Tariff Order of CESC Limited for the year 2010 – 2011CHAPTER - 1INTRODUCTION1.1.The West Bengal Electricity Regulatory Commission (hereinafter referred to asthe ‘Commission’) was constituted by the Government of West Bengal in theyear 1999 in terms of section 17 of the Electricity Regulatory Commissions Act,1998 (hereinafter referred to as the ‘1998 Act’). The 1998 Act, along with someother Acts, was repealed by section 185 of the Electricity Act, 2003 (hereinafterreferred to as the ‘Act’) which came into force with effect from 10.06.2003. Thefirst proviso to section 82(1) of the Act has ensured continuity of the Commission– along with that of all other State Electricity Regulatory Commissions – bylaying down that the State Electricity Regulatory Commission, established by aState Government under section 17 of the 1998 Act (and some otherenactments) and functioning as such immediately before coming into force of theAct, shall be the State Commission for the purpose of the Act.1.2.The functions of a State Commission are laid down in section 86 of the Act. Ofits many functions, a State Commission has to discharge the function ofdetermination of tariff for generation, supply, transmission and wheeling ofelectricity, wholesale, bulk or retail, as the case may be, within the State.Further, section 62(1) of the Act also requires the Appropriate Commission todetermine the tariff in accordance with the provisions of the Act for supply ofelectricity by a generating company to a distribution licensee, for transmission ofelectricity, for wheeling of electricity as also for retail sale of electricity.1.3.The Commission, therefore, has all the powers and authority under the Act todetermine the tariff as laid down in the Act and these powers and authority are incontinuation of similar powers and authority that were enjoyed by theCommission under section 29 of the 1998 Act.1.4.CESC Limited, a Company under the Companies Act, 1956, is a distributionlicensee in the State of West Bengal for supply of electricity in Kolkata and someWest Bengal Electricity Regulatory Commission2

It was a licensee under the provisions of the IndianElectricity Act, 1910 (since repealed) and has become a deemed licensee interms of the first proviso to section 14 of the Act with effect from 10.06.2003 i.e.the date of coming into force of the Act.1.5.In terms of the provisions of the Act, therefore, the Commission is fullyempowered to determine the tariff in respect of CESC Limited.1.6.The Commission had, in the past, passed tariff orders for ten years in respect ofCESC Limited. These were orders that determined the tariffs of CESC Limitedfor the years 2000 – 2001, 2001 – 2002, 2002 – 2003, 2003 – 2004, 2004 –2005, 2005 – 2006, 2006 – 2007, 2007 – 2008, 2008 – 2009 and 2009 – 2010respectively.1.7.A generating company or a licensee, whose tariff is to be determined by theCommission as per the provisions of the Act, is required to prepare theapplication for determination of tariffs for each year of a control period under themulti-year tariff framework complying with the provisions of the West BengalElectricity Regulatory Commission (Terms and Conditions of Tariff) Regulations,2007, as amended (hereinafter referred to as the ‘Tariff Regulations’) and submitthe same to the Commission within the specified date. Though as per the TariffRegulations the last date for submission of the application to the Commission bya generating company or a licensee for determination of tariffs for each year ofthe control period comprising three years from 2008 – 2009 to 2010 – 2011(hereinafter referred to as the ‘second control period’) was 1 March, 2008, theCommission, after considering the prayers of the licensees and the generatingcompany, whose tariffs are determined by the Commission, for extension of lastdate for submission of the aforesaid application to the Commission, extendedthe last date for the purpose upto 31 May, 2008. Since, however, 31 May, 2008West Bengal Electricity Regulatory Commission3

Tariff Order of CESC Limited for the year 2010 – 2011and 1 June, 2008 were holidays, in terms of the provision contained in the WestBengal Electricity Regulatory Commission (Conduct of Business) Regulations,2007, a generating company or a licensee was at liberty to submit the aforesaidapplication for determination of tariffs to the Commission on the next workingday i.e. on 2 June, 2008.1.8.Accordingly, CESC Limited, complying with the provisions of the TariffRegulations, prepared the application for determination of its tariffs for each yearof the second control period and submitted the same to the Commission on29.05.2008. This tariff application was admitted by the Commission and wasnumbered as TP – 37/08 – 09.1.9.CESC Limited was thereafter directed to publish, as required under section64(2) of the Act, the gist of the tariff application, as approved by theCommission, in at least four daily newspapers having wide circulation in the areaof supply of CESC Limited, at least 1 (one) of such newspapers being in Bengaliand English. The gist was, accordingly, published simultaneously on 12 June,2008 in Anandabazar Patrika, The Telegraph, Sanmarg, Business Standard andalso in some other newspapers. The publication invited the attention of allinterested parties, stake holders and the members of the public to the applicationfor determination of tariffs of CESC Limited for each year of the second controlperiod and requested for submission of objections, comments etc., if any, on thetariff application to the Commission by 14 July, 2008 at the latest. Opportunitieswere also afforded to all to inspect the tariff application and take copies thereof.1.10.By 14.07.2008 i.e. the due date, the Commissionreceived objections,comments, etc. from Manoranjan Roy Energy Education Centre, GanatantrikNagarik Samity, Howrah, All Bengal Electricity Consumers Association, AllBengal Printers Association, Bharat Chamber of Commerce and West BengalState Electricity Distribution Company Limited (in short ‘WBSEDCL’). Tariff Order of CESC Limited for the year 2010 – 2011Commission also received, by 14 July, 2008, identical printed objections,comments, etc. signed by one Shri Abhijit Sarkar and 4707 others and submittedby one Shri Satyen Bhattacharyya. As required under the Act, the Commissionhad duly considered the objections, comments, etc. of the persons, from whomsuch objections, comments, etc. were received, in determining the aforesaidARR and tariffs of CESC Limited.1.11.The Commission thereafter, in accordance with the provisions of the Act andTariff Regulations, passed the tariff order of CESC Limited for 2008 – 2009determining the Aggregate Revenue Requirement (in short ‘ARR’) of CESCLimited for each year of the second control period, revenue recoverable throughtariff by CESC Limited during 2008 – 2009 after carrying out negative adjustmentof the refundable amount to the consumers and WBSEDCL as determined in theAnnual Performance Review (in short ‘APR’) for the year 2006 – 2007 with thedetermined ARR for 2008 – 2009 and also the tariffs of CESC Limited for 2008 –2009. The analyses and findings for determination of the aforesaid ARR andtariffs of CESC Limited were recorded in the tariff order of CESC Limited for2008 – 2009. The amount recoverable through tariff during 2009 – 2010 byCESC Limited had also been determined subsequently after carrying outadjustments as were found necessary on APR relating to year 2007 – 2008 withthe amount of ARR determined earlier for the year 2009 – 2010. The analysesand findings in that regard were recorded by the Commission in its orders dated28 May, 2009 and dated 28 July, 2009 in cases no. APR-7/08-09 and no. TP37/08-09 respectively. The Commission now proceeds to determine the revenuerecoverable through tariff by CESC Limited during the year 2010 – 2011 as alsothe tariffs of CESC Limited for 2010 – 2011 and those may be found insubsequent chapters.West Bengal Electricity Regulatory Commission5

Tariff Order of CESC Limited for the year 2010 – 2011CHAPTER – 2SUMMARISED STATEMENT OF AGGREGATE REVENUEREQUIREMENT & REVENUE RECOVERABLETHROUGH TARIFF FOR THE YEAR 2010 – 20112.1As stated in the preceding chapter, the Commission determined the ARR ofCESC Limited separately for each of the three years of the second control periodcovering the years 2008 – 2009, 2009 – 2010 and 2010 – 2011 in the tariff orderfor 2008 – 2009 based on the analyses and findings recorded in that order. Suchsummarized statement of ARR for 2010 – 2011 is given in Annexure 2A.2.2Revision of the ARR for the year 2010 – 2011:2.2.1In terms of regulation 2.5.1 of the Tariff Regulations, the amounts of ARR ofCESC Limited, as were determined for the ensuing year 2010 – 2011 under MultiYear Tariff (in short “MYT”) approach and shown at Annexure – 2A, require to berevised on account of considerable increase in the fuel cost and power purchasecost.2.2.1.1 Revision in Fuel Cost:In its application dated 19 May, 2010, registered by the Commission as Case No.OA-82/10-11, CESC Limited represented that Eastern Coalfields Limited (in short“ECL”), had introduced a new policy under which supply of superior grades ofcoal from its underground mines would be only at a negotiated price (almostdouble the price notified earlier). Such superior grades of coal, i.e., A, B and Cgrades, being scarce as also essential for operating its power stations of differentvintages, CESC Limited had to enter into an arrangement with ECL and sign aMemorandum of Understanding (in short “MOU”) accordingly. The notified coalprices were also revised by ECL with effect from 16 October, 2009. The revisedaverage price came to about 15% higher than that of previous price notification.The matter relating to inadequacy of coal receipts, both in quantity and quality,from the subsidiaries of Coal India Limited (in short “CIL”) against Fuel SupplyWest Bengal Electricity Regulatory Commission6

Tariff Order of CESC Limited for the year 2010 – 2011Agreement (in short “FSA”) as per allocation made by CIL had also been viewedby the Department of Power & NES, Government of West Bengal and in exerciseof the power conferred by section 11 (1) of the Act, the Government of WestBengal directed CESC Limited to procure 0.70 million tones of higher grade coalfrom the subsidiaries of CIL and 0.63 million tones through import subject toactual requirement during the year 2010 – 2011 to ensure optimum generation atits generating stations. The Department of Power & NES, Government of WestBengal also requested the Commission to consider to offset under section 11(2)of the Act the adverse financial impact of the referred directive to CESC Limitedunder the provision of section 11(1) of the Act.Department of Revenue, Ministry of Finance, Government of India, vide itsNotification No. 06/2010-Clean Energy Cess dated 22 June, 2010 levied cleanenergy cess @ Rs. 50/- (Rupees Fifty only) per tone of coal with effect from 1July, 2010. Thereupon, CESC Limited submitted another application on 30 June,2010 asking for taking into account the effect of the levying clean energy cesswhile considering the revision in the cost of fuel for its different generatingstations. The referred application dated 30 June, 2010 of CESC Limited hasbeen registered as Case No. OA-91/10-11. The Commission has viewed the saidapplication of CESC Limited. The clean energy cess and the additional amount ofVAT etc. chargeable on that will, however, be for three quarters of the financialyear and hence on annual basis the average increase in the cost of coal on thataccount will come to around Rs. 39/- per ton only.After careful consideration of the estimations submitted by CESC Limitedincluding the issue relating to offset, under section 11(2) of the Act, the adversefinancial impact of the directive given to CESC Limited by the Government ofWest Bengal under section 11(1) of the Act and considering the grade mix of coaluse at different generating stations at par with the earlier projections, the averageprices of coal per MT now comes as under:West Bengal Electricity Regulatory Commission7

New Cossipore generating station (of 1949 vintage) is beingoperated as a peaking station and hence the quanta of power for such sellingoutside the state during off peak period are available mainly from Budge Budge,Titagarh and Southern generating stations. Part of the total fuel cost of each ofthose generating stations will be realized by CESC Limited by way of such saleand, therefore, requires to be reduced from the revised amount of fuel costcomputed above. Tariff Order of CESC Limited for the year 2010 – 2011during 2010 – 2011 has been re-determined by the Commission as 450 paise /kWh against 255 paise / kWh considered in the tariff order for the year 2008 –2009. Sourcing power from the open market also has become costlier. TheCommission, therefore, feels the necessity of revising the total amount ofpurchase cost considered earlier in ARR for the year 2010 – 2011. The amountsof power purchase cost after revision come as ket)(openTotalRateAmount(Paise/kWh) (Rs. in Lakh)450.0047610150666.4499971208-57607The revised statement of ARR for the year 2010 – 2011 incorporating thechanges as stated above is given at Annexure – 2B.2.2.1.3 Amount allocated to Power Purchase Fund by distribution of SLDC-UIFund:CESC Limited shall utilize Rs. 1295.00 lakh from the Power Purchase Fund tomeet a portion of its increased cost of power purchase due to increase in powerpurchase price. The amount of Rs. 1295.00 lakh is being deducted from thegross ARR of CESC Limited as that amount will be available from the PowerPurchase Fund. CESC Limited is directed to keep an account of Power PurchaseFund duly audited and submit the same along with APR application for the year2010 – 2011.2.3In terms of the Tariff Regulations, the Commission is to ascertain the amount ofrevenue recoverable through tariff by CESC Limited for the year 2010 – 2011West Bengal Electricity Regulatory Commission10

Tariff Order of CESC Limited for the year 2010 – 2011after carrying out, at its discretion, any positive or negative adjustment of therecoverable or refundable amount determined in APR for the year 2008 – 2009taking into consideration the admissible variable costs determined in Fuel andPower Purchase Cost Adjustment (in short ‘FPPCA’), admissible fixed costsdetermined in APR and the revenue realized by CESC Limited by sellingelectricity to its consumers and WBSEDCL during that year with the revised ARRof CESC Limited for 2010 - 2011. The Commission in its order dated 26 July,2010 in Case No. APR-14/09-10 has determined in APR of CESC Limited for2008 – 2009 the net amount of Rs. 3841.39 lakh refundable by CESC Limited toits consumers and WBSEDCL for 2008 – 2009 after taking into consideration theadmissible variable costs (determined in FPPCA vide Commission’s Order dated30.06.2010 in Case No. FPPCA-40/09-10), the admissible fixed costs(determined in APR vide Commission’s Order dated 26 July, 2010 in Case No.APR-14/09-10) and the revenue realized by CESC Limited by selling electricityto its consumers and WBSEDCL during that year. The Commission has decidedto make negative adjustment of the entire portion of aforesaid net refundableamount of Rs. 3841.39 lakh, determined in APR for 2008 - 2009, with the revisedARR of CESC Limited for 2010 – 2011 to determine the revenue recoverablethrough tariff by CESC Limited during 2010 – 2011. The Commission alsodecides to keep the refundable amount of Rs. 12580.35 lakh determined in APRfor 2007 – 2008 but not adjusted with the ARR of 2009 – 2010 as regulatoryliability unadjusted this year also to contain abnormal tariff hike in future years inview of the increased fuel and power purchase cost which CESC Limitedincurred during 2009 – 2010. Tariff Order of CESC Limited for the year 2010 – 2011CHAPTER - 3TARIFF ORDER3.1In the previous chapter, the Commission has determined for CESC Limited therevenue recoverable through tariff during 2010-11 and the average tariff forthe consumers of CESC Limited for 2010-11 as well. The Commission nowproceeds to determine the tariff schedule applicable to the consumers ofCESC Limited and also the associated conditions of tariff of CESC Limited for2010-11. The Commission is passing other orders also as mentioned insubsequent paragraphs.3.2The tariff schedule as applicable to the consumers of CESC Limited in theyear 2010-11 is given at Annexure – 3A1 for LV and MV consumers and atAnnexure – 3A2 for HV and EHV consumers. Details of different tariffschemes of different classes of consumers and various associated terms andconditions are specified in various regulations and in Annexure – C1 andAnnexure – C2 of the Tariff Regulations.
