-1COLLECTIVE AGREEMENT made this 14th day of December, 2018BETWEENALBERTA HEALTH SERVICES(hereinafter referred to as the "Employer")OF THE FIRST PARTANDALBERTA UNION OF PROVINCIAL EMPLOYEES(hereinafter referred to as the "Union")OF THE SECOND PARTPREAMBLEWHEREAS the Parties are mutually desirous of entering into a Collective Agreement settingforth rates of pay, hours of work, and other terms and conditions of employment.NOW THEREFORE THIS COLLECTIVE AGREEMENT WITNESSETH:

-2-ARTICLE 1TERM OF COLLECTIVE AGREEMENT1.01Except where otherwise stated in this Collective Agreement, this CollectiveAgreement, including appendices hereto unless altered by mutual consent of bothParties hereto, shall be in force and effect from and after the date upon which theUnion and the Employer exchange notice of ratification by their principals of theterms of this Collective Agreement, up to and including March 31, 2020 2022 andfrom year-to-year thereafter unless amended or terminated. Notification of desireto amend or terminate may be given, in writing, by either Party to the other Partynot less than sixty (60) days nor more than one hundred and twenty (120) daysprior to the expiration of its desire to amend this Collective Agreement.1.02Where notice is served by either Party to commence collective bargaining, thisCollective Agreement shall continue in full force and effect until a new CollectiveAgreement has been executed.1.03In the event that any law passed by the Government of Alberta, or Canada rendersnull and void any provisions of this Collective Agreement, the remainingprovisions shall remain in effect for the term of the Collective Agreement.1.04An Employee whose employment has terminated prior to the ratification of thisCollective Agreement is eligible to receive retroactively any increase in wages,which the Employee would have received but for the termination of employment,upon submission of a written application to the Employer during the periodbetween the expiry date of the preceding Collective Agreement and sixty (60)calendar days after the ratification of this Collective Agreement.1.05Any notice required hereunder to be given shall be deemed to have beensufficiently served if personally delivered or mailed in a prepaid registeredenvelope, or by receipted courier, addressed in the case of the Employer to:President and Chief Executive OfficerAlberta Health ServicesSeventh Street Plaza1400 North Tower, 10030 - 107 Street NWEDMONTON AB T5J 3E4and in the case of the Union to:The PresidentAlberta Union of Provincial Employees10451 - 170 Street NWEDMONTON AB T5P 4S7PROPOSAL: AUPE reserves the right to introduce proposals during bargaining.RattrayArticle per PageJanuary 2020

-3ARTICLE 2DEFINITIONS2.01"Code" means the Labour Relations Code, as amended from time-to-time.2.02"Arbitration" shall take meaning from the section of the Code dealing with theresolution of a difference.2.03"Union" shall mean the Alberta Union of Provincial Employees (AUPE). In theevent of a change of name of the aforementioned Union, the subsequent nameshall be recognized.2.04"Basic Rate of Pay" shall mean the incremental step in the Salary Scheduleapplicable to an Employee in accordance with the terms of this CollectiveAgreement, exclusive of all premium payments.2.05"Continuous Service" shall mean the period of employment commencing on thelatest date of employment within the bargaining unit that is not interrupted bytermination or dismissal.2.06"Employee" shall mean a person covered by this Collective Agreement andemployed by the Employer. At the time of hire the employment status of eachEmployee shall be determined in accordance with the following:(a)(b)Rattray"Regular Employee" is one who works on a full-time or part-time basis onregularly scheduled shifts of a continuing nature:(i)"Full-time Employee" is one who is regularly scheduled to workthe full specified hours in Article 12A: Hours of Work (for facilityemployees) and Article 12B: Hours of Work (for community andmental health clinic employees) of this Collective Agreement;(ii)"Part-time Employee" is one who is regularly scheduled for lessthan the normal hours specified in Article 12A: Hours of Work (forfacility employees) and Article 12B: Hours of Work (forcommunity and mental health clinic employees) of this CollectiveAgreement."Casual Employee" is one who:(i)is regularly scheduled for a period of three (3) months or less for aspecific job; or(ii)relieves for absences the duration of which is three (3) months orless; or(iii)works on a call-in basis and is not regularly scheduled.Article per PageJanuary 2020

-4(c)"Temporary Employee" is one who is hired on a temporary basis for afull-time or part-time position:(i)for a specific job of more than three (3) months but less thantwelve (12) months. A request by the Employer to extend the timelimit shall not be unreasonably denied; or(ii)of finite duration of between twelve (12) and twenty-four (24)months, where the funding is external to the Employer, with theUnion’s consent, such consent not to be unreasonably withheld; or(iii)to replace a Full-time or Part-time Employee who is on approvedleave of absence for a period in excess of three (3) months; or(iv)to replace a Full-time or Part-time Employee who is on leave dueto illness or injury where the Employee has indicated that theduration of such leave will be in excess of three (3) months.Alteration of employment status thereafter will be regulated by the termsof this Collective Agreement.AMD2.072.07Rattray(a) “Temporary position” is a full-time or part-time position:(i)that has an anticipated start and end date.(ii)is for a specific job of more than three (3) months but lessthan six (6) months; or(iii)is to replace a Full-time or Part-time Employee who is onleave due to illness or injury, or who is on approved leaveof absence for a period in excess of three (3) months;(iv)A request by the Employer to extend the time limit under(ii) above, shall not be unreasonably denied;(b)The Employer ending a temporary position will not be deemed to be aviolation of the Collective Agreement.(c)The Employer shall provide an Employee in a temporary position at leastseven (7) calendar days written notice of ending of the temporaryposition.(d)A Full-time or Part-time Employee occupying a temporary position shallretain their seniority, will have entitlements in accordance with theposition in which they are working and shall be returned to theEmployee’s regular position and former status when they are no longerrequired in the temporary position."Employer" shall mean and include such officers as may from time-to-time beappointed, or designated, to carry out administrative duties in respect of theoperations and management of the business.Article per PageJanuary 2020

-52.08The provisions of this Collective Agreement are intended to be gender neutral andgender inclusive. Similarly, the singular shall include the plural and vice-versa, asapplicable.2.09"Site" shall mean the building(s), as designated by the Employer, at or out ofwhich an Employee works.2.10"Registration" shall take meaning from the Health Professions Act R.S.A. 2000, c.H-7 as amended. Registration is not membership in the Union.2.11"Shift" shall mean a daily tour of duty of not less than three (3) consecutive hours,excluding overtime hours.2.12"Shift Cycle" means the period of time when the shift schedule repeats itself. Inthose instances where the schedule does not repeat itself, the term "Shift Cycle"shall be understood to mean a period of time not exceeding twelve (12) weeks.2.13For the purpose of applying the terms of this Collective Agreement, time workedshall be deemed to have been worked on the day on which the majority of hoursof the shift fall.2.14"Union Representative" means a representative from the Union authorized by theUnion to act on behalf of an Employee.2.15"Local" means a Local of AUPE.2.16"Bargaining Unit" shall mean the unit of Employees as described on the LabourRelations Board Certificate.2.17"Ambulance" shall include any vehicle or conveyance used for ambulance duty.RattrayArticle per PageJanuary 2020

-6-ARTICLE 3RECOGNITION3.01The Employer acknowledges that when duly certified as the bargaining agent forEmployees described in the certificate issued by the Alberta Labour RelationsBoard, the Union has exclusive authority to bargain collectively on behalf of theEmployees in the unit for which it is certified and to bind them by a CollectiveAgreement.3.02No Employee shall be required or permitted to make any written or verbalagreement which may be in conflict with this Collective Agreement.3.03(a)For the purposes of this Collective Agreement, the Union will berepresented by its properly appointed officers. The Union shall provide theEmployer with a current list of the officers' names.(b)The Employer shall grant Union Representatives access to its premises forUnion business subject to the approval of Human Resources or theirdesignate.3.04Union membership meetings may be held on Employer premises subject to theapproval of the Employer.3.05The Union will exercise its rights in a manner which is professional, fair andreasonable in the circumstances, and in accordance with the CollectiveAgreement.RattrayArticle per PageJanuary 2020

-7-ARTICLE 4UNION MEMBERSHIP AND DUES DEDUCTION4.01An Employee shall have the right to wear or display the recognized insignia of theUnion, however, no such insignia larger than a lapel pin shall be worn while onduty and no lapel pin shall be worn while in nurseries. No Union insignia shall bedisplayed on the Employer's equipment or sites.4.02(a)All Employees have the right:(i)to be members of the Union and to participate in its lawfulactivities;(ii)to bargain collectively with the Employer through the Union.4.03The Employer will, as a condition of employment, deduct from the earnings ofeach Employee covered by this Collective Agreement an amount equal to the duesas determined by the Union. The Union acknowledges that the deduction ofamounts equal to the dues does not constitute membership in the Union, and thatmembership shall continue to be voluntary.4.04Consistent with the payroll system of the Employer, the Union will advise theEmployer of the amount of its membership dues. An amount equal to saidmembership dues will be deducted from each Employee at the prescribed rate andremitted to the Union not later than the fifteenth (15th) of the month following.The remittance shall be accompanied by a list specifying the following:Rattray(a)the Employee's name;(b)mailing address;(c)classification;(d)site(s);(e)status (Regular Full-time, Regular Part-time, Temporary, Casual);(f)hourly rate of pay;(g)the amount of deduction for each Employee;(h)the Employee's gross pay;(i)long-term absence status (where applicable);(j)phone number on record;Article per PageJanuary 2020
