EXCEPT THAT the California 'HSDUWPHQW 2I 7D[ QG )HH GPLQLVWUDWLRQ has ruled that a SALE IS NOT TAXABLE if the"buyer, before fall of the auctioneer's hammer . directed theauctioneer to ship the horse to a point outside of this state via licensedcarrier", and "if the horse does not come into possession of the buyeruntil it arrives at the out-of-state destination".Purchasers who desire exemption from payment of sales tax asaforesaid must provide 1) a completed and signed Interstate DeliveryAgreement (printed in this catalog / please check Table of Contents)PRIOR TO BIDDING; and 2) a bill of lading, signed by anauthorized signatory for an insured MCC/USDOT carrier acceptable tothe Sale Management.A partial exemption applies to "RACE HORSE BREEDING STOCK”NOTE TO MCC/USDOT CARRIERSMCC Carriers should file with the Sale Management a copy of theirBill of Lading and a list of authorized signatories. ATTENTION CONSIGNORS:Read Carefully CHRB Medication RegulationsThe California Horse Racing Board regulations in Chapter 4 of theCalifornia Administrative Code read as follows:ARTICLE 13.5 - AUTHORIZED HORSE SALES1807. Authorized Horse Sales.Upon application by a recognized breeders' association, sales organizations or any other person, theBoard may authorize a horse sale or horse auction sale for the sale of race horses or breeding stock thatis used in the production of race horses, to be held on the premises of a racing association, and theauthorization and approval of such horse sale or horse auction sale shall be upon such conditions asmay be imposed by the Board.1808. Medications Prior to Sale.(a). Person owning or having care, custody or control over a horse offered for sale at an authorizedhorse sale or horse auction sale under the jurisdiction of the Board shall not administer to such horseany substance which is recognized as an injectable, oral or topical medication or drug within 72 hoursof the time the horse is offered for sale unless the administration of the medication or drug is reportedto the official veterinarian appointed by the Board to act at the authorized horse sale or horse auctionsale prior to the sale of such horse in such manner as the official veterinarian by direct.(b). Upon request of a prospective purchaser of a horse offered for sale at such authorized horse sale orhorse auction sale the official veterinarian shall make available to the prospective purchaser the reportof medication administered to the said horse.(c). Compliance with this section is the responsibility of the consignor of the horse offered for saleand/or person(s) having the care, custody or control of said horse. Violation of this section ispunishable at the discretion of the Board by fine or in such other manner as may be determined by theBoard.1809. Post-Sale Tests.The official veterinarian at any authorized horse sale or horse auction sale may administer a blood testto any horse sold at such sale and shall make such test at the request of the purchaser of the horse, andthe blood sample shall be delivered to the official laboratory approved by the Board for analysis.Rule 1858. Test Sample Required(b) The Board may at any time on any date take official blood, urine or other biological samples, in accordance with Rules 1859 and 1859.1, from a horse to enhance the ability of the Board to enforce its medication and anti-doping rules. (c) Every horse within the inclosure, every horse registered to race at an inclosure, every horse under the care or control of a licensed trainer, or owned by a licensed owner, or nominated, pre-entered or entered in any race that will be held within a licensed inclosure is subject to pre-race, post-race, and out-of-competition testing by the Board. No owner, trainer or other person having the care of a horse shall refuse to submit it for testing when directed by the Equine Medical Director, the Executive Director, the stewards or the official veterinarian. (1) For the purposes of this regulation, a horse is registered to race at an inclosure when the horse's registration papers are on file with a racing association under the jurisdiction of the Board, and/or the horse has raced at a licensed inclosure within the previous twelve (12) months. (2) A horse is out of competition when it is not entered in a race as defined in this Article. This regulation does not permit out of competition testingoutside of a licensed inclosure on weanlings, yearlings, or any horse proven to be no longer engagedin horse racing unless such horse is entered in a horse sale authorized by the Board pursuant to1807 .A "Medication Report" must be completed for every horse consigned to the sale -- regardless of whether anymedication has been administered. Medication report forms will be available to consignors and prospectivepurchasers at the Stable Manager's Office prior to the start of the sale and must be completed and returnedprior to 8 a.m., 2FW Rule 1867.1Use of Bisphosphonates Prohibited.9

PCQHRA/SaleManagement, LAESC, Auctioneer and employees act as agents for the consignors and assume noliability for either purchasers or consignors. PCQHRA and/or LAESC reserves at its sole optionthe right to cancel, postpone, end the sale early or preclude one or more horses from participatingin the sale, at any time, for any reason or no reason at all, with or without notice. EACH MARE DESCRIBED AS A BROODMARE OR BROODMARE PROSPECT IN THIS SALE WILL BE OFFERED WITH A VETERINARY CERTIFICATE PROVIDED BY CONSIGNOR FROM A LICENSED VETERINARIAN SETTING FORTH THEPREGNANCY AND BREEDING STATUS OF THE MARE IN THE OPINION OF THEEXAMINING VETERINARIAN BASED ON AN EXAMINATION CONDUCTED WITHIN 14DAYS OF THE DATE OF SALE UNLESS SO ANNOUNCED. BOTH PURCHASERS AND CONSIGNORS AGREETO DEFEND, INDEMNIFY AND HOLD HARMLESS PCQHRA/SALE MANAGEMENT,LAESC, LOS ALAMITOS QUARTER HORSE RACING ASSOCIATION, LOS ALAMITOSRACE COURSE, AUCTIONEER AND EMPLOYEES AND EACH OF THEM FROM ANYALL LIABILITIES, COSTS, AND EXPENSES, INCLUDING REASONABLE ATTORNEY'SFEES INCURRED THAT ARISE OUT OF OR RELATE TO THE PREGNANCY OR BREEDING STATUS OF THE MARE.4. BIDDINGThe highest accepted bidder is the Purchaser. The Auctioneer shall have sole discretion and fullauthority to settle any dispute which may arise between or among two or more bidders in whatevermanner he/she sees fit. The Auctioneer's decision is final in all cases. Consignors, purchasers, andbidders hereby waive any and all rights to challenge or object in any manner to this decision.5. AGENTSAny person wishing to act as an agent for a purchaser other than himself/herself must file with thePCQHRA/ Sale Management written authorization at least five (5) days prior to the sale datesigned by the said purchaser naming the agent and specifying his/her authority to bid and accepttitle and delivery. Any person, having been qualified as agent for a purchaser, who, while actingas that purchaser’s agent, is the successful bidder on any lot in this sale, must identify the purchaseron the "Acknowledgment of Purchase" contract before the agent shall sign said contract.Notwithstanding this authorization to bid and accept title and delivery, every agent who is a successful bidder shall comply with all the terms and conditions of sale including CONDITION 7:SETTLEMENT. Except as otherwise provided in this CONDITION, the Person signing theAcknowledgment of Purchase shall be personally liable as the purchaser regardless of how theAcknowledgment of Purchase is signed or whether such signature indicates the Acknowledgmentis signed by an agent and/or discloses the principal.11

6. ACKNOWLEDGMENT OF PURCHASE CONTRACT, TITLE AND TRANSFERTitle passes to the purchaser at the fall of the auctioneer’s hammer, at which time the purchaserassumes all risk and responsibility for the horse. Immediately upon the fall of the hammer the purchaser or his/her authorized agent shall sign the Acknowledgment of Purchase which is presentedto him/her. Should the Acknowledgment of Purchase not be presented to him/her prior to the commencement of the next lot he/she shall immediately identify himself/herself to the auctioneer aspurchaser and sign the Acknowledgment of Purchase when presented. Right of purchase of thehighest bidder is not impaired in case of signing of Acknowledgment of Purchase by another.Consignor and purchaser agree to release, defend, indemnify, and hold PCQHRA/SaleManagement, LAESC, Los Alamitos Quarter Horse Racing Association, Los Alamitos RaceCourse, Auctioneer and any and all employees harmless from all losses, damages, expenses,claims, causes of action or attorney’s fees arising out of or related to the bidding, purchase andsale, possession, care, custody, control or maintenance of any horse of which the purchaser, including but not limited to claims arising out of injuries or damage caused to or by the horse before orafter the fall of the hammer. Horses sold in this sale will be transferred by PCQHRA/SaleManagement and ownership registered with the American Quarter Horse Association exactly asthe purchaser’s name and address appear on the Acknowledgment of Purchase contract.PCQHRA/Sale Management and LAESC reserves the right to make public the name of every purchaser and consignor. AQHA Certificates of Registration will not be released to the purchaser orhis/her agent at the sale. A 25 transfer fee will be added to the purchase price to be paid as partof the final settlement by the purchaser.7. SETTLEMENTPayment in full must be made within thirty (30) minutes of the conclusion of the sale session inwhich the horse(s) is purchased or as soon as reasonably practical after the sale session, as determined by the sole discretion of PCQHRA/Sale Management and/or LAESC. Payment must bemade in U.S. currency, pre-approved bank check, certified check, traveler’s checks or cashier’schecks. Any lot not paid for in full at the sale and not declared in default by the undersigned shallbe subject to a finance charge of 2% per month from the date of the sale on all amounts owing untilthe lot(s) are paid in full. Any checks not honored by payor’s bank shall be subject to penaltiesprovided in Section 1719 of the Civil Code including treble damages. Purchaser is to pay salecashier in all cases. In no case shall any part of the purchase price be paid by purchaser to consignor. Such payment will not be regarded as valid nor will it entitle purchaser to delivery.Registration papers will be held until the purchaser’s account is paid in full.All Horses shall be paid for and removed promptly by the purchaser or his agent.
