awarded to that Offeror.2. Local Oahu Office and/or Representative:a. Offeror shall have a permanent office location and/or representative on theisland of Oahu from which he/she conducts business, from which he/she shallbe accessible for telephone calls, and where products and parts can be stagedand/or stored, as may be necessary, in the event that the project is not readyon schedule for furniture installation. Failure to maintain the permanent Oahuoffice location shall be sufficient grounds for termination of contract.b. If Offeror will be subcontracting any of the work specified herein, thesubcontractor shall have the qualifications listed above for the portion of workto be subcontracted as well as any adjustments and repairs of productsprovided herein. Offeror shall complete "Offeror Information" on the OFFERFORM.1.4CERTIFICATION OF INDEPENDENT COST DETERMINATIONBy submission of a bid response to this IFB, Offeror certifies as follows:a. The costs in this IFB have been arrived at independently, without consultation,communication, or agreement with any other bidder, as to any matter relatingto such costs for the purpose of restricting competition.b. Bid PricesBid prices shall include, but not be limited to the following:a. Delivery and installation complete to destinations: Kona Judiciary Complex, 745485 Kamakaeha Avenue, Kona, Hawai’i, Hawai’i 96740.b. All applicable taxes, including the Hawaii General Excise Tax, manufacturer andfreight costs, labor, materials, equipment, storage, transportation, installation,warranty, and any other incidental cost to provide items as specified herein.c. Each item, including all sub-items, offered shall be priced separately and the unitprices extended and totaled. In case of error in extension of price, unit price willgovern.d. In case of error in the Total Sum Bid, the sum of the total amount bid for eachappropriate line item or sub-item will govern.e. Offeror need not offer pricing for each group to be considered for award.However, Offeror must bid on all sub-items (e.g. Item C1 thru W) within anitem grouping (e.g. Seating and Misc.) to be considered for award for that itemgrouping.f.Delivery of items, to the destinations specified herein above, completelyassembled, adjusted, and placed as directed by the Contracts Administrator.g. b. Pursuant to §103D-310(c), HRS, the lowest responsive Offeror shall berequired to submit a certificate of compliance issued by the Hawai'i StateDepartment of Labor and Industrial Relations (DLIR). The certificate is valid forsix (6) months from the date of issue and must be valid on the date it isreceived by the DAGS-PW. A photocopy of the certificate is acceptable to theDAGS-PW.The certificate of compliance shall be obtained on the State of Hawai'i, DLIRAPPLICATION FOR CERTIFICATE OF COMPLIANCE WITH SECTION 3-122112, HAR, Form LIR#27 which is available athttp://hawaii.gov/labor/formsall.shtml, or at the neighbor island DLIR DistrictOffices. The DLIR will return the form to the Offeror who in turn shall submit itto the SPO. The application for the certificate is the responsibility of theOfferor, and must be submitted directly to the DLIR and to the DAGS-PW.c. Certificate of Good Standing1) Compliance with Section 103D-310(c), HRS. Pursuant to Section 3-122112, HAR, the lowest responsive Offeror shall be required to submit aCERTIFICATE OF GOOD STANDING (Certificate) issued by the State ofHawai'i Department of Commerce and Consumer Affairs (DCCA) BusinessRegistration Division (BREG).2) The Certificate is valid for six (6) months from date of issue and must bevalid on the date it is received by the DAGS-PW. A photocopy of thecertificate is acceptable to the DAGS-PW.5. Hawaii Compliance Express (HCE)Alternately, instead of separately applying for the certificates from the various stateagencies (DLIR, DCCA, and DOTAX), vendors may choose to use the HawaiiCompliance Express (HCE) which allows businesses to register online through asimple wizard interface at http://vendors.ehawaii.gov to acquire a "Certificate ofVendor Compliance". The HCE provides current compliance status as of theissuance date. The "Certificate of Vendor Compliance" indicating that vendor'sstatus is compliant with the requirements of §103D-310(c), HRS, shall be acceptedfor both contracting purposes and final payment. Vendors that elect to use the newHCE services will be required to pay an annual fee of 12.00 to the HawaiiInformation Consortium, LLC (HIC). Vendors choosing not to participate in theHCE program will be required to provide paper certificates as instructed in thesections previous to this one.6. Timely Submission of all Compliance Certificatesa. To obtain the Certificate, the Offeror must first be registered with the BREG. Asole proprietorship, however, is not required to register with the BREG, andtherefore not required to submit the certificate.b. 1) To register or to obtain the Certificate by phone, call (808) 586-2727 (M-F7:45 a.m. to 4:30 p.m. HST).2) Offerors are advised that there are costs associated with registering andobtaining the Certificate.c. The above certificates should be applied for and submitted to the DAGS-PW assoon as possible.d. If a valid certificate is not submitted on a timely basis for award of a contract,an otherwise responsive and responsible offer may not receive the award.7. Tax Liabilitya. Work to be performed under this solicitation is a business activity taxable underChapter 237, HRS, and if applicable, taxable under Chapter 238, HRS.b. Vendors are advised that they are liable for the Hawaii GET at the current4.167% rate for work done on Hawai’i.c. If, however, an Offeror is a person exempt by the HRS from paying the GETand therefore not liable for the taxes on this solicitation, Offeror shall state itstax exempt status and cite the HRS chapter or section allowing the exemption.8. Taxpayer Preferencea. For evaluation purposes, pursuant to §103D-1008, HRS, the Offeror's taxexempt price offer submitted in response to an IFB shall be increased by theapplicable retail rate of general excise tax and the applicable use tax. Under nocircumstance shall the dollar amount of the award include the aforementionedadjustment.11. Cost for Bid Preparationa. Any costs incurred by the Offeror for the development and submittal of abid in response to this IFB shall be the responsibility of the Offeror, whetheror not any award results from this solicitation. The State of Hawai'i shall notbe responsible for any such costs.1.6SUBSTITUTION REQUEST1. Pre-approved ProductsFor this solicitation all products offered require pre-approval by the State prior tobid opening date.2.
