2013 SGA ConstitutionP a g e 1PREAMBLEThe Student Government Association,hereafter referred to as SGA, will serve as theprimary voice of the undergraduate student bodyat main campus of Campbell University. Itspurpose shall be to advocate student opinionsand concerns regarding the academic, athletic,social, and religious environment of the school.The SGA shall uphold fair student disciplinaryprocedures, establish proper student electionrules and regulate and govern student activitiesin the fairest manner possible under the authorityof this Constitution and its Bylaws.The authorities of Campbell University,having confidence in the abilities of the studentsto engage in the process of self-determinationand self-government, and believing suchparticipation by the students in the affairs of theuniversity community to be of mutual benefit toboth students and administrators, do herebyenter into this agreement, the Constitution of theStudent Government Association of CampbellUniversity, with the present and future studentsof this University. This agreement, containingthe rights and privileges of students at thisUniversity, shall not be rescinded save by theratification powers of the President of theUniversity, the SGA, or the Campbell Universitystudent body.ARTICLE 1Rights of the StudentC.D.E.F.G.H.every such right shall be exercised inpursuance of law and consistent with theConstitution of SGA, as well as any otherrules, regulations, or policies of CampbellUniversity.The right to assemble peacefully to consultfor their common good, to makerecommendations to their representatives,and to apply to the SGA for a redress ofgrievances.The right to vote in student elections andthus have representatives.Protection from any ex post facto rule,regulation, or policy.Protection from any seizure of property,except in accordance with the law of theSGA and the rules, regulations, and policiesof Campbell University.Equal protection of the laws.The right to:1. Be informed of any accusations orcharges brought against him/her.2. Confront all accusers and witnesses withtestimony and witnesses in his/herdefense.3. Refrain from giving ating evidence.4. A prompt hearing after a reasonableamount of time to prepare his/herdefense.ARTICLE IIDefinitionsA student of Campbell University is guaranteed:A. Equality with all other students at CampbellUniversity.B. The inherent, sole, and exclusive right ofregulating the internal government, and ofaltering or abolishing their Constitution andform of government whenever it may benecessary to their safety and happiness; butFor the purposes of interpreting this constitutionand its bylaws, the following definitions shallapply.A. A constituent shall:1. Be defined as any duly enrolled studentof Campbell University.

Be defined as any duly enrolled studentof Campbell University properly electedby the constituents of SGA or appointedto SGA in accordance with thisConstitution and its Bylaws.2. Remain a constituent of the SGA duringhis/her period of office and retain allrights, privileges, and responsibilitiesthereof.3. Take the oath of office, as outlined inArticle X.C. A boarding student shall:1. Be defined as any constituent whorightfully resides in a CampbellUniversity owned residential facility.2. Be eligible to vote in SGA elections forMen’s Community Coordinator andWomen’s Community Coordinator, asoutlined in this Constitution and itsBylaws.D. A commuting student shall:1. Be defined as any constituent who doesnot rightfully reside in a CampbellUniversity residential facility.2. Be eligible to vote in SGA elections forCommuting Students Coordinator, asoutlined in this Constitution and itsBylaws.ARTICLE IIIRelationship to Campbell UniversitySection 1. Presidential VetoA. The president of Campbell University orhis/her designee reserves the right to vetoany decision of the SGA.Section 2. Contracts & ObligationsA. No constituent of SGA or representative ofSGA may obligate Campbell University tocontract with a third party. All contracts andagreements with companies, agents,organizations, etc. outside of the universitymust be submitted to the Vice President ofBusiness for approval and signature. TheVice President of Student Life or his/herdesignee is responsible for reviewing allsuch documents prior to forwarding them tothe Vice President of Business.Section 3. SGA FundingA. The Campbell University Business Officeshall collect a fee from all constituents ofSGA during the fall, and spring semesters,from which the budgets of the SGA shall bederived.B. Supplementary funds may be requested bythe SGA in the form of a resolution.Section 4. AdvisorsA. The Dean of Students shall serve as advisorto the SGA, as well as a liaison betweenSGA and the Campbell UniversityExecutive Administration. The Dean orhis/herdesigneeshallattendallCongressional meetings and be available toconsult with SGA members, providingadvice, assistance, and support asappropriate.B. The Director of Residence Life shall serveas an advisor to the Men’s CommunityCoordinator and the Women’s CommunityCoordinator. The director shall consult withthese SGA representatives, providingadvice, assistance, and support asappropriate.C. The Director of Student Activities shallserve as an advisor to each class or

The Director shallconsult with these representatives andprovide advice, assistance, and support asappropriate.ARTICLE IVMembershipSection 1. ProvisosA. The SGA is inclusive and welcoming of allstudents and shall not discriminate againstany student in good standing with theuniversity based on personal characteristicsor beliefs .Section 2. RequirementsA. All representatives must have and maintain acumulative grade point average, hereafterreferred to as GPA, of 2.0 on a 4.0 scale.Members of the Executive Council mustmaintain a GPA specified in the relevantportions of Article V of this Constitution.Representatives cannot be on academicprobation and must not have been deemedineligible to run or be appointed to office.B. Representatives are required to take the oathof office detailed in Article X of thisConstitution.C. Representatives are expected to adhere tothe attendance policies of SGA as detailed inArticle VII of this Constitution.D. If a member of congress is terminated,resigns due to known bad conduct in whichimpeachment has been officially broughtforward, impeached, or removed forattendance, then he/she will not be eligibleto serve as a member of congress for onecalender year.The Executive VicePresident of SGA shall keep a record ofresignations/terminations and pass saidrecord to his/her successor.E. Classification of Classes-The OfficialClassification System which is solely for theuse in SGA Elections and ClassRepresentation shall be as follows:1. Freshmen Class Representationshall be comprised of FirstTime, Full-Time Freshmen whohave not completed any creditsfrom a 4-Year School orCommunity College unless doneas a dual-enrollment programwhile in High School or asAdvance Placement or othersimilar courses which aretransferable to this University.2. Sophomore ClassRepresentation shall be basedupon credit hours, of which youmust have between 24 and 63.9credit hours completed or be inprogress of completion upontaking office.3. Junior Class Representationshall be based upon credithours, of which you must havebetween 64 and 97.9 credithours completed or be inprogress of completion upontaking office.4. Senior Class Representationshall be based upon credit hoursof which you must have 98credit hours completed or inprogress of completion.Returning Seniors as well asRising Seniors are eligible torun for the Senior Class, youmust have completed or be inprogress of completing 98 credithours upon taking office.F. No Class Officer or Representative shallbe deprived of their office based upon

If they have been duly elected orappointed to that office they shall retaintheir office for the duration of the schoolyear.Section 3. DutiesA. All representatives must serve on at leastone committee during their term.B. All representatives must serve a minimum ofone office hour per week.ARTICLE VExecutive BranchSection 1. StructureA. The Executive Branch will be composed ofthe President, the Vice President, theTreasurer, the Secretary, the Men’sCommunity Coordinator, the Women’sCommunity Coordinator, the CommutingStudent’s Coordinator, the Parliamentarian,and the Chaplain.Section 2. Executive PresidentA. Provisos1. The Executive President shall be electedfrom the constituency of SGA.2. The office of Executive President shallbe a twelve-month position, starting atthe end of the spring semester in whichhe/she was elected.3. Not adhering to any of the requirementsor duties listed in this section of theConstitution shall be considereddereliction of duty and will result inpunitive action and may result inimpeachment.4. No person shall serve as ExecutivePresident for more than one full term.B. Requirements1. Have and maintain a GPA of 2.5 on a4.0 scale.2. Be a constituent of the SGA.3. Have completed at least 64 credit hoursof undergraduate work upon takingoffice, of which at least 24 credit hoursshall have been completed at CampbellUniversity.C. Duties1. Serve as the chief executive officer ofSGA and supervise the execution of allundertakings of the SGA as authorizedby this Constitution, its Bylaws andCongress.2. Preside at meetings of the ExecutiveCouncil, to be held at least once everytwo weeks, and make all necessarypreparations for Executive Councilmeetings, calling on the Parliamentarianfor assistance as needed.3. Sign or veto all legislation passed byCongress within three (3) universitybusiness days of its passage and providecopies to the President of the Universityand the Vice President for Student Life,as well as other appropriate Universityfaculty, staff or administration.4. Announce to Congress during his/herreport at the following meeting whichlegislation was signed and which wasvetoed.5. Provide a written statement oftermination to any representative whohas violated attendance policy orcommitted any other offense that wasdeemed terminable by the ExecutiveBranch.6. Must be available to meet with the VicePresident of Student Life at least onceevery two weeks, and when he deemsnecessary, the President of theUniversity.

Ensure, with the help of theAdvancement Committee Chair and theExecutive Council, that this Constitutionand its Bylaws are printed and madeavailable to representatives of SGA.8. Appoint, with 2/3 majority approval ofCongress, the following positions: theParliamentarian, the Chaplain, the RulesCommittee Chair, the AcademicsCommittee Chair, the AdvancementCommitteeChair,theElectionsCommittee Chair and the StudentConduct Committee Chair (subject toapproval of the Vice President ofStudent Life).Removal of theseappointees is subject to 2/3 approvalfrom Congress.9. Make appointments to fill vacancies inthe Presidential Cabinet subject to a 2/3majority approval of Congress by thesecond meeting following a vacancy.Class Presidents, though members of thePresidential Cabinet, shall not beappointed in the event of a vacancy.10. Appoint Ad-Hoc Committee Chairs.11. Sit on the Executive Student ConductCommittee when a representative ofSGA appeals his/her impeachment.12. Require any representative of SGA toassist with his/her duties as he/shedeems necessary.13. Serve as a nonvoting member ofCongress and its committees andcouncils.14. Serve as a voting member of theExecutive Council.15. Be willing to serve on Universitycommittees as appointed.D. Powers1. May veto any legislation which he/shefeelsisunnecessary,improper,unconstitutional or not in the bestinterest of the student body or theUniversity.2. May create a Presidential Task Force ifhe/she deems one is necessary. This taskforce shall:i. Perform a temporary, limitedfunction to help the President carryout his/her responsibilities.ii. Consist of members and a chair tobe appointed by the President.iii. Have its appointed chair serve as aPresidential Cabinet member as longas the Presidential Task Forceexists.iv. Be dissolved by the President.v. Be defined by the President to theExecutive Council at the time of theTask Force’s creation.TheExecutive Council may, by a 2/3majority vote, agree to have the taskforce announced to Congress.Section 3. Executive Vice PresidentA. Provisos1. The Executive Vice President shall beelected from the constituency of SGA.2. The office of Executive Vice Presidentshall be a twelve-month position,starting at the end of the spring semesterin which he/she was elected.3. Not adhering to any of the requirementsor duties listed in this section of theConstitution shall be considereddereliction of duty and will result inpunitive action and may result inimpeachment.B. Requirements1. Have and maintain a GPA of 2.5 on a4.0 scale.2. Be a constituent of SGA.3. Serve as a general assistant to thePresident.4. Assume the office of the President if theoffice is vacated.5. Serve on the Executive Cabinet of theInter-Organizational Council, hereafterreferred to as IOC.6. Shall keep a record of resignations thatmust be passed to the successor.7. Serve as Chief Prosecutor in the event ofa trial against a member of Congress.8. Decide on hours that the SGA officewill be open and ensure that the office isstaffed at those times.9. Require any member of SGA to assistwith his/her duties as he/she deemsnecessary.10. Serve as a nonvoting member ofCongress and its committees andcouncils.11. Serve as a voting member of theExecutive Council.Section 4. Executive TreasurerA. Provisos1. The Executive Treasurer shall be electedfrom the constituency of SGA.2. The office of Executive Treasurer shallbe a twelve-month position, starting atthe end of the spring semester in whichhe/she was elected.3. Not adhering to any of the requirementsor duties listed in this section of theConstitution shall be considereddereliction of duty and will result inpunitive action and may result inimpeachment.B. Requirements1. Have and maintain a GPA of 2.5 on a4.0 scale.2. Be a constituent of SGA.C. Duties1. Chair the Finance Committee.2. Conduct the financial affairs of theSGA, as instructed by the ExecutiveCouncil.3. Keep an accurate record of expendituresand receipts of the SGA to be madeavailable at any time upon request.4. Ensure prompt reimbursement forsanctioned expenditures of the SGA.5. Be prepared to report the financial statusof the SGA at any meeting of Congress.6. Propose a recommended budget to theVice President of Student Life at the endof each semester or upon his/her request.7. Require any representative of SGA toassist with his/her duties as he/shedeems necessary.8. Serve as a voting member of theExecutive Council and of Congress.9. Shall be the sole possessor of theAssociation’s Account Number withinthe congressional body.10. The Director of Student Activities shallapprove all expenditures of theAssociation’s budget.Section 5. Executive SecretaryA. Provisos1. The Executive Secretary shall be electedfrom the constituency of SGA.2. The office of Executive Secretary shallbe a twelve-month position, starting atthe end of the spring semester in whichhe/she was elected.3. Not adhering to any of the requirementsor duties listed in this section of theConstitution shall be considereddereliction of duty and will result in

Starting with the second congressionalmeeting of each academic year, theExecutive Secretary shall acceptamendments to the minutes from theprevious congressional meeting.a. In the absence of the ExecutiveSecretary at a congressional meeting,it is the duty of the Senior ClassSecretary to assume the duties of theExecutiveSecretaryduringacongressional meeting. In the absenceof the Executive Secretary and theSenior Class Secretary, the duties ofthe Executive Secretary are passeddown to the Junior Class Secretaryduring a congressional meeting, andso on.2. Compile an accurate record of approvedminutes for congressional meetings andmake this record available to allconstituents of SGA in the SGA Office.3. Keep an accurate record of attendance atExecutive Council and congressionalmeetings.4. Maintain an accurate record ofattendance from class and committeemeetings, based on attendance recordskept by class secretary/treasurers andcommittee chairs.5. Send a letter to any member who hasmissed two Executive, congressional,class or committee meetings definingtheir attendance status.6. Report any member who has missedthree Executive, congressional, class orcommittee meetings to the ExecutivePresident.7. File and distribute to the President of theUniversity, the Vice President forStudent Life and all representatives of8.9.10.11.12.13.14.SGA, copies of all congressionalminutes and other necessary documentswithin seven university business days.Under the supervision of the VicePresident for Student Life, check theGPA of each SGA representative at thebeginning of each semester to assurecontinued eligibility for his/her electedoffice.Compile a contact sheet of allrepresentatives of SGA using the listsreceivedfromeachclassSecretary/Treasurer and the Men’s andWomen’s Community Coordinators. Bythe third SGA meeting, he/she shouldgive a copy of the list to allrepresentatives of SGA and make copiesavailable in the SGA office.Shall keep the list updated to includenew representatives and provide a newcontact sheet to Congress at the meetingfollowing the swearing in.Ensure that a copy of this Constitutionand its Bylaws is kept on file in the SGAOffice, and updated when amendmentsare passed.Require any members of SGA to assistwith his/her duties as he/she deemsnecessary.Serve as a nonvoting member ofCongress.Serve as a voting member of theExecutive Council.Section 6. Women’s Community CoordinatorA. Provisos1. The Women’s Community Coordinatorshall be elected from the constituency ofSGA.
