Meadowbrook is pleased to includeyour company in the California Medical Provider Network (MPN) program. You will be utilizingthe MEADOWBROOK MPN.The MEADOWBROOK MPN provides access to an exclusive group of physicians who understandWorkers’ Compensation requirements and are experienced in providing quality medical care forinjured workers. Our program ensures that every covered employee that suffers a work-relatedinjury or illness has access to prompt medical care, along with a safe Return-To-Work as soon asmedically appropriate.This Employer guide contains important information to assist you with the administration of theMEADOWBROOK MPN. To ensure your employees receive the required materials in a timelymanner, you will find copies (and samples) of forms and recommended procedures. This guideis only a summary of the MPN program. Meadowbrook-Harbor MPN Program11/1/2011Revised Workers’ Compensation and Medical Provider Network (MPN) ChangesThe California Division of Workers’ Compensation (DWC) released new Workers’ Compensationregulations, including the Medical Provider Network (MPN). These include mandatory new/revisedemployee and posting notices.Effective October 8, 2010, California employers must:1. Post revised Workers’ Compensation employee posting notices,2. Distribute an updated version of the new hire pamphlet to employees hired on or afterthat date,3. Provide a new DWC-1 Claims Form/Notice of Potential Eligibility to workers injured onor after that date, and4. Post new Medical Provider Network (MPN) notices if they use an MPN.All California employers must: Post the new version of the ‘Notice to Employees – Injuries Caused by Work’ (DWC7) Distribute a new ‘Your Rights to Workers’ Compensation Benefits’ pamphlet to all newemployees who start to work on or after 10.08.10, at the time of hire or before the end ofthe first pay period.Employers with an existing Medical Provider Network (MPN) must also:1. Create an MPN “Implementation Notice” to distribute to employees at the “time ofhire”2. Create a complete written MPN Notice (English and Spanish) and post it “in aconspicuous location frequented by employees during the hours of the workday and inclose proximity to the Workers’ Compensation posting (Notice to Employees – InjuriesCaused by Work) by 10.08.10.3. Distribute the complete MPN Notice to any employee injured at work on or after thatdate.Employers who are implementing, changing or terminating an MPN must also: Create an MPN “Implementation Notice” to distribute to employees “prior to theimplementation of an MPN or at Time of Hire” Post a complete written MPN Notice (English and Spanish) and post it “in a conspicuouslocation frequented by employees during the hours of the workday and in close proximity tothe Workers’ Compensation posting (Notice to Employees – Injuries Caused by Work) by10.08.10. Give the Complete MPN Notice to any employee injured at work on or after 10.08.10. Meadowbrook-Harbor MPN Program11/1/2011Employee Notification - MPNThe following discusses the MPN Employee Notification process and procedures to beperformed by the Employer.SummaryEvery covered employee shall be notified, in writing, about the use of the HARBOR MedicalProvider Network (MPN) for work-related injuries and illnesses. The written notification isrequired by Labor Code section § 4616.3.Initial MPN Employee NotificationThe Initial MPN Implementation Notice shall be sent to all covered employees at one of thefollowing times:1. Prior to the implementation of the MPN Program; or2. At the time of Hire.An MPN Implementation Notice is not required if the MPN Applicant or insured employer ischanging from one MPN to another MPN within 60 days. The MPN implementation notice shallbe provided in English and also in Spanish, to Spanish-speaking employees.Complete MPN Employee NotificationThe Complete Written MPN Implementation Notice shall be sent to all covered employees atone of the following times:1. At the time of Injury; or2. When an existing employee transfers into the MPN Program (MPN Transfer of Care).The Complete Written MPN implementation notice to all covered employees shall, at aminimum, include the following information:1. That medical treatment for new work injuries will be provided through the MedicalProvider Network (MPN) as of the effective date of coverage unless the employeeproperly predesignates a physician or medical group prior to injury;2. The effective date of coverage under the new MPN;3. That existing work injuries may be transferred into the new MPN. The name of your MPN designated contact for all employees;6. A description of the MPN Program;a. How to review, receive or access the provider network;b. How to access initial care and subsequent care (including access standards);c. How to access treatment outside the MPN geographical service area;d. How to choose a physician within the MPN;e. What to do if your employee has trouble getting an appointment with a MPNprovider;f. How to change a physician within the MPN;g. How to obtain a referral to a specialist within the MPN or outside the MPN, ifneeded;h. How to use the second and third opinion processes;i.How to request and receive an Independent Medical Review;j.A description of the standards for transfer of ongoing care into the MPN anda notification that a copy of the policy shall be provided upon request; andk. It must be managed and administered consistently. The notificationprocess could be significant if the claim becomes litigated.1. Post the MPN Notification (Complete Written Employee MPN Notification)a. NOTE: The notice shall be posted in both English and Spanish in a conspicuouslocation frequented by employees during the hours of the workday and in closeproximity to the mandatory Workers’ Compensation posting.2. Distribute the following MPN information to all current covered employees and futurenew hire employees: (English version to all employees and also Spanish version toSpanish-speaking employees).a. MPN Implementation Notice (Exhibit A)b. Employee MPN Acknowledgement Forms (optional)c. Physician Pre-Designation Forms3. Collect the completed and executed Employee MPN Acknowledgement Forms fromyour employees.4. CHANGE OF MPN – For employers that utilized a different MPN previously, provide theCHANGE OF MPN notice to injured covered employees to give the required notice of thechange of MPN coverage.5. NEW EMPLOYEES – Provide the MPN Implementation Notice at time of hire.6. TIME OF INJURY – Provide the Complete Written MPN Employee Notification at time ofinjury. Meadowbrook-Harbor MPN Program11/1/2011Important Information about Medical Care if you havea Work-Related Injury or IllnessComplete Written MPN Employee Notification(Title 8, California Code of Regulations, section 9767.12)California law requires your employer to provide and pay for medical treatment if you are injured at work. Youremployer has chosen to provide this medical care by using a Workers’ Compensation physician network called aMedical Provider Network (MPN). This MPN is administered by Harbor Health Systems. This notification tells youwhat you need to know about the MPN program and describes your rights in choosing medical care for workrelated injuries and illnesses.What is a MPN?A Medical Provider Network (MPN) is group of health care providers (physicians and other medical providers) usedby your employer to treat workers injured on the job. Each MPN must include a mix of doctors specializing in workrelated injuries and doctors with expertise in general areas of medicine. MPNs must allow employees to have achoice of provider(s).How do I find out which doctors are in my MPN?The MPN contact listed at the end of this notification will be able to answer your questions about the MPN and willhelp you obtain a regional list of all MPN doctors in your area. At minimum, the regional listing must include a listof all MPN providers within 15 miles of your workplace and/or residence or a list of all MPN providers within thecounty where you live and/or work. You may choose which list you wish to receive. You can get the list of MPNproviders by calling the MPN contact or by going to the network search site listed at the end of this notice. Youalso have the right to a complete listing of all of the MPN providers upon request.What happens if I get injured at work?In case of an emergency, you should call 911 or go to the closest emergency room.If you are injured at work, notify your employer as soon as possible. Your employer will provide you with a claimform. When you notify your employer that you have had a work-related injury, your employer or insurer will makean initial appointment with a doctor in the MPN.How do I choose a provider?After the first medical visit, you may continue to be treated by this doctor, or you may choose another doctor fromthe MPN. You may continue to choose doctors within the MPN for all of your medical care for this injury. Ifappropriate, you may choose a specialist or ask your treating doctor for a referral to a specialist. If you need help inchoosing a doctor you may call the MPN Contact listed above.Can I change providers?Yes. You can change providers within the MPN for any reason, but the providers you choose should beappropriate to treat your injury.What standards does the MPN have to meet?The MPN has providers for the following for the entire state of California.The MPN must give you a regional list of providers that includes at least three physicians in each specialtycommonly used to treat work injuries/illnesses in your industry. The MPN must provide access to primaryphysicians within 15 miles and specialists within 30 miles. If you live in a rural area there may be a differentstandard.Proprietary and ConfidentialPage 11

Meadowbrook-Harbor MPN Program11/1/2011The MPN must provide initial treatment within 3 days. You must receive specialist treatment within 20 days ofyour request. If you have trouble getting an appointment, contact the MPN.What if there are no MPN providers where I am located?If you are a current employee living in a rural area or temporarily working or living outside the MPN service area,or you are a former employee permanently living outside the MPN service area, the MPN or your treating doctorwill give you a list of at least three physicians who can treat you. The MPN may also allow you to choose your owndoctor outside of the MPN network. Contact your MPN for assistance in finding a physician or for additionalinformation.What if I need a specialist not in the MPN?If you need to see a type of specialist that is not available in the MPN, you have the right to see a specialist outsideof the MPN.What if I disagree with my doctor about medical treatment?If you disagree with your doctor or wish to change your doctor for any reason, you may choose another doctorwithin the MPN.If you disagree with either the diagnosis or treatment prescribed by your doctor, you may ask for a second opinionfrom another doctor within the MPN. If you want a second opinion, you must contact the MPN and tell them youwant a second opinion. The MPN should give you at least a regional MPN provider list from which you can choosea second opinion doctor. To get a second opinion, you must choose a doctor from the MPN list and make anappointment within 60 days. You must tell the MPN Contact of your appointment date, and the MPN will send thedoctor a copy of your medical records. You can request a copy of your medical records that will be sent to thedoctor.If you do not make an appointment within 60 days of receiving the regional provider list, you will not be allowed tohave a second or third opinion with regard to this disputed diagnosis or treatment of this treating physician.If the second opinion doctor feels that your injury is outside of the type of injury he or she normally treats, thedoctor's office will notify your employer or insurer. You will get another list of MPN doctors or specialists so youcan make another selection.If you disagree with the second opinion, you may ask for a third opinion. If you request a third opinion, you will gothrough the same process you went through for the second opinion.Remember that if you do not make an appointment within 60 days of obtaining another MPN provider list, thenyou will not be allowed to have a third opinion with regard to this disputed diagnosis or treatment of this treatingphysician.If you disagree with the third opinion doctor, you may ask for an Independent Medical Review (IMR). Youremployer or MPN contact person will give you information on requesting an Independent Medical Review and aform at the time you request a third opinion.If either the second or third opinion doctor agrees with your need for a treatment or test, you will be allowed toreceive that medical service from a provider inside the MPN, including the second or third opinion physician.If the Independent Medical Reviewer supports your need for a treatment or test you may receive that care from adoctor inside or outside of the MPN.What if I am already being treated for a work-related injury before the MPN begins?Your employer or insurer has a “Transfer of Care” policy which will determine if you can continue beingtemporarily treated for an existing work-related injury by a physician outside of the MPN before your care istransferred into the MPN.Proprietary and ConfidentialPage 12

Meadowbrook-Harbor MPN Program11/1/2011If you have properly predesignated a primary treating physician, you cannot be transferred into the MPN. (If youhave questions about predesignation, ask your supervisor.) If your current doctor is not or does not become amember of the MPN, then you may be required to see a MPN physician.If your employer decides to transfer you into the MPN, you and your primary treating physician must receive aletter notifying you of the transfer.If you meet certain conditions, you may qualify to continue treating with a non-MPN physician for up to a yearbefore you are transferred into the MPN. The qualifying conditions to postpone the transfer of your care into theMPN are below: (Acute) The treatment for your injury or illness will be completed in less than 90 days;(Serious or chronic) Your injury or illness is one that is serious and continues for at least 90 days withoutfull cure or worsens and requires ongoing treatment. You may be allowed to be treated by your currenttreating doctor for up to one year, until a safe transfer of care can be made.(Terminal) You have an incurable illness or irreversible condition that is likely to cause death within oneyear or less.(Pending Surgery) You already have a surgery or other procedure that has been authorized by youremployer or insurer that will occur within 180 days of the MPN effective date.You can disagree with your employer’s decision to transfer your care into the MPN. If you don’t want to betransferred into the MPN, ask your primary treating physician for a medical report on whether you have one of thefour conditions stated above to qualify for a postponement of your transfer into the MPN.Your primary treating physician has 20 days from the date of your request to give you a copy of his/her report onyour condition. If your primary treating physician does not give you the report within 20 days of your request, theemployer can transfer your care into the MPN and you will be required to use a MPN physician.You will need to give a copy of the report to your employer if you wish to postpone the transfer of your care. Ifyou or your employer disagrees with your doctor’s report on your condition, you or your employer can dispute it.See the complete transfer of care policy for more details on the dispute resolution process.For a copy of the entire transfer of care policy, ask your MPN Contact.What if I am being treated by a MPN doctor who decides to leave the MPN?Your employer or insurer has a written “Continuity of Care” policy that will determine whether you cantemporarily continue treatment for an existing work injury with your doctor if your doctor is no longerparticipating in the MPN.If your employer decides that you do not qualify to continuing your care with the non-MPN provider, you and yourprimary treating physician must receive a letter of notification.If you meet certain conditions, you may qualify to continue treating with this doctor for up to a year before youmust switch to MPN physicians. These conditions are set forth below:Qualifying Conditions (Acute) The treatment for your injury or illness will be completed in less than 90 days.(Serious or chronic) Your injury or illness is one that is serious and continues for at least 90 days withoutfull cure or worsens and requires ongoing treatment. If your primary treating physician does not give you the report within 20 days of yourrequest, the employer can transfer your care into the MPN and you will be required to use a MPN physician.You will need to give a copy of the report to your employer if you wish to postpone the transfer of your care intothe MPN. If you or your employer disagrees with your doctor’s report on your condition, you or your employer candispute it.
