This stage of the project entails an updateto the feasibility study to evaluate the physical site and market support for the facility; the development of apreferred site Master Plan to guide capital investment in the Park in a manner consistent with targeted markets,market demand and site attributes; and the development of a Generic Environmental Impact Study (GEIS) toevaluate and mitigate potential impacts and establish benchmarks and criteria for future development. Theintent is to have sufficient information in the GEIS to facilitate an application for a Shovel-Ready designation inthe future.The site consists of approximately 240 acres. The Master Plan for the site will identify proposed layout ofinfrastructure and support services, identify a subdivision plan and set forth land use and development principlesfor the property. The project will also identify an implementation strategy to guide and attract future developmentof the site.After conducting a Coordinated Review and receiving input and comments from Interested and Involved Agencies,the ILDC has issued a Positive Declaration for the project and determining that a GEIS will be prepared to evaluatepotential impacts and mitigations. Enclosed, please find attached the Positive Declaration and a Draft ScopingDocument that sets forth what will be evaluated in the GEIS. A Public Scoping Meeting will be held on May 18,2021 at 7 pm. The Buffalo and ErieCounty ILDC, as the approval/funding agency, is acting as Lead Agency for SEQR purposes.SEQR STATUS:Type I ActionDESCRIPTION OF ACTION:The proposed project is the adoption and implementation of a Master Plan for the Erie CountyAgribusiness Park that includes installation and construction of utilities and infrastructure in support ofthe future industrial and commercial development of the site.LOCATION:The project is located on the north side of Eden Evans Center Road, east of Delamater Road in the Townof Evans, Erie County, New York.REASONS SUPPORTING THIS DETERMINATION:Impact on Land and Geological Resources:1. The project will result in the physical alteration of much of the site.2. The project could involve construction over an extended period of time.3. The project will impact the topographic conditions of the site.

Impact on Surface Water & Groundwater Resources:1. The project may impact protected and non-protected bodies of water.2. The project may involve extensive paving and buildings that will result in large quantities ofstormwater.3. The Project will impact the existing drainage patterns.Impact on Air Quality and Climate/Climate Change1. The proposed project will increase the land committed to commercial/industrial use; with anunknown mix of uses/occupants.2. Dust from construction activities may impact adjoining areas.Impact on Terrestrial and Ecological Resources1. Potential minor loss of habitat and plant communities from proposed Project may impact residentand migratory birds and other wildlife utilizing the area.2. The proposed Project may impact threatened or endangered species or any species of specialconcern.Impact on Land Use & Zoning, Community Plans, Open Space and Recreation, and Agriculture1. Potential incompatibility of the Project with local plans (Town’s Comprehensive Plan/other plans[State, County and Regional Plans]) and Town zoning.2. The proposed Project will cause a change in the density of land use and potential industrial/manufacturing uses on this property, and this level of development will need to be shown to becompatible with the surrounding rural area.Impact on Aesthetic Resources:1. The proposed Project represents a land use that is different from current surrounding landuses (rural, residential, undeveloped areas, but also previous airport use).2. The development of uses with the Agribusiness Park site could be inconsistent with thepredominant architectural scale and character of the area.3. Installation of site lighting fixtures that could change dark sky conditions.Impacts on Historic and Archaeological Resources1. The Project may impact historic and cultural resources in the area.Impact on Transportation:1. The significance, likelihood and degree of impacts to this resource cannot be fully evaluateduntil the final mix of uses/occupants is presented.2. Potential connection to existing rail line to the west of the project site via rail spur, andadditional rail traffic/coordination related to access to site.

Noise, Odor and Light Impacts1. Temporary impacts during construction may produce noise and dust exceeding the localambient levels.2. The significance, likelihood and degree of noise, odor, light impacts cannot be fullyevaluated until the final mix of uses/occupants is presented.Impacts on Public Health and Safety1. The significance, likelihood and degree of impact to the public health and safety frommaterials and chemicals that may be stored or handled at the Agribusiness Park site cannotbe fully evaluated as the final mix of uses/occupants is unknown at this time.Impact on Community Character1. The proposed Project may potentially increase usage of community facilities.2. The proposed Project may create a demand for additional community services (police, fire,etc.).Impact on Public Utilities and Infrastructure:1. DRAFT SCOPING DOCUMENTDRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENTPROPOSED ERIE COUNTY AGRIBUSINESS PARK PROJECT1.0INTRODUCTIONThe Buffalo and Erie County Industrial Land Development Corporation (ILDC) is theLead Agency for the State Environmental Quality Review Act (SEQR) review of theProposed Action, which is the adoption and implementation of a Master Plan for the ErieCounty Agribusiness Park that includes installation and construction of utilities andinfrastructure in support of the future industrial and commercial development of the site(the “Project” or Master Plan). This Draft Scoping Document outlines the issues to bestudied and analyzed in a Draft Generic Environmental Impact Statement (DGEIS)pursuant to 6 NYCRR Part 617, SEQR. The purpose of the DGEIS is to evaluate thepotential impacts of a Master Plan targeting business/industrial development at theproposed Erie County Agribusiness Park site, which is located on Eden Evans CenterRoad in the Town of Evans and sponsored by the ILDC.This Draft Scoping Document has been prepared to provide a general description of theproposed action and an outline of the SEQR process, and to identify relevant potentialenvironmental impacts associated with the proposed action, which will be addressed inthe DGEIS. The intent of the Draft Scoping Document is to provide interested andinvolved agencies and the public with information about the proposed Project, and togenerate public comments that will help ILDC identify important issues and concerns thatneed to be addressed in the GEIS process.1.1Site LocationThe Project site is located in the Town of Evans, on the north side of Eden EvansCenter Road, east of Delamater Road and the parallel running railroad tracks andwest of Southwestern Boulevard (Route 20) and the New York State ThruwayInterchange (Interstate-90) at Exit 57A “Eden – Angola” (see Figure 1-1).1.2Proposed Action and Classification of the ActionThe Project will involve the Master Plan approval, and construction andoperation of necessary infrastructure in support of the development of anAgribusiness Park at the Project site. Subsequent to the successful completion ofthe DGEIS, the ILDC proposes to apply for Shovel Ready Certification for theProject Site. Shovel Ready Certification gives official recognition to sites thathave completed intensive state and local government review necessary toaccelerate future investment and development and are prepared to offerbusinesses the opportunity to break ground on a new facility in a greatlyexpedited process.The ILDC has classified the proposed action as a Type 1 action under SEQRbased on a determination that it will ultimately involve the physical alteration of1

This threshold for a Type 1 action is set forth at 6NYCRR Part 617.4(b). The ILDC is in the process of completing a coordinatedenvironmental review of the proposed action. SEQR requires a Lead Agency toconduct a coordinated environmental review of all Type 1 actions.2

DRAFT SCOPING DOCUMENTDRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENTPROPOSED ERIE COUNTY AGRIBUSINESS PARK PROJECT1.3Description of the SEQR Process1.3.1GeneralAll discretionary decisions of a state, regional, or local agency toapprove, fund, or directly undertake an action that may affect theenvironment are subject to review under SEQR. SEQR, as implementedby 6 NYCRR Part 617, requires the consideration of environmentalfactors in the early stages of the planning, review, and decision-makingprocesses of state, regional, and local agencies. The intent of SEQR is toensure that a balance of social, economic, and environmental factors isincorporated into the planning and decision-making processes.1.3.2Determination of SignificanceAs part of the process, the Erie County ILDC completed anEnvironmental Assessment Form (EAF) Part 1. The EAF providedinformation about the proposed Project and identified agencies that havepermitting and approval jurisdiction over the proposed Project. The EAFprovided basic information as it was the intent of the ILDC to have aGEIS completed on this project.It is up to the Involved Agencies to select a Lead Agency that will beprimarily responsible for approving a proposed action, determiningwhether an Environmental Impact Statement (EIS) is required, andpreparing and filing the EIS, as necessary. The ILDC requested LeadAgency status to commence the SEQR process for this action. The ILDCis requesting to be the Lead Agency as it is the site owner and thefunding agency for this Project. Due to the nature of the Project(Feasibility Study update, development of a Master Plan for anAgribusiness Park and potential NYS Shovel Ready Designation), theILDC is the only funding/approval agency. It is the ILDC’s intent toissue a Positive Declaration and have a GEIS developed.Based on the EAF Part 1 and previous information generated on the site,the ILDC had prepared Part 2 of the EAF in order to identify the range ofpotential impacts, their scale and whether impacts so identified can bemitigated or reduced. Subsequently, the ILDC determined that theproposed action and the future development of the subject property couldhave a significant adverse impact on the environment. Based upon itsDetermination of Significance, the ILDC (after assuming Lead Agency)issued a Positive Declaration on April 28, 2021, requiring the preparationof an EIS.4

DRAFT SCOPING DOCUMENTDRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENTPROPOSED ERIE COUNTY AGRIBUSINESS PARK PROJECTBecause the proposed action involves the preparation andimplementation of a Master Plan to guide potential development of thesubject property for agricultural businesses and related lightmanufacturing, and because no site-specific development project hasbeen determined, a generic assessment will be undertaken and thepreparation of a GEIS is required. A copy of the Positive Declaration(the resolution and Parts 1, 2 and 3 of the Final EAF) is included inAppendix A.1.3.3ScopingFollowing the Determination of Significance, the next step in the SEQRprocess is Scoping, which is no longer optional. The ILDC is committedto conducting public scoping for this GEIS in order to identify andaddress public issues and concerns. The purpose of this ScopingDocument is to identify the important environmental impacts that are tobe considered in the DGEIS. The DGEIS is a broader, more generalenvironmental assessment than a site or project specific EIS, thatdiscusses the logic and rationale for potential site development. A virtualpublic scoping session will be held to gather public input on specificareas for study in the DGEIS. Substantive comments received during thepublic scoping session will be incorporated in the final written scope.1.3.4Draft Generic Environmental Impact StatementOnce scoping is complete, the DGEIS will be prepared. The DGEISprovides a detailed description of the Proposed Action, identifies thevarious permits and approvals required, identifies the relevant positiveand adverse impacts of the proposed action, discusses measures tomitigate or lessen potentially adverse impacts, and evaluates reasonablealternatives to the proposed action. A preliminary outline for the DGEISis included in Appendix B.1.3.5Public Comment PeriodAfter the ILDC, as Lead Agency, has reviewed the DGEIS anddetermined it is complete, the DGEIS is released for public review andcomment. After a complete document has been accepted, the length ofthe public review and comment period will be a minimum of 30 days.The ILDC will establish public review time frames meeting the SEQRrequirements and schedule a public hearing.5

DRAFT SCOPING DOCUMENTDRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENTPROPOSED ERIE COUNTY AGRIBUSINESS PARK PROJECT1.3.6Final Environmental Impact StatementUpon completion of the public review period for the DGEIS, ILDC willprepare a Final Generic Environmental Impact Statement (FGEIS) thatresponds to public and agency comments. The FGEIS includes theDGEIS, the substantive comments received, responses to thesecomments, revisions to the DGEIS, and reasons for the revisions.1.3.7Findings StatementThe SEQR process concludes with the preparation of the FindingsStatement by the Lead Agency. The Findings Statement positivelydemonstrates that the proposed action minimizes or avoids potentialadverse environmental effects to the maximum extent practicable, andthat the proposed action incorporates practicable mitigation measuresthat were identified through the SEQR process.These demonstrations must be based on facts and conclusions that arederived from the GEIS, public, and agency comments, any hearingrecords, and the approved FGEIS. The Findings Statement identifies theconsiderations that have been weighed and the Lead Agency's rationalefor its approval or disapproval of the proposed action.1.4Purpose and ScopeThe purpose of this Scoping Document is to identify the relevant environmentalissues to be addressed in the GEIS. The issues discussed herein were identifiedby the ILDC based on the EAF Parts 1 and 2, the Positive Declaration, theoriginal Feasibility Study, the requirements of NYS Shovel Ready Designation,comments from Involved Agencies and the public comments.Pursuant to 6 NYCRR Part 617, the SEQR Lead Agency, Involved Agencies, andInterested Parties are listed in Section 2.3. Potential significant environmentalimpacts and mitigation measures to be considered in the DGEIS, as well as theprobable sources of information are provided in Section 3.0. Alternatives to theproposed action that will be considered in the DGEIS are identified in Section 4.0and a description of information that will be appended to the DGEIS is providedin Section 5.0.6

DRAFT SCOPING DOCUMENTDRAFT GENERIC ENVIRONMENTAL IMPACT STATEMENTPROPOSED ERIE COUNTY AGRIBUSINESS PARK PROJECT2.0ENVIRONMENTAL REVIEW PROCESS2.1Purpose of SEQRSEQR provides a process for the consideration of potential environmentalimpacts in the early planning stages of actions that are directly undertaken,funded, or approved by local, regional, or state agencies. By listening to publicand agency input, and conducting a thorough environmental review into thedevelopment of this Erie County Agribusiness Park Master Plan and its relatedcomponent parts, impacts can be identified early in the process, and projects canbe modified, as needed, to avoid or minimize adverse impacts on theenvironment.A critical aspect of SEQR is its public participation component. There areopportunities for public participation incorporated into the EIS process. Thisincludes the SEQR Lead Agency option to hold public scoping of the DGEIS,conducting a SEQR public hearing, the mandated 30-day public comment periodon the DGEIS and the review period after completion of the FGEIS beforeFindings are made. These opportunities allow other agencies and the public toprovide input into the environmental review process.2.2SEQR ProcessThe overall SEQR Process is described in Section 1.3. The ILDC has determinedthat this Project will require preparation of an GEIS, and at this time the ILDC isat the Scoping stage.2.3Scoping the DGEISScoping is the process that identifies the important environmental issues of aProject to be addressed in the GEIS process. The objectives of scoping are to:1.2.3.4.5.Identify significant environmental issues.Eliminate insignificant or irrelevant issues.Identify the limits of the Project's potential impacts.Identify the range of reasonable alternatives to be addressed.Identify potential mitigation measures.It will be the responsibility of the ILDC, as SEQR Lead Agency, to organize andconduct Scoping. The Involved Agencies have an obligation to give their agencyperspective and to participate in the scoping process. Involved Agencies arethose that have the authority to fund, approve, or directly undertake an actionrelated to the Project (6 NYCRR Part 617 Section 2). The following are the7
