ARTICLE 1. GENERAL PROVISIONSSECTION 7000. AUTHORITY AND CITATIONThe County Subdivision Regulations are adopted to supplement and implement theSubdivision Map Act, Section 66410, et seq., of the Government Code of the State ofCalifornia (hereafter “Map Act”), and may be cited as the Subdivision Regulations of theCounty of San Mateo.SECTION 7001. PURPOSEIt is the purpose of the County Subdivision Regulations to regulate and control thedivision of land, the movement of property lines between parcels, the removal ofparcel property lines, and the determination of parcel legality within the unincorporatedterritory of San Mateo County.In addition, through these Subdivision Regulations it is the County’s intention:1.To protect and preserve the public health, safety, and general welfare, tofacilitate orderly growth and development, and protect natural resources.2.To provide for the regulation and control of the design and improvement ofsubdivisions and the dedication of such improvements for public purposes inorder to ensure the provision of adequate traffic circulation, utilities and services,and other infrastructure.3.To protect the public and individuals from potential fraud and exploitationresulting from the improper division of real property.4.To implement the goals and policies of the County General Plan, Local CoastalProgram, and adopted area plans.SECTION 7002. APPLICABILITYThe requirements set forth in the Subdivision Regulations apply to all or parts ofsubdivisions within the unincorporated territory of the County of San Mateo. Everyperson, firm, corporation, partnership, or association seeking to subdivide land withinthe unincorporated territory of San Mateo County will be is subject to the provisions ofthese Subdivision Regulations, except as provided in Section 7003, below.SECTION 7003. EXCLUSIONSThe County Subdivision Regulations do not apply to any of the following:1.The financing or leasing of apartments, offices, stores or similar space withinapartment buildings, industrial buildings, commercial buildings, mobilehome parks,1.2Exhibit ALCP-2-SMC-18-0036-1-Part B5 of 209

or trailer parks.2.The financing or leasing of existing separate commercial or industrial buildings ona single parcel.3.The financing or leasing of any parcel of land, or any portion thereof, inconjunction with the construction of commercial or industrial buildings on a singleparcel, unless the project is not subject to review under any other provisions of theCounty Ordinance Code regulating site design and improvement.4.The construction, financing or leasing of a second unit, authorized pursuant toChapter 22.5 of the County Zoning Regulations, but the Subdivision Regulationsdo apply to the sale or transfer, but not leasing, of such units where the sale ortransfer does not include the entire site upon which the second unit is located. Forpurposes of this section, “second unit” includes, but is not limited to, a “grannyunit” as defined in State Government Code Section 65852.1.5.Mineral, oil, or gas leases.6The leasing of, or the granting of an easement to, a parcel of land, or any portionor portions thereof, in conjunction with the financing, erection, and sale or lease ofa wind-powered electrical generation device on the land, if the project is subject todiscretionary action by the Advisory Agency or legislative body.7.Leases of agriculturally zoned land to nonprofit organizations for the purpose ofoperating an agricultural labor housing project on the property if all of the followingconditions apply:a.The property to be leased shall not be more than five acres.b.The lease shall be for not less than 30 years.c.The lease shall be executed prior to January 1, 2017.78.Land dedicated for cemetery purposes under the Health and Safety Code of theState of California.89.Boundary line or exchange agreements to which the State Lands Commission ora local agency holding a trust grant of tide and submerged lands is a party.9.10. A division creating four (4) or fewer parcels for construction of removablecommercial buildings having a floor area of less than one hundred (100) squarefeet.1011. Any separate assessment under Section 2188.7 of the Revenue and TaxationCode.1.3Exhibit ALCP-2-SMC-18-0036-1-Part B6 of 209

1112. Unless a parcel or final map was approved by the Board of Supervisors, theconversion of a community apartment project, as defined in Section 11004 of theBusiness and Professions Code, to a condominium, as defined in Section 783 ofthe Civil Code, but only if all of the following requirements are met:a.At least seventy five (75) percent of the units in the project were occupiedby record owners of the project on March 31, 1982.b.A final or parcel map of the project was properly recorded, if the propertywas subdivided, as defined in Section 70098, after January 1, 1964, with allof the conditions of that map remaining in effect after the conversion.c.The County certifies that the above requirements were satisfied.1213.Unless a parcel or final map was approved by the Board of Supervisors, theconversion of a stock cooperative, as defined in Section 11003.2 of the Businessand Professions Code, to a condominium, as defined in Section 783 of the CivilCode, but only if all of the following requirements are met:a.At least fifty one (51) percent of the units in the cooperative were occupiedby stockholders of the cooperative on January 1, 1981, or individuallyowned by stockholders of the cooperative on January 1, 1981. As used inthis paragraph, a cooperative unit is “individually owned” if and only if thestockholder of that unit owns or partially owns an interest in no more thanone unit in the cooperative.b.No more than twenty five (25) percent of the shares of the cooperativewere owned by any one person, as defined in Section 17, including anincorporator or director of the cooperative, on January 1, 1981.c.A person renting a unit in a cooperative shall be entitled at the time ofconversion to all tenant rights in State or local law, including, but not limitedto, rights respecting first refusal, notice, and displacement and relocationbenefits.d.The County certifies that the above requirements were satisfied.SECTION 7004. CONFORMITY WITH OTHER COUNTY PLANS AND ORDINANCESNothing contained in the Subdivision Regulations relieves any person from therequirement to comply with any other ordinance of the County. The provisions ofthese regulations shall supplement and facilitate the County Zoning and BuildingRegulations.1.4Exhibit ALCP-2-SMC-18-0036-1-Part B7 of 209

SECTION 7005. CONSIDERATION OF REGIONAL HOUSING NEEDSIn carrying out the provisions of the Subdivision Regulations, the County shall considerthe effect of actions taken pursuant to these regulations on the housing needs of theregion and the housing needs in the County as expressed in the Housing Chapterof the County’s General Plan and balance these needs against the public serviceneeds of residents. When considering allocation of scarce resources such aspotable water supply or sanitary sewer service, priority shall be given to projectscontaining affordable housing.SECTION 7006. TIME LIMIT FOR ACTION AGAINST COUNTY; JUDICIAL REVIEWAny action or proceeding to attack, review, set aside, void or annul the decision orproceedings of the County concerning a subdivision, or to determine thereasonableness, legality or validity of any condition attached to approval of asubdivision, must be commenced and service of summons effective within ninety (90)days after the date of such decision. Thereafter all persons are barred from any suchaction.SECTION 70076. SEVERABILITYThe provisions of the Subdivision Regulations are severable. If any section,subsection, sentence, clause or phrase of these regulations is for any reason held tobe invalid, the decision will not affect the remaining portions of the regulations.SECTION 70087. DESIGNATION OF ADVISORY AGENCY1.Planning CommissionThe Planning Commission is hereby designated as the Advisory Agency for alldiscretionary decisions under the Subdivision Regulations, except those delegatedto the Planning Community Development Director or Board of Supervisors, asspecified in Sections 70087.2 and 3, below. The Planning Commission shallhave the power to:a.Approve, conditionally approve or disapprove all major subdivisions.b.Approve, conditionally approve or disapprove minor subdivisions when:c.(1)Located within a scenic corridor or agricultural preserve;(2)An Environmental Impact Report (EIR) is required; and(3)Other permits requiring Planning Commission action are involved.Approve, conditionally approve, or disapprove, for subdivisions specified in1.5Exhibit ALCP-2-SMC-18-0036-1-Part B8 of 209

(a) and (b), above: (1) vesting maps; (2) extensions; and (3) exceptions todesign, improvement and exaction requirements.Planning CommunityDevelopment Directord.The Planning Community Development Director is hereby designated asthe Advisory Agency for certain decisions under the Subdivision Regulationsas specified herein. The Planning Community Development Directorshall have the power to approve, conditionally approve or disapprove:(1)All minor subdivisions, except those specified in Section 70087.1b,above.(2)For subdivisions specified in (1), above: (a) vesting tentative parcelmaps; (b) extensions; and (c) exceptions to design, improvement andexaction requirements.Voluntary Parcel Mergers and Unmergers, Lot Line Adjustments and Certificates ofCompliance in accordance with Chapters 9, 10 and 11, respectively.2.a.The Planning Community Development Director is also authorized toinitiate Parcel Mergers and Notices of Violation on behalf of the County inaccordance with Chapters 9 and 11, respectively.b.The Planning Community Development Director may refer any actionhe/she is authorized to take under this in sSection 7007.2 to the PlanningCommission for action if it includes a related permit request for whichthe Planning Commission has discretionary authority, or in his/heropinion, it is in the public interest to refer the action.c.Pursuant to Section 6104 of the County Zoning Regulations, the PlanningCommunity Development Director is also the Zoning Administrator, whomay appoint in writing an assistant to act as the Zoning Hearing Officer, whomay exercise all of the powers of the Zoning Administrator. Such powersinclude those delegated to the Planning Community DevelopmentDirector, as specified in Section 7008.2, above.Board of SupervisorsThe Board of Supervisors shall have the power to approve, conditionallyapprove or disapprove Reversions to Acreage in accordance with Chapter 8.ARTICLE 2. DEFINITIONSSECTION 70098. DEFINITIONS1.Advisory Agency1.6Exhibit ALCP-2-SMC-18-0036-1-Part B9 of 209

A designated official or an official body charged with making investigations andreports on the design and improvements of proposed subdivisions of real property,imposing requirements or conditions thereon, and having the authority to approve,conditionally approve, or disapprove subdivision maps. The Advisory Agency forSan Mateo County is the Board of Supervisors, Planning Commission, or thePlanning Community Development Director, as set forth in Section 70087 of theSubdivision Regulations.2.Affordable HousingHousing with a contract price or rent which is affordable by very low, lower, ormoderate income households; income levels area as established at periodicintervals by resolution of the Board of Supervisors.43.Agricultural and Floricultural Non-Residential Accessory Structures and UsesUses and structures including barns, storage/equipment sheds, enclosures forfarm animals, water wells and covers, pump houses, water storage tanks, waterimprovements, water pollution control facilities for agricultural purposes and othersimilar uses determined to be appropriate by the Planning CommunityDevelopment Director.34.Agricultural and Floricultural UsesActivities including the cultivation of plants for food and fiber; livestock pasturing,grazing and growing; the cultivation of plants and flowers for ornamental purposes;and other similar uses determined to be appropriate by the Planning CommunityDevelopment Director.5.AlleyA public or private street primarily designed to serve as secondary access to theside or rear of properties whose principal frontage is on another street.6.Appeal BoardA designated board or other official body charged with the duty of hearing andmaking determinations upon appeals with respect to divisions of real property, theimposition of requirements or conditions thereon, or the kinds, nature and extent ofthe design or improvements, or both, recommended or decided to be required bythe Advisory Agency or official. For San Mateo County, the Planning Commissionserves as the Appeal Board for determinations or decisions made by the PlanningCommunity Development Director or Zoning Administrator; the Board ofSupervisors serves as the Appeal Board for determinations or decisions made bythe Planning Commission.1.7Exhibit ALCP-2-SMC-18-0036-1-Part B10 of 209

7.Area PlanA policy document that guides decisions about the physical development of aspecific community or district. Area plans are also known as community orneighborhood plans and are considered to be part of the General Plan.8.Arm’s Length TransactionA transfer of real property characterized by all the following:89.a.sale price at fair market value;b.transfer to someone other than a close relative (by blood or marriage)or a business associate;c.no retention of control or financial interest by the seller;d.all parties clearly act in their own self-interest and are not subject topressure or duress from another party; ande.generally, a transfer not a part of or related to any conspiracy to evadethe Subdivision Map Act.BikewayA pathway designed to be used by bicycle riders.910. BlockA unit of land bounded by streets or by a combination of streets and public land,railroad right-of-way, waterways or any other barrier to the continuity todevelopment.1011. Board of SupervisorsThe Board of Supervisors of the County of San Mateo. As the County’s legislativebody, the Board of Supervisors has final authority on the appeal of any subdivisiondecision for the unincorporated area.1112. BridgeA structure spanning and providing passage over a waterway, railway, freeway,roadway, or canyon.1213. CEQAThe California Environmental Quality Act of 1970 (Public Resources Code1.8Exhibit ALCP-2-SMC-18-0036-1-Part B11 of 209

Section 21000 et seq.) and the Guidelines for the Implementation of CEQA(Administrative Code Section 15000 et seq.) as they have been or maysubsequently be amended, including all amendments thereto.1314. Certificate of ComplianceA written statement, issued by the County upon request of a property owner orvendee, stating that a parcel of real property complies with the provisions of theMap Act and the County Subdivision Regulations. A conditional certificate ofcompliance may be issued subject to the fulfillment of conditions necessary tobring the property into compliance with the Map Act. A recorded final map orparcel map constitutes a certificate of compliance.1415. Coastal ResourcesNatural features found in the Coastal Zone, including, but not limited to, sensitivehabitats, agricultural land, coastal viewsheds, and shoreline access areas.Sensitive habitats include wetlands, riparian (or stream) corridors, andendangered species.1516. Coastal ZoneA statutorily defined area extending inland from the Pacific Ocean. The CoastalZone is subject to a set of locally administered coastal protective regulationsknown collectively as the Local Coastal Program (LCP).1617. Community Apartment ProjectA common interest development in which an undivided interest in land is coupledwith the right of exclusive occupancy of any apartment located thereon.1818. Common Open SpaceLand within or related to a development, which is not individually owned ordedicated for public use, but is designed and intended for the common use andenjoyment of the residents of the development and may include complementarystructures and improvements.6919. Planning Community Development DirectorThe Director of the Planning and Building Division of the County Department ofEnvironmental Management the County of San Mateo. The PlanningCommunity Development Director is also the Secretary of the PlanningCommission and the Zoning Administrator and, in the absence of an appointee,the Zoning Hearing Officer. and is empowered to hear and decide on certain matters related to subdivisions,as specified in Section 7008.1720. Condominium ProjectA development consisting of condominiums. As defined in Section 1351(f) of theState Civil Code, a condominium consists of an undivided interest in common in aportion of real property together with a separate interest in space called a unit, theboundaries of which are described on a recorded final map, parcel map, orcondominium plan in sufficient detail to locate all boundaries thereof. Acondominium may include, in addition, a separate interest in other portions of thereal property.19.ConstructionDesign, acquisition of right-of-way, administration of construction contracts, andactual construction.2021. ConversionA proposed change in the ownership interest of a parcel or parcels of land,together with the existing or added structures, from that established to the type ofownership interest defined as community apartments, stock cooperative orcondominiums.2122. County CounselA representative of the Office of the San Mateo County Counsel who providesadvice on civil matters to the Planning Division and Building Department, actsas counsel to the advisory and decision-making bodies, and approves as to formany legal documents related to subdivisions.2223. Cul-De-SacA local street segment which has only one outlet with the other end designed tosafely accommodate the turning around of vehicles.2324. CurbA vertical, or sloping, or flat edge of a paved roadway.2425. 2526. DedicationThe transfer of land or an interest in land by its owner to public ownership, to beused for a public purpose.2627. DensityThe level of development permitted per unit of land area, usually expressed as thenumber of dwelling units per acre. The General Plan and Zoning Regulationsestablish maximum development densities for unincorporated areas of the County.In the rural areas of the Coastal Zone which are zoned Planned Agricultural,Resource Management/Coastal Zone, or Timberland Preserve/Coastal Zone, themaximum density of development for non-agricultural uses is based on waterconsumption as specified in Policy 1.8 of the Local Coastal Program.2728. Density Analysis or Density CertificationAn analysis of the physical and environmental constraints of a parcel in order todetermine its maximum development density in accordance with the variablezoning techniques established for certain zoning districts, as set forth in theCounty Zoning Regulations.2829. Design“Design” means: (1) street alignments, grades and widths; (2) drainage andsanitary facilities and utilities, including alignments and grades; (3) location andsize of all required easements and rights-of-way; (4) fire roads and fire breaks; (5)parcel size and configuration; (6) traffic access; (7) grading; (8) land to bededicated for park or recreational purposes; (9) other specific physicalrequirements in the plan and configuration of the entire subdivision as may benecessary to ensure consistency with, or implementation of, the General Plan orany applicable area or specific plan.30.Developable AreaThe buildable portion(s) of a proposed or approved lot, including accessroads, utility corridors and easements, and driveways as depicted on asubdivision map, within which all future development is intended to belocated.2931. DevelopmentThe uses to which the land which is the subject of a map shall be put, thebuildings to be constructed on it, and all alterations of the land and constructionincident thereto. Environmental Impact Report (EIR)A detailed report prepared pursuant to the California Environmental Quality Act(CEQA), setting forth the environmental effects and considerations pertaining to aproject and discussing ways to mitigate or avoid the adverse effects. A detailedreport prepared pursuant to the California Environmental Quality Act(CEQA) that identifies and analyzes the types of impacts a project couldhave upon the environment, offers ways to avoid or mitigate the significantadverse impacts, describes and analyzes alternatives to such a project, andincludes public comments received on the project.42.Environmental SubdivisionA subdivision created for the perpetual maintenance of the property as abiotic and/or wildlife habitat.3843. ExactionA contribution of property, improvements, or cash funds required of a developeras a condition of receiving subdivision approval.3944.
