RESOLUTION NO. T-2021-02-001R AUTHORIZING THE SUPERVISOR TO SIGN AN INTERGOVERNMENTAL AGREEMENT WITH THE SCHOOL DISTRICT OF EDUCATION OF THE URBANA SCHOOL DISTRICT NO. 116 (For the Purposes of Providing Emergency Housing Services to Homeless Families with the Urbana School District Boundaries) WHEREAS, Champaign Urbana lacks same day emergency shelter for homeless parents with children; and WHEREAS, The Regional Office of Education provided for emergency housing for families with children in school until Summer of 2019 when the program ended; and WHEREAS, the Cunningham Township Supervisor explored all known options to have existing providers to expand services to homeless families; and WHEREAS, Cunningham Township Supervisor’s Office (CTSO) launched an emergency housing program for parents with children to fill this gap using privately fundraised dollars; and WHEREAS, Cunningham Township Supervisor’s Office intends to continue this program supported by tax dollars, state funds, and/or private dollars as a core program; and WHEREAS, the School District and CTSO are both public bodies as defined under Illinois law, and have authority to enter into intergovernmental agreements pursuant to the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.; and WHEREAS, the parties are willing and able to provide a framework for cooperation to assist in providing services to eligible members of the community. NOW THEREFORE BE IT RESOLVED by the Township Board of the Town of Cunningham that the Resolution Authorizes the Township Supervisor to sign an Intergovernmental Agreement with School District of Education of the Urbana School District No. 116. INTERGOVERNMENTAL AGREEMENT This Intergovernmental Agreement (hereafter “Agreement”), entered into this day of , 2021, between the School District of Education of Urbana School District No. 116 (hereafter “School District”) and the Cunningham Township Supervisor’s Office (hereafter “CTSO”) WHEREAS, the School District and CTSO are both public bodies as defined under Illinois law, and have authority to enter into intergovernmental agreements pursuant to the Intergovernmental Cooperation Act, 5 ILCS 220/1 et seq.; and WHEREAS, there is currently a need for collaboration and cooperation between the parties to assist in making adequate housing available to homeless families within the Urbana School District boundaries; and WHEREAS, the parties are willing and able to provide a framework for cooperation to assist in providing services to eligible members of the community. NOW, THEREFORE, the School District and CTSO agree as follows: 1. The School District shall appoint a School District representative(s) to coordinate with CTSO staff for the following: a. Referral of potential families using initial household screening using documentation provided by CTSO; b. Assist families in submitting relevant applications, where able (e.g. general assistance, school enrollment verification, etc.); c. Provide participant families with relevant referrals to other programs and benefits in Champaign County. 2. All representative(s) from the School District shall attend an orientation with CTSO. 3. CTSO shall screen referrals from the School District for eligibility for CTSO programs, including but not limited to supporting applicants with necessary documentation, and coordinate communication between temporary housing, participating families, CTSO, and the School District. 4. CTSO shall insure that any request by CTSO for family / participant eligibility related to student enrollment verification includes a release and waiver from the parent / guardian authorizing the School District to provide said information about students. 5. The parties acknowledge that final participation in CTSO programs is at CTSO discretion, and that referrals by the School District shall be processed and

implemented in accordance with CTSO policies and procedures. The School District shall make referrals only in accordance with the guidelines provided by CTSO, and in no event with the School District provide student record information unless authorized as provided in the Illinois School Student Records Act or the Family Educational Rights and Privacy Act. 6. There shall be no fee charged to either party in relation to this Intergovernmental Agreement. 7. CTSO agrees to indemnify, defend, and hold harmless the School District, the Board of Education, board members individually, officers, administrators, employees, agents, representatives and volunteers (hereinafter referred to collectively as the “Indemnitees”) from and against any and all claims, demands, causes of action, losses, liabilities, and damages (including reasonable attorney’s fees and court costs), whether in contract or tort, statutory or otherwise, excluding the intentional and/or willful and wanton acts of School District employees or agents arising out of this Intergovernmental Agreement. No provision of this agreement is intended to waive or abridge any other defense or immunity available to the CTSO Board or the School District Board of Education. 8. The waivers set forth herein constitutes the complete and final understanding of the undersigned with respect to the subject matter, with the exception of contract claims related to enforcement of this Agreement. 9. Should any section of this Waiver be determined to be invalid or unconstitutional, by a court of competent jurisdiction, such decision shall not affect any remaining portion, which can be implemented without the invalid provision. 10.
