PRESIDENT’S ANNUAL REPORT 20172. PRESIDENT’S MESSAGELocal Government in WA is entering a time of financialchallenge. The gloomy fiscal climate is furtherexacerbated by the State Government’s budget crisisand the meagre share of GST.However, the sector is also illuminated by a more cordialworking relationship with the new State Government.The current cabinet has indicated a willingness to workwith the sector, agreeing on several election platformsset out by the Association.This new era of positive progress is certainly welcomedby the Association. It is in stark contrast to the way thesector was treated by the previous State Governmentthat made constant demands with scant discussion andunwarranted criticism.WALGA has a role to achieve the best possible outcomefor the Local Government sector and is well-advanced tothis end. I will detail the positioning and planningunderway by the Association later in this review of thepast year.My focus is to continue to ensure that WALGA is asopen and relevant for its Member Local Governmentsjust as Councils should aspire to be for theircommunities. At the core of my thinking is that WALGAexists to support and benefit its Members with a serviceorientated attitude across the organisation.The Association has launched the Members Firstprogram. The program reflects WALGA’s freshperspective on how to better understand and respond tothe needs of Local Government by focusing onimproving Member engagement and service.It’s about reconnecting and listening to feedback fromMembers and ensuring that the Members are consultedon all matters related to their membership and LocalGovernment business.Finally I would finally like to recognise the hard work ofRicky Burges, her Executive Team and all WALGA staffas well as the valuable contributions and support ofState Council and all those who have helped to bringabout the sector’s achievements during the year.Cr Lynne CraigiePresident2.1 Overview of key outcomes for2016/2017WALGA is committed to providing representation andservices that deliver value to Member LocalGovernments.It delivers these benefits by: Providing Strong Representation Providing Effective Leadership Building a Positive Profile Enhancing the Capacity of the SectorIn support of these objectives, significant achievementsby WALGA for its Members during the past year are asfollows:Strong RepresentationState Election OutcomeWALGA developed the State election campaign positionon behalf of the sector with short term and long termobjectives. The key strategic issues being considered forthe campaign focus are Securing a PartnershipAgreement and Consultation Protocol with the StateGovernment; Opposition to the Introduction of RateCapping; Commitment to Poll Provisions to give thecommunity a vote on any amalgamation; Securing aState Local Road Funding Agreement that restores the27% allocation from motor vehicle licence fees;Restoration of the Country Local Government Fund;Restoration of the Community Sporting and RecreationalFacilities Funding to 20m per annum; Restructuring ofLibrary Arrangements; Major Review of the LocalGovernment Act to reduce unnecessary and outdatedcompliance requirements; Introduction of a ContainerDeposit Scheme; and the Deregulation of LocalGovernment Fees and Charges.The current State Government has agreed to theplatforms, pending a cost-benefit analysis.Vehicle Licence Fee ConcessionsAdvocacy continues with the new Government to havethe decision to apply licence fees (and stamp duty) toLocal Government vehicles from 1 July 2017 bereversed. A letter detailing why this decision of theprevious Government should be reversed was sent tothe Minister for Transport and a further letter was sent tothe Premier. The Hon Rick Mazza introduced adisallowance motion in the Legislative Council in relationto the regulation changes and all Legislative Councilmembers were contacted, urging them to support thedisallowance motion and outlining the reasons for this.WA Local Government AssociationAnnual General Meeting 20179

PRESIDENT’S ANNUAL REPORT 2017Natural Disaster Recovery and Relief ArrangementsDiscussions between the Federal Government, theStates and ALGA concerning a potential new “up-front”payment arrangement to assist States and LocalGovernments responding to natural disasters occurredduring 2016 with the view to piloting some new measuresprior to 2018. Widespread flooding during February,which affected the majority of Local Governments, wasthe catalyst to trial a key element of the potential newarrangements, enabling Local Governments to recoverthe costs associated with using their own labour andequipment to undertake disaster reconstruction work.Although details of the exemption required from theFederal Government took a very long time to achieve,about 10 Local Governments are using their ownresources for some reconstruction work and in so doingtrialing the process. Unfortunately the agreement toprovide an initial up-front payment to enable Councils toproceed with reconstruction work was subsequentlywithdrawn. WALGA will continue to seek ways that willenable reconstruction to proceed quickly without theconstraint of inadequate cash flow.Local Government Industry Reference CommitteeAt a national level, WALGA has been successful in itsnomination for membership of the Local GovernmentIndustry Reference Committee which provides a conduitfor industry feedback to government on the review,development and implementation of the LocalGovernment Training Package. This places WALGA atthe center of Local Government Training Packagedevelopment for the next 3-4 year term of theCommittee.Local Government Act ReviewOne of the key Policy Priorities listed in WALGA’s StateElection Campaign document was for a commitment tocomprehensively review the key areas of the LocalGovernment Act. The new State Government hasagreed to this request and the Minister for LocalGovernment has advised of a two stage process toreview the Act and Regulations.The first stage will focus on modernising LocalGovernment, with the policy work and consultation to becompleted in 2017 with a Bill in 2018. Key topics in thisphase will be simplifying the disclosure of gifts,amendments to Regional Subsidiary legislation andregulation, increasing elector participation, electronicdisclosure (making information more readily available),and some red tape reduction provisions.The focus for the second phase is delivering for thecommunity, with the policy work and consultation to becompleted in 2018 with a Bill in 2019. Key themes forthis phase will be improving behaviour and relationships,increasing community participation, enabling ement and reducing red tape.WALGA will carry out a thorough consultation processwith the sector on the key issues for the Act reviewprocesses.Regional Subsidiary ModelThe Association welcomed the passing of legislation bythe State Government to enable the regional subsidiarymodel for Local Government cooperation in late 2016.The Association has long campaigned for the legislativechange based on the South Australian Subsidiary Modelwhereby a Regional Group forms a legal entity for thedelivery of services on a regional basis without the needto become a formal Regional Council. This suitsCouncils that prefer a representative structure to carryout a shared service delivery model.Unfortunately the regulations that have been establishedfollowing the Act amendment have applied a number ofsignificant restrictions on Regional Subsidiaries that willrestrict many groups of Local Governments from wantingto establish a Subsidiary. The primary governancecontrol for a Subsidiary should be the Charter itestablishes and not the Act or Regulations.The most significant restrictions are as follows; Restriction on Land Transactions – Currently aSubsidiary cannot acquire or dispose of land, whichmeans it cannot lease, purchase or sell property. Restriction on Borrowing – A subsidiary cannot borrowin its own right, it can only borrow from one or more ofthe recipients. Restriction on Trading Undertakings – A subsidiaryneeds to be able to undertake commercial activity. It isacknowledged that a Subsidiary is not set up to carryout major commercial enterprises; this would be moreappropriate for a Council Controlled Organisations(Local Government Enterprises).WALGA has advocated to the new Local GovernmentMinister seeking amendments to the Act andRegulations. The Minister has advised that amendmentswill be considered in a review of the Act to take place in2017/18.Effective itiesWALGA continues to works with the State Governmentto implement the Regional Reform Program forAboriginal Communities. It is a commitment totransformational change and is part of the broaderCommonwealth reform program to reform servicedelivery and human services. 'Resilient Families:Strong Communities' Road Map released in July 2016,set out 10 actions for the State Government to reformthe delivery of housing, education, employment andhuman services.
