HOW TO RESPOND TO A MORTGAGE FORECLOSURECOMPLAINTWho can use the Mortgage Foreclosure Appearance &Answer?o You can use the Mortgage Foreclosure Appearance &Answer if your name is listed on the Summons and theMortgage Foreclosure Complaint as a Defendant.o NOTE: a Mortgage Foreclosure Complaint might alsobe called “Complaint to Foreclose Mortgage” or“Complaint for Foreclosure.”What form may I fill out and file with the court torespond to a Mortgage Foreclosure Complaint?o You may fill out the Mortgage Foreclosure Appearance& Answer form.o If you and the other Defendants want to answerdifferently from each other, you may each file aseparate Mortgage Foreclosure Appearance & Answer.o NOTE: If you think the Complaint or the way youreceived it is defective in some way and you want to askthe court to dismiss the case or take other action, talk toan attorney before filing this form.What is a Mortgage Foreclosure Appearance & Answer?o The Mortgage Foreclosure Appearance & Answer tellsthe court you know about the foreclosure case andwhether you agree or disagree with what was stated inthe Mortgage Foreclosure Complaint.o It also allows you to tell the court what defenses youhave to the complaint.o If you do not file a Mortgage Foreclosure Appearance &Answer, the foreclosure case can go ahead without youand the court might rule against you.Where can I find the form I need?You can find the form s there a deadline for filing the Mortgage ForeclosureAppearance & Answer?You must file within 30 days after you were properly servedwith the Mortgage Foreclosure Complaint. If you miss thisdeadline you can ask the court for an extension of time byfiling a Motion to Extend Time to File.NOTE: If you have legal reason to challenge (quash)service of process you need to file a Motion before you fileyour Foreclosure Answer. You can find the Motion form at:http://www.illinoiscourts.gov/Forms/approved/. You maywant to consult with a lawyer about whether you have alegal reason to challenge (quash) service 735 ILCS 5/2-301.What costs will I need to pay to file a MortgageForeclosure Answer & Appearance?o There is a fee for each Mortgage ForeclosureAppearance & Answer filed with the Circuit Clerk.AA-I 905.4oIf you cannot afford the fee, you can ask the court tofile for free. Fill out and file an Application for Waiverof Court Fees to ask the court for a fee waiver. Thisis a separate set of forms you can find hat if I think I have a defense to the foreclosurelawsuit?o In Section C of the Mortgage ForeclosureAppearance & Answer, enter any defenses youhave. You must state facts that support yourdefenses.o If any of the following applies, you may wish tocontact a lawyer: Your lender violated any of the Making HomeAffordable Program (HAMP) guidelines; formore information go tohttp://www.makinghomeaffordable.gov; Your mortgage company wrongfully deniedyour application for a loan modification; Your mortgage company failed to respond toyour request for a mortgage modification; You had a loan modification application underreview with your mortgage company when theforeclosure case was filed; Your refinance or home equity loan is lessthan 3 years old and the lender did notaccurately tell you information about theloan's Annual Percentage Rate (APR),finance charges, amount financed, total ofpayments or schedule of payments; Your broker received an unreasonable lumpsum payment (commission) for brokering theloan; A contractor started the loan as part of ahome repair contract; You have your own insurance, and the lenderhas added an insurance premium to youraccount (force-placed insurance). In certaincircumstances, forced insurance may belegal; OR Your lender has not applied all of yourpayments to your account. These situations do not necessarily mean youhave a defense to your mortgage foreclosurecase. Also, you might have a defense notlisted here.o When you use the form Answer, you may beautomatically admitting that certain facts are true,like that you were given all the required noticesabout the default on the mortgage. oA complete list of the facts that do not have to be listedin the approved form complaint can be found at 735ILCS 5/15- 1504(c). If you want to deny any of thesefacts, do not use this form.Visit http://www.illinoislegalaid.org/foreclosure for moreinformation about mortgage foreclosure defense or toapply for legal help.What do I do if I want to try to refinance my loan? Check with your local courthouse to see if your countyhas a mediation program to assist foreclosuredefendants. See a HUD counselor for advice on your options. Call800-569-4287 or m for a listof HUD counselors in your area.What do I do after I fill out the Mortgage ForeclosureAppearance & Answer?Step 1: File your form with the Circuit Clerk in thecounty where the court case is filed.o You must electronically file (e-file) court documentsunless (1) you are an inmate in a prison or jail and youdo not have a lawyer, or (2) you qualify for anexemption from e-filing. You will qualify for an exemption if: (1) you do nothave internet or computer access at home and itwould be difficult for you to travel to a place whereyou could use a computer, (2) you have a disabilitythat keeps you from e-filing, or (3) you have troublereading or speaking in English. Fill out a Certification for Exemption from E-Filingfound .asp. File the original and 1 copy of your MortgageForeclosure Appearance & Answer, and theCertification, with the Circuit Clerk’s office in personor by mail.o To e-file, create an account with an e-filing serviceprovider. Visit tm to select a service provider. Someservice providers are free while others charge aprocessing fee. For instructions on how to e-file forfree with Odyssey eFileIL, see the self-help userguides sources/Self-Represented Litigants/self-represented.aspo If you do not have access to a computer or if you needhelp e-filing, take your form to the Circuit Clerk’s officewhere you can use a public computer terminal to e-fileyour form. You can bring your form on paper or saved on aflash drive. The terminal will have a scanner and computer thatyou can use to e-file your form.AA-I 905.4Step 2: Send a copy of your Mortgage ForeclosureAppearance & Answer to the other party.o You must send your forms to the other parties in thecase. If a party has a lawyer, send the forms to thelawyer.o You may send forms to the other parties bypersonal hand delivery, by mail, third-partycommercial carrier (for example, FedEx or UPS), orthrough the court's electronic filing manager or anapproved e-filing service provider. You may e-mailyour form to a party if they have listed their e-mailaddress on a court document. Complete the proof ofdelivery with information to show how you sent theforms to each party. It has room for 3 parties. If youare sending forms to more than 3 parties, fill out andfile one or more Additional Proof of Delivery formswith the main form.Step 3: Get ready for your court date.o Decide and write down: What you want to ask the judge to do for you;AND What you will say to the judge if asked to tell yourside of the case.o Gather and make copies of pictures and documentsyou want the judge to see. Bring the original for thejudge and one copy for you and each of the peoplein the case.Step 4: Go to your court date.o You should have received a court date and timefrom the Circuit Clerk when you filed your courtforms OR on a written notice from the other party orCircuit Clerk. If you cannot find your court date andtime, call the Circuit Clerk.o Bring these items with you to court: A copy of the Mortgage Foreclosure Complaintand Summons; Two copies of your completed and stampedMortgage Foreclosure Appearance & Answer;AND Other papers related to your mortgage or homesuch as: proof of your payment history, loanmodification packet, information from a housingcounselor, real estate sale contract, proof ofemployment or other income.o Get to the courthouse at least 30 minutes early.o Go to the courtroom number listed on your courtform. If your forms do not have a courtroom numberlook for a list of cases at the courthouse or ask theCircuit Clerk.o Check in with the courtroom staff and wait for yourname and case number to be called.o When your case is called, walk to the judge andintroduce yourself, and briefly tell the judge whatyou are asking for. How do I present my case to the judge?Step 1: Tell the judge your side of the case and answerquestions.o Bring any important documents relating to yourforeclosure including documents mentioned above. Give a copy to the judge and a copy to the otherparty. Be prepared to explain why the document isimportant.o The judge decides what materials can be considered inmaking a decision about your case.Step 2: What do I do when the other party presents theircase?o The other party will also get to present their case.o Write down your questions while they are speaking tothe other party or judge.Step 3: What happens after both sides present theircase?o The judge has to make a decision. The decision iscalled a court order.o If the judge needs more information to make a decision,the judge may set up another court date. Make sure youunderstand what information is needed and get it beforethe new court date.o If the judge needs to think about it more, the judge maylet you know the decision later by mailing a court orderor at another court date.o If the judge has enough information, the judge maydecide right then and fill out a court order. Get a copy of the order that has the court stamp onit. If the other party was not in court to get a copy, youmust send them a copy by 5:00 p.m. on the dateyou get the order. Fill out and file a Proof of Deliverycourt form with the Circuit Clerk to show that yousent the copy.
