FROM THE PRESIDENTAllegations of Fraud UnfoundedThe state-wide wage allocationmeeting was held on Saturday,Jan. 7, 2017, at the BAC LocalUnion Hall in Minneapolis. Duringthe meeting, allegations of fraudwithin the Apprenticeship Fundwere made by Brother JosephVanek. As President / SecretaryTreasurer of the Local Union andSecretary of the ApprenticeshipFund, I knew that these wereMike Cook, President/ serious accusations. I also knewSecretary-Treasurer that arguing at the meetingwithout independent facts in myhand to refute these claims was pointless. Promptly afterthe meeting, the Chairman of the Fund, Mr. Tim Miller,was contacted along with Fund counsel and the Fundauditors, and an investigation was undertaken.The next business day after the meeting, a certified letterwas sent by Fund counsel requesting that Brother Vanekmeet and make a sworn statement regarding the allegedfraud. Brother Vanek received the letter and agreed tomeet with the Fund’s attorney. Brother Vanek gave hisstatement before a court stenographer while he was beingquestioned by Fund counsel. Brother Vanek cited twoinstances of what he believed was fraud. The Board ofTrustees was notified regarding the allegations as wellas the Fund auditors. The Board requested a thoroughinvestigation. After completing the appropriate accountingprocedures in the areas of the alleged fraudulent activities,the Fund auditors shared their results with the Board. TheBoard concluded that there was no indication of fraud andthat there was no misuse of fund assets. The Fund attorneyconcluded that the allegations caused harm to the fund byrequiring professional time and effort investigating mattersthat were entirely insubstantial and untrue.I have worked for the Local Union for more than 20 years.During my tenure, it has been my duty and my privilegeto serve in many different capacities. I currently serve asthe President / Secretary-Treasurer the Local Union andthe Mutual Relief Fund. I have been the Secretary on theApprenticeship Fund for many years. I am the Chairmanof the Minnesota / North Dakota Defined Benefit PensionPlan. Also, I am the Chairman of the Health Plan, theVacation Plan and the Minnesota Ceramic Tile RetirementFund. I have also served as the Chairman during thelast two years for the Chapter BAC #1 and Insulators#49 Supplemental Retirement Fund in Duluth. All told,the BAC Funds that I am entrusted with total almost 500,000,000.00. That’s half a billion dollars! I take my jobseriously. When the Apprenticeship Fund was accused ofallowing fraud to take place while under my leadership,I was personally insulted and so was the entire Boardof Trustees. The board was forced to take action andincurred costs of nearly 10,000.00 to document the lackof truthfulness of these claims. I can only hope that in thefuture if a claim was brought against one of our trust fundsor the union, it would not be undertaken frivolously. I alsobelieve all of the trustees of the Apprenticeship Fund areowed an apology for the unfounded allegations that werelevied.Our Union Constitution provides, in part, that:“No member shall publicly make or publish slanderousstatements concerning any other member as a member orofficer, knowing the statements to be false or in recklessdisregard of the truth.”Members should always keep in mind that they areaccountable for their conduct toward the Union body. We,as trade unionists, need to stand together. If members haveconcerns or complaints, they need to be made respectfully,and with a view toward strengthening and improving ourUnion.MARCH 2017 QUARTERLY UPDATE 3

IMI Supervisor Certification Program Foreman Training Level I. The primary mission of SCP is to develop highly skilled,confident and effective supervisors for the union masonry industry. Each level of certification requires successful completion of 16hours of instruction.Terrazzo Floor at the Training Center is Stunning!It started as a small endeavor. TheWomen Bricklayers and AlliedCraftworkers members wanted toassist with a terrazzo project in theentryway. However the vision grewfrom a 2 x 3 entryway project to a 32 x16 work of art that spreads across twoof the training center classrooms.Thanks to the ingenuity and leveragingof connections, Mike Feyler, terrazzomechanic, was able to providemany of the materials at a heavilydiscounted cost. Mike artfully set the design that JulieBraschayko, bricklayer, created. Kelly Feyler, terrazzofinisher, strategically picked the perfect marble and glasschips for the project. Mike, Kelly and Julie carefully cutand placed the metal divider strips for the design. Next,the mixing and troweling began. Brent Malo, apprenticefinisher, stopped by and gave additionalassistance when the main colors werepoured. After everything was in place,Kelly and Julie spent 3 to 4 full daysgrinding and polishing the marble andglass to bring out the full luster.Total labor donated to the project wasmore than 216 hours.Special thanks to Greg Grazzini,Grazzini Brothers and Co., for theirgenerous donation of materials andequipment as well as delivery and pickup. Donationswere also provided by WTG Grazzini, Advance Terrazzo& Tile, Terrazzo & Marble Supply and Sherwin Williams.Last but not least, Jayson Moore, tile coordinator at thetraining center, played an integral part in assisting andcoordinating this 15,000 project that was created by ourmembers, for our members.Help Wanted at theBAC Training CenterWe are looking for a part-time handyman/maintenance person – a great position for aretired member. HEALTH BENEFITSBricklayers Health Reimbursement Arrangement (HRA)What is an HRA?An HRA stands for “Health Reimbursement Arrangement.” Itis a savings account funded by employer contributions that canbe used for reimbursement of anything the IRS considers aneligible expense under Section 213(d) of the Internal RevenueCode.Can I “cash” out?No. Only IRS Section 213(d) expenses, as explained inPublication 502 are eligible for reimbursement.How long do I have to submit my claims each year?You can submit claims until the later of twelve (12) months fromwhen you received the medical service or March 31 followingthe close of the plan year in which the medical care expense wasincurred.How do I receive reimbursement from my HRA?You will receive a reimbursement check or a direct deposit forthe claim submitted from the funds in your HRA that wereavailable at the time you submitted your claim. Or, you can useyour debit card to pay for your eligible out-of-pocket expenses.Why do I have to submit a claim to receivereimbursement from my account?Under IRS rules, the plan must verify the expense is eligiblefor reimbursement. The plan does this by requesting supportingdocumentation from the member. The plan also uses the claim tohelp track your account balance.What can I submit for supporting documentation?Claim reimbursement requests and debit card swipes mustinclude either an Explanation of Benefits (EOB} from yourinsurance company OR an itemized receipt. MEMBER EVENTS4th Annual Fishing EventBrotherhood Brings Warmth to WinterFebruary 11th at Nichols Lake in Cotton, MN, was the perfectday for the 4th annual fishing event. The relaxing get togetherwas complete with moderate temps, no wind and an overcastsky, which made for good fishing conditions. Members caught afew pan fish and one small northern pike. Vice-President StanPaczynski hosted a traditional lunch of his famous wild rice andchicken soup, sloppy joes and signature Coney dogs. This year’snew attraction was the bonfire to warm up to and a visit froma Great Gray owl, which brought many birdwatchers throughthe area for pictures. IMI CORNERWhat Everybody Ought to Know About IMIThe main goal of IMI is to create morejob opportunities for the members ofBAC Local 1 Minnesota/North Dakota byeducating design professionals, skilledcraftworkers, and project decision makersabout using masonry. Let’s look at fourIMI activities that help us achieve this.lodging, food, and training are free for allBAC members. The International MasonryTraining and Education Foundation(IMTEF) provides training, certificationsand continuing education programs to themembers of the International Union ofBricklayers and Allied Craftworkers.IMI and Training CenterCollaboration with ArchitectsVisit www.IMTEF.org to find out moreabout training programs available to you.Cuningham Group had a brick patternchallenge. Their architects were usingsoftware that didn’t really time-out withmodular dimensioning and created adiamond pattern that was going to requiremany cuts in the field. IMI Director MarkSwanson, working in conjunction withKelley Casey, project leader at CuninghamGroup, coordinated a dry stacking studyat the BAC Training Center to see ifthe pattern could be achieved withfewer masonry cuts or none at all. JohnSlama, Masonry Coordinator and BrickInstructor Darrell Koffler put the secondyear brick apprentices to the task. Theireagerness and problem solving skills gaveCuningham the information they neededto revise their design to make it moreefficient. John Slama and Dave Malone,manager of Training and Education,are now certified to teach this course tomembers. Slama and Malone, along withSwanson, will take this training programto outstate Minnesota in the near future.Wysocki reminded members that theycan receive free training at the NationalTraining Center in Bowie, MD. Airfare,Kelley Casey John Slama and DarrellKofflerIMI Convention SeminarsSwanson exhibited at the 82nd annual AIAMinnesota Convention in November. Morethan 2,000 architects from around thestate attend this event. Swanson deliveredone of the first seminars of the conventiontitled, “Designing with Tile,” which waswell received. This presentation focused onLarge Format Tile and Gauged PorcelainTile (that super thin tile) as well as theA.C.T. certification. Expect to see more onA.C.T. certification in 2017.In January, at the MN School BoardConference, Swanson, in addition toexhibiting an IMI booth, gave a seminarcalled “Tornados and High WindSheltering.” He delivered the seminarwith Dr. Virginia Dahlstrom, theSuperintendent of Wadena, Deer CreekSchools. Dahlstrom was very involved withthe rebuild after the F4 tornado struckthe high school in June 2010. Thankfully,no one was injured, but not all schools arethis lucky. Making school superintendentsaware of the IBC 2015 requirement forstorm shelters in public schools andemergency response centers is essential inkeeping masonry as the building materialsolution for schools.
