Pennsylvania ChildSupport Enforcement ProgramApplying for Child SupportChild support is money a parent pays to helpprovide food, clothing and other things for his orher child. Child support may include medicalsupport, payment of uncovered medical bills andcontributions to child care costs.When applying for child support, a complaint forchild support must be filed with the court. If themother of the child is unmarried, the DRS willneed proof of the child’s paternity. For additionalinformation about establishing paternity, seepage 9, “Establishing Paternity for your Child is inyour Hands.”The Department of Public Welfare, Bureau of ChildSupport Enforcement, BCSE, administers thePennsylvania Child Support Enforcement Program.State and federal laws govern how child supportorders are established and enforced. These lawsalso govern how child support is collected.The DRS will schedule a support conference andsend notices with the date and time to the parents.Child support owed to the family usually begins onthe date the complaint is filed. Some countiescharge a filing fee. If you cannot pay the filing fee,you may ask to be excused from paying the fee byfiling a petition to proceed In Forma Pauperis.County Domestic Relations SectionsChild support enforcement services in Pennsylvaniaare provided by the Domestic Relations Sections,DRSs, of the county Court of Common Pleas. 25 Annual Federal User FeeDRSs help parents apply for child support services,establish paternity and support orders, and enforcesupport orders. A DRS worker will set up anappointment or help with an application. If youhave domestic or family violence concerns, talkwith the DRS about safety measures. See page 5,“Domestic Violence: Addressing Safety Risks in theSupport Process,” for more information about howDRSs handle cases in which domestic violence maybe a concern.The United States Congress requires collection of a 25 annual fee each year for open/active childsupport cases that receive at least 500 in childsupport payments annually if the custodial parenthas never received cash assistance. The commonwealth will pay the 25 fee for families with collections between 500 and 1,999.99. The 25 feewill be collected from the custodial parent in caseswhich have annualcollections that equal orexceed 2,000.The county DRS can also helpif the noncustodial parentlives in another Pennsylvaniacounty, a different state oreven another country. Thenoncustodial parent is theparent who does not live withthe child and must pay childsupport.The 25 fee is collected onceeach Federal Fiscal Year, FFY.The FFY is the period betweenOctober 1 and September 30of the following year. The 25fee will be collected betweenOctober 1 to November 30and March 1 to September30. The fee will not becollected in the months ofDecember, January andFebruary.Feel free to ask questions ofthe DRS worker. You shouldkeep a written record ofcontacts with the DRS andthe documents received fromthe DRS.2

Pennsylvania ChildSupport Enforcement Programsupport until the child turns 18 or graduates fromhigh school, whichever occurs later, unless otherwiseordered by the court. Either parent may be orderedto provide medical support if it is available at nocost or at a reasonable cost. “Reasonable cost” isdefined as an amount not to exceed five percent ofthe net monthly income. The incomes and assets ofboth parents are considered when the courtestablishes a support order. For detailed informationabout the support guidelines, check under“Frequently Asked Questions” on the PennsylvaniaChild Support website at www.childsupport.state.pa.us.The website also includes the Pennsylvania SupportEstimator, which you can use to estimate theamount of your monthly child support obligation.However, the court will establish the amount ofmonthly support, and it may be different than theamount on the Support Estimator.Parent Locator ServiceIf you do not know where your child’s noncustodialparent lives, the DRS can refer your case to theParent Locator System. This service uses federal,state and local resources to search for noncustodialparents. You must give the DRS the noncustodialparent’s name; date of birth; Social Securitynumber, if you know it; and as much otherinformation as possible for the search.If you go to the Pennsylvania Child Supportwebsite at www.childsupport.state.pa.us and clickon the link for “Frequently Asked Questions,” youwill find more information about what a DRS doesto locate noncustodial parents.The Support ConferenceYou will receive notice advising you when thesupport conference is scheduled and whatinformation to bring. You should be prepared totalk about and provide proof of any special needsthe child has, such as any medical conditions.The Support OrderThe support order is a court order that lists thedetails about child support payments. The supportorder tells how much and how often supportpayments must be made and other expenses thenoncustodial parent must pay, such as medicalsupport. When the noncustodial parent has morethan one child support order, the support paid isdivided between each support case.You must attend the support conference.Depending on the county, if you believe youcannot attend, you may ask the DRS if you mayattend by telephone. You will need to explain whyyou believe you cannot attend, and you may berequired to provide other information. This requestmust be made as soon as possible. County DRSstaff can help with questions and explain theprocess for obtaining child support.A support officer will establish the support orderbased on the income and expense informationprovided by the parents and in accordance with thePennsylvania Support Guidelines. The support officerwill also consider the time each parent is responsiblefor the child.Pennsylvania Support GuidelinesThe guidelines were developed with the principlethat the child(ren) of separated, divorced or singleparents should receive the same amount ofparental support as if the parents were together.The State Supreme Court issues these guidelinesfor the DRSs to use in calculating how much childsupport a parent should pay.The support order can be appealed. In somecounties that appeal is heard by an attorney hiredby the DRS; the individual may appeal theattorney’s decision to a judge. In other counties, theappeal of the support order goes directly to thejudge for decision.The guidelines are based on the needs of the childand the ability of the parents to provide child3

You may ask to be excused frompaying the fee by filing a petition to proceed InForma Pauperis. It is then up to the DRS worker toaccept or decline the request.Modifying the Child Support OrderParents can petition the court for a review andmodification of their child support order at anytime if they feel there is a change in circumstancethat may affect the amount of the child supportorder. Additionally, every three years the DRS willsend each parent a notice asking if they want theirsupport case reviewed. The DRS must reviewTemporary Assistance for Needy Families, TANF,support cases every three years. The review is tomake any appropriate increase, decrease,modification, or termination of the order takinginto account the best interest of the child. Thefollowing factors related to the child support orderare considered:For Your InformationThe information contained here is not intended togive solutions for all situations. Each child supportcase has individual differences that may requirespecial attention by a qualified professional at theDRS.If you have any questions about your case or theamount of your child support order, contact thecounty DRS handling your case. See page 19 titled“Child Support Resources and Telephone Numbers”for the telephone number of the county DRS. The income of either parent significantlyincreases or decreases. The child now has significant or continuingmedical expenses.The county DRS also handles spousal supportmatters. Ask the DRS if you have questions aboutapplying for spousal support. Child care and/or medical insurance changes. The parents are now living together.Pennsylvania Child SupportEnforcement System, PACSES The child receiving support is 18 years of ageand graduated from high school.PACSES is the statewide computer system that isused by the county domestic relations sections.Case, personal and payment information aremaintained in PACSES. DRS staff use PACSES tomonitor support payments and enforce supportorders. The child starts living with the noncustodialparent or someone other than the custodialparent/plaintiff. The noncustodial parent is incarcerated. Other substantial changes in circumstanceoccur.Contact the county DRS that handles your caseif you have any questions about the PennsylvaniaChild Support Enforcement Program.You can learn more about the PennsylvaniaChild Support Enforcement Program and checkinformation about your child support case atwww.childsupport.state.pa.us. Domestic Violence: Addressing SafetyRisks in the Support ProcessEveryone involved in a support action needs tounderstand how the process works. This helpsyou make informed decisions about whetherand/or how to pursue support.The Support Process The parent or individual with custody of thechild, who is called the custodial parent orthe caretaker, will be asked to provideinformation about the parent(s) not livingwith the child, who is/are called thenoncustodial parent(s). An individual will be asked to provideinformation to locate the noncustodialparent or spouse. It is necessary to go to the DomesticRelations Section, DRS, or court todetermine if the noncustodial parent orspouse will be ordered to pay support and,if so, how much. If the mother is not married when the childis born, paternity must first be established. Both adults in the support action will receivecourt papers that contain the addresses ofeach party. Both adults involved in the support actionwill be required to attend conferences andhearings.These requirements may present safetyrisks if you are concerned about family ordomestic violence.Addressing Safety RisksPursuing support may present safety risks forsome individuals or families. The support processprovides the following safeguards: If domestic violence is reported, the DRS orcourt can place a Family Violence Indicator onPACSES for the custodial parent and/or noncustodial parent as appropriate so that5addresses and other confidential informationwill not be given out or printed on any papersthat are sent to others. The following factorsreported by an individual or reliable source(s)are used to decide whether to mark the casewith a Family Violence Indicator: There is an active Protection FromAbuse, PFA, order, either temporary orpermanent, against the person fromwhom support would be sought. There is reason to believe that therelease of information on thewhereabouts of the individual or childmay result in physical or emotionalharm or the individual’s or family’ssafety would be endangered by thisdisclosure. The DRS or court may provide safeguards ifdomestic violence is reported. Each countyhas different safety options and proceduresavailable. Individuals applying for or receiving cashassistance may be excused from the requirement to pursue support based on domesticviolence or other good cause. See page 7titled “Child Support and Cash Assistance.”Note: Many government agencies and groupsthat work in the prevention of domestic violenceuse the phrases “domestic violence,” “domesticabuse” and “family violence” to mean the samething.Victims or potential victims of domesticviolence may include: children, custodialparents, noncustodial parents, caretakers andspouses. Any individual with safety concernsshould talk to the DRS or court staff at least oneweek before a scheduled conference or hearingto review safety options.

Domestic Violence: Addressing SafetyRisks in the Support ProcessDomestic violence occurs within a family orintimate relationship as a way to control anotherperson. Victims suffer physical injury, live in fearin their homes and lose power over their lives.Domestic violence includes: threats of, or attempts at, physical or sexualabuse; or neglect or deprivation of medical care.Property or Economic Abuse: Stealing ordestroying personal belongings, hurting pets,taking money, withholding basic needs such asfood and clothing, or not allowing you to work.Physical Abuse: Hitting, slapping, shoving,kicking, punching, burning, choking, not allowingyou to leave home or using objects to cause injury(guns, knives, baseball bats, etc.).If you need help about domestic violence problems, call the national helpline at 1-800-799-SAFE(7233) or a local agency. Local agency informationfor the Pennsylvania Coalition Against DomesticViolence is available at www.pcadv.org.Mental Abuse: Threats, telling you what you canor cannot do, name calling, or put-downs.Sexual Abuse: Rape, unwanted touching, forcedsexual acts, refusal to practice safe sex, or sexualactivity involving a dependent child; being forced as the caretaker/relative of adependent child to engage in nonconsensualsexual acts or activities;6

Child Support andCash Assistancesomeone wants to claim Good Cause, the DRS willnot take any action on establishing paternity orsupport. Applicants for or recipients of cashassistance will be referred to the CAO for help infilling out the Domestic Violence Verification Form(PA 1747) or providing verification in cases of rape,incest or adoption. Ask the CAO staff for help!The CAO will decide whether or not to grant GoodCause and will give written notice of this decisionto the individual who claimed Good Cause. If theGood Cause claim is denied, the individual claimingGood Cause has the right to appeal and request afair hearing.If a parent or spouse applies for or receivesTemporary Assistance for Needy Families, or TANF,also called cash assistance, the law requirescooperation in establishing paternity and pursuing asupport order. If domestic or family violence orother circumstances make complying with thesesupport requirements dangerous or inappropriate,the county assistance office, CAO, may excuse anapplicant or recipient from cooperating based onGood Cause.What is considered GoodCause for not filing for support?Domestic Violence - Good Cause is granted whenpursuing support would:What does “assignment of support rights”mean? Make it more difficult for an individual orfamily member to escape domestic violence;If you receive cash assistance, current support owedduring the time you receive cash assistance will bepaid to the state. This is called “assignment ofsupport rights” and is required by law. The amountof your support that may be collected by the state islimited to the amount of cash assistance you receive. Place an individual or family member at risk offurther domestic violence; or Unfairly penalize an individual who has beenvictimized or who is at risk of further violence.See page 5 titled “Domestic Violence: AddressingSafety Risks in the Support Process” for moreinformation.Support paid to the state will be limited to theamount of current support owed during the timeyou receive cash assistance capped by the amountof cash assistance you received.Rape, Incest or Adoption – Good Cause isgranted when:What happens to the “assignment of supportrights” when cash assistance ends? The child was conceived as a result of rapeor incest.When cash benefits stop, support collections will bepaid in the following order: Court proceedings for adoption of the child arepending or the applicant or recipient is workingwith an agency that is helping to decidewhether or not the child should be placed foradoption and these discussions have notprogressed for more than three months.1. The full amount of current monthly supportowed to the family.2. The full amount of arrears owed to the family.3. The amount of arrears assigned to the State.The family will receive all support collections firstbefore the state collects any support that is owed.This includes support collected through the FederalTax Refund Offset Program.How and when can someone requestGood Cause?Good Cause can be claimed at any time. Whenthe Domestic Relations Section, DRS, is told that7

Child Support andCash AssistanceWhat is a support pass-through? If you have two or more children, you willreceive the first 200 of the current childsupport paid in each month; orEvery month that the amount of current childsupport owed is paid on time for a familyreceiving cash assistance, DPW pays a portionof the child support to the custodial parent orcaretaker. This is called the child supportpass-through. If you have an order for spousal support for achild, you will receive the first 50 of thecurrent support paid in each month.You will receive only one support pass throughpayment a month. If you have one child, you will receive thefirst 100 of the current child support paid ineach month;8

Establishing Paternity for yourChild is in your HandsImportant Information for Unmarried Parentsbe challenged in court only on the basis of fraud,duress or material mistake of fact, which must beestablished by clear and convincing evidence.What is paternity?In Pennsylvania, when a child is born to a womanwho is unmarried, there is no legal relationshipbetween the father and the child. The father of achild born to an unmarried woman is not the fatherfor legal purposes unless:Do not sign the Acknowledgment of Paternityform if either party is unsure of who is thefather. Instead, contact or go to your county DRS tohave paternity established through the court. Thecourt may order genetic testing. See page 20 titled“Child Support Resources and Telephone Numbers”to find the telephone number of your county DRS. A valid Acknowledgment of Paternity form (PA/CS611) signed by both parents is on record, or A court has entered an order that establishes thelegal father of the child.What if the birth mother will not sign theAcknowledgement of Paternity form?Note: Under current Pennsylvania law, when a childis born to a married woman, the husband is thepresumed legal father of the child.A man claiming to be the father of a child may makea claim of paternity. The man needs to complete thechild’s information section, the child’s birthplaceinformation section, the mother’s name, and thefather’s information section on the Acknowledgmentof Paternity form. This allows the man to be notifiedof certain legal proceedings about the child, but doesnot give him any parental rights. If the man wantsparental rights, he may go to the DRS and requestgenetic testing.What is an Acknowledgment of Paternity formand when can it be signed?If the mother is unmarried, she and the fathermay sign an Acknowledgment of Paternity form.At the time of birth, the hospital staff will give theunmarried mother and birth father anAcknowledgment of Paternity form to complete. Thehospital staff can submit the completed form.After leaving the hospital, if both parties wish to filean Acknowledgment of Paternity, the form can beobtained at county assistance offices, DRSsor by contacting the Department of Public WelfareBureau of Child Support Enforcement PaternityCoordinator at 1-800-932-0211, option number two.Someone at all of these places can help you complete the form.What will establishing paternity do for mychild?When you establish paternity, your child may beeligible for the following:Birth CertificateYour child’s birth certificate will show the name ofthe father.An Acknowledgment of Paternity form must includethe signed consent of the birth mother and signatureof the birth father. The signatures must be witnessedby someone other than the birth mother or birthfather. Once BCSE determines the form is valid, it isrecorded as an acknowledgement of paternity.Health Care Benefits (Medical Support)If the father’s employer provides health carebenefits, the father may be able to include thechild under his health care plan.A voluntary Acknowledgment of Paternity may becancelled by either party within 60 days after theform is signed or before the date of a court proceeding related to the child, whichever is sooner. Afterthe 60 days, the acknowledgment of paternity maySocial SecurityThe child may be eligible to receive SocialSecurity benefits if the father becomes disabledor dies.9

Fathers whopay child support tend to be more involved intheir children’s lives and children who receivechild support appear to perform better in schooland are less likely to become teen parents.I don’t know who the father is, what can Ido?Contact the DRS for help. See page 19 titled “ChildSupport Resources and Telephone Numbers.”I do not know where my child’s father is,what can I do?The DRS can help you locate the father if you wantto establish paternity.What must I do if I am receiving cashassistance for my child?If you receive cash assistance, the law states thatyou must cooperate in establishing paternity andobtaining a child support order unless there isGood Cause to excuse you from doing so. Tell theCAO if you have domestic violence or Good Causeconcerns. ReceivingChild SupportThere are two ways to receive child supportpayments, the EPPICard Debit MasterCard Cardor direct deposit into a personal bank account. Youmust contact the PA State Collection andDisbursement Unit, PA SCDU, at 1-877-727-7238 toset up direct deposit into your checking or savingsaccount. If you do not choose direct deposit, anEPPICard will be issued to you.PA SCDU receives and sends out child supportpayments. Pennsylvania’s Department of PublicWelfare operates PA SCDU.What is an EPPICard Debit MasterCard Card?The EPPICard is a fast, convenient way to receiveyour child support payments. The EPPICard is saferthan using cash or checks. The EPPICard is a typeof debit card.How does the EPPICard work?Your support payments are sent electronically to anaccount that has been set up only for your childsupport payments. When payments are sentelectronically you get them more quickly and safely.You cannot make your own deposits into yourEPPICard account. You will need to select a PersonalIdentification Number, also known as a PIN, toactivate your EPPICard .Where can I use the EPPICard ?The EPPICard can be used at any location thataccepts Mastercard or displays its logo such asbanks, retail stores, and automatic teller machines,ATMs. You can get cash back with purchases at manybusinesses that accept Maestro , like grocery stores.You can use your EPPICard for all of your purchasesas long as you have money in your account.11

ReceivingChild SupportHow do I use the EPPICard ? Cash Back With a Purchase. Many retailstores that accept Maestro , in addition togrocery stores, will give cash back with no feewhen you make a purchase.1. To Make Purchases: Present your card whenpaying. The amount of your purchase is automatically deducted from your account. At ATMs. You can use any ATM that has theMasterCard or Maestro logo. Some ATMscharge a fee for cash withdrawls.2. To Get Cash: From a Teller at a Bank. Give your card to ateller in any bank displaying the MasterCard logo, and ask for the amount of cash you wantthat is available to you. There is no charge toyou to get cash from a bank teller where theMasterCard logo is displayed. When makingyour cash withdrawal, do not ask the teller fora cash advance.If you are an EPPICardTM cardholder and youhave a question about your support payment,call EPPICard Customer Service at 1-800-3041669. For information about your direct depositsupport payments, contact PA SCDU CustomerService at 1-877-727-7238. Individuals withhearing impairment should use 1-877-6769582.These numbers are toll-free nationwide. You canreview your payment information 24 hours a day,7 days a week. To speak with customer service,call between 8 a.m. and 5 p.m. Monday throughFriday.Must I do anything else?The law requires each parent to tell theDomestic Relations Section, DRS, within sevendays of a change happening, such as moving,changing employment or getting married.Please be sure the DRS has your current address.The DRS lists your address in the Pennsylvania ChildSupport Enforcement System, the state’s childsupport computer. You can update this informationonline at www.childsupport.state.pa.us.If you have questions about your case that are notrelated to your support payment, you must contactthe DRS that handles your case. See page 20 titled“Child Support Resources and Telephone Numbers”for the telephone number of the county DRS thathandles your case.12

PayingChild Supportcredited. Write your PACSES member number orSSN on the check or money order and make itpayable to PA SCDU.Most child support is paid by income withholdingas ordered by the court and maintained in thePennsylvania Child Support Enforcement System,which is the state’s child support computer.Pennsylvania maintains monthly support orderswhich charge the first of each month. If youremployer gets a court order, the employer will takechild support out of your pay and send it to PASCDU. Support can also be taken from yourunemployment compensation, workers’ compensation, Social Security, and retirement and pensionbenefits. Telephone. You can make a payment over thephone from your checking or savings account.Contact the PA SCDU Customer Service Unit at1-877-727-7238 for instructions. Recurring Automatic Withdrawals. You canchoose to have your support payments takenelectronically from your checking or savingsaccount. This is called recurring automaticwithdrawal. Call PA SCDU at 1-877-727-7238 ifyou would like to set up recurring automaticwithdrawal. You may also have a one-timepayment or recurring payments withdrawn fromyour bank account at www.expertpay.com.How can I pay child support if I don’thave income withholding?PA SCDU sends payment coupons to parents orderedto pay support who do not have income withholding.You must write on the coupon the amount of moneyyou are paying. Make your personal check,cashier’s check or money order payable to PASCDU. A coupon should be sent with every paymentto PA SCDU. However, if you do not have a paymentcoupon, write your PACSES member number, whichis found on your court order, or Social Securitynumber, SSN, on your check or money order andsend payments to:PA SCDUP.O. Box 69110Harrisburg, PA 17106-9110PA SCDU cannot accept checks that are considerednon-negotiable by banking standards. Someexamples of non-negotiable items are: checks thatare stale dated, post dated or not signed; checksthat are not payable to PA SCDU; or the amount innumbers does not match the amount “written out”.PA SCDU also does not accept temporary checks orstarter checks. Credit/Debit Card. PA SCDU accepts Visa ,MasterCard , or Discover . You can pay bytelephone with your credit/debit card by callingPA SCDU toll free at 1-800-955-2305. Becauseyou will not be able to set up your account toautomatically charge your credit card, you mustcall PA SCDU every time you wish to make acredit/debit card payment. Credit card paymentsmay also be made online atwww.e-childspay.com.For information about your support payment, contactthe PA SCDU at 1-877-727-7238.
