ORDINANCE G-6453AN ORDINANCE AMENDING CHAPTER 10 OF THEPHOENIX CITY CODE BY ADDING ARTICLE XV ANDAMENDING CHAPTER 19 OF THE PHOENIX CITY CODE TOREGULATE THE LICENSING OF STRUCTURED SOBERLIVING HOMES.WHEREAS, there are a number of structured sober living homes locatedwithin the City of Phoenix and it is in the interests of the health, safety, and welfare ofthe individual residents living in these homes as well as the local neighbors to providecertain minimum standards and regulations for structured sober living homes, and toprovide standards for the operators of such homes.NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITYOF PHOENIX as follows:SECTION 1. Chapter 10, Phoenix City Code, is amended by adding newArticle XV to read:ARTICLE XV. STRUCTURED SOBER LIVING HOMESSEC. 10-175. DEFINITIONS.IN THIS ARTICLE, UNLESS THE CONTEXT OTHERWISE REQUIRES:(A)APPLICANT MEANS THE OWNER(S) OF A STRUCTUREDSOBER LIVING HOME, INCLUDING EACH INDIVIDUAL MEMBER OF THEOWNERSHIP IF THE OWNER IS A CORPORATION, PARTNERSHIP, LIMITEDLIABILITY COMPANY, OR OTHER CORPORATE ENTITY, AS WELL AS THEMANAGER(S) OF A STRUCTURED SOBER LIVING HOME.

(B)BEHAVIORAL HEALTH SERVICES MEANS SERVICES THATPERTAIN TO MENTAL HEALTH AND SUBSTANCE USE DISORDERS ANDTHAT ARE EITHER:1)PERFORMED BY OR UNDER THE SUPERVISION OF APROFESSIONAL WHO IS LICENSED PURSUANT TO ARIZONA REVISEDSTATUTES TITLE 32 AND WHOSE SCOPE OF PRACTICE ALLOWS FOR THEPROVISION OF THESE SERVICES; OR2)PERFORMED ON BEHALF OF PATIENTS BYBEHAVIORAL STAFF AS PRESCRIBED BY RULE.(C)LICENSEE MEANS A PERSON IN WHOSE NAME ASTRUCTURED SOBER LIVING HOME LICENSE HAS BEEN ISSUED, ASWELL AS THE INDIVIDUAL OR INDIVIDUALS LICENSED AS THE MANAGEROF A STRUCTURED SOBER LIVING HOME.(D)OWNER MEANS THE INDIVIDUAL OR CORPORATE ENTITYRESPONSIBLE FOR OPERATING A STRUCTURED SOBER LIVING HOMEAND INCLUDES EACH INDIVIDUAL MEMBER OF THE OWNERSHIP IF THEOWNER IS A CORPORATION, PARTNERSHIP, OR LIMITED LIABILITYCOMPANY.(E)PERSON MEANS AN INDIVIDUAL, PROPRIETORSHIP,PARTNERSHIP, CORPORATION, ASSOCIATION, OR OTHER LEGAL ENTITY.(F)QUALIFIED MANAGER MEANS A PERSON THAT MEETS ALLOF THE FOLLOWING QUALIFICATIONS:1)IS CPR CERTIFIED AND THE CERTIFICATION ISCURRENT.2)HOLDS A CURRENT STRUCTURED SOBER LIVINGHOME MANAGER LICENSE ISSUED BY THE CITY OFPHOENIX.3)IS AT LEAST 21 YEARS OF AGE.(G)STRUCTURED SOBER LIVING HOME MEANS ANY PREMISES,PLACE, OR BUILDING THAT PROVIDES ALCOHOL-FREE OR DRUG-FREEHOUSING, PROMOTES INDEPENDENT LIVING AND LIFE SKILLDEVELOPMENT, AND PROVIDES STRUCTURED ACTIVITIES THAT AREDIRECTED PRIMARILY TOWARD RECOVERY FROM SUBSTANCE USEDISORDERS IN A SUPERVISED SETTING TO A GROUP OF UNRELATEDINDIVIDUALS WHO ARE RECOVERING FROM DRUG OR ALCOHOL2Ordinance G-6453

ADDICTION AND WHO ARE RECEIVING OUTPATIENT BEHAVIORALHEALTH SERVICES FOR SUBSTANCE ABUSE OR ADDICTION TREATMENTWHILE LIVING IN THE HOME. STRUCTURED SOBER LIVING HOME DOESNOT INCLUDE A PRIVATE RESIDENCE IN WHICH A RELATED FAMILYMEMBER IS REQUIRED TO RECEIVE OUTPATIENT BEHAVIORAL HEALTHSERVICES FOR SUBSTANCE ABUSE OR ADDICTION TREATMENT AS ACONDITION OF CONTINUING TO RESIDE IN THE FAMILY DWELLING.SEC. 10-176. LICENSE REQUIRED.(A)A PERSON VIOLATES THIS ORDINANCE IF THE PERSONOPERATES A STRUCTURED SOBER LIVING HOME WITHOUT A VALIDLICENSE ISSUED BY THE CITY OF PHOENIX.(B)A PERSON VIOLATES THIS ORDINANCE IF THE PERSONACTS AS A MANAGER OF A STRUCTURED SOBER LIVING HOME WITHOUTA VALID LICENSE ISSUED BY THE CITY OF PHOENIX.(C)EVERY APPLICANT FOR A STRUCTURED SOBER LIVINGHOME LICENSE AND STRUCTURED SOBER LIVING HOME MANAGERLICENSE MUST FILE AN APPLICATION FOR A LICENSE ON A FORMPRESCRIBED AND PROVIDED BY THE CITY CLERK. EACH APPLICANTMUST BE QUALIFIED ACCORDING TO THE PROVISIONS OF THIS ARTICLE.(D)THE LICENSE, IF GRANTED, MUST STATE ON ITS FACE THEAPPLICANT'S NAME, THE NUMBER OF THE LICENSE ISSUED TO THATAPPLICANT, AND THE EXPIRATION DATE. IF THE LICENSE IS FOR ASTRUCTURED SOBER LIVING HOME, IT MUST ALSO INCLUDE THESTRUCTURED SOBER LIVING HOME ADDRESS. IF THE LICENSE IS FOR ASTRUCTURED SOBER LIVING HOME MANAGER, IT MUST ALSO CONTAINA PHOTOGRAPH OF THE LICENSEE.(E)THE STRUCTURED SOBER LIVING HOME LICENSE MUST BEPOSTED IN A CONSPICUOUS PLACE AT OR NEAR THE ENTRANCE OFTHE STRUCTURED SOBER LIVING HOME SO THAT IT MAY BE READ ATANY TIME. A QUALIFIED MANAGER MUST KEEP THE MANAGER LICENSEON THE MANAGER'S PERSON OR ON THE PREMISES WHERE THELICENSEE IS THEN WORKING, AND MUST PRODUCE SUCH LICENSE FORINSPECTION UPON REQUEST BY A LAW ENFORCEMENT OFFICER OROTHER AUTHORIZED CITY OFFICIAL.SEC. 10-177. OWNER APPLICATION.(A)INFORMATION REQUIRED. A STRUCTURED SOBER LIVINGHOME LICENSE APPLICATION MUST INCLUDE THE FOLLOWINGINFORMATION ON A FORM PRESCRIBED AND PROVIDED BY THE CITYCLERK:1)THE NAME UNDER WHICH THE STRUCTURED SOBERLIVING HOME WILL BE DOING BUSINESS (IF ANY) AND THE FULL STREETADDRESS, EMAIL ADDRESS (IF ANY) AND PHONE NUMBER OF THESTRUCTURED SOBER LIVING HOME.3Ordinance G-6453

2)THE FULL TRUE NAME AND ANY OTHER NAMES USEDBY THE APPLICANT IN THE PRECEDING FIVE (5) YEARS.3)THE PHYSICAL DESCRIPTION, DATE, AND PLACE OFBIRTH OF THE APPLICANT.4)THE APPLICANT'S CURRENT RESIDENTIAL ADDRESS,MAILING ADDRESS, EMAIL ADDRESS (IF ANY), AND TELEPHONE NUMBER.5)THE NAME OF ALL OTHER BUSINESSES UNDER WHICHTHE APPLICANT OPERATES OR HAS OPERATED A STRUCTURED SOBERLIVING HOME.6)IF THE APPLICANT IS A CORPORATE ENTITY, THENAMES AND RESIDENTIAL ADDRESSES OF ALL OFFICERS, MEMBERS,GENERAL PARTNERS, OR DIRECTORS AND ANY INDIVIDUALS WITH ACONTROLLING INTEREST IN THE CORPORATION, PARTNERSHIP, LIMITEDLIABILITY COMPANY, OR OTHER FICTITIOUS ENTITY.7)IF THE APPLICANT IS A CORPORATE ENTITY, THENAME AND ADDRESS OF THE STATUTORY AGENT OR OTHER AGENTAUTHORIZED TO RECEIVE MAIL AND SERVICE OF PROCESS .8)THE NAME OF ISSUING JURISDICTION AND THEEFFECTIVE DATES OF ANY LICENSE OR PERMIT ISSUED TO THEAPPLICANT THAT RELATES TO OPERATING A STRUCTURED SOBERLIVING HOME, AND WHETHER ANY SUCH LICENSE OR PERMIT HAS BEENDENIED, REVOKED, OR SUSPENDED, AND IF SO, IDENTIFYING ANDDESCRIBING THE REASON OR REASONS THEREFORE.9)IDENTIFYING WHETHER THE APPLICANT HAS EVERENTERED INTO A CONSENT AGREEMENT WITH THE CITY CLERK UNDERTHIS ARTICLE, AND IF SO, THE DATE OF THE AGREEMENT.10)ALL CRIMINAL CHARGES, COMPLAINTS, ORINDICTMENTS AGAINST THE APPLICANT IN THE PRECEDING FIVE (5)YEARS, WHICH RESULTED IN A CONVICTION OR A PLEA OF GUlLTY ORNO CONTEST FOR ANY OFFENSE DESCRIBED IN SECTION 10-180 (A)(8)OF THIS ARTICLE AND COMMITTED IN THIS STATE, OR ANY OFFENSECOMMITTED OUTSIDE THIS STATE, WHICH IF COMMITTED IN THIS STATECONSTITUTES AN OFFENSE DESCRIBED IN SECTION 10-180 (A)(8).11)AFFIRMATION BY THE OWNER THAT ONLY RESIDENTS(OTHER THAN THE OWNER OR MANAGERS) WHO HAVE THE DISABILITYOF ADDICTION TO DRUGS OR ALCOHOL AS DEFINED BY STATE ANDFEDERAL LAW AND WHO ARE IN RECOVERY ARE ELIGIBLE TO RESIDE ATTHE STRUCTURED SOBER LIVING HOME AND THE HOME WILL NOTADMIT PERSONS WHO POSE A DIRECT THREAT TO THE HEALTH ANDSAFETY OF OTHERS.12)IF THE PROPERTY OWNER IS NOT THE SAME PERSONAS THE STRUCTURED SOBER LIVING HOME OWNER, THE NAME, STREET4Ordinance G-6453

THE APPLICANT FOR ASTRUCTURED SOBER LIVING HOME LICENSE MUST SUBMIT THEFOLLOWING DOCUMENTATION WITH THE APPLICATION TO THE CITYCLERK:1)IF THE APPLICANT IS A CORPORATE ENTITY, A ,COPYOF THE ARTICLES OF INCORPORATION, CERTIFICATE OF LIMITEDPARTNERSHIP OR OTHER ORGANIZATIONAL DOCUMENT, AND ANYAMENDMENTS THERETO. IF A FOREIGN CORPORATE ENTITY, A COPY OFAUTHORITY TO TRANSACT BUSINESS ISSUED BY THE ARIZONACORPORATION COMMISSION.2)A CLEARLY LEGIBLE FLOOR PLAN ON AN 8 Y2 BY 11SHEET OF PAPER OF THE STRUCTURED SOBER LIVING HOME THATINCLUDES THE TOTAL SQUARE FOOTAGE OF THE HOME, THE LAYOUT,LOCATION, DIMENSIONS, AND SQUARE FOOTAGE OF EACH BEDROOM,THE NUMBER OF BEDS IN EACH BEDROOM, AND THE MAXIMUM NUMBEROF RESIDENTS PROPOSED TO OCCUPY THE HOME NOW AND IN THEFUTURE.3)A COPY OF THE GENERAL LIABILITY INSURANCEPOLICY ON THE PROPERTY SHOWING THE STRUCTURED SOBER LIVINGHOME OWNER'S NAME AND THE STRUCTURED SOBER LIVING HOMEADDRESS AS COVERED.4)A COPY OF THE STRUCTURED SOBER LIVING HOME'SRULES AND REGULATIONS, AND WRITTEN PROCEDURES FOR HANDLINGRESIDENT INTAKE, MEALS, RELAPSE, AND DISCHARGE.5)A COPY OF THE STRUCTURED SOBER LIVING HOME'SGOOD NEIGHBOR POLICY.6)WRITTEN PROOF OF AGE FOR THE APPLICANT IN THEFORM OF A CURRENT DRIVER'S LICENSE WITH PICTURE OR OTHERCURRENT PICTURE IDENTIFICATION DOCUMENT ISSUED BY AGOVERNMENTAL AGENCY.7)WRITTEN PROOF OF LAWFUL PRESENCE IN THEUNITED STATES PURSUANT TO A.R.S. § 41-1080.8)FINGERPRINTS.ONE (1) SET OF THE APPLICANT'S COMPLETE9)IF THE PROPERTY OWNER IS NOT THE SAME PERSONAS THE STRUCTURED SOBER LIVING HOME OWNER, A COPY OF THELEASE OR AUTHORIZATION TO OCCUPY THAT STATES THAT THEPROPERTY WILL BE USED AS A STRUCTURED SOBER LIVING HOME ANDEVIDENCE THAT THE PROPERTY IS REGISTERED AS A RENTALPROPERTY WITH THE MARICOPA COUNTY ASSESSOR.5Ordinance G-6453

(IV)REQUIRE CIGARETTES BE DISPOSED OF IN THEHOME'S DESIGNATED DISPOSAL CONTAINERS.0/)THE RESIDENT'S RIGHTS AND GRIEVANCEPROCEDURES.0/1)REQUIRE THE REGULAR PARTICIPATION BYRESIDENTS IN SELF-HELP MEETINGS AND TO PROVIDE PROOF OFATTENDANCE TO THOSE MEETINGS TO THE STRUCTURED SOBERLIVING HOME OWNER OR QUALIFIED MANAGER WITHIN 24 HOURS OFATTENDANCE.0/11) REQUIRE RESIDENTS TO SEEK EMPLOYMENT,OR BE EMPLOYED OR PROVIDE VOLUNTEER SERVICES FOR AT LEAST 3HOURS PER DAY. THOSE RESIDENTS WHO HAVE BEEN MEDICALLYDIAGNOSED AS MENTALLY ILL OR DISABLED OTHER THAN SUBSTANCEABUSE OR ALCOHOL OR DRUG ADDICTION ARE EXEMPT FROM THISREQUIREMENT.0/111) REQUIRE RESIDENTS TO BE SUBJECT TORANDOM DRUG AND ALCOHOL TESTING.(B)COPIES OF EACH OF THE FOLLOWING DOCUMENTS MUSTBE POSTED IN A CONSPICUOUS LOCATION IN THE HOME:1)GOOD NEIGHBOR POLICY.2)HOME RULES AND REGULATIONS.3)MEAL SCHEDULE OR WRITTEN PROCEDURES THATENSURE RESIDENTS HAVE KNOWLEDGE OF AND ACCESS TO MEALS IFMEALS ARE PROVIDED.4)EVACUATION MAPS AND PROCEDURES.5)EMERGENCY CONTACT INFORMATION FOR.RESIDENTS TO CONTACT THE OWNER OR QUALIFIED MANAGER(S).(C)THE OWNER MUST ONLY HIRE A QUALIFIED MANAGER(S)AND AT LEAST ONE (1) QUALIFIED MANAGER MUST BE ON THEPREMISES WHEN RESIDENTS ARE ON SITE EXCEPT ON A LIMITED BASISA MANAGER MAY BE AWAY FROM THE PREMISES FOR NO MORE THANTHREE (3) HOURS AT A TIME TO RUN ERRANDS.(D)AN OWNER OR QUALIFIED MANAGER MUST:1)DRUG TEST (URINE AND BREATHALYZER) EACHPROSPECTIVE NEW RESIDENT DURING THE INTAKE PROCESS TOENSURE THE INDIVIDUAL IS FREE OF DRUGS AND ALCOHOL BEFOREBEING ADMITTED AS A RESIDENT OF THE HOME.2)CONDUCT RANDOM DRUG TESTS (URINE ANDBREATHALYZER) ON ALL RESIDENTS AT LEAST ONCE PER QUARTER,8Ordinance G-6453

MAINTAIN A LOG OF ALL COMPLETED DRUG TESTS OF RESIDENTS ON AFORM PRESCRIBED BY THE CITY CLERK WITH THE DATE TESTED, ANDMAKE SUCH LOGS AVAILABLE FOR CITY INSPECTION, UPON REQUEST.3)PROVIDE EACH NEW RESIDENT WITH A COPY OF THEHOME'S RULES AND REGULATIONS, GOOD NEIGHBOR POLICY, MEALSCHEDULE OR INFORMATION ABOUT HOW TO ACCESS MEALS,LOCATION OF THE FIRST AID KIT, CIGARETTE DISPOSAL CONTAINERS,EVACUATION MAPS AND PROCEDURES, AND EMERGENCY CONTACTINFORMATION FOR THE OWNER AND QUALIFIED MANAGER(S).STRUCTURED SOBER LIVING HOMES THAT DO NOT PROVIDE MEALSARE EXEMPT FROM PROVIDING EACH NEW RESIDENT WITH THE MEALSCHEDULES OR RELATED ACCESS INFORMATION.4)RETAIN ALL RESIDENT'S PROOF OF ATTENDANCE ATSELF-HELP MEETINGS ON PREMISES AND MAKE THEM AVAILABLE FORCITY INSPECTION FOR A LEAST THREE MONTHS FROM THE DATE OFATTENDANCE.CONDUCT A SAFETY SELF-ASSESSMENT CHECKLIST5)FOR THE HOME AT LEAST ONCE PER QUARTER ON A FORMPRESCRIBED BY THE CITY CLERK AND MAINTAIN A COPY OF EACHCOMPLETED SAFETY SELF-ASSESSMENT CHECKLIST ON THE PREMISESFOR AT LEAST ONE (1) YEAR FROM THE DATE OF ASSESSMENT ANDMAKE AVAILABLE FOR CITY INSPECTION UPON REQUEST. IFTHE PROPERTY FAILS INSPECTION, THE OWNER MUST CURE ANYIDENTIFIED DEFECTS. AFTER THE IDENTIFIED DEFECTS ARECORRECTED, THE OWNER MUST SUBSEQUENTLY CONTACT THE CITYTO SCHEDULE A FOLLOW UP INSPECTION. THE CITY CLERK MAYAPPROVE A WRITTEN REQUEST FOR MORE TIME SUBMITTED BY THEOWNER FOR THE PURPOSE OF CURING ANY INSPECTION DEFICIENCIES.(E)A LICENSED STRUCTURED SOBER LIVING HOME MUST PASSAN ANNUAL PROPERTY INSPECTION CONDUCTED BY THE CITY AS PARTOF THE ANNUAL RENEWAL PROCESS.SEC.10-183. CRIMINAL HISTORY REVIEW; FINGERPRINTS.THE CITY CLERK MAY RECEIVE AND REVIEW THE CRIMINALHISTORY RECORD INFORMATION, INCLUDING CONVICTION AND NONCONVICTION DATA, OF LICENSE APPLICANTS FOR THE PURPOSE OFEVALUATING THE FITNESS OF THE APPLICANTS, LICENSEES,CONTROLLING PERSONS, AND MANAGERS IN CONNECTION WITH THEISSUANCE, RENEWAL, SUSPENSION, OR REVOCATION OF A LICENSE, ORTHE ADDITION OR CHANGE OF A CONTROLLING PERSON OR AMANAGER. SUCH INFORMATION WILL BE USED ONLY FOR THE PURPOSE14Ordinance G-6453
