INTRODUCTIONAn endorsement can be defined as a rider that modifies a title insurance policy. Most often anendorsement will have the effect of expanding the scope of policy coverage. However, apolicy may also be endorsed to limit coverage. Although all title policies can be endorsed, notall endorsements are intended to be issued with all policies. Some endorsements apply toowners policies while others are appropriate to loan policies with yet others being equallyapplicable to both, but not necessarily with standard and extended coverage policies.Old Republic National Title Insurance Company, issues policies and endorsementspromulgated by the American Land Title Association (ALTA) and the California Land TitleAssociation (CLTA) as well as its own “ORT” forms.ALTA is the nationwide association of the title insurance industry. Its members include titleinsurers, title agents, attorneys and other affiliated professionals. ALTA serves as an advocateon behalf of its members and the industry’s interest, provides education and information to itsmembers and the industry’s interest, provided education and information to its members andcreates and promotes professional industry standards. ALTA also promulgates uniform titleinsurance policies and endorsements for use by its members on a national basis.CLTA is the California association of thee title insurance industry. Its members also includetitle insurers, title companies, attorney’s and affiliated professionals. CLTA offers services toits members, provides a unified voice on legislative and regulatory issues and adopts, developsand publishes standardized title insurance forms.The primary types of title insurance policies issued by the Company are the CLTA StandardCoverage Policy, CLTA/ALTA Homeowner’s Policy of Title Insurance, ALTA Owner’sPolicy (2006) and ALTA Loan Policy (2006).The CLTA Standard Coverage Policy, as its name would imply, is a standard coverage policy.The ALTA Owner’s and ALTA Loan Policies may be issued in either standard coverage orextended form. The CLTA/ALTA Homeowner’s Policy of Title Insurance is distinct fromboth the CLTA and ALTA forms as it may insure only a one to four unit residential structurewhere the insured is a natural person. It is often referred to as an expanded coverage policy.The difference between “standard coverage” and “extended coverage” can be thought of, insimplistic terms, as the difference between “record coverage”, being insurance against thosematters covered by the policy disclosed by an examination of the public records and “offrecord coverage” being those covered matters disclosed by an inquiry, inspection and survey.As noted above the ALTA Owner’s Policy and ALTA Loan Policy may be issued in eitherstandard or extended coverage form. Structurally the distinction between standard andextended coverage is not the policy from, but the inclusion of the six “standard exceptions”,sometimes called “western regional exceptions” or “pre-printed exceptions”, in the policy.Thus, it is the exceptions to coverage in an ALTA Owner’s or Loan Policy that dictate whetherthe policy is written in standard or extended coverage form.Revised December 29, 20164

With the significant expansion of the policy coverage under an extended coverage policy overa standard coverage policy it is logical that endorsements that may add further coverage to anextended coverage policy are not appropriate with a standard coverage policy. Likewiseendorsements which may add coverage to a standard coverage policy may not be necessarywith an extended coverage policy as the desired coverage may exist by reason of the absenceof the standard exceptions in the policy.Endorsements are individually named and can be referred to by their particular title or purpose.However, endorsements are most commonly and more accurately identified by reference to theendorsement form number assigned by the originating and/or adopting title association.ALTA and CLTA both employ their own numbering sequence for endorsements. Since CLTAhas, with one exception, adopted all of the ALTA endorsement forms, this Guide will listendorsement forms primarily under the CLTA form designation number with a cross referenceto the ALTA number.CLTA employs a three digit numbering system beginning with “100”. Endorsements with acommon purpose or subject matter are generally numbered within the series using a subnumber, typically beginning with “.1”. Endorsements which employ a “-06” are specificallydesigned to be issued with the ALTA Owners Policy (2006) and/or ALTA Loan Policy (2006).For example, the CLTA 100 series encompasses endorsements that by and large provideassurance in respect to covenants, conditions and restrictions (CC&R’s). The firstendorsement in the 100 series is the “100-06”. The second endorsement is the “100.1” and thethird is the “100.2-06”. Of these three sample endorsements we know that the 100-06 and the100.2-06 are for use only with an ALTA 2006 Policy, in this case an ALTA Loan Policy(2006), whereas the 100.1 because of the absence of the “-06” is intended for use with theCLTA Standard Coverage Policy.Revised December 29, 20165
