Congressional findings – 15 U.S.C. § 1681(a) Banking system is dependent upon fair and accurate credit reporting.Inaccurate credit reports directly impair the efficiency of the bankingsystem, and unfair credit reporting methods undermine the publicconfidence which is essential to the continued functioning of the bankingsystem. 15 U.S.C. § 1681(a)(1) An elaborate mechanism has been developed for investigating andevaluating the credit worthiness, credit standing, credit capacity,character, and general reputation of consumers. 15 U.S.C. § 1681(a)(2) Consumer reporting agencies have assumed a vital role in assembling andevaluating consumer credit and other information on consumers. 15U.S.C. § 1681(a)(3) There is a need to insure that consumer reporting agencies exercise theirgrave responsibilities with fairness, impartiality, and a respect for theconsumer’s right to privacy. 15 U.S.C. § 1681(a)(4)Purposes – 15 U.S.C. § 1681(b) Reasonable procedures. It is the purpose of this title torequire that consumer reporting agencies adopt reasonableprocedures for meeting the needs of commerce for consumercredit, personnel, insurance, and other information in amanner which is fair and equitable to the consumer, withregard to the confidentiality, accuracy, relevancy, and properutilization of such information in accordance with therequirements of this title.27
Key concepts Consumer Report (broad definition) any written, oral, or other communication of any informationby a consumer reporting agency bearing on a consumer’s creditworthiness, credit standing, credit capacity, character, generalreputation, personal characteristics, or mode of living which isused or expected to be used or collected in whole or in part forthe purpose of serving as a factor in establishing theconsumer’s eligibility for(A) credit or insurance to be used primarily for personal,family, or household purposes; (B) employment purposes; or (C) any other purpose authorized under section 604 [§ 1681b].Key concepts Consumer Reporting Agency*Any person which, for monetary fees, dues, or on a cooperativenonprofit basis, regularly engages in whole or in part in thepractice of assembling or evaluating consumer creditinformation or other information on consumers for the purposeof furnishing consumer reports to third parties, and whichuses any means or facility of interstate commerce for the purpose ofpreparing or furnishing consumer reports.28
