The purpose of these rulesis to regulate game bird hunting, field trials, andcommercial shooting preserves. [Eff 9/28/81; comp11/06/99; am and comp 05/09/15] (Auth: HRS §§183D-3,183D-31, 183D-34) (Imp HRS §§183D-2, 183D-3, 183D-4)§13-122-2 Definitions. As used in these rulesunless context requires otherwise:“Archery” means the use of a bow and arrows forthe purpose of hunting."Board" means the board of land and naturalresources.“Bow” means a device which consists of flexiblematerial having a string connecting its two ends andused to propel an arrow held in a firing position byhand only, including long bow, recurve bow, orcompound bow.“Closed area” means an area within or adjacent toa public hunting area, where entry is prohibited toprevent a hazard to people or property.“Cooperative game management or cooperativehunting area" means any lands, including but notlimited to privately-owned lands or state leased lands,where the landowner or lessee has entered into anagreement with the State, granting the board authority,subject to landowner review, to engage in activitiesthat are mutually agreed upon for the purposes of gameenhancement or public hunting or both.“Crossbow” means a device which consists of a bowor curved latex material (referred to as linear bow)3

affixed to a stock that utilizes any device attacheddirectly or indirectly to the bow for the purpose ofkeeping a crossbow bolt, an arrow, or the string in afiring position.“Department" means the department of land andnatural resources.“Disabled hunter" means a hunter who has animpairment that substantially limits one or more ofthat person's major life activities.“Division" means the division of forestry andwildlife.“Dog identification” means a license, tag,microchip, tattoo, or other documentation of ownershipattached to or worn on a dog, which is registered withthe county of ownership.“Field trial" means the judging of performance offield dogs in locating, holding, and retrieving gamebirds released for such purposes.“Game birds" means those birds designated by lawor rule for hunting.“Hunter" means a person who pursues with themeans to take, kill, or capture game animals incompliance with this chapter. In public hunting areasa person who has the appropriate hunting license,stamps, tags, permits, or permit tags on their personis deemed to be a hunter.“Hunter assistant" means a person who accompaniesa hunter and assists by carrying game or unloadedfirearms or archery equipment. Hunter assistants maynot have ammunition or arrows in their possession.“Hunting" means the act of pursuing with themeans to take, kill, or capture game birds incompliance with this chapter.“Means of take” refers to any device or set ofdevices capable of killing game animals; also referredto as hunting gear or hunting methods.“Muzzleloading firearm" means a shotgun that mustbe loaded through the discharge end of the firearm orthe barrel and that employs flint or percussionignition. Muzzleloading shotguns must have a shoulderstock and a barrel. The length of the barrel must beat least eighteen inches.4

“Private land" means those lands that are notstate-owned, where hunting for game birds occurs.“Public highway" means any roadway that is underthe jurisdiction of the Hawaii state department oftransportation or any of the counties. Access roads onpublic hunting areas that are maintained by thedepartment of land and natural resources are notconsidered to be public highways.“Public hunting area" means those landsdesignated by the board as public hunting areas wherethe public may hunt game birds, including:(1) Game management areas;(2) Forest reserves and surrendered lands;(3) Natural area reserves;(4) Restricted watersheds;(5) Cooperative game management areas;(6) Military training areas;(7) Unencumbered state lands;(8) Designated sanctuaries; and(9) Other lands designated by the board.“Safety zone" means an area within or adjacent toa public hunting area, where possession or dischargeof a loaded firearms or archery equipment isprohibited to prevent a hazard to people or property.“Senior citizen" means a person who is sixty-fiveyears of age or older.“Youth hunter" as it pertains to specificallydesignated youth hunts, means a hunter who is fifteenyears of age or younger, who possesses a valid Stateof Hawaii hunting license. Youth hunters must beaccompanied by a non-hunting adult, who also possessesa valid State of Hawaii hunting license. These rules aredeclared to be severable and if any portion or theapplication thereof to any person or property is heldinvalid for any reason, the validity of the remainder5

The Board or itsauthorized representative may issue permits to conductactivities otherwise prohibited by this Chapter. A person may hunt,kill, or have in their possession any game bird onlywith a valid hunting license from the department andonly as provided by this chapter and the followingexhibits which are located at the end of this chapterand by reference made a part hereof:(l) Chapter 122, Exhibit 1, "Game birds to betaken, daily bag limits, hunting periods,hunting days, and special conditions forhunting on the island of Hawaii" 10/2013;(2) Chapter 122, Exhibit 3, "Game birds to betaken, daily bag limits, hunting periods,hunting days, and special conditions forhunting on the Island of Maui" 04/2013;(3) Chapter 122, Exhibit 5, "Game birds to betaken, daily bag limits, hunting periods,hunting days, and special conditions forhunting on the Island of Molokai" 04/2013;(4) Chapter 122, Exhibit 7, "Game birds to betaken, daily bag limits, hunting periods,hunting days, and special conditions forhunting on the Island of Lanai" 05/2014;(5) Chapter 122, Exhibit 9, "Game birds to betaken, daily bag limits, hunting periods,hunting days, and special conditions forhunting on the Island of Oahu” 04/2013; and6

Bag limits, open seasons, hunting days, specialconditions for hunting, and game birds that may behunted are listed in Exhibits 1, 3, 5, 7, 9, and 11,located at the end of this chapter and by referencemade a part hereof. (a) The boardor its authorized representative shall have theauthority to limit the number of hunters and todetermine eligible hunters or assign hunting datesthrough a random selection method.(b) The board or its authorized representativewill follow policies and procedures for the fair andequitable selection of eligible hunters including, butnot limited to, the following procedures:(1) Random drawing;(2) Telephone reservations; and(3) Other appropriate methods.(c) These administrative policies and proceduresreferenced in subsection (b)(1), (2), and (3) will beavailable as public information. §13-122-5.1 Applications, permits, tags, andstamps. (a) The department shall have the authority torequire application forms for the selection of hunters.Exhibit 13, entitled “Fees for hunting licenses,wildlife stamps, applications, and tags for hunts,including special or lottery hunts” (07/2010), locatedat the end of this chapter and by reference made apart hereof, identifies and sets the costs forwildlife stamps, applications, and tags required forhunts, including special or lottery hunts. Thedepartment shall have the authority to determine themanner in which such wildlife stamps, permits, or tagsare to be affixed, displayed, or utilized.(b) The department shall have the authority tocontract with an individual or a commercial stamp artfirm to design, print, and provide said stamps to thedepartment at no cost to the State. Further, thecontracted party or firm, as consideration forproviding the stamps to the department, upon approvalof the board may produce and offer for sale, artprints of the selected wildlife stamp artwork andother products that display copies or replicas of thatsame artwork. Royalties or fees or both shall be paidto the department from such sales, which shall bedeposited into the department's wildlife revolvingfund.(c) The department shall have the authority toestablish specific qualifications for disabled huntersin accordance with national and state standards, andto issue permits for disabled hunters which areconsistent with existing disability definitions, rules,and statutes. The hunting of the following game birds ispermitted with a valid hunting license and in8

accordance with Exhibits 1, 3, 5, 7, 9, and 11 and theprovisions of this chapter:(l)Ring-necked Pheasant (Phasianus colchicusvar.);(2)Melanistic mutant(blue) Pheasant(Phasianusspp.);(3)Green Pheasant (Phasianus versicolor);(4)Kalij Pheasant (Lophura leucomelana);(5)California Quail (Callipepla californicus);(6)Gambel's Quail (Callipepla gambelii);(7)Japanese Quail (Coturnix coturnixjaponica);(8)Spotted Dove (Streptopelia chinensis);(9)Barred Dove (Geopelia striata);(10) Mourning Dove (Zenaida macroura);(11) Chestnut-Bellied Sandgrouse (Pteroclesexustus);(12) Chukar Partridge (Alectoris chukar);(13) Gray Francolin (Francolinus pondicerianus);(14) Black Francolin (Francolinus francolinus);(15) Erckel's Francolin (Francolinus erckelii);(16) Wild Turkey (Meleagris gallopavo); and(17) Other game birds the division may establishand designate. No person shall hunt, kill, or have in theirpossession any game birds not authorized by thedivision. §13-122-8 Hunting hours. Hunting is permittedfrom one-half hour before sunrise to one-half hourafter sunset for all legal game birds unless otherwisedesignated. No person shall hunt during the periodfrom one-half hour after sunset to one-half hourbefore sunrise. Huntingon private lands requires a valid State of Hawaiihunting license and the permission of the landowner.This is provided for in Exhibits 1, 3, 5, 7, 9, and 11,under Special Conditions and Restrictions, located atthe end of this chapter and by reference made a partthereof. [Eff and comp 05/09/15] (Auth: §183D-26)§13-122-9 Mourning doves. Mourning doves areconsidered migratory birds and subject to conditionsset by federal regulations (Title 50, Code of FederalRegulations, Part 20.21). The following conditionsand restrictions to the hunting of mourning doves arefrom the federal regulations:(l) Only shotguns, not larger than No. 10 gaugeand incapable of holding more than threeshells, using BB or smaller shot, or bowsand arrows are permitted;(2) Rifle-shotgun combination firearms andarrows equipped with explosive heads orheads containing drugs or poison areprohibited;(3) Bird calls may be used except for recordedor electrically amplified bird calls orsounds;(4) Mourning doves may be taken on or overstanding crops or over lands where grain orother crop residue remains as a result ofvalid agricultural operations or procedures;10

(5)(6)(7)The use or aid of live birds as decoys isprohibited;One fully-feathered wing must remainattached to each mourning dove while beingtransported by any means; andNo person shall have in their possessionmore than ten mourning doves, while they arein the hunting area.[Eff 9/28/81; am and comp 11/06/99; am andcomp 05/09/15] (Auth: HRS §183D-3) (Imp:HRS §§183D-3, 183D-32; 50 CFR §20.21)§13-122-9.1 Nuisance or crop damage. (a) Theboard or its authorized representative, upon receiptof written notice of nuisance or damage to crops,vegetative habitat, or native plants by game birds,shall initiate an investigation of the damage ornuisance and, based on the investigation, may issue apermit or permits authorizing the destruction orcontrol of game birds responsible for the damage ornuisance.(b) The method of destruction or control shallbe stated on the permit together with any other termsand conditions the board or its authorizedrepresentative may deem proper and applicable. (a)Authorized employees or agents of the division maytake game birds for scientific, educational, andpropagation purposes approved by the board.(b) The board or its authorized representative,upon receipt of written requests or applications, mayissue permits or licenses to scientific or educationalinstitutions or individuals to collect a designatednumber of game birds for purposes approved by the11

Any person violating any ofthe provisions of this subchapter shall be subject tocriminal and or administrative penalties as providedin section 183D-5,171-6.4 or 171-31.6, Hawaii RevisedStatutes. (a)Unit C on the island of Maui (Exhibit 4) consists of:(1) A portion of the Kula Forest Reserveincluding nine hundred forty acres ofKaonoulu Ranch connecting the northern andsouthern portions of the Kula Forest Reservemaking it a contiguous unit; and(2) The Kahikinui Forest Reserve.(b) Unit F on the island of Maui (Exhibit 4)consists of the Kahakuloa Game Management Area andportions of the West Maui Forest Reserve. [Eff9/28/81; am and comp 11/06/99; am and comp 05/09/15](Auth: HRS §183D-3) (Imp: HRS §183D-4)§13-122-11.3 Public hunting areas on Molokai.(a) Unit C on the island of Molokai (Exhibit 6)consists of the portions of the Molokai Forest Reservewhich are included in Kalawao County.(b) Unit D on the island of Molokai (Exhibit 6)consists of the Molokai Forest Reserve or lands ofMakakupaia West, Kalamaula, Kahanui, and Kaunakakai,which lie north of the Maunahui Forest Access Road andeast of Kalahuapeo to Makakupaia along the commonboundary fence of The Nature Conservancy-KamakouPreserve and the Molokai Forest Reserve Boundary.(c) Unit E on the island of Molokai (Exhibit 6)consists of the Molokai Forest Reserve lands of Kawela,Makakupaia, Kamiloloa, Kapaakea, and Kaunakakai, makai(south) of the Maunahui Forest Road. §13-122-11.4 Public hunting areas on Lanai. (a)All units are part of a Cooperative Game ManagementArea leased from the private landowner. Conditions forentry into the units and public use conditions for thehunt are subject to landowner’s review. Unit 1 on theisland of Lanai (Exhibit 8) consists of the portion ofthe Lanai Cooperative Game Management Area bounded bythe fifty foot safety zone along Polihua Road to thenorth, the Guard Road to the east, the five hundredfoot safety zone at Kaumalapau Highway to the south,and the coast to the west, with the exception of thethree hundred foot Safety Zone mauka of the coast fromPolihua Road to Kaena Point.(b) Unit 2 on the island of Lanai (Exhibit 8)consists of the portion of the Lanai Cooperative GameManagement Area bounded by the three-hundred footSafety Zone along the coast to the north, the fivehundred foot safety zone at Keomuku and the fifty footsafety zone along Polihua Roads to the west and east,respectively, the western boundary of Kanepuu Preserveto the east, and with the southern boundary extendingfrom the entrance to Kanepuu Forest parallel to theGuard Road to the horse pasture fence line, andcontinuing along the fencing of the pasture to thesouth end of Keamuku Road.(c) Unit 3 on the island of Lanai (Exhibit 8)consists of a portion of land on the eastern side ofUnit 1. The eastern boundary of Unit 3 follows along“No. 57 Road” off the Kaumalapau Highway northward toPaliamano Gulch, and continues along the cattle fenceline to the fence intercept with the “Guard Road,”with the southern boundary being along the KaumalapaHighway.(d) The seven units of the Kanepuu Preserveoperated by The Nature Conservancy of Hawaii areexcluded from the Lanai Cooperative Game ManagementArea. §13-122-11.5 Public hunting areas on Oahu. (a)Unit 1 on the island of Oahu (Exhibit 10) consists ofthe Kuaokala Game Management Area and the KuaokalaForest Reserve, and a portion of the Mokuleia ForestReserve west of the paved road leading from PeacockFlats to the Old Radar Station.(b) Unit 2 on the island of Oahu (Exhibit 10)consists of a portion of the Makua-Keaau ForestReserve.
