No Class1 (explosive) material, except smallarms ammunition, may be carried inthe passenger-carrying space of anymotor vehicle transporting passengersfor hire.(d) Hazardous materials on passengercarrying vehicles; quantity. Where noother practicable means of transportation is available the following articles in the quantities as shown may betransported in motor vehicles carryingpassengers for hire in a space otherthan that provided for passengers: Notto exceed 45 kg (99 pounds) grossweight of any or all of the kinds ofClass 1 (explosive) materials permittedto be transported by passenger-carrying aircraft or rail car may be transported on a motor vehicle transportingpassengers: Provided, however, Thatsamples of Class 1 (explosive) materialsfor laboratory examination, not to exceed two samples, or a total of no morethan 100 detonators, Division 1.4 (explosive) materials at one time in a singlemotor vehicle, may be transported in amotor vehicle transporting passengers.(e) Articles other than Class 1 (explosive) materials on passenger-carrying vehicles. The gross weight of any givenclass of hazardous material other thanClass 1 (explosive) materials shall notexceed 45 kg (99 pounds), and the aggregate weight of all such other dangerousarticles shall not exceed 225 kg (496pounds). This provision does not applyto nontoxic, nonflammable refrigerants, when such refrigerant is forservicing operations of a motor carrieron whose motor vehicles the refrigerant is used. A cylinder securedagainst shifting while in transit andnot exceeding 113 kg (250 pounds) grossweight may be transported.(f) Division 6.1 (poisonous) or Division2.3 (poisonous gas) materials on passenger-carrying vehicles. No motor carrier may transport any extremely dangerous Division 6.1 (poisonous) or Divi-sion 2.3 (poisonous gas) material, orany paranitroaniline, in any amount,in or on any bus while engaged in thetransportation of passengers; or anyless dangerous Division 6.1 (poisonous)material, which is other than a liquid,in any amount exceeding an aggregateof 45 kg (99 pounds) gross weight in oron any such bus.(g) Class 7 (radioactive) materials. Inaddition to the limitations prescribedin paragraphs (b) and (e) of this section, no person may transport anyClass 7 (radioactive) material requiringlabels under §§ 172.436, 172.438, and172.440 of this subchapter in or on anymotor vehicle carrying passengers forhire except where no other practicablemeans of transportation is available.Packages of Class 7 (radioactive) materials must be stored only in the trunkor baggage compartment of the vehicle, and must not be stored in any compartment occupied by persons. Packages of Class 7 (radioactive) materialsmust be handled and placed in the vehicle as prescribed in § 177.842.[29 FR 18795, Dec. 29, 1964. Except as specificallyprovided in §§ 178.337–18 and 178.345–10 ofthis part, the manufacturer or otherperson certifying compliance with therequirements of this part, and eachsubsequent distributor of that packaging shall—(1) Notify in writing each person towhom that packaging is transferred—(i) Of all requirements in this partnot met at the time of transfer, and(ii) With information specifying thetype(s) and dimensions of the closures,including gaskets and any other components needed to ensure that thepackaging is capable of successfullypassing the applicable performancetests. This information must includeany procedures to be followed, including closure instructions for inner packagings and receptacles, to effectivelyassemble and close the packaging forthe purpose of preventing leakage intransportation. For packagings sold orrepresented as being in conformancewith the requirements of this subchapter applicable to transportation byaircraft, this information must includerelevant guidance to ensure that thepackaging, as prepared for transportation, will withstand the pressure differential requirements in ‘‘ 173.27 ofthis subchapter.(2) Retain copies of each written notification for at least one year fromdate of issuance; and(3) Make copies of all written notifications available for inspection by arepresentative of the Department.(d) Except as provided in paragraph(c) of this section, a packaging not conforming to the applicable specifications or standards in this part may notbe marked to indicate such conformance.(e) Definitions. For the purpose of thispart—Manufacturer means the person whosename and address or symbol appears aspart of the specification markings required by this part or, for a packagingmarked with the symbol of an approvalagency, the person on whose behalf theapproval agency certifies the packaging.Specification markings mean the packaging identification markings requiredby this part including, where applicable, the name and address or symbol ofthe packaging manufacturer or approval agency.(f) No packaging may be manufactured or marked to a packaging specification that was in effect on September 30, 1991, and that was removedfrom this part 178 by a rule publishedin the FEDERAL REGISTER on December21, 1990 and effective October 1, 1991.[Amdt. 178–97, 55 FR 52715, Dec. 21, 1990; 56 FR66284, Dec. 20, 1991, as amended by Amdt. No.178–106, 59 FR 67519, Dec. 29, 1994; Amdt. 178–117, 62 FR 14338, Mar. 26, 1997; 68 FR 45041,July 31, 2003; 69 FR 34612, June 22, 2004]§ 178.3Marking of packagings.(a) Each packaging represented asmanufactured to a DOT specificationor a UN standard must be marked on anon-removable component of the packaging with specification markings conforming to the applicable specification,and with the following:(1) In an unobstructed area, with letters, and numerals identifying thestandards or specification (e.g. UN 1A1,DOT 4B240ET, etc.).(2) Unless otherwise specified in thispart, with the name and address orsymbol of the packaging manufactureror, where specifically authorized, thesymbol of the approval agency certifying compliance with a UN standard.Symbols, if used, must be registeredwith the Associate Administrator. Duplicative symbols are not authorized.(3) The markings must be stamped,embossed, burned, printed or otherwisemarked on the packaging to provideadequate accessibility, permanency,contrast, and legibility so as to bereadily apparent and understood.(4) Unless otherwise specified, lettersand numerals must be at least 12.0 mm(0.47 inches) in height except that forpackagings of less than or equal to 30 L(7.9 gallons) capacity for liquids or 30kg (66 pounds) capacity for solids theheight must be at least 6.0 mm (0.2inches). For packagings sold orrepresented as being in conformancewith the requirements of this subchapter applicable to transportation byaircraft, this information must includerelevant guidance to ensure that thepackaging, as prepared for transportation, will withstand the pressure differential requirements in ‘‘ 173.27 ofthis subchapter.(2) Retain copies of each written notification for at least one year fromdate of issuance; and(3) Make copies of all written notifications available for inspection by arepresentative of the Department.(d) Except as provided in paragraph(c) of this section, a packaging not conforming to the applicable specifications or standards in this part may notbe marked to indicate such conformance.(e) Definitions. For the purpose of thispart—Manufacturer means the person whosename and address or symbol appears aspart of the specification markings required by this part or, for a packagingmarked with the symbol of an approvalagency, the person on whose behalf theapproval agency certifies the packaging.Specification markings mean the packaging identification markings requiredby this part including, where applicable, the name and address or symbol ofthe packaging manufacturer or approval agency.(f) No packaging may be manufactured or marked to a packaging specification that was in effect on September 30, 1991, and that was removedfrom this part 178 by a rule publishedin the FEDERAL REGISTER on December21, 1990 and effective October 1, 1991.[Amdt. 178–97, 55 FR 52715, Dec. 21, 1990; 56 FR66284, Dec. 20, 1991, as amended by Amdt. Duplicative symbols are not authorized.(3) The markings must be stamped,embossed, burned, printed or otherwisemarked on the packaging to provideadequate accessibility, permanency,contrast, and legibility so as to bereadily apparent and understood.(4) Unless otherwise specified, lettersand numerals must be at least 12.0 mm(0.47 inches) in height except that forpackagings of less than or equal to 30 L(7.9 gallons) capacity for liquids or 30kg (66 pounds) capacity for solids theheight must be at least 6.0 mm (0.2inches).
