By a chemical dependency treatment center that meets the provider participationrequirements established in Section 2 of this administrative regulation.(2)(a) Direct[Face-to-face] contact between a practitioner and a recipient shall be required foreach service except for:1. Collateral outpatient therapy for a recipient under the age of twenty-one (21) years if thecollateral outpatient therapy is in the recipient’s plan of care;2. A family outpatient therapy service in which the corresponding current proceduralterminology code establishes that the recipient is not present; or93. A psychological testing service comprised of interpreting or explaining results of an10examination or data to family members or others in which the corresponding current procedural11terminology code establishes that the recipient is not present.12131415(b) A service that does not meet the requirement in paragraph (a) of this subsection shall not becovered.(3) A billable unit of service shall be actual time spent delivering a service in an[a face-to-face]encounter.16(4) A service shall be:17(a) Stated in the recipient’s plan of care; and18(b) Provided in accordance with the recipient’s plan of care.19(5)(a) A chemical dependency treatment center shall establish a plan of care for each recipient20receiving services from a chemical dependency treatment center.21(b) A plan of care shall meet the treatment plan requirements established in 902 KAR 20:160.22Section 2. Provider Participation. (1)(a) To be eligible to provide services under this23administrative regulation, a chemical dependency treatment center shall:2

Except as established in subsection (2) of this section, be currently participating in theKentucky Medicaid Program in accordance with 907 KAR 1:671;3. Be licensed as a chemical dependency treatment center to provide outpatient and inpatientbehavioral health services in accordance with 902 KAR 20:160; and74. Have:8a. For each service it provides, the capacity to provide the full range of the service as established91011in this administrative regulation;b. Documented experience in serving individuals with mental health, substance use, or cooccurring[behavioral health] disorders;12c. The administrative capacity to ensure quality of services;13d. A financial management system that provides documentation of services and costs; and14e. The capacity to document and maintain individual health records.15(b) The documentation referenced in paragraph (a)4.b. of this subsection shall be subject to16audit by:171. The department or its designee;182. The Cabinet for Health and Family Services, Office of Inspector General;193. A managed care organization, if the chemical dependency treatment center is enrolled in its20network;214. The Centers for Medicare and Medicaid Services;225. The Kentucky Office of the Auditor of Public Accounts; or236. The United States Department of Health and Human Services, Office of the Inspector3

DocuSign Envelope ID: DF637822-C428-447D-8D1A-338FF76AB5671General.2(2) In accordance with 907 KAR 17:015, Section 3(3), a chemical dependency treatment center3that[which] provides a service to an enrollee shall not be required to be currently participating in4the fee-for-service Medicaid Program.5(3) A chemical dependency treatment center shall:6(a) Agree to provide services in compliance with federal and state laws regardless of age, sex,789race, creed, religion, national origin, handicap, or disability; and(b) Comply with the Americans with Disabilities Act (42 U.S.C. 12101 et seq.) and anyamendments to the act.10(4)(a) Except as provided by paragraph (b) of this subsection, a chemical dependency treatment11center shall possess accreditation, within one (1) year of initial enrollment, by one (1) of the12following:131. The Joint Commission;142. The Commission on Accreditation of Rehabilitation Facilities;153. The Council on Accreditation; or164. A nationally recognized accreditation organization.17(b) The department shall grant a one (1) time extension to a chemical dependency treatment18center that requests a one (1) time extension to complete the accreditation process, if the request19is submitted at least ninety (90) days prior to expiration of provider enrollment.20Section 3. Covered Services.21(1) Reimbursement shall not be available for services performed within a chemical dependency2223treatment program by a:(a) Licensed behavior analyst;4

A licensed psychologist;102. A licensed psychological practitioner;113. A certified psychologist with autonomous functioning;124. A licensed clinical social worker;135. A licensed professional clinical counselor;146. A licensed professional art therapist;157. A licensed marriage and family therapist;168. A physician;179. A psychiatrist;1810. An advanced practice registered nurse;1911. A licensed psychological associate working under the supervision of a board-approved20212223licensed psychologist;12. A licensed professional clinical counselor;86. A licensed professional art therapist;97. A licensed marriage and family therapist;108. A physician;119. A psychiatrist;1210. An advanced practice registered nurse;1311. A licensed psychological associate working under the supervision of a board-approved14151617181920licensed psychologist;12. A certified psychologist working under the supervision of a board-approved licensedpsychologist;13. A licensed clinical alcohol and drug counselor in accordance with Section 11 of thisadministrative regulation; or14. A behavioral health practitioner under supervision, except for a licensed assistant behavioranalyst.21(3)](a) A screening shall:221. Determine the likelihood that an individual has a substance use disorder;232. Not establish the presence or specific type of disorder; [and]10

Be provided face-to-face or via telehealth as appropriate pursuant to 907 KAR 3:170; and35. Be provided by:4a. An approved behavioral health practitioner, as limited by subsection (1) of this section; or5b. An approved behavioral health practitioner under supervision, as limited by subsection (1)6of this section.7(b) An assessment shall:81. Include gathering information and engaging in a process with the individual that enables the9practitioner to:10a. Establish the presence or absence of a substance use disorder;11b. Determine the individual’s readiness for change;12c. Identify the individual’s strengths or problem areas that may affect the treatment and recovery131415processes; andd. Engage the individual in developing[the development of] an appropriate treatmentrelationship;162. Establish or rule out the existence of a clinical disorder or service need;173. Include working with the individual to develop a plan of care; [and]184. Not include psychological or psychiatric evaluations or assessments;195. Utilize a multidimensional assessment that complies with the most current version[edition]20of The ASAM Criteria to determine the most appropriate level of care;216. Be provided face-to-face or via telehealth as appropriate pursuant to 907 KAR 3:170; and227. Be provided by:23a. An approved behavioral health practitioner, as limited by subsection (1) of this section; or11

An approved behavioral health practitioner under supervision, as limited by subsection (1)of this section.3(c) Psychological testing shall:41. Include[:5a.] a psychodiagnostic assessment of personality, psychopathology, emotionality, or intellectual6disabilities;72. Include an[and b.] interpretation and a written report of testing results;83. Be face-to-face or via telehealth as appropriate pursuant to 907 KAR 3:170; and94. Be provided by:10a. A licensed psychologist;11b. A certified psychologist with autonomous functioning;12c. A licensed psychological practitioner;13d. A certified psychologist under supervision; or14e. A licensed psychological associate under supervision[and152. Be performed by an individual who has met the requirements of KRS Chapter 319 related to16the necessary credentials to perform psychological testing].17(d) Crisis intervention:181. Shall be a therapeutic intervention for the purpose of immediately reducing or eliminating19the risk of physical or emotional harm to:20a. The recipient; or21b. Another individual;222. Shall consist of clinical intervention and support services necessary to provide integrated23crisis response, crisis stabilization interventions, or crisis prevention activities for individuals;12

[On-site in the facility where the outpatient behavioral health services are provided;3b.]As an immediate relief to the presenting problem or threat; and4b.[c.] In a one (1) on one (1)[face-to-face, one-on-one] encounter between the provider and the5recipient, which is delivered either face-to-face or via telehealth if appropriate pursuant to 9076KAR 3:170;74. Shall be followed by a referral to non-crisis services if applicable; [and]85. May include:9a. Further service prevention planning including[that includes]:10(i) Lethal means reduction for suicide risk; or11(ii) Substance use disorder relapse prevention; or12b. Verbal de-escalation, risk assessment, or cognitive therapy; and136. Shall be provided by:14a. An approved behavioral health practitioner, as limited by subsection (1) of this section; or15b. An approved behavioral health practitioner under supervision, as limited by subsection (1)16of this section.17(e) Mobile crisis services shall:181. Be available twenty-four (24) hours per day, seven (7) days per week, every day of the year;192. Be provided for a duration of less than twenty-four (24) hours;203. Not be an overnight service;214.[Ensure access to a board-certified or board-eligible psychiatrist twenty-four (24) hours per2223day, seven (7) days per week, every day of the year;3. Be provided for a duration of less than twenty-four (24) hours;13

Not be an overnight service;25.] Be a face-to-face, or via telehealth as appropriate pursuant to the most current version3of The ASAM Criteria and 907 KAR 3:170, multi-disciplinary team-based intervention in a4home or community setting that ensures access to substance use disorder services and supports to:5a. Reduce symptoms or harm; or6b. Safely transition an individual in an acute crisis to the appropriate least restrictive level of7care;85.[6.] Involve all services and supports necessary to provide:9a. Integrated crisis prevention;10b. Assessment and disposition;11c. Intervention;12d. Continuity of care recommendations; and13e. Follow-up services;146. Include access to a board-certified or board-eligible psychiatrist twenty-four (24) hours a15day, seven (7) days a week, every day of the year; and167. Be provided by:17a. An approved behavioral health practitioner, as limited by subsection (1) of this section;18b. An approved behavioral health practitioner under supervision, as limited by subsection (1)19of this section; or20c. A peer support specialist who:21(i) Is under the supervision of an approved behavioral health practitioner, as limited by2223subsection (1) of this section; and(ii) Provides support services for a mobile crisis service[face-to-face in a home or community14

DocuSign Envelope ID: . Day treatment shall be a non-residential, intensive treatment program for an individual23under the age of twenty-one (21) years who has:4a. A substance use disorder; and5b. A high risk of out-of-home placement due to a behavioral health issue.62. Day treatment shall:7a. Be face-to-face, or via telehealth as appropriate pursuant to the most current version of8The ASAM Criteria and 907 KAR 3:170;b. Consist of an organized, behavioral health program of treatment and rehabilitative services;910c.[b.] Include:11(i) Individual outpatient therapy, family outpatient therapy, or group outpatient therapy;12(ii) Behavior management and social skills training;13(iii) Independent living skills that correlate to the age and developmental stage of the recipient;141516or(iv) Services designed to explore and link with community resources before discharge and toassist the recipient and family with transition to community services after discharge; and17d.[c.] Be provided:18(i) In collaboration with the education services of the local education authority including those19provided through 20 U.S.C. 1400 et seq. (Individuals with Disabilities Education Act) or 29 U.S.C.20701 et seq. (Section 504 of the Rehabilitation Act);212223(ii) On school days and during [on non-instructional weekdays during the school yearincluding]scheduled school breaks;(iii) In coordination with the recipient’s individualized educational plan or Section 504 plan if15

DocuSign Envelope ID: DF637822-C428-447D-8D1A-338FF76AB56712345the recipient has an individualized educational plan or Section 504 plan; and(iv) [Under the supervision of a licensed or certified approved behavioral health servicesprovider or a behavioral health practitioner working under clinical supervision; and(v)] With a linkage agreement with the local education authority that specifies theresponsibilities of the local education authority and the day treatment provider.63. To provide day treatment services, a chemical dependency treatment center shall have:7a. The capacity to employ staff authorized to provide day treatment services in accordance with891011this section and to coordinate the provision of services among team members; andb. Knowledge of substance use disorders and co-occurring disorders.4. Day treatment shall not include a therapeutic clinical service that is included in a child’sindividualized education program or Section 504 plan.125. Day treatment shall be provided by:13a. An approved behavioral health practitioner, as limited by subsection (1) of this section;14b. An approved behavioral health practitioner under supervision, as limited by subsection (1)15of this section; or16c. A peer support specialist who:17(i) Is under the supervision of an approved behavioral health practitioner, as limited by18subsection (1) of this section; and19(ii) Provides support services for a day treatment service.20(g)1. Peer support services shall:21a. Be emotional support that is provided by:22(i) An individual who has been trained and certified in accordance with 908 KAR 2:220 [or 90723KAR 2:240]and who is experiencing or has experienced a substance use disorder to a recipient by16

DocuSign Envelope ID: DF637822-C428-447D-8D1A-338FF76AB5671sharing a similar substance use disorder in order to bring about a desired social or personal change;2(ii) A parent or other family member, who has been trained and certified in accordance with3908 KAR 2:230, of a child having or who has had a substance use disorder to a parent or family4member of a child sharing a similar substance use disorder in order to bring about a desired social5or personal change;[or]6(iii) An individual who has been trained and certified in accordance with 908 KAR 2:240 and7identified as experiencing a substance use disorder [A family member who has been trained and8certified in accordance with 908 KAR 2:230 of a child having or who has had a substance use9disorder to a parent or family member of a child sharing a similar substance use disorder in order10to bring about a desired social or personal change]; or11(iv) A registered alcohol and drug peer support specialist who has been trained and certified in12accordance with KRS 309.0831 and is a self-identified consumer of substance use disorder13services who provides emotional support to others with substance use disorder to achieve a desired14social or personal change;15b. Be an evidence-based practice;16c. Be structured and scheduled non-clinical therapeutic activities with an individual recipient or1718192021a group of recipients;d. Be provided face-to-face, or via telehealth as appropriate pursuant to the most currentversion of The ASAM Criteria and 907 KAR 3:170;e. Promote socialization, recovery, self-advocacy, preservation, and enhancement ofcommunity living skills for the recipient;22f. Except for the engagement into substance use disorder treatment through an emergency23department bridge clinic,[e.] be coordinated within the context of a comprehensive, individualized17

DocuSign Envelope ID: DF637822-C428-447D-8D1A-338FF76AB5671plan of care developed through a person-centered planning process;2g.[f.] Be identified in each recipient’s plan of care; and3h.[g.] Be designed to contribute directly to the recipient’s individualized goals as specified in4the recipient’s plan of care.52. To provide peer support services, a chemical dependency treatment center shall:6a. Have demonstrated:7(i) The capacity to provide peer support services for the behavioral health population being8910111213served including the age range of the population being served; and(ii) Experience in serving individuals with behavioral health disorders;b. Employ peer support specialists who are qualified to provide peer support services inaccordance with 908 KAR 2:220, 908 KAR 2:230,[or] 908 KAR 2:240, or KRS 309.0831;c. Use an approved behavioral health practitioner[services provider] to supervise peer supportspecialists;14d. Have the capacity to coordinate the provision of services among team members; [and]15e. Have the capacity to provide on-going continuing education and technical assistance to peer1617181920support specialists;f. Require individuals providing peer support services to recipients to provide no more thanthirty (30) hours per week of direct recipient contact; andg. Require peer support services provided to recipients in a group setting to not exceed eight(8) individuals within any group at one (1) time.21(h)1. Intensive outpatient program services shall:22a. Be an alternative to or transition from a higher level of care for a substance use disorder or23co-occurring disorders[inpatient hospitalization or partial hospitalization for a substance use18

Offer a multi-modal, multi-disciplinary structured outpatient treatment program that is3significantly more intensive than individual outpatient therapy, group outpatient therapy, or family4outpatient therapy;5c. Meet the service criteria, including the components for support systems, staffing, and6therapies outlined in the most current version[edition] of The ASAM Criteria for intensive7outpatient level of care services;89d. Be provided face-to-face, or via telehealth as appropriate pursuant to the most currentversion of The ASAM Criteria and 907 KAR 3:170;10e. Be provided at least three (3) hours per day at least three (3) days per week for adults;11f. Be provided at least six (6) hours per week for adolescents; and12g.[d.] Include:13(i) Individual outpatient therapy, group outpatient therapy, or family outpatient therapy unless14contraindicated;15(ii) Crisis intervention; or16(iii) Psycho-education related to identified goals in the recipient’s treatment plan.172. During psycho-education, the recipient or recipient’s family member shall be:18a. Provided with knowledge regarding the recipient’s diagnosis, the causes of the condition, and19the reasons why a particular treatment might be effective for reducing symptoms; and20b. Taught how to cope with the recipient’s diagnosis or condition in a successful manner.213. An intensive outpatient program services treatment plan shall:22a. Be individualized; and23b. Focus on stabilization and transition to a lesser level of care.19

Access to a board-certified or board-eligible psychiatrist for consultation;4b. Access to a psychiatrist, physician, or advanced practice registered nurse for medication567891011prescribing and monitoring;c. Adequate staffing to ensure a minimum recipient-to-staff ratio of ten (10) recipients to one(1) staff person;d. The capacity to provide services utilizing a recognized intervention protocol based onnationally accepted treatment principles; ande. The capacity to employ staff authorized to provide intensive outpatient program services inaccordance with this section and to coordinate the provision of services among team members.125. Intensive outpatient program services shall be provided by:13a. An approved behavioral health practitioner, as limited by subsection (1) of this section; or14b. An approved behavioral health practitioner under supervision, as limited by subsection (1)15of this section.16(i) Individual outpatient therapy shall:171. Be provided to promote the:18a. Health and wellbeing of the recipient; and19b. Restoration of a recipient to their best possible functional level from substance use disorder20or co-occurring disorders[Recipient’s recovery from a substance use disorder];212. Consist of:22a. A face-to-face encounter or via telehealth as appropriate pursuant to 907 KAR 3:170 that is23a one (1) on one (1) encounter between the provider and recipient[, one-on-one encounter between20

A behavioral health therapeutic intervention provided in accordance with the recipient’sidentified plan of care;43. Be aimed at:5a. Reducing adverse symptoms;6b. Reducing or eliminating the presenting problem of the recipient; and7c. Improving functioning; [and]84. Not exceed three (3) hours per day alone or in combination with any other outpatient therapy9per recipient unless additional time is medically necessary; and105. Be provided by:11a. An approved behavioral health practitioner, as limited by subsection (1) of this section; or12b. An approved behavioral health practitioner under supervision, as limited by subsection (1)13of this section.14(j)1. Group outpatient therapy shall:15a. Be a behavioral health therapeutic intervention provided in accordance with a recipient’s16identified plan of care;17b. Be provided to promote the:18(i) Health and wellbeing of the individual[recipient]; and19(ii) Restoration of a recipient to their best possible functional level from a substance use20disorder or co-occurring disorders[Recipient’s recovery from a substance use disorder];21c. Consist of a face-to-face, or via telehealth as appropriate pursuant to the most current22version of The ASAM Criteria and 907 KAR 3:170, behavioral health therapeutic intervention23provided in accordance with the recipient’s identified plan of care;21

Be provided to a recipient in a group setting:2(i) Of nonrelated individuals except for multi-family group therapy; and3(ii) Not to exceed twelve (12) individuals in size;4e. Focus on the psychological needs of the recipients as evidenced in each recipient’s plan of567891011care;f. Center on goals, including building and maintaining healthy relationships, personal goalssetting, and the exercise of personal judgment;g. Not include physical exercise, a recreational activity, an educational activity, or a socialactivity; andh. Not exceed three (3) hours per day alone or in combination with any other outpatient therapyper recipient unless additional time is medically necessary.122. The group shall have a:13a. Deliberate focus; and14b. Defined course of treatment.153. The subject of group outpatient therapy shall relate to each recipient participating in the161718group.4. The provider shall keep individual notes regarding each recipient within[of] the group andwithin each recipient’s health record.195. Group outpatient therapy shall be provided by:20a. An approved behavioral health practitioner, as limited by subsection (1) of this section; or21b. An approved behavioral health practitioner under su
