Board of Commissioners Minutes are Subject to Approval County of Marquette December 6, 2022 REGULAR MEETING – TUESDAY, DECEMBER 6, 2022 – 3:00 P.M. – COMMISSIONERS ROOM 231, HENRY A. SKEWIS ANNEX, MARQUETTE, MI 49855 1. CALL TO ORDER – SALUTE TO THE FLAG – PLEDGE OF ALLEGIANCE Call to Order by Chairperson Corkin – Room 231 Henry A. Skewis Annex Salute to the Flag followed by the Pledge of Allegiance. 2. PUBLIC ANNOUNCEMENT OF ELECTRONIC PARTICIPATION Present: Comm. DePetro, Comm. Derocha, Comm. Adamini, Comm. Nordeen, Comm. Alholm and Chairperson Corkin 3. APPROVAL OF THE MINUTES: Board Action: Comm. DePetro moved to approve the minutes from the Regular Meeting held on November 22, 2022; and Closed Session Meeting held on November 22, 2022. Second by Comm. Nordeen. Motion adopted (6-0) 4. PROCLAMATION, PRESENTATIONS AND AWARDS 5. APPROVAL OF THE AGENDA: Board Action: Comm. Alholm moved to approve the agenda with the following addition: a) Michigan Spark Grant; b) Treasurer Property Tax Payment Issue. Second by Comm. DePetro. Motion adopted. (6-0) 6. PUBLIC COMMENT: Chairperson Corkin opened the meeting for public comment. Jen Chapman - member of the AFSME Courthouse Union #2914 – stated the wages have not stayed competitive causing a problem of being able to recruit new workers and maintain staff in Marquette County. As minimum wage in Michigan rises the County is not staying competitive. Please invest in your employees! Pam Waterman spoke as a member of the AFSME Courthouse Union #2914 stated the union conducted a survey concerning if any employees need another job outside of their full time employment to maintain their household. Out of 69 employees – 19 members have another job outside the county after their 40-hour week at the County and 17 have other duties outside to supplement their County pay. Ms. Waterman went onto discuss the comments by employees as well – and urged the Commissioners to consider this during negotiations! Jacqueline Love - Marquette County Health Dept. Registered Nurse, represented the ten nurses employed by Marquette County Health Dept. – Ms. Love updated the Board regarding the Negotiations that have been going on – we’ve been offered a 3% wage increase and this doesn’t even come close to the rise in cost of living that has taken place. We’ve been told that there is no money in the budget for anything beyond 3%; however, management has been able to find a raise for the Health Dept. Officer in 2017 he received an 8.8% raise and 6.1% in 2018 as well as a 10,000 bonus during the COVID Pandemic – Civil Counsel stated he was paid these because the Health Dept. Officer is underpaid and irreplaceable – when told this it’s hard not to feel undervalued! During the pandemic our nurses vaccinated over 46,000 residents while still keeping up on their other duties. We stepped up and after the pandemic we received a 1% increase. Please recognize our worth and act accordingly during these negotiations. Stephen Krygier, Acting Executive Director, Room at the Inn, gave an update on what is offered for services at Room at the Inn for the health safety and wellbeing of our many guests in the shelter. Stating some of the facility improvements that are needed to keep the facility functioning. With no more public comment to come before the board this portion of the meeting was closed. 7. REVIEW OF CLAIMS AND ACCOUNTS Board action: Comm. Alholm moved to approve the total expenditures for the period November 18, 2022 through December 1, 2022 were 204,996.48; (this amount does not include check payable to Alger-Delta CoOp Electric); and Bi-Weekly Payroll for the period ending December 1, 2022 was 761,558.74; and EFT Transfers for the Period November 18, 2022 through December 1, 2022 were 316,434.03. Second by Comm. Derocha. Motion adopted. (6-0) Board action: Comm. Nordeen moved to Approve check #216504 dated 11/25/2022 in the amount of 1,854.58 Payable to Alger-Delta Co-Op Electric. Room at the Inn ARPA Fund Request Stephen Krygier, was present to answer questions regarding the following: When the County Board of Commissioners established how the American Rescue Plan Act funds would be allocated, 200,000 was originally set aside for a homeless initiative with Great Lakes Recovery, Janzen House, and the Room at the Inn (RATI). As you are aware, this project did not come to fruition. Since the project did not proceed the County has since approved the use of 100,000 for numerous improvements at the Janzen House. 100,000 still remains for homeless initiatives. RATI’s interim director, Stephen Krygier, has submitted the attached request for the remaining 100,000 for facility updates. RATI has made significant strides towards improving services and housing for individuals that find themselves homeless, and these updates will continue the needed enhancements for its facility at 447 W. Washington Street in Marquette. Board action: Comm. Nordeen moved to approve 100,000 from the American Rescue Plan Act revenue loss funds to the Room at the Inn for needed facility upgrades. Second by Comm. Alholm. Motion adopted (6-0) b. MDOT PFAS Investigation Grants Negaunee Airport Site Duane DuRay, Sawyer Operations Manager, Sawyer International Airport staff is requesting Board consideration to approve and accept another State of Michigan PFAS investigation grant. Working with AECOM and EGLE, staff developed a comprehensive plan to continue on with a phase two of the former Negaunee airport site PFAS contamination investigation. This grant will provide an additional 350,000 for a PFAS contamination investigation at the former airport site. This phase of the project will further evaluate potential risks to human and environmental receptors through the installation of an expanded network of groundwater monitoring wells in effort to laterally and vertically delineate known PFAS impacts in groundwater at the site. This grant is 100% state funded requiring no local funding. Following the execution of the grants an agreement between Marquette County and AECOM will be presented to the Marquette County Board Commissioners for reviewed and approval. This grant may require periodic reporting throughout the grant cycle. The current State procedure requires the individual who executed the grant to also sign the reporting documentation. To assist in streamlining of the process, a request is to authorize County Administrator, Scott Erbisch to sign the agreement. Board action: Comm. Derocha moved to approve the Michigan PFAS investigation grant and approve the following Resolution authorizing Scott Erbisch, Administrator to sign the agreement. Second by Comm. Nordeen. A roll call vote was taken: Ayes: Comm. Derocha, Comm. Adamini, Comm. Nordeen, Comm. Alholm, Comm. DePetro and Chairperson Corkin. Nays: None. Motion Adopted (6-0) RESOLUTION ADOPTING AND APPROVING THE EXECUTION OF THE CONTRACT BY THE MARQUETTE COUNTY BOARD OF COMMISSIONERS OF MARQUETTE, MICHIGAN, AND THE MICHIGAN DEPARTMENT OF ENVIRONMENT, GREAT LAKES, AND ENERGY FOR THE PURPOSE OF EXECUTING CONTRACT NO. 2023-XXXX BE IT RESOLVED by the Board of Commissioners of Marquette County, Michigan: Section I. That the Board of Commissioners of Marquette County, Michigan shall enter into a Contract for airport PFAS testing, and that such Contract shall be as set forth hereinafter; 2

County of Marquette December 6, 2022 That Scott Erbisch, County Administrator of Marquette County is hereby authorized and directed to execute said Contract on behalf of the County of Marquette, Michigan, and Linda Talsma, Marquette County Clerk is hereby authorized and directed to attest said execution: That the Contract Agreement referred to herein shall be as attached. c. Signatory Air Cargo Carrier Agreement Duane DuRay, Sawyer Operations Manager, staff is requesting consideration to approve a Signatory/Non Signatory agreement with Freight Runners Express, Inc. and the County of Marquette. Freight Runners is an additional cargo hauler that recently entered the market and are providing services for United Parcel Services (UPS). Marquette County currently has a two three-year Signatory/Non Signatory Agreements with Ameriflight and CSA. These agreements provide operational rights, outlined insurance requirements, and defined landing fees for air cargo companies’ operations. The standard agreement term is three (3) years with a current end date of February 28, 2025, Freight Runners agreement is proposed to begin upon approval and sync with the other two agreements end date. An annual three (3) % escalator running the term of the agreement. This agreement will generate additional revenues; we are anticipating several operations per month at the current rate of 104.32 per landing. Board action: Comm. Alholm moved to approve the Agreement and authorize the County Board Chairperson to sign the agreement between the County of Marquette and Freight Runners Express, Inc. Second by Comm. Adamini. Motion adopted (6-0) d. Airport Services Center Lift Station Clean Out Duane DuRay, Sawyer Operations Manager, Sawyer International Airport staff is requesting Marquette County Board of Commissioners consider waiving the comprehensive purchase policy for the selection of a UP Environmental Services, Inc. to accomplish the cleanout of the airport services center (ASC) lift station. Over the past several years’ staff worked closely with UP Environmental Services to facilitate hazardous material clean up at the airport for several projects, and most recently for assistance with PFAS contamination within the sanitary system at the airport. We have selected UP Environmental for many reasons, but namely for two particular reasons. 1. UP Environmental is a very reputable organization; 2. UP Environmental is one of the only groups that have the equipment and certifications to complete the job in this region. Currently the ASC sanitary lift station is turned off due to PFAS contamination. To avoid the risk of creating a larger volume of contamination at the treatment plant staff deactivated the lift station to isolate it from the remaining system. The next step is to have a vendor come in and pump out the contaminated material and provide a cleaning of the lift station, floor drains, and the oil water separator. The estimated cost for the service is 11,000 but may fluctuate with the volume of water that will be transported off-site. Staff has been taking the appropriate steps to address the residual contamination, the fire hall floor drains have been isolated and routed into a newly installed holding tank, all of the floors drains in the ASC have been flushed, the oil water separator was cleaned and the lift station was pumped and the waste was transported to an approved collection facility. This recent contamination is believed to be caused by residual contamination that must have remained in the plumbing, lift station, oil water separator, and floor drains. Understanding the level of contamination is measured in parts per trillion (PPT), even the slightest residue in the system can affect the levels. Board action: Comm. Adamini moved to waive the comprehensive purchase policy and allow staff to work with UP Environmental Services, Inc. for this project. Second by Comm. Alholm. Motion adopted (6-0) 3

FY2020 Operation Stonegarden Grant Equipment Purchase Brian Hummel, Emergency Management Program Coordinator, requested the following: The Marquette County Sheriff’s Department, under the FY2020 Operation Stonegarden Grant, is seeking to purchase four 800 MHz portable radios. Staff have fulfilled all the pre-purchase requirements of both the State of Michigan as well as the U.S. Department of Homeland Security. The cost of the four radios is 14,973.04. This includes 13,973.04 for the equipment with an additional 1,000.00 to cover state activation fees. The Stonegarden Grant will fund 14,424.00. This will leave the county with an expense of 549.04 which will be paid for from the Sheriff’s Department Operating Budget. Board action: Comm. Nordeen moved to authorize the purchase of four 800MHz radios for a total cost not to exceed 14.973.04. Second by Comm. Alholm. Motion adopted (6-0) f. Collective Bargaining Agreement Between the County of Marquette & Teamsters Local #406 RESOLUTION ADOPTING COLLECTIVE BARGAINING AGREEMENT BETWEEN THE COUNTY OF MARQUETTE AND TEAMSTERS LOCAL #406 WHEREAS, Teamsters Local #406 is recognized by the Michigan Employment Relations Commission and the County of Marquette as the exclusive representative of certain employees of Marquette County; and, WHEREAS, the parties have collectively bargained mutually acceptable terms and conditions; and NOW THEREFORE, pursuant to the recommendation made to the Board of Commissioners, the County resolves that the Tentative Agreement amending the collective bargaining agreement for the period January 1, 2023 through December 31, 2024, is hereby approved. It is further resolved that the Board Chairperson is authorized to take all necessary administrative actions to implement this resolution. Dated: December 6, 2022 Board Action: Comm. Michigan Spark Grant Comm Derocha requested the following item: This letter is written in support of the Powell Township Park and Recreation Department’s Spark Grant application for upgrades to Draver Park. In the past, there have been multiple attempts to obtain grant funding to provide barrier-free access to the park, but they have not been approved. Now is an opportunity to secure funding for Draver Park. The proposed improvements will be a complete redesigning of the park, and will make it ADA-compliant for adults and children. Toilets, food shack, announcing booth to be constructed to ADA standards Ballfield fence with an opening gate, making the field more useable for other activities Dugout/bleacher shade and other upgrades Updated playground equipment Construction of fitness path encircling the park, as well as fitness equipment Installation of pavilion electric and speaker system, with drop sides for weather protection Landscaping, parking spaces and accessible paths/walkways to all amenities The proposed upgrades to Draver Park will be a huge asset for Powell Township and surrounding communities in Marquette County. We appreciate the Michigan DNR’s consideration of this grant request. Please do not hesitate to contact me if you require any additional information regarding our support for this application. DePetro moved to send a letter of Support for Powell Township Park and Recreation Department Spark Grant Application for upgrades to Draver Park. Second by Comm. Derocha. Motion adopted (6-0) b. Treasurer Property Tax Payment Issue Comm. Derocha stated on of his constituents brought this tax payment issue to his attention. Seems he went in to pay his taxes on 3 parcels and 1 was paid correctly and the other two payments were posted to the wrong parcels, leaving his 2 parcels unpaid. Customer felt that his due diligence was completed, however it was wrongly applied to someone else’s account. Jackie Solomon, Marquette County Treasurer, explained a receipt was given and it was up to the customer to notice this was paid in error. The amount in question is 573.27 that was paid incorrectly. Stating she was statutorily barred from giving refunds on property payments. Board action: Comm. Derocha moved to refund 573.27 to the Parcel Owner, subject by review by Civil Counsel. Second by Comm. Adamini. Motion adopted (6-0) 13. PUBLIC COMMENT: Chairperson Corkin opened the meeting for public comment: Undersheriff Dan Willey, gave an update on the September, October and November Stats: Road Patrol: 881 Calls for service; 62 arrests; 255 citations; 145 crashes; 530 civil’s taken in and 404 served. Search & Rescue: 12 calls out for assistance. Rescue 131: 10 Personal Injury Accidents; 7 Structure Fires and 8 Other Call Outs Jail: Lodged 272 males and 103 females; released 269 males and 126 females; Average Daily Population 74 Between 5 & 6 Federal Inmates Daily. Stephen Krygier, Acting Executive Director, Room at the Inn, sincerely appreciated the funds that were given tonight and will help support so many needed people in the upcoming difficult months. With no more public comment to come before the board this portion of the meeting was closed. 14. COMMISSIONER COMMENTS, STAFF COMMENTS AND ANNOUNCEMENTS: Chairperson Corkin and Comm. DePetro attended the renaming of the Veterans Facility as George LaBlonde – Mr. LaBlonde was instrumental in achieving this Veterans Affairs Office in Marquette County. This renaming is well deserved! 5
