The Kerala Factories Rules, 1957Chapter IGOVERNMENT OF KERALALabour and Local Administration DepartmentNOTIFICATIONNo. D Dis. 4373/57/L and L.A.D dated Trivandrum 12th December 1957In exercise of the powers conferred by section 112 of Factories Act, 1948 (Central Act LXIII of1948), the Government of Kerala hereby make the following rules, the same having been previouslypublished as required by section 115 of the said act.THE KERALA FACTORIES RULES, 1957CHAPTER IPRELIMINARY1.Short title, extent and commencement:(1)These rules may be sited as the Kerala Factories Rules, 1957.(2)These rules shall extent to the whole of the State of Kerala.(3)These rules except rules 29 to 33, 81, 88, 91 to 102 and 122 shall come into force at once andrules 29 to 33, 81, 88, 91 to 102 and 122 shall come into force on such days as are specifiedtherein2.Definitions:In these rules unless there is anything repugnant in the subject or context –(a)“Act” means the Factories Act, 1948.(b)“Appendix” means an appendix append to these rules.(c) “Artificial humidification” means the introduction of moisture into the air of a room by anyartificial means whatsoever ; except the unavoidable escape of a steam or water vapour into theatmosphere directly due to a manufacturing process:Provided that the introduction of air directly from outside through moistened mats or screensplaced in opening at times when the temperature of the room is [26.5 0C] or more, shall not bedeemed to be artificial humidification.(d)“Belt” includes any driving strap or rope.(e)“Degrees” (of temperature) means degrees on the [Celsius] scale.(f)“District Magistrate” includes such other official as may be appointed by the State Governmentin that behalf.(g)“Fume” includes gas or vapor.(h)“Health officer” means the municipal health officer in a municipality or corporation, theDistrict Health Officer concerned in any area within the jurisdiction of a district board orPanchayath or such other officer as may be appointed by the State Government for any area in thatbehalf irrespective of whether such area is within the limits of a municipality or the jurisdiction ofa district board or Panchayath.(i)“Hygrometer” means an accurate wet and dry bulb hygrometer conforming to the prescribedconditions as regards constructions and maintenance.(j)[omitted](by GO(Rt) 1786/79 L&H dt.17-12-1979).(k)“Maintained” means maintained in an efficient state, in efficient working order and in goodrepair.Department of Factories & Boilers, Kerala1

The Kerala Factories Rules, 1957Chapter I(l)“Manager” means the person responsible to the occupier for the working of the factory for thepurposes of the Act.(m)“Family” means the wife, son, daughter, father, mother, brother or sister of the owner of any placewherein a manufacturing process is carried on and who lives with or is dependent, on such owner.(n)“Local authority” means the commissioner in the case of an area within the limits of aMunicipality or Corporation, the executive officer in the case of an area within the Jurisdiction ofa Panchayath and the president of a District Board in the case of any other area.(o)"Public Health authority” means the Local Health Officer having jurisdiction over the area.(p)“Competent authority” means the Chief Inspector or an authority notified by the StateGovernment from time to time for the purpose of Registration and grant of licence, renewal,amendment, transfer and issue of duplicate licence to factories.Rule under Section 2 (ca)2A. Competent Person(1) The Chief Inspector may recognize any person as a ‘competent person’ within such area and forsuch period as may be specified for the purpose of carrying out tests, examinations, inspections andcertification for such buildings, dangerous machinery, hoists and lifts, lifting machines and liftingtackles, pressure plant, confined space, ventilation system and such other process or plant andequipment as stipulated in the Act and the Rules made thereunder, located in a factory, if such aperson possesses the qualifications, experience and other requirements as set out in the scheduleannexed to this Rule:Provided that the Chief Inspector may relax the requirements of qualifications in respect of a‘competent person’ if such a person is exceptionally experienced and knowledgeable, but not therequirements in respects of the facilities at his command:Provided further that the ‘Competent person’ recognized under this provision shall not be above theage of 62 and shall be physically fit for the purpose of carrying out the tests, examination andinspection.(2) The Chief Inspector may recognize an Institution of repute having persons possessingqualifications and experience as set out in the schedule annexed to sub rule(1) for the purpose ofcarrying out tests, examinations, inspections and certification of buildings, dangerous machinery,hoists and lifts, lifting machines and lifting tackles, pressure plant, confined space, ventilation systemand such other process or plant and equipment as stipulated in the Act and the Rules made thereunder, as a competent persons within such area and for such period as may be specified.(3) The Chief Inspector on receipt of an application in the prescribed form from a person or aninstitution intending to be recognized as a ‘competent person’ for the purposes of this Act and theRules made thereunder shall register such application and within a period of sixty days of the date ofreceipt of application, either after having satisfied himself as regards competence and facilitiesavailable at the disposal of the applicant recognise the applicant as a ‘competent person’ and issue aDepartment of Factories & Boilers, Kerala2
