Homeowner’s insurance policyThis document contains all the terms of your insurance contract (Policy) between Standard Insurance Limited(Us) and You, the Policyholder.The Certificate of Insurance is proof of this Policy. It makes up your insurance contract together with thisPolicy, and any certificate of insurance or other terms. We may communicate with You in letters or phone calls.Please make sure that You read and understand all the documents and check that all details are correct.The quality of the construction of your home is the responsibility of the seller (or builder and/or developer)and yourself as the buyer. But it is also very important for You to make sure that your property has nostructural or other problems, which may be difficult to see during an ordinary inspection. If You want to makechanges to the property or need to fix any problems, You should find out about the costs and any municipalregulations that apply. We suggest You get advice from suitable professionals to make sure You are buying ahome and not a headache. This policy will not cover such structural defects.We have put notes in this document in blue italics to help You understand all the terms of this Policy.We have put defined words and important terms in bold print.Please read your Policy and Certificate of Insurance carefully. DefinitionsIn this Policy and any related documents, certainwords have the meanings below.FamilyMeans all relatives living in the same household andtheir domestic helpers.GroupDefinitions of other words appear in the textwhere applicable.Means Our affiliates, associates, subsidiaries anddivisions together with Our holding company and theaffiliates, associates, subsidiaries and divisions of Ourholding company.AbandonedHeat pumpMeans that You or Your legal tenant has moved out ofa building and nobody is looking after it.Means domestic air source water heating heatpump system.Accidental DamageIndemnityMeans sudden and unexpected loss of or damage toproperty that is not directly or indirectly caused by anevent We cover or exclude. Not done on purpose.Means your right to be restored as closely as possibleto your financial position before the insured losshappened, as long as the sum insured is enough.Active SoilsInsured PropertyMeans soil that expands or shrinks because itsmoisture content increases or decreases. Thishappens in soil or rock with a lot of clay in it.Means the physical structure of your privateresidence and domestic outbuildings at the RiskAddress in your Certificate of Insurance. Thestructure must be built according to National BuildingRegulations and as shown in your Certificate ofInsurance. It must also comply with SANS regulations.Certificate of InsuranceMeans a document issued by the insurance companyto prove the existence of an insurance Policy.It states the type of cover, the value of cover, thecommencement date of the Policy and theInsured Property.LandslipMeans that soil supporting or supported by anybuilding moves sideways and downwards.CoverMaintenanceMeans benefits offered in terms of this Policy to thePolicyholder in exchange for a premium.Means keeping an Insured Property in good conditionby checking it regularly and repairing it when needed.Dual InsuranceMalicious damageMeans there is more than one Policy with differentinsurers covering the same object or property andloss at the same time.Means something done on purpose or deliberatelywith the aim of causing damage.ExcessMeans The Standard Bank of South Africa Limitedor another financial institution with a bond over theInsured Property. The Mortgagee’s rights are strongerthan Your own rights until You pay back all the moneyYou owe it.Means the first amount of every claim that Youmust pay.FAIS ActMeans the Financial Advisory and IntermediaryServices Act, 37 of 2002, as amended from time totime and including subordinate legislation.6MortgageePersonal InformationMeans information relating to an identifiable,natural or juristic person, including but not limitedto, information relating to race, gender, sex, maritalstatus, nationality,ethnic or social origin,colour, sexual orientation,age, physical or mentalhealth, religion, belief, disability,language, birth, education, identitynumber, telephone number, email, postalor street address, biometric information andfinancial, criminal or employment history as well ascorrespondence sent by the person that is implicitlyor explicitly of a private or confidential nature orfurther correspondence that would reveal thecontents of the original correspondence.PipeMeans the hot and cold clean water supply pipingfrom the main supply installed in the InsuredProperty, including the overflow pipes associatedwith the geyser installation, excluding irrigation pipes.PolicyMeans the legal document containing the terms ofyour insurance cover.PolicyholderMeans the person in whose name the Certificate ofInsurance is issued. The mortgagee may also be aPolicyholder while it has a mortgage bond overthe land.ProcessMeans any operation or activity, whether automatedor not, concerning Personal Information, including:collection; receipt, recording; organisation; collation;storage; updating or modification; retrieval; alteration;consultation; use; dissemination by meansof transmission, distribution or making available inany other form; merging, linking, as well as blocking,degradation, erasure or destruction of information.Processing will have a similar meaning.RejectionMeans We refuse to pay Your claim or part ofYour claim.Risk AddressMeans the address on the Certificate of Insurance.SettlementMeans the gradual downward movement of theground due to the weight of the building, which isthe wholly natural effect of applying a load on theground and is predictable.Solar Water Heating (SWH) SystemMeans a system for heating water using the energyof the sun. A solar water heating system consists ofa solar tank, solar collector (flat plate or evacuatortube), thermal lagged piping and fittings related tothem, TP valve, ball and relief valves, safety valve,anode, vacuum breakers, thermostat, SANS approvedtimer and anti-freeze.7

SubsidenceMeans that the ground that supports or is supportedby a building moves downwards for any reasonexcept settlement.General TermsPlease read these terms carefully because You mustalways follow them.Sum insured1.Means the full stated cost of replacing or rebuildingthe building on the Certificate of Insurance. Thereplacement value includes the cost of rebuilding allbuildings with new materials at today’s prices. It alsoincludes professional fees.This Policy and your Certificate of Insurance must beread together as if they are one document.TheftMeans dishonestly taking the property of someoneelse with the intention of never giving it back tothe owner.Interpretation Explanatory notes (inserted in blue italics) do notaffect the meaning of the Policy. Words defined in this Policy have no othermeaning unless clearly changed or limited byother words in the Policy.2.Your adherence to the termsMeans without people staying in or using the InsuredProperty for at least 30 days in a row.Our liability (responsibility) depends on You followingthe Policy terms. This means We will not have to payYour claim if You do not keep to the terms ofYour Policy.Vacant3.Means that nobody lives in or uses the building, orthat somebody uses the building withoutYour permission.We will reject any claim under this Policy that isfraudulent (dishonest) in any way. It is fraud if Youuse any dishonest method to get any benefit underthis Policy, or if someone does this for You. It is alsofraud to cause or allow any insured event to happenon purpose.UnoccupiedWater ApparatusMeans any of the following if permanently fixed tothe building: reservoirs water tanks geysers fixed fish tanks toilet cisterns fixed water purifiers.4.Deliberate or fraudulent actChange of riskYou must tell Us within 30 days about: any change in circumstances that could affect therisk of loss, damage, injury or liability; any additions or alterations (changes) to thebuilding structure; and any change of use if the building is not used fordomestic purposes.We, Us or Our5.Means the insurer, Standard Insurance Limited.You must be careful and take reasonable steps toprevent or reduce any loss, damage, accident, injuryor liability (legal responsibility).You or YourMeans the Policyholder whose name is on theCertificate of Insurance. This can include anycompany, close corporation, trust, or any of theirdirectors, shareholders, trustees or beneficiaries,where this applies.8Preventing lossInsurance does not cover the cost of homeMaintenance or security.Examples of your responsibilities include: regularly inspecting your building and repairinganything needed to prevent a loss or damage tothe Insured Property; and paying to remove any tree that presents adanger to any property.6.How to claim (what You must do)6.1You must tell Us within 30 days if Youknow about any event that will, or is likelyto result in a claim. As soon as possibleafter telling Us, You must give Us: details about any other insurance covering thesame event; details of the event; any proof, document, information or swornstatement We ask for; documents or details of communicationsYou receive about a claim; and any assistance. We may require to obtainsettlement from any other party.6.2 You must not agree, admit, confirm, offer,promise, pay or guarantee anythingto another person without Ourwritten permission.6.3 You must report any theft, Maliciousdamage (vandalism) or vehicle accident tothe South African Police Services (SAPS)within 24 hours or as soon as You knowabout the incident.6.4 You must give us an SAPS case number oraccident report number.7.Subrogation (transfer of rights)We may take over your rights related to any claim Wecover. This means We may pursue, defend or settlerelated claims and use Your name for this.8.8.1Rejection (of claims) and disputesabout thisIf We reject Your claim or do not agreewith the value of Your claim and You areunhappy with this, You may do thefollowing within 90 days from receipt ofYour rejection letter: ask Our management to reconsider Your claim; or write to The Ombudsman for Short-TermInsurance, PO Box 32334, Braamfontein, 2017.8.2 If You remain unhappy after We havereconsidered Your claim You may take legalaction against Us but it must be within6 months from the end of the 90 daysmentioned above.8.3 You will lose Your rights to claim if You do nottake legal action in time (within six monthsfrom the end of the 90 days mentionedabove). This means We will not have to payYou anything.9.JurisdictionWe will accept the decision of the Ombudsman forShort-Term Insurance.This Policy is subject to the jurisdiction of theSouth African courts.Legal action about this Policy must be taken inSouth Africa.10. More than one Policy covering thesame risk insured by this Policy(Dual Insurance)In the case of Dual Insurance We will be liable onlyfor Our proportionate share. Since We are to paya proportionate share of claims occurring duringthe period of Dual Insurance, We will refund You aproportionate share of the premiums paid from thedate of Dual Insurance as long as We have not paidany claims during the Dual Insurance period. It is Yourduty to inform Us as soon as You become aware ofthe Dual Insurance.11. Cancellation or changes ofyour Policy11.1 You must tell Us about any changes in Yourpostal address where You want Us to sendall letters about your Policy or anyclaims information.11.2 We may change, cancel or endorse thePolicy by giving you 30 days notice inwriting to the latest email or postal addressWe have for You.Notice will be sent to your last-known address.11.3 You must write to Us 30 days before You cancelthis Policy. You may only cancel the Policy with theMortgagee’s written permission.9

12. Personal Information12.1 We may and You expressly consent to thecollecting and Processing of Your PersonalInformation by Us, to: Administer Your Policy; Provide any combination of services, analysis,advice or intermediary service linked to YourPolicy, to You; Monitor and analyse Your conduct relating tothe Policy for fraud, compliance and other riskrelated purposes; Carry out statistical and other analysis to identifypotential markets and trends; and Develop new products and services.12.2 You hereby expressly consent that We may: Process and further Process your PersonalInformation within the group for the abovepurposes; Disclose your Personal Information to any personwho provides services to Us or acts as Our agentor to whom We have transferred or purpose totransfer any of Our rights and duties in respectof Your Policy. Some of these persons may belocated in countries outside of the Republic ofSouth Africa; and Share Your Personal Information with Our serviceproviders, locally and outside South Africa, asnecessary. We ask persons who provide servicesto Us to agree to Our privacy policies if theyneed access to any Personal Information to carryout their service.12.3 You acknowledge that: We will at all times remain responsible fordetermining the purpose of and means forProcessing your Personal Information; We are required by various laws, includingthe FAIS Act, to collect some of your PersonalInformation; Without your Personal Information We may beunable to open or continue to offer services toYou; and You are providing Us with Your PersonalInformation voluntarily.12.4 Our address is stated in the serviceaddress clause in the Policy.13. Riot and strike damage cover,including political violenceWe have arranged cover for You with the SouthAfrican Special Risks Insurance Association(SASRIA). This covers You for damages causedby terrorism, riots, strikes, public disorder andpolitical violence.14. SalvageIf We pay You for a total loss of Your Insured Property,We will own the salvage (whatever We can recover)and any sale proceeds from the property. This alsoapplies if We pay You for constructive totalloss (where damaged property cannot beeconomically repaired).15. Solar Water Heating (SWH) systemsWe will pay You the cost of replacing or repairing Yoursolar water heating system if it bursts or is damagedby an insured event.A certified and accredited plumber and electricianwho issued certificates of compliance must haveinstalled the entire solar water heating system.The system’s solar tank and collector must have: been approved by the South African Bureau ofStandards (SABS); had a 10 year (or longer) manufacturer’swarranty; and been operated and maintained according to themanufacturer’s warranty.All parts must comply with the following SouthAfrican National Standards (SANS) standards forsolar water heating systems: SANS 1307:2009 – domestic solar waterheaters. SANS 10101 – the installation, Maintenance,repair and replacement of domestic solar waterheating systems, edition three. ISBN 0-62617636-0. SANS 10252 – part 1 – Water supply anddrainage for buildings. Part 1 Water supplyinstallation for buildings. SANS 10254 – the installation, Maintenance,replacement and repair of fixed electric storagewater heating systems. SANS 10400 – the application of nationalbuilding regulations.16. Own service providerWe have the right to require that a service providerof Our choice do any work required on the InsuredProperty. If You ask to use a service provider ofyour choice, We will not be responsible for anyamount above of the amount quoted by Our serviceprovider. This means You will be paid out accordingto Our set rates.17. ValuationAlthough the property was evaluated, thepurpose of the evaluation was to determine thatthe property was sufficient as security for theMortgagee. The valuation does not guarantee thatthe property is free of defects or that the propertyis built according to building regulations.It is Your responsibility to ensure that the suminsured is adequate to cover the replacement costof the Insured Property.18. Payment of the ExcessYou will be responsible for paying the applicableExcess to the service provider before the start ofany repairs when asked to do so by the serviceprovider appointed by Us.In the event of any claim requiring You to pay twoseparate Excesses, You will be responsible for thepayment of the Excesses before the start of therepairs to each service provider if more than oneservice provider is involved or for the accumulativeamount if one service provider is involved.19. Interest on damagesWe will pay no interest on any amount due in termsof this Policy, except by order of a competent court.20. Period of graceYou are entitled to a period of 30 days from thepremium due date in which to pay Your outstandingpremium. The Policy will be cancelled if premiumsare not paid for two consecutive months.21. Reinstatement of sum insuredThe sum insured will no
