Annual ReportInsurance DivisionInsurance Division OrganizationThe Insurance Division, to protect the insurance-buying public, regulates insurance companies, agencies, and agents doingbusiness in Oregon. Activities include licensing, monitoring,examining, and investigating. The division also collects andaudits premium taxes on insurance companies.from insurers, which amounted to 69.5 million in general fundmoneys in Fiscal Year 1996; supervision of all surplus linesbusiness in Oregon; and maintenance of security deposits bylicensed insurers. The section also reviews applications for information of risk retention and purchasing groups under theprovisions of the Liability Risk Retention Act of 1986.Administrative Services and OperationsIn addition to providing administrative support to the Insurance Division, the Administrative Services and OperationsSection receives and reviews applications and appointmentsfor agents, firms, and corporations licensed to sell insurance inthe State of Oregon. The section establishes licensing requirements for insurance agents, oversees the development andadministration of licensing examinations, and processes continuing education course registrations.Administrative Services and Operations develops legislationand administrative rules, and tracks legislation during the legislative session. The section is also responsible for developingthe budget of the Insurance Division.Company RegulationMost insurance policies offered for sale in Oregon must firstbe submitted to the insurance administrator for approval. TheCompany Regulation Section oversees the form approval process; the policies that insurance companies offer to consumersare reviewed for legality and fairness. Property and casualtyand health pricing systems are also reviewed to ensure thatsystems are not inadequate, excessive, or unfairly discriminatory. In some cases, advertising and marketing practices arealso reviewed. Additionally, the section provides objective dataand testimony to the Legislature on property and casualtyissues.Company Regulation Section is also responsible for the licensing and examination of all domestic and foreign insurers.Company Regulation activities include maintenance of fileson approximately 1,500 licensed insurers; review of annual financial statements; review of applications to transact insurancebusiness in Oregon; collection of premium and retaliatory taxes1Examination activities include examination of the financial condition, market conduct, and insurance operations for all insurersdomiciled in Oregon at least once every three years, as well asparticipation in the examination of other foreign and alien insurers. Additional responsibilities include administration andreview of filings for new company formations and applicationsfor mergers and/or acquisitions of domestic insurers. The examinations staff also supervises the rehabilitation and liquidationactivities involving domestic insurers.Consumer ProtectionConsumer Services and Enforcement Section responds to complaints and concerns brought to the attention of the insurancecommissioner involving insurance transactions. Inquiries andcomplaints are received by phone, letter, and in person. Whenthere is reason to believe that the insurance code or administrative rules have been violated by an individual, agent, agency,or company, an investigation may be conducted and evidencemay be presented at a formal hearing. This section also conducts workers’ compensation premium audit and classificationhearings, as well as sanction, rate and rulemaking hearings. Inaddition, alternative dispute resolution provides a more costeffective means of resolving workers’ compensation premiumaudit and medical service provider fee disputes.Consumer Advocacy, created in 1987 as a part of the department is intended to make the insurance industry and theregulatory process more responsive to consumer needs andconcerns. The Consumer Advocacy program assists insuranceconsumers through a three-pronged approach: public education; representation in ratemaking and rulemaking hearings; andadvocacy for consumers in the legislative process.

Annual ReportInsurance DivisionExplanation of Terms Used in TablesThe next several pages show the accounting results of eachcompany for each line of insurance as categorized in the financial reporting format required. These categories do not provideinformation about some specific insurance coverages (such asproducts liability) or classes of insureds (such as houses lessthan five years old). These figures are accounting data intendedfor use in evaluating the financial condition of each company.Comparing premiums and losses in this form provides only arough indication of how appropriately priced each line of business may be for all companies combined. The results reportedfor a single line, company, and year are subject to considerablevariation as well as artificial mechanics of accounting procedures.“Direct” is the term used to describe insurance transactionsbetween the insurance buyer and the insurance company before or without regard to reinsurance transactions amonginsurance companies.years. This includes claims which might not yet have beenreported and claims which have not yet been resolved.“Dividends paid” is the amount paid to policyholders underparticipating agreements. These dividends are paid to policyholders after coverage for which they have paid premiumsexpired. The premiums for which dividends have been paidin the current year are almost entirely written and earned oneto two calendar years before. Hence, dividends paid in 1995are not strictly comparable to 1995 premiums. Dividendspaid to company stockholders are not included.“Premium written” is usually defined as premium billed byproperty and casualty companies. Rules of life insurance accounting require reporting premiums actually collected. Thisitem is a measure of marketing activity in this state for theyear.“Premium earned” is constructed from premium written thisyear and in previous years, and in some instances, premiumto be written in the future for current coverages. It is approximately the pro rata portion of the premium charged for eachpolicy, for the portion of coverage provided, within the calendar year.“Annuity considerations” are revenue received for annuitycontracts during the latest year. This amount corresponds topremium written for insurance contracts. ‘Consideration’ isa term from contract law for payment given by one party toobligate the other to performance specified by contract.“Unearned premium reserves” are premiums written forfuture coverage. This might also be understood as the amountan insurer would have to return to policyholders if it canceled all policies in force. This amount of revenue is deferredfrom earnings to achieve a proper matching with losses andexpenses incurred.“Insurance in force” is the total amount of coverage provided by policies that are in force at a specified moment.These are policies that have become effective and have notexpired or lapsed. This construct is primarily meaningfulfor life insurance or other insurance where a stated amountof coverage is purchased.“Losses paid” is the sum of all payments made during theyear to, or for, the benefit of insurance claimants. These payments include amounts paid in the current year for claimsarising from coverage in prior years, and exclude amountswhich will be paid in future years for claims arising from thecurrent year. Hence, this item is not a measure of the actualcost of current coverages, but only of current cash flows.“Benefits paid” is the amount paid in performance ofobligaions imposed by life or annuity contracts. This corresponds to ‘losses paid’ and includes amounts paid during thecurrent year for obligations incurred in prior years, but doesnot include amounts insurers are obligated to pay in futureyears. This is a cash flow item only and not a measure ofprofitability or the cost of current coverages.“Losses incurred” equals losses paid, plus a year-end estimate of future payments for all current and prior year claims,minus the losses incurred estimate for the preceding year. Ifthese estimates were to be exactly correct, then losses incurred would be the actual cost of all claims on coverageprovided during the current year. However, incurred lossesreported also includes estimated amounts unpaid for incurredbut-not-reported (IBNR) claims.“Loss ratio” equals losses incurred divided by premiumsearned. This is the best accounting representation of the portion of each premium dollar that has been needed to honorthe company’s promise to pay claims. The figures shown aresubject to many artificialities of insurance accounting, suchas those explained above, as well as considerable variationbetween years and among companies.“Losses unpaid” is the insurer’s estimate of amounts to bepaid in the future for coverage provided in the current or prior(Continued on page 12)11

Annual ReportInsurance DivisionThe permissible or expected loss ratios differ according to theorganization and marketing methods used by each company,the line of business, and the particular coverage within a line.Fidelity and surety insurance companies, for instance, expectlosses to be infrequent and the insurers to have recovery rights.Title companies also provide a loss prevention service with infrequent losses expected.The reports for property and casualty and life companies wereobtained from the companies’ Annual Statements, “Direct Business in the state of Oregon during 1996,” as filed with theinsurance commissioner. For informational purposes, the Oregon experience of non-authorized (unlicensed) insurance12companies is shown separately. ORS 735.410 allows a licensed“surplus lines” agent under certain circumstances to place business with companies other than those authorized by theinsurance commissioner to transact business in Oregon. Sincethese companies are authorized by the regulator of some otherstate, or country, the NAIC receives their Annual Statements.A list of authorized insurers is available on request from theInsurance Division as a separate publication. Data containedherein for fraternal, health care service contractors, mortgageguaranty and title companies have been manually compiled bythe Information Management Division.
