Your contract of insuranceThis policy document gives details of your coverand it should be read along with your schedule andcertificate of motor insurance. Please take timeto read through all these documents that containimportant information about the details you have givenand check that the information is correct. If anything iswrong or needs to be changed please advise us via MyAXA Account.You must also advise us of any changes to yourinformation via My AXA Account during the policyperiod of insurance; details of the type of changes weneed to know about are contained in General condition2 on page 27 of this policyIf the information that you have given us is not trueand complete to the best of your knowledge and beliefyour policy may not protect you in the event of a claim.You should also show your policy to anyone else whois covered under it and ensure that they are aware ofits terms and conditions.You and we can choose the law which applies to thispolicy. Unless we and you agree otherwise, Englishlaw will apply to this policy.The parties to this contract are you and us. Nothingin this contract shall create any rights to third partiesunder the Contracts (Rights of Third Parties) Act 1999and no variation of this contract, nor any supplementalor ancillary agreement shall create any such rightsunless expressly so stated. Further information aboutthe compensation scheme arrangements is availablefrom the FSCS www.fscs.org.uk.Uninsured driver promiseIf you have comprehensive cover and you make aclaim where the driver of the other car involved in theaccident is found to be uninsured, you will not haveto pay your excess or lose any part of your no claimsdiscount (NCD) as long as: You are able to provide the make model andregistration number of the other car involved; We can establish that you were not at fault inany way.It will also help if you are able to provide the detailsof the other driver involved and details of anyindependent witnesses if possible.When you first claim you may have to pay your excessand your NCD may be affected but once we haveestablished that you were not at fault in any way andthe driver of the other car was uninsured your excesswill be refunded and NCD restored.Managing your policyWe hope you will choose to be in total control ofyour policy by managing it online. Your usernameand password will give you access to My AXAAccount, your secure area of our site. Please keepyour security details safe. You can access MyAXA Account at any time to review or update yourinformation, or you can call us.Who we will speak to about your policyWe recognise you may need to talk to us. Howeveras we are an internet based company and you canmanage your policy online, an administration feemay be charged for administration by telephone. SeeGeneral condition 15 Fees.We will deal only with you or people authorised by youto act on your behalf. However to prove that anotherperson has your permission to discuss your policy wewill require them to provide your security details4 of 33

If the policy is to be cancelled this must be done byyou. To protect your interests, we are unable to dealwith anyone cancelling the policy on your behalf.We may monitor or record telephone calls to improveour service and to prevent fraud.Sensitive informationIn order to provide you with insurance we will needto process sensitive information about you and thenamed drivers (such as information about health orcriminal convictions). Please make sure you have theconsent of the named drivers before sharing theirsensitive information with us.RenewalYour policy will renew automatically. You will becontacted prior to the renewal date to check that yourdetails are still correct and current. Please see generalcondition 14 on page 30 of this policy.5 of 33

DefinitionsThese definitions apply throughout your policy.Where we explain what a word means, that word willbe highlighted in bold print and will have the samemeaning wherever it is used in the policy.There are further definitions in Sections I to L of thepolicy and those definitions only apply to the section inwhich they are found.AccessoriesParts or products specifically designed to be fittedto your car, including spare parts and child carseats but excluding car audio, telephone, in carentertainment and/or satellite navigation systems.Audio equipmentManufacturer permanently fitted car audio,telephone, in-car entertainment and/or satellitenavigation systems up to the limits shown inthe schedule.AXACarMy AXA AccountYour own secure online area, hosted by us, whereyou can access your policy details.Named driverA person who is named on the certificate ofmotor insurance as entitled to drive.PartnerSomeone you have been living with (as if you aremarried or in a civil partnership with them) for atleast six months.Period of insuranceThe period from the start date to the end dateof your current policy. This is shown on yourschedule and certificate of motor insurance.PolicyThis policy wording for your motor insurancetogether with your schedule and certificate ofmotor insurance.AXA Insurance UK plcRecycled partsAny private motor vehicle insured under this policyand described in your current certificate ofmotor insurance and schedule including any carprovided under Sections A, B or J – Courtesy carupgrade.ScheduleCertificate of motor insuranceThe document which provides evidence that youhave taken out insurance as required by law. Yourcertificate of motor insurance shows who isentitled to drive your car and the classes ofuse permitted.Excess/excessesThe amount you must pay towards any claim evenif the incident is not your fault. Excesses applyunder Sections A, B, D, and G of this policy.Market valueThe cost of replacing your car with another ofthe same make and model and of a similar age,mileage and condition at the time of the accidentor loss. The market value may also be affectedby other factors such as a valid MOT, how youpurchased your car and whether it has beenpreviously declared a total loss.MisfuellingAccidental filling of the fuel tank with inappropriatefuel for your car.Parts that are recycled from other cars includingparts denoted by the motor trade industryas "green".The document which identifies the policyholderand sets out details of your policy cover includingthe applicable excesses and any optional sectionsyou have selected.Territorial limitsUnited Kingdom, the Channel Islands and the Isleof Man - refer to Section G (Foreign use) for fulldetails.TrailerAny form of trailer, caravan or car which is towedby a car insured under this policy.United Kingdom (UK)England, Scotland, Wales and Northern Ireland.We/Us/OurAXA insurance UK plc who underwrite all sectionsof the policy except Section L Breakdown, whichis underwritten by Inter Partner Assistance SA whoare fully owned by and are a part of the worldwideAXA Group.You/YourThe person named as the policyholder on theschedule and certificate of motor insurance.6 of 33

Section A - Damage including misfuellingWhat is covered under this sectionWe will pay for loss of or damage to1. Your car.2. Accessories including child car seats, while in oron your car.3. Audio equipment while in your car.4. Your car key, key fob or entry card or any otherdevice designed and made by the manufacturer toaccess and start your car.We may choose to replace them, to repair them or payan amount equal to the loss or damage.We will not pay more than the market value of yourcar at the time of the loss less any excessesWe will also arrange for your car to be moved to aplace of free and safe storage until it is repaired, soldor scrapped. The salvage of your car will become ourproperty after your claim is settled.If the damage to your car can be repaired, we willuse one of our approved repairers to repair it. If youchoose not to use them, we may not pay more thanour approved repairers would have charged and wemay choose to settle the claim by a financial payment.We may choose to repair your car with recycledparts, where appropriate. Parts used may not havebeen made by your car’s manufacturer but will beof a similar standard. All repairs carried out by ourapproved repairers are guaranteed throughout thetime that you own your car.Courtesy carIf your car is repaired by one of our approvedrepairers, you will be supplied with a courtesy carwhile your car is being repaired. Unless you havepurchased the Courtesy car upgrade under SectionJ of this policy, the car provided will be a 1 litre 3door petrol manual transmission car and cover willautomatically be provided under your certificate ofmotor insurance while the car is on loan to you.If a courtesy car cannot be arranged, we will repayyour alternative travelling costs up to a maximum of 15 per day.If your car has been specially adapted for you or for anamed driver with disabilities and we cannot arrangea suitable car, we will repay your alternative travellingcosts up to a maximum of 15 per day.In all cases if your car cannot be repaired, the loan ofthe courtesy car or alternative payments will stop witheffect from the date your car is declared a total loss.Finance or hire purchase agreementsIf you have bought your car under a finance or hirepurchase agreement, or are leasing it, any moneyowed to the company or bank involved will be paiddirectly to that company or bank first and any balanceof the agreed settlement sum will then be paid to you.New car coverIf your car is less than one year old and you have beenthe first and only registered keeper and legal owner,we will replace it with a new one of the same makeand model if it has suffered damage covered by thissection and the cost of repairing it will be more than70% of the manufacturer's last UK list price (includingtaxes). If a replacement car of the same make andmodel is not available we reserve the right to settleyour claim on the basis of the market value of yourcar at the time of the loss.Cherished platesIn the event of a total loss, if your car has a cherishedregistration number plate, we will give you 30 daysfrom the date it is declared a total loss to transfer thatcherished registration number onto a DVLA RetentionCertificate in your name. If you do not tell us that youwish to keep the cherished registration number plate,we will dispose of it with your car.Overnight accommodationIf your car cannot be driven as a result of damagecovered under this policy we will pay the cost ofovernight accommodation or onward travel.Child car seatsIf your car is fitted with any child car seats, we will payfor their replacement following an accident covered bythis policy, whether or not visible damage has beencaused to the car seat.No excess will apply in respect of replacement of childcar seats.You should purchase the replacement seat and we willreimburse you on presentation of the receipt.Misfuelling, drainage and flushing thefuel tank.If you accidentally fill your car with the wrong fuelplease do not start the engine. If your car is subject to misfuelling during the periodof insurance we will pay for:1. Drainage and flushing of the fuel tank on site usinga specialist roadside vehicle.2. Recovery of your car, the driver and up to 6passengers to the nearest repairer to drain andflush the fuel tank.3. Replenishing the fuel tank with 10 litres of thecorrect fuel up to a maximum value of 250 perclaim. You will be responsible for paying any coststhat exceed 250 per claim.4. Damage to your car engine caused solely anddirectly by misfuelling.A 75 excess applies in respect of claims for drainingand flushing the fuel tank. For damage to the engine,the excess shown in your schedule under the heading‘Excess amounts (based on driver in charge at timeof accident)’ will apply instead. Claims for misfuellingshould be supported by original receipts and a writtenreport from the specialist who drained or recoveredyour car.*Call costs may vary depending on your service providerWhat is not covered under this section.1. The sum of all policy excesses shown inthe schedule.2. More than 1,000 for loss or damage to audioequipment unless it is standard equipmentsupplied with your car at its first registration.3. Loss or damage caused by rust, corrosion, wearand tear or any loss of value includingfollowing repair.4. Loss of or damage to your car if, at the time ofthe incident, it was under the custody or control ofanyone with your permission who is not coveredunder this policy.5. Loss of excise licence or fuel.6. Any unnecessary repair or replacement whichimproves your car beyond its condition before theloss or damage took place.7. Loss or damage caused by any mechanical,electrical, computer breakdown, failure or breakage.8. More than 300 per incident in respect ofovernight accommodation.9. Damage to tyres caused by braking, punctures,cuts or bursts.10. Loss or damage arising from or in consequence ofwater freezing in the cooling circulation system ofyour car.11. Loss of use or any other loss, damage or additionalexpense, (including the cost of any alternativetransport under this section) following on fromthe event for which you are claiming, unless weprovide cover under this policy.12. Loss or damage as a result of theft, attemptedtheft, fire, lightning, or explosion under this sectionof the policy.13. the additional cost of modifications (including anychange to the fuel system) other than:a) those supplied and fitted by the manufactureror their recommended garage at the time oforiginal registration,b) any modification to accommodate a disability14. In respect of misfuelling, any claim resulting fromforeign matter entering the fuel system except fordiesel or petroleum.15. Claims for misfuelling outside theUnited Kingdom,16. Fuel, other than the 10 litres of correct fuel toreplenish the fuel tank after draining and flushingout incorrect fuel.17. Any loss or damage if at the time of the incidentyour car key, key fob or key card is under thecustody or control of anyone with your permissionwho is not covered under the policy.18. More than 2,500 in respect of loss of or damage tocar keys, key fobs, key cards or replacement locks.19. More than 300 per seat in respect of childcar seats.Section B - Fire and theftWhat is covered under this section.We will pay for loss or damage as a result of theft,attempted theft, fire, lightning or explosion to:1. Your car.2. Accessories including children’s car seats, while inor on your car.3. Audio equipment while in your car.4. Your car key, key fob or entry card or any otherdevice designed and made by the manufacturer toaccess and start your car.We may choose to replace them, to repair them or payan amount equal to the loss or damage.We will not pay more than the market value of yourcar at the time of the loss less any excesses8 of 33

Loss or damage caused by theft or attempted theftif your car was not switched off, properly locked orif any window, roof opening, removable roof panelor hood was left open or unlocked.3. Loss or damage caused by theft or attempted theftif the keys (or keyless entry system) to your car areleft unsecured or unattended, or are left in or onyour car whilst it is unattended.4. More than 1,000 for loss or damage to audioequipment unless it is standard equipmentsupplied with your car at its first registration.5. Loss of or damage to your car and its contents dueto deception or fraud.6. Loss or damage caused by theft or attempted theftif your car was taken by a member of your familyor household, or taken by an employeeor ex-employee.7. Loss or damage if any security or tracking device,which either we have required you to fit or youhave told us is fitted to your car, has not been set,is not in full working order or, the annual networksubscription for the maintenance contract of anytracking device has not been renewed.9 of 33

8. Any loss or damage due to theft unless it hasbeen reported to the police and a crime referencenumber obtained.9. Loss or damage if we have required you to fitand maintain a tracking system to your car andthe device fitted is not to TQA (Thatcham QualityAssurance) standard.10. Loss of or damage to your car if, at the time ofthe incident, it was under the custody or control ofanyone with your permission who is not coveredunder this policy.11. Loss or damage caused by rust, corrosion, wear andtear or any loss of value including following repair.12. Loss of road excise licence or fuel.13. More than 300 per incident in respect ofovernight accommodation.14. Any unnecessary repair or replacement whichimproves your car beyond its condition before theloss or damage took place.15. Loss of use or any other loss, damage or additionalexpense (including the cost of any alternativetransport under this section) following on fromthe event for which you are claiming, unless weprovide cover under this policy.16. Any loss, damage or costs from returning your carto its legal owner or arising out of its repossessionor seizure by any person or company having afinancial interest in your car.17. The additional cost of modifications (including anychange to the fuel system) other than:a) those supplied and fitted by the manufactureror their approved garage at the time oforiginal registration,b) Any modification to accommodate a disability.18. Any costs due to loss or damage to keys (orkeyless entry system) other than by theft, fire,lightning or explosion.19. Loss or damage caused by any mechanical,electrical, computer breakdown, failureor breakage.20. Any loss or damage if at the time of the incidentyour car key, key fob or key card is under thecustody or control of anyone with your permissionwho is not covered under the policy.21. More than 2,500 in respect of loss of or damage tocar keys, key fobs, key cards or replacement locks22. More than 300 per seat in respect of loss of ordamage to child car seats.Section C - Your legal liability to other peopleWhat is coveredCover for you:We will pay if you have an accident which results inyou being legally liable for: Death or injury to any person. Damage to anyone’s property - the most we willpay is a maximum of 20,000,000 (including alllegal and other expenses) for any one claim ornumber of claims arising from one cause.Caused by or whilst using:1. Your car.2. Any trailer being properly towed (in accordancewith both the law and manufacturer’s designspecifications) by your car (for which cover isprovided under this section).3. If Section 5 of your certificate of motor insuranceprovides cover for the policyholder to drive othercars, any other car driven by you, provided.a) You do not own or have not hired the car undera hire purchase or lease hire agreement.b) There is valid cover in force for the car underanother insurance policy.c) You have the owner’s permission to drive the car.d) The car is being driven in Great Britain,Northern Ireland, the Channel Islands or theIsle of Man.e) You are 25 years of age or over.f) You still own your car and it has not beendamaged beyond economic repair.g) You are not a company or firm.h) The car is being used within the limitations ofuse shown in your current certificate ofmotor insurance.Note: Cover to drive other cars only applies if shownin Section 5 of your certificate of motor insuranceand the cover provided is limited to that required bythe UK Road Traffic Acts (Third Party) only. There is nocover provided in respect of damage to the car you aredriving.Cover for other peopleOn the same basis that we cover you under thissection, we also cover:1. Any person driving your car with your permissionprovided that person is entitled to drive underSection 5 of your certificate of motor insurance “persons or classes of persons entitled to drive".2. Any person using but not driving your car withyour permission for social, domestic and pleasurepurposes.10 of 33

3. Any passenger travelling in or getting into or out ofyour car.4. The employer or business partner of anyonecovered under this section of your policy as longas the certificate of motor insurance allowsbusiness use.5. The legal personal representatives of anyonecovered under this policy in the event of thatperson’s death.Statutory emergency treatmentIn the event of an accident involving a car insuredunder this section, we will also refund any paymentsthat anyone using the car has made under the relevantroad traffic legislation for emergency treatment. (Anypayments solely for emergency treatment will notaffect your no claims discount).Defence costsIn the event of an accident involving a car insuredunder this section, we will at our discretion pay thereasonable legal costs and/or expenses to defend orrepresent you or any named driver covered bythis policy: at a coroner’s inquest or fatal accident inquiryand/or in criminal proceedings arising out of the accident.where there is a reasonable chance of success.What is not covered1. Any legal liability if any person insured under thissection does not keep to the terms, exceptions andconditions of this policy.2. Any legal liability if you are aware that any nameddriver does not hold a valid licence to drive yourcar for the purpose it is being used.3. Any legal liability if you do not take reasonablecare to ensure any named driver driving your carobserves their licence conditions.4. Legal costs and expenses incurred without ourwritten consent or related to charges connectedwith speeding, driving under the influence ofalcohol or drugs, or parking offences.5. Legal liability for anyone killed or injured while theyare working with or for the named driver or policyholder unless we must provide cover under therelevant road traffic legislation.6. More than our legal liability under the relevantroad traffic legislation if at the time of the accidentthe car you were driving is not specified in ‘Section1 - Registration mark of vehicle’, of the certificateof motor insurance.7. Property owned or jointly owned by, or in thecustody care or control of anyone insured underthis section of the policy.8. Any claim for loss or damage unless cover appliesunder section A-L of this policy.9. Any claim for loss or damage to a car being drivenunder the driving other cars extension ofthis policy.10. Any legal liability, loss or damage for any claim, ifyour car was towing a load over the legal limit atthe time of the accident.11. Any loss or damage to;a) any caravan, trailer or other vehicle,b) any contents of caravans, trailers or othervehicles whilst being towed by your car.Section D - Windscreen and window damage (This section is only included if you have comprehensive cover.)What is coveredWe will pay to repair or replace broken glass in yourcar's windscreen (including panoramic windscreens) orwindows, and any scratching to the bodywork causedsolely and directly by broken glass from a brokenwindscreen or window. We may choose to repairyour car with parts that may not have been made byits manufacturer but are of a similar standard. Anypayment for replacement of glass under this sectionwill not reduce your No claims discount, (althoughat your next renewal you will no longer be eligible forany increase in your No claims discount a
