SARTELL PLANNING COMMISSION MINUTESMonday, April 4, 2022Sartell City Hall6:30 PMPursuant to due call and notice thereof, a Planning Commission meeting was held on April 4, 2022, at6:30 p.m. at Sartell City Hall.MEMBERS PRESENT:Nate Crowe, Kelly Bartlow, Kelly Mager, Ben Drewes, David WallMEMBERS ABSENT:NoneOTHERS PRESENT:Scott Saehr, Community Development Director, Kari Theisen,City Planner, Jill Hollenkamp, Development Specialist, MarkWilliams, Rick Schultz, Lucas DingmannCrowe called the meeting to order at 6:30 p.m.AGENDA REVIEW AND ADOPTIONA motion was made by Mager and seconded by Drewes to approve the agenda as presented. Motioncarried unanimously.APPROVAL OF MINUTESA motion was made by Wall and seconded by Drewes to approve the minutes of March 7, 2022. Motioncarried unanimously.NEW BUSINESS:Dingmann Estates – Preliminary and Final PlatSaehr discussed Dingmann Estates. The property owner is looking for approval on preliminary andfinal plat for the proposed four-acre parcel, single plat site. This property has recently been annexedinto the city in 2021. There will not be utility services available at the time of plating. Staff if looking forapproval to move forward with this plat contingent on a wetland delineation. A motion was made byMager and seconded by Drewes to approve. Motion was carried unanimously. Pending on Wetlanddelineation and approval.OLD BUSINESSRick Schultz Property (Ferche Southwest 35 Plat 3)In 2017, the property owner stated he had approval for a multifamily property with undergroundgarage and four stories above that for multifamily. When the city rezoned, this PUD parcel was zonedto R-3. Staff is looking for direction on how to move forward with this property. Drewes asked about

how long approval is good for. Once approved, how long is that approval valid if they do not move onit? Saehr will check with the county for recorded documents and contact legal for recommendation.Wall asked what particulars would be part of a PUD Agreement. Saehr explained that the PUDAgreements are part of the reason for the moratorium. City does not have a signed document of thePUD or any zoning changes to the plat. The signed amendment is not in the possession of the city andhas not been recorded. Staff spoke about preliminary plats that and that after two years, the City coderequires a new plan to be submitted.Rick Schultz spoke to commission regarding what was approved by council and felt that they did notneed to have the mixed use to have four stories. That amendment cannot be located. Mr. Schultzstated that the resolution stated the changes to the Amendment, but an amendment cannot belocated. Rick is looking to build 127 units on the site.Staff requested to work with developer on his needs for the site and request direction from thecommission in doing so. Saehr suggest that a variance would be needed moving forward if his plansremain moving forward.Planning Commission gave direction to Staff to work with Mr. Schultz on a concept plan to be broughtback to a later meeting.OTHER BUSINESSProject updatesi.An update was given on a request from MWF Properties. Saehr wanted to update thecommission and get a feel for their thoughts on a TIF project. Tax revenue would bedeferred for 23 years (proposed). Toppan was the last TIF approved several years ago.ii.Staging Policy was reviewed and approved by the commission.iii.There was discussion of bringing a stockpile ordinance and moratorium forward at alater date.iv.Xcel Energy proposed a Community Code Support Program. Staff will provide moreinformation at a later date and research the program.Planning Commission Updates – None.Open Discussion – None.ADJOURNMotion made by Mager and seconded by Wall to adjourn the meeting. Scott and Lisa own both 112 and 110 Sartell StreetWest. City staff informed the applicant that the vacation would need to extend beyond their property lines dueto the layout of 1st Street South. The Applicants were also informed that since they were the ones requestingthe vacation that they would be responsible for the fees incurred for the completed Survey.RECURRING REQUEST: Other portions of 1st Street South may be vacated dependent on futuredevelopments.PROPOSED BUDGET/FISCAL IMPACT: None.OPPORTUNITY COST IF APPROVED: None.ACTIONS REQUESTED: Motion and 2nd to recommend approval of the Vacation.ATTACHMENTS: Vacation Application, Vacation Resolution, and Supporting Documents.

City staff was made aware of a Home Occupation that was being operated within an accessorybuilding.City Staff conducted a site visit and informed the applicant of the Home Occupation Code (10-8-16) and that aHome Occupation shall not be conducted in any building on the premises other than the building in which isused by the occupant as the private dwelling (including garage). The applicant was given direction to move theHome Occupation into the private dwelling and complete a Home Occupation Permit. The application wascompleted and approved on May 5, 2022. Home Occupations are renewed on a yearly basis.Variances shall only be permitted when they are in harmony with the general purposes and intent of theordinance and when the variances are consistent with the comprehensive plan. Variances may be grantedwhen the applicant for the variance establishes that there are practical difficulties in complying with the City’sZoning ordinance. “Practical difficulties”, as used in connection with the granting of a variance, means that theproperty owner proposes to use the property in a reasonable manner not permitted by the City’s zoningordinance; the plight of the landowner is due to the circumstances unique to the property not created by thelandowner; and the variance if granted, will not alter the essential character of the locality. Economicconsiderations alone do not constitute practical difficulties.RECURRING REQUEST: No.PROPOSED BUDGET/FISCAL IMPACT: Home Occupation permits need to be renewed on a yearly basis due bythe end of December ( 80 fee).OPPORTUNITY COST IF APPROVED: None.COUNCIL ACTIONS REQUESTED: Motion and 2nd to recommend approval of the Variance.ATTACHMENTS: Variance Application and Supporting Documents.
