WHAT IS THE POWERGARD PROTECTION PLAN?PowerGard is an extended warranty for John Deere AMS Componentsthat provides coverage for failures or breakdown due to faulty materialsor original workmanship that occur beyond the John Deere BasicWarranty coverage. PowerGard is not insurance and should never be represented as such. Contracts can only be sold through: Authorized John Deere dealerships Direct Mail Programs approved by Deere & Company Contracts are available to your customers who purchase any of NEWeligible AMS components/products under the program. This includescustomers who purchased AMS components up to 95 days prior to theprogram launch on November 27, 2006. PowerGard Protection Plan Coverage starts upon expiration of the JohnDeere basic warranty (post warranty, up to the PowerGard End Date). The Coverage Form Available on AMS Components is Full Machine (Comprehensive) (Specific non-covered components are listed.)Note: All PowerGard coverage forms exclude high wear items, maintenanceitems, and attachments. WHY MARKET THE POWERGARD PROGRAMS?In today’s competitive, customers are demanding more warranty coverage,guaranteed or known total costs associated with product ownership, and quality partsand service support after the sale. The PowerGard Protection Plan extended warrantyhelps you compete in these areas of customer expectations in the following ways: Total Cost of Ownership – PowerGard is a great way for your customers tobudget their total cost of ownership. With a one-time fee they can protect themselvesfrom future repair or replacement costs associated with post-warranty failures. 0 Deductible – Your customers incur no deductible, which means no out-ofpocket expenses on covered repairs or replacements when failures occur. Flexible Coverage Terms to Fit Customer’s Needs – PowerGard offersterm options to meet the needs of your customers. Customers may choose either 24total months or 36 total months of coverage, which includes the underlying 12 monthbasic warranty. Transferable Coverage with No Transfer Fees – PowerGard Protectioncoverage is fully transferable to subsequent owners of the covered components up tothe PowerGard End Date. Customers incur no transfer fees. Also, if an AMS unitwith PowerGard Protection coverage fails while under basic warranty and is replacedwith a new AMS unit, the PowerGard Protection coverage will be transferred to any/allreplacement units, and have remaining coverage up until the original PowerGard EndDate. The dealership only needs to enter a current owner delivery receipt to JohnDeere for proper record updating of the AMS PIN and customer information when anoriginal AMS unit is sold to a different customer. When a new AMS component withPowerGard is replaced under basic warranty, the dealership must register thereplacement AMS component PIN through the normal delivery receipt process. ThePowerGard Department automatically updates and transfers the coverage toreplacement PINs once the new delivery receipt of the replacement unit is entered.NOTE: All basic warranty claims filed in JD Warranty for AMS Components will require theservice tech to enter the PIN # of any replacement AMS units, in order for the remainingPowerGard Protection Plan coverage to be transferred to the new unit, which will then expireupon the original PowerGard End Date. Fast Electronic Claims Processing – Claims are submitted similar to basicwarranty claims. WHY SELL THE POWERGARD PROGRAMS? Increase Your Profit Margin on Each Unit Sold – Every time yourdealership sells an AMS component, have the salesperson include the PowerGardProtection Fee (List) price. It helps protect your customer against future repair billsand also increases your overall profit margin on the entire transaction. Get Ahead of Competitive Programs – PowerGard can put you ahead ofcompetitors who may or may not have extended warranty programs available forcustomers. The low cost of the additional protection offered by PowerGard and theadditional peace of mind that comes with a longer warranty can be the difference inmaking the final sale. Tie Customers back to Your Dealership - PowerGard allows your dealershipto be tied more closely to your AMS customers through service agreements. PowerGard contracts include the following benefits to you and your customer:Only authorized John Deere dealers can service covered equipment under the Plan.PowerGard requires only Genuine John Deere AMS parts/components be used in allcovered repairs. Once an AMS component is replaced (when occurring beyond the basicwarranty and under the PowerGard Protection coverage period), the contract is void.PowerGard pays full LIST on all covered components under the program.Covered labor (1 hour for AMS) is reimbursed based on published pricing guides and/ordealership statistical averages. NOTE: PowerGard Protection does not pay fordiagnostic time on any/all coverage repairs or replacements of AMS components. Transfer All Risk with Extended Warranties to Deere & Company Avoid costs associated with dealership-backed extended warranties by selling theJohn Deere PowerGard Protection Plan contracts. PowerGard provides you profitmargin potential, but with no risk to your dealership. Reduce Cost Sharing under Special Allowance Programs/Policies Selling PowerGard reduces the need for special allowance payments made by yourdealership or your customers. POWERGARD PROTECTION PLAN – AMS EquipmentA.COVERAGE: Subject to the terms and conditions of the PowerGard Protection Plan, we will repair or replace, at our option, Covered Components (asdefined below) of Covered AMS Equipment described in the Schedule of Coverage that are defective in material or workmanship. For the PowerGardProtection Plan to apply, the repair or replacement of Covered Components must be performed by an authorized John Deere dealer using only genuineJohn Deere AMS parts or components. Such repair or replacement will be made without charge to you.The PowerGard Protection Plan for AMS equipment is only available through authorized John Deere dealers. The PowerGard Protection Plan is noteffective unless and until (1) John Deere AMS components have been purchased, settled and delivered to the customer (with Delivery Receipt processingby the dealership); (2) the information on this form is electronically submitted to us by a John Deere dealer; (3) the fee for the coverage has been paid;and (4) the coverage purchaser receives written confirmation from John Deere (certificate card and contract terms).B.COVERED COMPONENTS: The PowerGard Protection Plan only applies to covered John Deere AMS components to which coverage has beenpurchased by individual product category and PIN (product identification number). Covered Components will include either factory installed or genuineJohn Deere AMS replacements components (which may be reconditioned units) as well as related components that perform a similar function:1.2.3.John Deere AMS GreenStar/GS2 Displays – and all parts and components contained inside this system.John Deere AMS Mobile Processors – and all parts and components contained inside this system.John Deere AMS Starfire Receivers – and all parts and components contained inside this system.C. COMPONENTS NOT COVERED: Covered components of all AMS systems (displays, processors, receivers) shall not include:1.AMS Software (unless John Deere authorizes revision updates)2.Wiring harnesses for John Deere AMS systems within John Deere equipment3.External Devices to John Deere AMS components4.Accessories or parts added to the John Deere AMS system (after the system is shipped from John Deere)5.Accessories or parts added to the Johh Deere AMS system (that are not installed at the factory)D.COVERAGE LIMITATIONS:1.The following are not included in and not covered by the PowerGard Protection Plan agreement unless required to be covered by law: (a) Diagnosticlabor, or overtime labor charged in excess of the dealer’s normal labor rate; (b) Charges for service calls or storage of the Covered Equipment; (c)Depreciation, damage or failure caused by normal wear, lack of reasonable and proper maintenance, failure to follow operating instructions, misuse, orlack of proper protection during storage; (d) Loss or damage due to theft, vandalism or riot, the elements, fire, explosion, chemicals or salt, or collision orother accidents; (e) Normal maintenance and replacement of maintenance items, wear items, or consumables; and (f) Any defect in a non-coveredcomponent, or damage to or failure of a Covered Component caused by a defect in a non-covered component.2.The following are not included in and are not covered by the PowerGard Protection Plan agreement: (a) Failures covered under any other warranty,product improvement program or product recall, other service agreement, or insurance; (b) Failures occurring while the Covered AMS Equipment isbeing used for any illegal purpose; (c) Costs incurred for discretionary retrofitting of current design components on older Covered AMS Equipment orreconditioning of the Covered Equipment or its components or software; (d) Expenses associated with any repair required or provided for by anyregulation or order of a court or regulatory agency, or by consent decree or settlement; (e) Damage to other property or injury to any person; and (f) Anyindirect or consequential damage or injuries, including but not limited to loss of crops or profits, rental charges for substitute equipment, or other loss ofincome, loss of use, or loss of data.E.WHEN COVERAGE APPLIES: The PowerGard Protection Plan will apply during the Coverage Term indicated in the Schedule of Coverage for thecoverage term selected, unless one of the events described in paragraph F. below occurs, in which case, plan coverage will terminate immediately.F.TERMINATION OF COVERAGE: The PowerGard Protection Plan will terminate immediately when any of the following occur: (1) The total monthcontract term indicated in the Schedule of Coverage has expired; (2), the Covered Equipment in the schedule is replaced with a new unit by thePowerGard Protection Plan while under the PowerGard Protection coverage period, (3) The Maximum Recovery limits have been meet, as defined inparagraph G. below; (4) The Covered AMS Equipment is modified or altered in ways not approved by us or not in accordance or compliance with JohnDeere factory specifications; (5) Service or repair, other than normal maintenance and/or replacement of service items, is performed by someone otherthan an authorized John Deere dealer; (6) The Covered AMS Equipment is moved to a location outside the United States or Canada.G.MAXIMUM RECOVERY: Our cumulative liability over the Coverage Term for covered repairs or replacement shall not exceed the manufacturer’ssuggested list price of the individual Covered AMS Equipment, excluding any transportation charges, license fees, taxes, software costs, the cost of thePowerGard Protection Plan itself, the cost of options not covered by the PowerGard Protection Plan, and any insurance premiums on the product.H. MAINTENANCE OF COVERED EQUIPMENT AND RECORDS: You must properly maintain the Covered AMS Equipment and, at your expense,perform scheduled maintenance and updates in accordance with the Operators Manual for the Covered AMS Equipment. You must maintain records ofall scheduled maintenance, repair, or service work completed and must present these records to us, upon our request, to verify compliance with thiscondition.I. ASSIGNMENT: The PowerGard Protection Plan will apply only to the specific Covered AMS Equipment described in the Schedule of Coverage of thePowerGard Protection Plan.
