PART 1 PROCUREMENT REQUIREMENTS

CLEAN WATER SERVICES DURHAM AWWTF WASSTRIP IMPROVEMENTS ADVERTISEMENT FOR BIDS Sealed Bids for construction of the Durham WASSTRIP Improvements Project No. 7045 (Project) will be accepted by Michelle Mann electronically via Bid Locker at https://bidlocker.us/details/1290 Itb Durham Wasstrip Improvements Project (Bid Locker) until 2:00 p.m., local time, Thursday, November 12, 2020. Before Bidders can submit their Bids, they will need to register with Bid Locker at https://bidlocker.us/Home/bidlockerus. There is no cost to register. Any Bids received after the specified time will not be considered. First-Tier Subcontractor Disclosure Forms must be electronically submitted to Bid Locker at or before 4:00 p.m. local time on the same day through Bid Locker (Deadline). If Bidder fails to submit a disclosure form with the information required by the stated Deadline, the Bid will be deemed nonresponsive and will not be considered. Owner will not accept Bids by facsimile or email. Bids will then be publicly opened and read aloud by telephone conference at 2:00 p.m. local time on November 12, 2020 at Owner’s Office. Bidders can attend the opening by calling the telephone conference number (503) 681-4498. Contractor shall complete the work as specified or indicated in Owner’s Contract Documents for the Project. The Project contemplated consists of, but is not limited to furnishing all labor, materials and equipment necessary to: Convert an existing concrete tank to a Waste Activated Sludge (WAS) Equalization Tank with associated piping and valves. Install new WAS Pre-Thickening Feed Pumps and associated piping and valves in the existing Aeration Tunnel. Install new WAS piping and valves from the WAS Pre-Thickening Feed Pumps in the Aeration Tunnel, through the tunnel system, Solids Building Basement to the Rotary Drum Thickeners in Digester Complex 1 (DC1). Install two Rotary Drum Thickeners and their appurtenances including wash water booster pumps, controls, sludge hoppers, access platforms and polymer mixers in DC1. Install new P-Release Transfer Pumps in the ground level of DC1. Install a pumped jet mixing system including piping, nozzles, and a mix pump associated with the P-release Tank (a former anaerobic digester) in lower level of DC1. Install an odor control system for the P-release Tank consisting of ducting and an at grade carbon cannister odor control system. DURHAM AWWTF WASSTRIP IMPROVEMENTS CLEAN WATER SERVICES Piping and HVAC system modifications within DC1. Install new Thickening Centrifuge Feed Pumps in the lower level of DC1. Install new piping and valves from the Thickening Centrifuge Feed Pumps through the tunnel system to piping located in the Solids Building. Modify piping associated with the chemical sludge system to change the point of discharge to the filter drain. Install new polymer blending units and associated piping, valves, and controls in the existing Solids Building. Install exposed and buried piping, valves, and instruments associated with the equipment and systems outlined above. Install new motor controls, variable frequency drives, electrical panelboards, transformers, instrumentation and control panels, associated conduits, conductors, and other appurtenances necessary to complete the Work and to provide a complete and functional system constructed in accordance with the Contract Documents. The Work Site is located at Durham Advanced Water Resource Recovery (AWRRF) Facility, 16580 SW 85th Ave, Tigard, OR 97224 (Site). The Work is a public works project subject to ORS 279C.800 to 279C.870. The estimated construction cost of the Work is 3,910,000. The Bidding Documents are entitled “Durham WASSTRIP Improvements Project No. 7045.” Bidding Documents and Bid Results should be downloaded from the Owner's Website at http://bids.cleanwaterservices.org (Website) under the Project name. Prospective Bidders are responsible for obtaining any Addenda from either Owner's Website under the Project name or by using the links provided in automatic emails that come from the Owner. Each Bid must be submitted on the prescribed Bid Form and accompanied by Bid security as prescribed in the Instructions to Bidders. Bidders must deliver the original of the Bid security to Owner’s office at Rock Creek AWRRF, Engineering Building, 3235 S.E. River Road, Hillsboro, OR 97123 within five business days of the Deadline or Owner may declare the Bid nonresponsive. CLEAN WATER SERVICES DURHAM AWWTF WASSTRIP IMPROVEMENTS Prior to submission of its Bid, Bidder shall be registered with the Oregon Construction Contractors Board. The Work does not involve asbestos, so the requirements of ORS 468A.700 through 468A.760 shall not apply. Bidders shall be qualified in accordance with the applicable parts of ORS 279C in order to submit a Bid for public work in Oregon. Prospective Bidders are required to schedule and attend a prebid conference and Site visit on Tuesday, October 20, 2020 between 1:00 p.m. to 4:00 p.m. Site visit appointments can be scheduled by contacting Michelle Mann at mannm@cleanwaterservices.org. Each one-hour session will be scheduled on a first-come, first-served basis, with a limited number of attendees allowed at each session. Attendees will be required wear a mask when on-site. Michelle will provide additional instructions when scheduling the appointments. Representatives of Owner and Engineer will be present to discuss the Project. CLEAN WATER SERVICES DURHAM AWWTF WASSTRIP IMPROVEMENTS INSTRUCTIONS TO BIDDERS 1. DEFINED TERMS 1.1. Terms used in these Instructions to Bidders and the Advertisement for Bids which are defined in the General Conditions have the meanings indicated in the General Conditions and Supplementary Conditions. Certain additional terms used in the Bidding Documents have the meanings indicated below which are applicable to both the singular and plural thereof: 1.1.1.1 Owner’s Office—The office from which the Bidding Documents are to be issued and where the bidding procedures are to be administered. 1.1.2.1 Bidder—One who submits a Bid directly to Owner, as distinct from a sub bidder, who submits a price or quote to a Bidder. 1.1.3.1 Successful Bidder—Lowest, responsible and responsive Bidder to whom Owner (on the basis of Owner’s evaluation as hereinafter provided) makes an award. 2. COPIES OF BIDDING DOCUMENTS 2.1. Complete sets of Bidding Documents shall be used in preparing Bids. Neither Owner nor Engineer assumes responsibility for errors or misinterpretations resulting from use of incomplete sets of Bidding Documents. 2.2. The Bidding Documents can be downloaded from the Owner’s Website at http://bids.cleanwaterservices.org (Website). Prospective Bidders are responsible for obtaining any Addenda from District's Website listed above or using links from emails from Owner. Full-size Drawings may be obtained from Owner at cost of reproduction and handling, plus postage for mailing (if mailing is requested) and half-size drawings and specs are 250 per set. Drawings will only be made available to firms on the Bid Holders List having complete sets of Bidding Documents. 2.3. Owner and Engineer, in making copies of Bidding Documents available on the above terms, do so only for the purpose of obtaining Bids for the Work and do not authorize or confer a license or grant for any other use. 3. QUALIFICATIONS OF BIDDERS 3.1. To demonstrate qualifications to perform the Work, the apparent Successful Bidder and other Bidders as determined by Owner, must be prepared to submit within seven calendar days after Owner’s written request, evidence such as financial data, previous PW\DEN003\050058\D3244305 OCTOBER 2020 INSTRUCTIONS TO BIDDERS 00100 - 1

Each Bid must contain evidence of Bidder’s qualification to do business in the state where the Project is located or covenant to obtain such qualification prior to Contract award. 3.3. Nothing indicated herein will prejudice Owner’s right to seek additional pertinent information as is provided in Article 24 – Evaluation of Bids and Award of Contract. 3.4. Bidders and every Subcontractor performing Work on the Project must have filed with the Construction Contractors Board a public works bond in the amount of 30,000 with a corporate surety authorized to do business in the State of Oregon before starting Work on the Project unless exempt under ORS 279C.836(4), (7), (8), or (9). 3.5. In order to perform public work, Bidder and its Subcontractors, prior to award of Contract or as otherwise required by the jurisdiction, shall hold or obtain such licenses as required by State Statutes, and federal and local Laws and Regulations. 3.6. Bidder is advised to carefully review those portions of the Bid Form requiring representations and certifications. 3.7. Bidder shall not be listed on the Bureau of Labor and Industries list of persons having violated prevailing wage rate laws as required in ORS 701.227. 3.8. Bidder shall not be in violation of any tax laws as required in ORS 305.385. 3.9. Bidder shall have a drug-testing program as required in ORS 279C.505. 3.10. Bidders for public work in Oregon shall be qualified in conformance with ORS Chapter 279C, in the manner designated in the Advertisement for Bids. 4. REGISTRATION REQUIREMENTS 4.1. A person, partnership, corporation, limited liability company or joint venture shall have a current, valid license issued by the Oregon Construction Contractors Board, as required by ORS Chapter 701 with respect to licensing, prior to submitting a Bid to do work as a Contractor or Subcontractor. 4.2. Asbestos is not anticipated to be encountered during the project. 5. EXAMINATION OF BIDDING DOCUMENTS, OTHER RELATED DATA, AND SITE 5.1. It is the responsibility of each Bidder before submitting a Bid to: 5.1.1.1 Examine thoroughly the Bidding Documents and other related data identified in the Bidding Documents. CLEAN WATER SERVICES DURHAM AWWTF WASSTRIP IMPROVEMENTS 5.1.2.1 Visit the Site and become familiar with and satisfy Bidder as to the general, local and Site conditions that may affect cost, progress, or performance of the Work. 5.1.3.1 Become familiar with and satisfy Bidder as to federal, state, and local Laws and Regulations that may affect cost, progress, or performance of the Work. 5.1.4.1 Study and carefully correlate the Bidder’s observations with the Bidding Documents. 5.1.5.1 Carefully study all: 5.1.5.1.Reports of explorations and tests of subsurface conditions at or contiguous to the Site and all drawings of physical conditions relating to existing surface or subsurface structures at the Site (except Underground Facilities) that have been identified in Paragraph 5.03 of the Supplementary Conditions as containing reliable “Technical Data”. 5.1.5.2.Reports and drawings of Hazardous Environmental Conditions, if any, at the Site that have been identified in Paragraph 5.06 of the Supplementary Conditions as containing reliable “Technical Data”. 5.1.6.1 Consider the information known to Bidder; information commonly known to contractors doing business in the locality of the Site; information and observations obtained from visits to the Site; the Bidding Documents; and the Site-related reports and drawings identified in the Bidding Documents, with respect to the effect of such information, observations, and documents on: 5.1.6.1.Cost, progress, and performance of the Work. 5.1.6.2.Means, methods, techniques, sequences, and procedures of construction to be employed by Bidder, including applying any specific means, methods, techniques, sequences, and procedures of construction expressly required by the Bidding Documents. 5.1.6.3.Bidder’s safety precautions and programs. 5.1.7.1 Agree at the time of submitting its Bid that no further examinations, investigations, explorations, tests, studies, or data are necessary for the determination of its Bid for performance of the Work at the price(s) Bid and within the times required, and in accordance with the other terms and conditions of the Bidding Documents.
