CHAPTER: 900911 - INMATE VISITATIONPAGE 1FEBRUARY 3, 2017EXPECTED PRACTICES [Revision – February 11, 2021]American Correctional Association (ACA) Expected Practices: 5-ACI-2E-03, 5-ACI-7D-14, 5-ACI-7D-15, 5ACI-7D-16, 5-ACI-7D-17, 5-ACI-7D-19, and 5-ACI-7D-21PURPOSEThis Department Order establishes procedures authorizing family members and others to visit inmates forthe purpose of maintaining family and community ties.APPLICABILITYThis Department Order applies to all Department Prisons. Visitation for inmates assigned to private prisonsshall be in compliance with this Department Order and any applicable Department contract.RESPONSIBILITYExcept where noted, the Warden, unit Deputy Wardens, unit Associate Deputy Wardens, or the ContractBeds Deputy Warden or Associate Deputy Warden, possess discretionary authority and shall be responsiblefor the management of visitation in their area. Specific responsibilities include: Screening and approval of visitors.Placement of inmates into non-contact visitation.Suspension of visits.Approval of special circumstance visitation.The Department retains the authority to deny any individual visitation privileges. The decision of the parentor legal guardian shall always be the determining factor when rendering a determination to permit a minor’svisitation.PROCEDURES1.0VISITATION APPLICATION PROCESS – Persons with a disability may request reasonableaccommodation, e.g., a sign language interpreter, in accordance with Department Order #108,Americans With Disabilities Act (ADA) Compliance, by contacting the Department. Requests shouldbe made as early as possible to allow time to arrange the accommodation.1.1Initial Processing1.1.1During intake processing, inmates who choose to have visits shall complete andsubmit a Visitation List, Form 911-1, to the designated staff. Inmates are permittedto have a maximum of 20 approved visitors on their Visitation List form. {5-ACI-7D14} {5-ACI-7D-15} [Revision – February 11, 2021]1.1.2Inmates who submit a Visitation List shall list the full name and relationship of eachpotential visitor.1.1.3Persons wishing to visit and/or receive telephone calls from an inmate shall completeand submit the Application to Visit an Inmate, Form 911-4, on line athttps://corrections.az.gov/or print, complete and mail the form as outlined in 1.1.3.3of this section. In private prison facilities or institutions not listed on the website asable to receive the electronic form the inmate shall be responsible for mailing anApplication to Visit an Inmate form to each person listed on the Visitation List.1.1.3.1Inmates shall be responsible for postage expenses associated withmailing the applications.

CHAPTER: 900911 - INMATE VISITATION1.1.41.1.51.2PAGE 2FEBRUARY 3, 20171.1.3.2The Department shall pay the postage for mailing applications for allinmates verified as Health and Welfare indigent by the appropriateBusiness Office.1.1.3.3All applications shall be legible, fully completed, signed by the potentialvisitor (unless submitted electronically), and returned by mail with theenvelope reading “Attention Visitation Officer” or via the Internet directlyto the unit Visitation Officer where the inmate is assigned. The one-time 25.00 background check fee shall be mailed in accordance with 1.2.2.1of this section.1.1.3.3.1Applications to visit on behalf of a minor child may only besubmitted by a non-incarcerated parent, legal guardian ortemporary custodian of that minor child and must have theapplicable custody documents attached. When someoneother than a parent submits the visitation application, theapplication shall include documentation from a courtdocumenting legal guardianship and/or temporary custodyof the minor child.1.1.3.3.2A non-incarcerated parent, legal guardian or temporarycustodian of record of a minor child may authorize a thirdparty to accompany and be responsible for the minor childat visitation, as long as that third party has a notarizedstatement from the non-incarcerated parent, legal guardianor temporary custodian of record and is also an approvedvisitor.Former Department and private prison employees:1.1.4.1Shall be prohibited visitation with an inmate for a period of two yearsfrom the date of separation of employment, except when the inmate isan immediate family member or relative.1.1.4.2Employees terminated or who resigned while under investigation forinappropriate behavior with an inmate or possession and/or introductionof contraband are permanently ineligible to visit any inmate.Former inmates shall be prohibited visitation with an inmate for a period of twoyears from the date of release, except when the inmate is an immediate familymember or relative.Background Check Fee – A one-time, non-refundable, 25.00 background check fee must bepaid for all adult visitors applying for visitation. The fee is applicable regardless of theoutcome, unless the visitor is exempt from the fee as set forth below in 1.2.1. The Directorshall deposit all background check fees into the Department’s Building Renewal Fund,established by Arizona Revised Statute (A.R.S.) §41-797.1.2.1The following persons are exempt from the one-time 25.00 background check fee:1.2.1.1Children under the age of 18

CHAPTER: 900911 - INMATE VISITATION1.2.21.3PAGE 3FEBRUARY 3, 20171.2.1.2Inmates’ attorneys of record and their agents1.2.1.3Foster parents or court appointed legal guardians of the inmates’ minorchild(ren)1.2.1.4Persons applying for telephone-only contactApplications received by mail and/or electronically for adult visitors shall not beprocessed until the background check fee is received. If payment is not receivedwithin 30 calendar days from the date of receipt of the application, the applicationwill be denied.1.2.2.1Money Orders/Cashier’s Checks – The money order/cashier’s check mustbe payable to “Arizona Department of Corrections, Rehabilitation andReentry – Visitation”. The visitor’s name, the inmate’s name and ArizonaDepartment of Corrections, Rehabilitation and Reentry (ADCRR) Numbermust be written in the memo section of the money order/cashier’s check.Separate money orders/cashier’s checks must be completed for eachapplicant. Money orders/cashier’s checks shall be sent by mail with theenvelope reading “Attention Visitation Officer – Background Check Fee”directly to the unit Visitation Officer where the inmate is assigned.Money orders/cashier’s checks shall not be accepted in person.1.2.2.2Electronic Payment – An electronic payment method is available throughthe on-line Visitation Application process. Separate electronic paymentsmust be completed for each applicant.1.2.2.2.1Should the applicant be denied and the decision appealed,an additional 25.00 background check fee shall not beimposed, whether the Administrator’s decision is overturnedor upheld.1.2.2.2.2In the event an inmate recommits and the visitor haspreviously paid the 25.00 background check fee, anadditional 25.00 background check fee shall not beimposed.1.2.3The Visitation Officer shall annotate receipt of payment in A rizona CorrectionalInformation System (ACIS) and forward all money orders/cashier’s checks to theComplex Business Office for processing the same date they are receivedaccompanied by a Visitation Money Order/Cashier’s Check Tracking Log listing allmoney orders/cashier’s checks received.1.2.4The Visitation Officer shall ensure the ACIS and web-based system have currententries reflecting the application status.Approval of Visitors – The Warden, unit Deputy Warden or Associate Deputy Warden, or theContract Beds Deputy Warden or Associate Deputy Warden shall approve visitation forinmates assigned to the unit.1.3.1An improper and/or incomplete visiting application shall be returned to the personsubmitting the application. The potential visitor shall have an opportunity to properlycomplete the visitor application(s) and return it through the mail to the unit wherethe inmate is assigned.

CHAPTER: 900911 - INMATE VISITATIONPAGE 4FEBRUARY 3, 20171.3.2All visitor applications shall be forwarded to the receiving unit when an inmate istransferred.1.3.3All visitor applications not received directly from the applicant through the mail or viainternet shall be returned marked “unprocessed.”1.3.4Staff shall verify the accuracy of all information provided on each visitor applicationsubmitted. A complete criminal history background check of all potential visitors,including infants and minors, using the Arizona Criminal Information Center/NationalCrime Information Center (ACIC/NCIC) system, shall be completed prior t osubmitting the application to the approving authority for final approval/disapproval ofthe visitation. {5-ACI-7D-14} [Revision – February 11, 2021]1.3.5All minors and infants shall be run through the ACIC/NCIC Wants and Warrants andMissing Persons data bases. Minors, ages 7 - 17, shall also be run through theJuvenile Online Tracking System (JOLTS).1.3.6The one-time background check fee will not be applicable to minors. Upon reachingtheir 18th birthday, an ACIC/NCIC Wants and Warrants check will be run. Minor sturning 18 will be required to apply for visitation privileges, and pay the one-time, 25.00 background check fee.1.3.7The parent, legal guardian, or temporary custodian of all minor children applying tovisit an inmate, shall submit a copy of the minor’s birth certificate, which shall beretained on file for future reference. Additionally, documentation of legalguardianship and/or temporary custody from adults who are not a non-incarceratedparent of the minor child, shall be submitted in the form of a cour t order or otherlegal record from a court of law that establishes the adult’s legal responsibility to theminor, as outlined in 1.1.3.3.1 of this section.1.3.8All Process Servers shall undergo a complete criminal history background check,using the ACIC/NCIC system, prior to approval being granted by the institution'sChief of Security, or, if applicable, the Contract Beds Deputy Warden, to permit theprocess server access to the facility and/or inmate.1.3.9A properly completed visitation application shall be processed and approved ordenied within 60 calendar days of receipt of the application and background fee. Ifthe visitation application cannot be finalized within this time frame, writtennotification explaining the delay shall be mailed to the applicant within threeworkdays after the expiration period.1.3.10Approved minors, including the inmate's natural, step or adopted children, shall bepermitted to visit when accompanied by an approved adult listed on the inmate’sVisitation List, unless the inmate has lost or forfeited parental rights, or the minor isthe victim of a crime perpetrated by the inmate, as outlined in 1.5.1.2 of thissection.1.3.10.1A notarized letter from the parent or legal guardian, authorizing the visit,is required if the minor is escorted by someone other than a parent orlegal guardian. A notarized letter from the inmate shall not be accepted.

CHAPTER: 900911 - INMATE VISITATION1.3.11PAGE 5FEBRUARY 3, 20171.3.10.2Both the minor and the accompanying adult shall be listed on theinmate's approved visitation list prior to the visit.1.3.10.3A copy of the minor's birth certificate is required to be on file prior to thevisit.1.3.10.4In instances where documented proof of the minor's legal marriage tothe inmate is presented, the minor shall not require supervision by aparent or legal guardian.Visitors shall be approved for only one inmate's Visitation List. A person shall bepermitted visitation with only one inmate, unless the person is an immediate familymember to other inmates incarcerated in the Department’s institutions. The personmay be approved and placed on the approved Visitation List of each inmate verifiedas an immediate family member.1.3.11.1A visitor applying to visit multiple immediate family members shall onlybe required to pay one background check fee. If a visitor is alreadyapproved to visit one immediate family member, the Administrator mayrun an ACIC/NCIC background to determine continuation as an approvedvisitor.1.3.11.1.1 If the Administrator discovers a current felony or recentcriminal activity which may constitute a denial or a threat tothe safe and orderly operation of the institution, theAdministrator or designee shall notify the other institutionwhere the visitor is currently approved to determine if thevisitor shall continue to be approved as a current visitor.The outcome shall be at the discretion of the Administratorsto approve/deny visitation privileges.1.41.3.12A copy of all decisions related to visitation authorizations shall be retained in theinmate's visitation file.1.3.13A current Visitation List for each inmate choosing to have visits shall be maintainedin the Visitation file at the assigned unit and updated as necessary.1.3.14Each inmate shall initially be provided a copy of the approved Visitation List.Processing Visitation Applications – After determining that an application has been properlysubmitted, visitation staff shall:1.4.1Stamp the reverse side of the application "RECEIVED," including the date of receipt.1.4.2Verify receipt of application payment in ACIS.1.4.3Compare the applicant's name against the submitted visitation list to ensure thepotential visitor is identified on the inmate’s Visitation List.

CHAPTER: 900911 - INMATE VISITATION1.4.4PAGE 6FEBRUARY 3, 20171.4.3.1If an applicant is not identified on the inmate’s Visitation List, staff shallprovide written notification to the inmate that an Application to Visit anInmate has been received, but cannot be processed until a change ismade to his/her visitation list. The inmate has 30 calendar days toprovide the change.1.4.3.2A copy of the notification shall be retained in the inmate's visitation file.Request a criminal history background investigation for all potential visitors(including minors) by submitting a Criminal History Information Request, Form 1211, or the ACJIS Information Request List, Form 121-6, to the Arizona CriminalJustice Information System (ACJIS) Terminal Operator. {5-ACI-7D-14} [Revision –February 11, 2021]1.4.4.1If the criminal history background investigation reveals no criminalhistory, the ACJIS operator shall record the results on the writtenrequest and return it to Visitation staff. The unit Deputy Warden or unitAssociate Deputy Warden shall check the ACJIS Information RequestList for the clearances, verify the information and sign and date thebottom of the form.1.4.4.2If the criminal history background investigation reveals a warrant forarrest, the ACJIS operator shall provide the results to the local CriminalInvestigations Unit (CIU) for further investigation. The results of thisinvestigation shall be provided to the Warden or Deputy Warden thatrequested the background investigation.1.4.4.3If the criminal history background investigation reveals a criminal history,the ACJIS operator shall forward all documentation to the unit DeputyWarden, or the Contract Beds Deputy Warden, for review and finaldecision to approve or deny the application. The unit Deputy Wardenshall:1.4.4.3.1Return approved visitation applications to the VisitationOfficer for processing.1.4.4.3.2Return all denied visitation applications and copies of denialletters to the Visitation Officer for processing.1.4.4.3.3Destroy all ACJIS related documentation after determiningaction to be taken.1.4.5Ensure that criminal history information remains confidential.1.4.6Prior to approval for phone privileges, verify the accuracy of telephone numbers,individuals and stated relationships listed on the visitation application.1.4.7Ensure that all inmates are provided written notification of all visitation actions. Anupdated copy of all approved changes to the inmate’s visitation list shall beprovided. The inmate shall be advised of his or her responsibility to inform the

CHAPTER: 900911 - INMATE VISITATIONPAGE 7FEBRUARY 3, 2017potential visitor of his or her visitation status.1.4.81.5Ensure that potential visitors are provided written notification when visitation isdenied.1.4.8.1Criminal history background information shall not be included in thewritten notification.1.4.8.2A copy of the written notification shall be retained in the inmate’svisitation file.Denial or Removal of Visitors from Visitation List – The Warden, unit Deputy Warden, unitAssociate Deputy Warden, or the Contract Beds Deputy Warden or Associate Deputy Wardenshall be responsible for:1.5.1Denial of visitation or removal of a person(s) from an inmate's approved VisitationList, when the person:1.5.1.1Poses a direct threat to the safety, security and/or orderly operation ofthe institution.1.5.1.2Is the victim of the inmate. A person identified as the victim and whoseeks visitation status with the inmate who victimized him/her, shallsubmit a written request listing the reason(s) for visitation. The entirecircumstances shall be reviewed, prior to visitation being authorized. Ifthe victim is a minor, the minor's parent(s) and/or legal guardian shallsubmit a notarized request listing the reason(s) for visitation. A minoridentified as a victim of a sex offense shall not be permitted to visit thatsex offender.1.5.1.3Is discovered to have a previously undisclosed felony conviction or isconvicted of a new felony.1.5.1.4Has previously introduced illegal contraband into a correctional/confinement facility.1.5.1.5Is listed as an approved visitor on another inmate’s Visitation List, exceptas outlined in 1.3.10 of this section.1.5.1.6Has felony charges or other active warrants pending. The person shall bereconsidered for visitation after the criminal charges/warrants have beenresolved, the appropriate documentation submitted, and a reviewconducted.1.5.1.7Provided false information on the visitation application.1.5.1.8Is currently suspended at any of the Department’s institutions.1.5.1.9Has been prohibited from visiting pursuant to section 6.0.1.5.1.10Has not been properly cleared due to Department employee(s) failure tofollow policy.

CHAPTER: 900911 - INMATE VISITATIONPAGE 8FEBRUARY 3, 20171.5.1.111.5.2Providing written notification of the action taken to any person denied orinvoluntarily removed from an inmate’s approved Visitation List.1.5.2.11.6Persons denied visitation may appeal the decision. Those persons whodo not appeal may not apply again for visitation for a period of sixmonths from the date of denial.Visitation Denial/Removal Appeals1.6.1A person appealing the denial or removal of visitation privileges shall submit anappeal in writing or electronically via email, within ten workdays of the action taken,to the Warden of the institution where the inmate is assigned.1.6.1.11.6.21.7Has not submitted payment within 30 calendar days of receipt ofapplication.For inmates assigned to private prison facilities, the Contract BedsOperations Director or Bureau Support Administrator shall be responsiblefor reviewing the appeal and initiating appropriate action.The Warden or the Contract Beds Operations Director or Bureau SupportAdministrator, if applicable, shall be responsible for providing written notification ofthe outcome of the appeal to the visitor within ten workdays of receipt of thewritten appeal. Appeal decisions shall be final.1.6.2.1When an appeal is denied, the person may not apply for Visitationreinstatement for a period of six months after the date of initial denial orremoval action, or until the threat posed by the person ceases to exist.1.6.2.2Upheld appeals shall result in visitation being granted or reinstatedimmediately.1.6.2.3Upon denying an appeal, ACJIS documents used during the appealprocess shall be destroyed.Visitation List Changes1.7.1An inmate may request the addition or deletion of approved persons to the VisitationList by submitting a Request to Change Visitation/Telephone Listing, Form 911-3and the Visitation List, Form 911-1, to visitation staff.1.7.1.1After authorized changes have been entered in ACIS by staff, a copy ofthe Visitation List shall be provided to the inmate in a timely manner.1.7.1.2Changes requested by the inmate to the current Visitation List, can onlybe made once every 90 calendar days.1.7.1.2.11.7.2The 90 calendar day restriction applies to the entireVisitation List and not for individual visitors.Changes to an approved visitor’s address, telephone number, and/or name must besubmitted in writing or electronically, to include email, by the visitor. The inmate

CHAPTER: 900911 - INMATE VISITATIONPAGE 9FEBRUARY 3, 2017may not request a change be made to the visitors address, telephone number, and/orname.1.7.2.11.8The 90 calendar day restriction does not apply to changes requested byan approved visitor.1.7.3After an approved person has been entered on an inmate’s visitation list, the personshall not be removed by the inmate for a minimum period of 90 calendar days.1.7.4A person seeking voluntary removal from an inmate's Visitation List shall submit anotarized request for removal. All voluntary removals shall remain in effect for aminimum of 90 calendar days. The person who was removed shall not be placed onany inmate's visitation list during this period.1.7.5All persons under visitation suspension shall require written approval forreinstatement as described in the initial application process.Visitation Files1.8.1Visitation staff shall establish and maintain an inmate visitation file for each inmateassigned to the unit and shall enter all required visitor/visit information in ACIS. Eachinmate’s Visitation File shall contain the following information: A visitation file shallbe established for all inmates, including inmates electing not to participate invisitation activity.1.8.1.11.8.1.21.8.1.3Section One1.8.1.1.1All Background Information Forms1.8.1.1.2A Visitation List1.8.1.1.3Visitation Waiver, Form 911-2 – All waivers1.8.1.1.4Request to Change Visitation/Telephone ListingSection Two - All approved Applications to Visit an Inmate, Form 911-4Section Three1.8.1.3.1All denied applications and visitation notifications relating tothe approval, denial, or removal of visitation privileges1.8.1.3.2Copies of inmate marriage certificates and birth certificatesfor minor visitors1.8.1.3.3All inactivated applications1.8.1.3.4All legal guardianship documentation – To include, notarizedcorrespondence from a parent(s)/legal guardian(s)authorizing a minor to be escorted by another adult to visitan inmate.

CHAPTER: 900911 - INMATE VISITATIONPAGE 10FEBRUARY 3, 20171.8.1.4Section Four1.8.1.4.1Preliminary Notice of Visitation Suspension, Form 911-5 (allcopies)1.8.1.4.2Documentation for all special circumstance visits1.8.1.4.3Special Visit Request, Form 911-6 – All requests1.8.1.4.4Inmate correspondence regarding visitation1.8.1.4.5Responses to inmate correspondence regarding visitation1.8.1.4.6Information Reports regarding an inmate’s visitation1.8.1.4.7Inmate notification of approved visitors1.8.1.4.8All visitor suspension correspondence1.8.1.4.9All inmate non-contact assignment correspondence1.8.1.4.10 Visitor medical/special needs information1.8.2A daily Visitor Sign-In, Form 911-8, shall be completed for each day visits areconducted, to include special/legal visits. The daily record shall be retained aminimum of 30 calendar days in a separate filing system by the unit.1.8.3Visitation staff shall maintain a permanent record log reflecting receipt and/ortransfer of all inmate visitation files for a period of one year.1.8.4An inmate’s visitation file shall be forwarded by transportation staff when the inmateis transferred to another unit.1.8.5When unforeseen emergency movement of inmates occurs, visitation staff shallforward the visitation files to the inmate’s receiving unit on the first workdayfollowing the emergency movement.1.8.5.1If an inmate's visitation file was not forwarded with the transferr inginmate, the receiving unit shall notify the sending unit, by email or fax,that the file was not transferred. A copy of the notification shall beretained for the file.1.8.5.2A temporary visitation file for each inmate shall be established when theinmate’s permanent file is not available.1.8.5.3All persons currently listed on ACIS as approved for visitation may visitthe inmate at any Department unit without being subjected to requalifying through the Visitation Application process.1.8.5.4If a visitor’s application is missing and ACIS documents the visitor asapproved, the Visitation Officer shall request that a new application becompleted by the visitor prior to allowing visitation entry. The applicationwill be processed as described herein. The visitor will be inactivated only

CHAPTER: 900911 - INMATE VISITATIONPAGE 11FEBRUARY 3, 2017if he or she fails to provide a new application upon request.1.9Annual Background Review1.9.11.9.22.0Visitation staff shall annually:1.9.1.1Run all approved adult visitors through the ACIC/NCIC system todetermine continued visitation privileges and admittance to ADCRRinstitutions. Any criminal or felonious activity, to include warrantsdeemed to pose a threat to safe, orderly operations of an institution mayconstitute suspension or denial of visit privileges, as outlined in 1.4.4 ofthis section.1.9.1.2Run all minors and infants through the ACIC/NCIC Wants and Warrantsand Missing Persons data bases. Minors, ages 7 - 17, shall also be runthrough the Juvenile Online Tracking System (JOLTS), as outlined in1.4.4 of this section.The ACJIS operator shall run an annual background report. If a new felony, criminalactivity, etc. is discovered, the ACJIS operator shall forward the information to theUnit requesting the annual background. The unit Deputy Warden shall determine ifvisitation privileges shall continue for the visitor. If there is no new activity from thelast annual approval date, visitation privileges shall continue. The same process shallapply for denials/removals of visitation privileges as outlined in 1.4 through 1.5.2.1of this section.VISITATION PROCESS2.1Upon each visit, visitors shall be required to register by fully-completing the Visitor Sign-In atthe Visitation Office. Visitation staff shall ensure each form is complete before processing thevisitor. {5-ACI-7D-21} [Revision – February 11, 2021]2.1.1Completed visitor Sign-In forms shall be maintained for a minimum of 30 calendardays in the visitation office.2.1.2The accompanying visitor shall complete the information and sign the front and backof the form for each minor.2.2Visitation staff shall establish and maintain an ACIS visitation record for each visit an inmatereceives.
