The Louisiana Board of Regents(board), formerly the Louisiana Student Financial AssistanceCommission, was created by chapter 20, Higher EducationAssistance, Revised Statutes of 1950, comprised of R.S.17:3021-3036, for the purpose of supervising, controlling,directing and administering state and federal programs toprovide loans to assist persons in meeting the expenses ofhigher education, and state and federal scholarship and grantprograms for higher education. The Louisiana Office ofStudent Financial Assistance (LOSFA), under authority of theboard, administers state and federal post-secondary studentscholarship, grant and loan programs.5. ensure compliance with statutory and regulatoryprovisions governing the administered programs.C. Since these rules and regulations can neither anticipatenor address every situation that might be encountered in theadministration of the scholarship and grant programs includedherein, participants in doubt about the applicability orinterpretation of a rule or regulation in LAC 28:IV are advisedto contact LOSFA for guidance.D. LAC 28:IV shall be amended and updated as necessary.Such updates will be forwarded to institutions in the form ofscholarship and grant program memoranda (SGPM), orTaylor Opportunity Program for Students (TOPS) bulletins.These memoranda and bulletins will cover additions,deletions, revisions and clarifications to the rules andregulations. In compliance with R.S. 17:5063, informationshall be mailed to the president and superintendent of eachcity and parish school board in the state, the principal andcounselors of each high school in the state, the chancellor,director of financial aid, business office, auditor and registrarof each public post-secondary school in the state and eachregionally accredited independent college or university whichis a member of the Louisiana Association of IndependentColleges and Universities.B. Agency's Mission Statement. By participating in the scholarship and grant programsadministered by the board and described in LAC 28:IV, allparticipants, including high schools and post-secondaryinstitutions, grant the board and the Louisiana LegislativeAuditor the right to inspect records and perform on-site auditsof each institution's administration of the programs for thepurpose of determining the institution's compliance with statelaw and the board's rules and regulations.C. It is the intent and policy of the board that:1. LOSFA will collect and maintain only that PIInecessary to fulfill the board’s program responsibilities andduties, including but not limited to:a. providing information to participating studentsbeginning in the eighth grade that will guide and motivatestudents to prepare for and to achieve eligibility for financialaid programs to attend postsecondary education;AUTHORITY NOTE: Promulgated in accordance with R.S.17:3021-3031.HISTORICAL NOTE: Promulgated by the Student FinancialAssistance Commission, Office of Student Financial Assistance, LR22:338 (May 1996), repromulgated LR 24:632 (April 1998),amended LR 24:1898 (October 1998), LR 27:1841 (November2001), amended by the Board of Regents, Office of Student FinancialAssistance, LR 44:485 (March 2018).§109.b. determining the initial eligibility of participatingstudents for financial aid;c. determining the continuing eligibility of studentsawarded financial aid;d. making payments for students who have beenawarded financial aid; andDiscrimination ProhibitionA. The exclusion of a person from equal opportunity for aLouisiana scholarship and/or grant program administered bythe board because of race, religion, sex, handicap, nationalorigin or ancestry is prohibited. No policy or procedure of thisagency shall be interpreted as superseding or contradictingthis prohibition.e. submitting reports and assessments required bystate or federal law regarding the effectiveness of the financialaid programs administered by LOSFA;2. All certifications of student performance which aresubmitted to the board for the purpose of determining astudent's eligibility for an award under a student aid programadministered by the board shall be by sworn affidavit of thecertifying official and such official shall be subject to criminallaw applicable to false swearing.3. LOSFA will ensure that LOSFA employees will haveaccess only to that PII that is necessary to perform their duties;4. LOSFA will develop and use consent forms thatinform students, parents, and legal guardians of:b. possible college access advantages provided tostudents by consenting to the release of PII to LOSFA; andc. adverse consequences of withholding consent forrelease of PII to LOSFA;Personally Identifiable Information (PII)A. The board recognizes that personally identifiableinformation must be collected and maintained to determinewhether a student meets the initial and continuing eligibilityrequirements for state and federal financial aid programsadministered by the board, and when required by law for usein preparing and submitting reports required by state andfederal law.April 2019purpose(s) for which the PII will be used;b.who will have access to the PII;c.how long the PII will be retained by LOSFA; andd. how the PII will be destroyed at the end of theretention period;B. The board is required by the TOPS statute to inform“all students of the availability of the assistance.earlyLouisiana Administrative Codea.2
