Decks -State Building Code RequirementsPermit: A building permit is required. Homeowners may do their own work. Contractors shall be state licensed. Cost of the permit isbased on project value, and determined by using the City of Lake Elmo Building Permit Fee schedule.Deck permit applications shall include: A copy of the certificate of survey or site plan drawn to scale, showing all property lines,structures and the proposed deck location with distances to property lines.Two copies of the building plansPlans: Deck plans shall show the following:Size and depth of footingSize of beamsHeight and design of guardrailType of footing formsSize and spacing of joistsSize of deckSize and spacing of postsType of floor boardsDistance to property linesType of lumberHeight of deck off groundPlans shall be 8 ½ x 11, or 11x17Footings: Shall be at least 42 inches deep by 8 inch diameter. Footing forms shall be cardboard tubes. Deck footings are subject tofrost heave. Deeper footings and footings wider at the bottom will help prevent frost heave. Please note: Diamond Piers are notapproved for installation in the City of Lake Elmo.Treated Wood: All wooden members of decks shall be treated or rot resistant wood, such as redwood or cedar.Posts: Shall be anchored to prevent movement.Beams: Beam end joints and splices shall be made over posts. Beams bolted to posts shall have at least two ½ inch carriage bolts,staggered on each post.Ledger: Ledger boards shall be bolted to solid material such as 2x10 rim joist, floor trusses, sill plate, top plates, etc. Materials notacceptable to bolt into include: Manufactured I joists. Foam filled rim joists. Wall sheathing. Bolt ledger with a minimum of ⅜ inch boltsspaced 16 inch on center, staggered top and bottom. Flashing is required where the deck ledger board is attached to the house.Cantilever: Cantilevered areas, a boxed out area or bay usually with a patio door, will not support a deck. Double the joists around thecantilever area to make the deck self supporting. See diagram.Joist hangers: Joist hangers are required wherever joists do not have at least 1½ inch of bearing. Joist hangers shall be of proper size(i.e. 2x8 joists require 2x8 joist hangers). Joist hangers require one nail per nailing hole. Stainless steel or hot-dip galvanizedconnectors and fasteners are required with treated wood. Electroplated galvanized fasteners are not acceptable.Guardrail: Decks more than 30 inches off grade require a guardrail at least 36 inches high, built so that a 4 inch object cannot passthrough.Stairs: The maximum rise on stairs is 7¾ inch. Maximum opening in risers is 4 inches. The greatest riser height shall not exceed thesmallest by more than ⅜ inch. Special attention should be given to make sure the top and bottom riser heights are correct. Theminimum run is 10 inches. All runs shall be equal.Handrails: Continuous handrails are required for 4 or more stair risers. Handrails shall be 34-38 inches above the tread nosing. Thehandgrip portion of handrails shall be 1 ¼ - 2 inches wide and in a shape that is easy to grip firmly. The ends of the handrail shall bereturned to a wall or end in safety terminals to avoid the possibility of catching loose clothing. Stairs to decks more than 30 inchesabove grade require guardrails built so that a 4⅜ inch object cannot pass through.Escape Windows: There shall be a minimum of 36 inch clear height over basement escape windows.Inspections: Call for footing inspection after footing holes are dug, before pouring concrete. Call for final inspection when deck iscomplete.Call before you dig: Contact Gopher State One Call excavation notification center at tact-us to locate utilities. All utility lines will be located free of charge.Future Porch: Future porch additions on the deck require additional structural design and additional distance or setbacks to theproperty lines. Typical porch footings are up to 24 inch diameter and up to 60 inches deep. 8x42 inch footings will not work on a porch.Beams should be located under future wall locations and sized to carry the wall and roof loads. It is recommended that future porchplans be submitted with the deck plans for review.Completion Date: Decks must be completed within six months of issuance of the permit.While not all inclusive, this information and illustrations should be used as a general guide to meeting the minimum standards of thebuilding code. Diagrams are for illustrative purposes only. Other designs that meet the code are also acceptable

DECKS This handout is intended only as a guide. It shall not be considered a complete set of requirements. Materials and installation must comply with the current Minnesota State Building Code and themanufacturers’ installation specifications for each product. A building permit is required for any deck/platform that is attached to a structure or is 30” or more abovegrade. A deck/platform that is less than 30” above grade, is not attached to a structure with frostfootings, and is not part of an accessible route, does not require a building permit. Landings must beattached to structures or be engineered to resist both lateral and vertical forces. Most municipalitiesrequire a zoning review. Please check with your municipality regarding requirements.BUILDING Permit Submittal shall include:Building Permit Application, completed in its entirety, including signature and valuation.SUPPLEMENTAL WORKSHEET FOR DECKS (included in this handout).One set of plans (drawn to scale) showing the proposed design, and including:o Deck materials, including fasteners, connectors, and lumber type/material size.o Deck height.o Footing depths, sizes, and locations.o Joist, beam, decking sizes and locations. Lumber type.o Post spacing.o All window locations adjacent to deck.o Stair and landing location and size/height.A site plan (or Certificate of Survey if required by municipality) drawn to scale and dimensioned,identifying proposed deck dimensions with measurements from the adjacent lot lines; as well as alllot lines, setbacks, easements, adjacent street names, and all structures on the property. Checkwith your municipality to determine setback requirements for the property.Additional information may be required by the plan reviewer.PERMIT CARD AND APPROVED PLANS (throughout the project) shall be:POSTED prior to start of work - VISIBLE from street or driveway - ACCESSIBLE to the inspector.INSPECTION REQUIREMENTS:Inspections MUST be scheduled during office hours AT LEAST one business day prior to inspection. If aspecific date and time is required, additional notice may be needed. Failure to cancel a scheduledinspection may result in a reinspection fee. Any cuts in exterior finish shall beflashed.Frost footings are required for any deck attached to a structure that has frost footings. Frost footingsare required for all detached decks unless:o The joists bear directly on a precast concrete pier block at grade without support by beams or posts.o The area of the deck does not exceed 200 SF.o The walking surface is not more than 20” above grade at any point within 36” measured horizontallyfrom the edge.o Footings shall be designed to support the structure. The minimum depth to the base of the footingis 42” in Zone 1.Cantilevers (overhanging joists and beams) – Refer to Table R507.6 and Table R507.5 (footnote g) forjoist and beam cantilever requirements. Cantilevers greater than that listed in the tables will requireengineering to be provided.All joist to beam, beam to post, and post to footing connections must have a positive connection toresist lateral displacement.All exposed wood used in the construction of decks is required to be a type with natural resistance todecay (redwood, cedar, etc.) or approved treated wood. This includes posts, beams, joists, decking andrailings. If wood is to be used below or in contact with grade, it must be approved for ground contact.Field-cut ends, notches, and drilled holes of preservative-treated wood shall be treated in the field inaccordance with AWPA M4.All fasteners (nails, bolts, screws, hangers, etc.) must meet the requirements set forth in Table R507.2.3.All (round) joist hanger holes must be filled with nails/screws approved for joist hanger structuralconnections.Composite decking shall comply with Section R507.2.2 and ASTM D7032.If decking is installed perpendicular to the joists, joist spacing of 24” on center requires 2” minimum(nominal) decking, and joist spacing of 16” on center requires 5/4” minimum decking. For diagonallyinstalled decking, joist spacing of 16” on center requires 2” minimum (nominal) decking, and joistspacing of 12” on center requires 5/4” minimum decking. Decking may not be installed diagonally ifjoist spacing is greater than 16” on center. Maximum angle of 45 degrees from perpendicular for wooddeck boards. Composite decking shall be installed according to the manufacturer’s instructions as wellas R507.2.2 and ASTM D7032.Guards are required on all decks more than 30” above grade or floor below. Guardrails must be 36”minimum in height. Open guardrails must have intermediate rails or an ornamental pattern that a 4”sphere cannot pass through. The top section of guardrails must be built to withstand 200 lbs. of loadapplied from any direction. Stair Exception: Guardrails on stairs must be 34” minimum in height measured vertically from a lineconnecting the nosing. Open guardrails on stairs must have intermediate rails or an ornamental patternthat a 4-3/8” sphere cannot pass through. The triangular opening formed by the riser, tread, and bottomelement of a guardrail must be sized so that a 6” sphere cannot pass through.Stairways must be a minimum width of 36” above the handrail. Maximum riser height is 7-3/4”. Treaddepth is measured excluding nosing. Minimum tread depth is 10”. The largest tread depth or riserheight shall not exceed the smallest by more than 3/8”. Open risers are permitted, provided that theopening between treads does not permit the passage of a 4” sphere, or the riser is less than 30” abovegrade. Nosing not less than ¾” and not more than 1-¼” shall be provided with solid risers (unless thetread depth is 11” or greater).Exterior landings, decks, balconies, and stairs shall be positively anchored to the primary structure.Attachment shall not be accomplished by use of toenails or nails subject to withdrawal.Lighting must be provided to illuminate the stairway and shall have a light source located at the toplanding of the stairway.Handrails are required on at least one side of any stairway with 4 or more risers. The handrail must beplaced so that the top of the handrail is between 34” and 38” measured above the plane of the treadnosing. Handrails must be continuous for the entire length of the stairs, and shall include ALL risers.Handrails shall return at the ends or terminate into a newel post. The handgrip must have a smoothsurface with no sharp corners, and must meet the requirements for a Type 1 or Type 2 handrail as setforth in MRC Section R311.7.8.5. Please contact the inspections office for specific design details if youare using a 2x material placed on end.Landings are required at the top and bottom of each stairway.
