge at current rates).(B) POTENTIAL ADDITIONAL CHARGESYou may incur additional charges as a result of your use of the vehicle or other incidents that occurduring the rental. These include the following:FUELFuel Purchase Option(FPO)You pay for a full tank upfront (although no refunds are given for any unusedfuel).Refuelling PriceIf you don’t fill up the vehicle on return and haven’t opted for FPO, we willcharge you a price per litre to fill the tank.Refuelling ServiceChargeApplies on top of the amount charged for refuelling if we fill the tank for youon return and you have not taken FPO.VEHICLE CONDITIONDamage/Loss ChargesApply if the vehicle is lost or damaged either (i) if you have not purchasedour waiver products (e.g. CDW & TP), to the full value of the vehicle, or (ii) ifyou have taken our waivers to the excess amount. Not applicable if you takeSuperCover.Damage AdministrationCharge*Fixed charge to recover our costs for dealing with damage caused to the vehicle. Not applicable if you take SuperCover.Extra Cleaning Charge*Applies if you return the vehicle needing more than our standard cleaning tomake it ready for its next rental.Smoking Charge*Smoking is prohibited in all vehicles. This covers our costs of preparing thevehicle for the next rental.*For rentals in Germany this charge will not be applied if you can show that you are not responsible for the fine, that we do not haveany additional costs or that our costs are less than the specified charge.13

VEHICLE USELocal Road and TollChargesYou are responsible for paying all local road and toll charges applicable toyour rental.Traffic Finesand PenaltiesYou are responsible for paying the full penalty for any parking fine or charge,traffic fine or other penalty you incur during your rental.Fines AdministrationCharge*Standard charge to recover our costs of dealing with any road charge, parkingfine or charge, traffic fine or other penalty you incur during your rental.EARLY/LATE RETURNEarly Return Charge*Applies if you did not prepay your rental charges, committed to a rental termand then brought the vehicle back early. You will only pay for the days used,but we reserve the right to make this charge to compensate us in part for ourinability to rent your vehicle during the remaining time reserved for your use.Additional Rental DaysYou may be charged an extra day’s rental for each 24 hour period enteredinto following the return time at then current rental rates, although you areallowed a ‘grace period’ of 29 minutes to return the vehicle after the agreedreturn time.Late Return Charge*In addition to charging Additional Rental Days for late return, we reserve theright to make this charge to compensate us in part for the costs we incur infinding an alternative vehicle to satisfy our next booking for your vehicle plusour administration costs in contacting you to return the vehicle.All charges are calculated in accordance with our current rates and subject to final calculation at the endof the rental. Please ask at the counter for details or check the Charges section of our website.*For rentals in Germany this charge will not be applied if you can show that you are not responsible for the fine, that we do not haveany additional costs or that our costs are less than the specified charge.14

ANNEX 2 – FUEL POLICYFuel is not included in your rental rate. Your vehicle will be provided with a full tank of fuel and youcan decide how you wish to pay for the fuel you use during your rental. You have the following options:BUY A FULL TANK AT THE START. OR WITHOUT REFUELLINGOften referred to as a “full to empty” policy –this is our Fuel Purchase Option (FPO).A good option if you are in a hurry, did nottake FPO and do not have time to refill thetank on return.If you purchase a full tank of fuel from us at thestart of your rental, you will not need to refillthe tank before returning and will have nothingmore to pay for fuel.This is a good option for high mileage journeyswhere you are likely to use a full tank.We charge you at the start of your rentalfor a full tank of fuel at a pricecompetitive with local fuel stations. Youwill have nothing more to pay to us foryour fuel. Please note that we do notprovide a refund for unused fuel.RETURN WITH A FULL TANK.Often referred to as a "full to full" policy.Return the vehicle with a full tank of fuelpurchased from a local petrol station.This is a good option for low mileage journeys.Fuel gauges may still indicate that thetank is “full” many miles after it was lastre-filled. To deal with this practically,we ask you to refill the tank within 10miles/15 km of the return location andbring your fuel receipt with you when returning the vehicle. If you do not do so, wereserve the right to apply a small charge –please ask at the counter for details.Fuel chargesWe will charge you a price per litre to refillthe tank, including or in addition to aRefuelling Service Charge for our serviceof re-fuelling for you. These prices areindicated on your Rental Agreement.For your convenience we generally providetwo estimates of charges on your RentalAgreement to illustrate the potential cost ofreturning the vehicle without refuelling: without fuel (i.e. assumption that thevehicle is returned full); and with a full tank of fuel included (i.e.assumption that the vehicle is returnedempty to show the maximum charge);If you have any further questions, pleaseask at the counter when you pick up yourvehicle.15

ANNEX 3 – DAMAGE POLICYYour responsibility for damage to the vehicle is set out at the Damage and Theft section of the RentalTerms. This policy covers how we assess and charge for damage and how we deal with any disputesrelating to damage assessed.CHECKING THE VEHICLEWe will provide a summary of any damage onthe Vehicle Condition Report (VCR) at the startof the rental. Please check to make sure it iscorrect.
